&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;I.-&lt;/strong&gt; Aprovar el &lt;span style="color:black"&gt;Programa per a la restauració dels molins de vent d'extracció d'aigua del pla de sant Jordi de Palma, pluriennal 2024-2027,&lt;/span&gt; que s'adjunta i forma part integrant de la present resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;II.-&lt;/strong&gt; Ordenar la seva publicació en el BOIB. &lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;PREÀMBUL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;D'acord amb el Decret de la Presidència del Consell Insular de Mallorca, de dia 28 de juliol, pel qual s'estableixen les competències dels Departaments del Consell Insular de Mallorca (BOIB núm. 106, de 29 de juliol de 2023), corresponen al Departament de Cultura i Patrimoni, entre d'altres, les competències relatives a patrimoni monumental, cultural, històric, artístic, arquitectònic, arqueològic i paisatgístic. Per desenvolupar aquestes competències, el Departament de Cultura i Patrimoni desplega mitjans, tant humans com tècnics, per acomplir l'estudi, la conservació, la restauració i la posada en valor dels elements que formen part de l'herència preindustrial i industrial de l'illa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears a l'article 22.3 disposa que “&lt;em&gt;els poders públics promouran, per tots els mitjans al seu abast, la conservació, la consolidació i la millora dels béns integrants del patrimoni de titularitat pública i privada”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La mateixa Llei dedica el títol IX a les mesures de foment i difusió i a l'article 81 recalca: “&lt;em&gt;les administracions públiques competents col·laboraran amb els propietaris i titulars de drets sobre béns culturals&amp;nbsp; per a la conservació, la recuperació i la difusió d'aquests, mitjançant la prestació de l'assessorament tècnic i jurídic necessari i, si s'escau, de la concessió d'ajudes de tipus econòmicofinancer”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Emparats en aquestes disposicions, a la dècada de 1990 s'inicià la pràctica de restaurar béns culturals amb mà d'obra i mitjans tècnics desplegant diversos programes adreçats a la recuperació dels elements del patrimoni etnològic, marítim i historicoindustrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Primer. Objectiu &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- L'objectiu d'aquest Programa és promoure la restauració i posterior posada en valor dels molins de vent d'extracció d'aigua del Pla de Sant Jordi de Palma,&amp;nbsp; respectant-ne la tipologia originària i potenciant la utilització de les tècniques i els materials tradicionals locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Així mateix, aquest Programa es compatible amb els projectes que tinguin com a finalitat la generació d'electricitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- L'elecció del Pla de Sant Jordi de Palma, com a àrea objecte d'aquest Programa&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;està motivada per les següents raons: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- En una superfície d'uns 55 km&lt;sup&gt;2&lt;/sup&gt;, s'hi concentren més de 1.000 molins de vent d'extracció d'aigua, amb el seu corresponent sistema d'emmagatzematge d'aigua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- A altres zones de Mallorca, també trobam una gran concentració de molins de vent d'extracció d'aigua, però és en el cas del Pla de Sant Jordi on els molins aiguaders presenten més diversitat tipològica, tant a nivell arquitectònic com de la maquinària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Aquests molins es troben en un estat de degradació molt avançat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- El fet que estiguin a la zona de l'aeroport de Palma fa que la degradació d'aquests béns del patrimoni cultural illenc conformi una de les primeres imatges que perceben els forans en arribar a Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Segon. Finançament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;A) Quan es tracti de projectes de restauració amb l'ús tradicional del molí, o sigui, l'extracció d'aigua del subsòl:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- La propietat dels elements a restaurar es farà càrrec de les despeses de materials, transport i d'altres, així com d'obtenir les llicències i permisos necessaris, si escau. Mentre que el Consell Insular de Mallorca es farà càrrec de la redacció del projecte tècnic de restauració, tant de la part arquitectònica com de la maquinària, i aportarà la mà d'obra per executar els projectes mitjançant el personal propi del Departament de Cultura i Patrimoni. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Les obligacions d'ambdues parts es concretaran mitjançant la signatura d'un conveni (segons el model que apareix a l'annex II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- En els projectes en els quals la despesa per part de la propietat superi els 20.000,00 €, el Consell Insular de Mallorca, abans d'elaborar el projecte tècnic de restauració, pot presentar un avantprojecte que especifiqui l'aportació que ha de fer la propietat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;B) Quan es tracti de projectes de reutilització de molins per a la producció d'energia elèctrica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- El Consell Insular de Mallorca es farà càrrec de la redacció del projecte tècnic de la restauració dels elements arquitectònics (torre i safareig), així com de la seva execució. Mentre que seran a càrrec de la propietat les despeses de materials, transport i d'altres, així com d'obtenir les llicències i permisos necessaris, si escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Així mateix, seran a càrrec de la propietat, bé directament o bé amb càrrec a d'altres ajuts, totes aquelles despeses derivades de la reconversió de la maquinària del molí com a element generador d'electricitat. Tot això, sense perjudici de les tasques d'assessorament que puguin dur a terme els tècnics del Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Únicament es poden presentar projectes de reutilització de molins per a la producció d'energia elèctrica, d'aquells molins de la tipologia més recent (6 antenes, 18 pales de ferro) o que no conservin cap element de la maquinària. En cas, que les restes de la maquinària d'aquests molins, no pugui ser reutilitzades, seran donades a cost zero al Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;C) Aquesta cooperació tècnica del Consell Insular de Mallorca és compatible amb la concessió d'altres ajuts, sens perjudici de l'obligació de les persones beneficiàries de comunicar-ho al Consell Insular de Mallorca. L'import d'aquests&amp;nbsp; ajuts no pot superar, en cap cas, de manera aïllada o amb concurrència amb altres ajuts, el cost total de l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Tercer. Temporalització&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Aquest Programa té caràcter de pluriennal, corresponent als anys &lt;/span&gt;2024, 2025, 2026 i 2027. Si una vegada elaborat el Pla d'actuació, i distribuït en les anualitats previstes, fos d'impossible execució es pot tramitar l'expedient corresponent de reajustament d'anualitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Quart. &lt;span style="color:black"&gt;Caràcter de la cooperació tècnica&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Aquesta cooperació, mitjançant personal adscrit a la Direcció Insular de Patrimoni, té caràcter discrecional, voluntari i eventual, és lliurament revocable i reductible en tot moment per les causes previstes en aquest Programa; no genera cap dret a l'obtenció de subvencions i no es pot al·legar com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- La selecció dels elements susceptibles d'entrar dins el Programa es durà a terme mitjançant règim de concurrència competitiva, i d'acord amb els principis d'objectivitat, eficàcia, transparència, igualtat, no discriminació i publicitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Cinquè. Col·laboració institucional&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Per donar compliment a la Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears (art. 22.3 i 81), el Consell Insular de Mallorca aporta personal tècnic del Departament de Cultura i Patrimoni. Al tractar-se d'una cooperació tècnica, per dur a terme les actuacions previstes mitjançant conveni, ni s'ha d'aprovar despesa, ni adquirir compromís de despesa, ni fer cap despesa pròpiament dita. Durant la vigència del conveni no sorgirà cap obligació de pagament ni de reconeixement d'obligació amb contingut econòmic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En qualsevol cas, les despeses pròpies de l'execució d'aquest Programa es formalitzaran mitjançant els procediments legalment establerts a tal efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Sisè. Àmbit d'actuació &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Quan es tracti de projectes de restauració amb l'ús tradicional del molí, les actuacions previstes en aquest Programa comprenen l'adequació de les torres d'obra, de fusta i de metall, del safareig, així com altres elements vinculats directament amb el molí com son les síquies d'obra de distribució de l'aigua i la restauració de la maquinària. No s'inclou la neteja o la restauració del pou d'aquests molins.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;No és condició obligatòria d'aquest programa que el molí tregui aigua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En el cas de les torres de molí que no conservin cap element de la maquinària, es reconstruirà la tipologia més recent (6 antenes, pales de ferro), respectant la tipologia, les tècniques i els materials tradicionals locals. En cas que la propietat conservi fotografies històriques del molí es podrà reproduir la tipologia originària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Quan es tracti de projectes de reutilització de molins per a la producció d'energia elèctrica, a més de les actuacions d'assessorament previstes al punt Segon, apartat B) 2, les actuacions previstes en aquest Programa comprenen únicament l'adequació de les torres d'obra, del safareig, així com d'altres elements vinculats directament amb el molí com són les síquies d'obra de distribució de l'aigua. No s'inclou la neteja o la restauració del pou d'aquests molins.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Abans d'iniciar les obres, s'ha d'obtenir la corresponent llicencia municipal i s'haurà de signar el conveni establert a l'annex II. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Setè. Destinataris del Programa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Poden acollir-se al Programa les persones físiques, persones jurídiques (públiques i privades), agrupacions de persones físiques, comunitats de béns o altres agrupacions econòmiques sense personalitat jurídica i sense ànim de lucre, associacions i fundacions sense ànim de lucre que tinguin en propietat molins de vent d'extracció d'aigua situats dins el Pla de Sant Jordi, al terme municipal de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Els sol·licitants només podran demanar la subvenció per un molí de la seva propietat. Això no obstant, es poden incloure dos molins de la mateixa titularitat, si la comissió avaluadora considera que hi ha una relació històrica, tipològica o paisatgística entre ells.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- No podran ser beneficiàries d'aquest Programa les persones o entitats en les quals concorri alguna de les prohibicions establertes a l'art. 8 de l'Ordenança general de subvencions. Així mateix, el moli pel qual es sol·licita l'actuació no podrà tenir oberts expedients sancionadors per part de l'administració per incompliments de la normativa en altres intervencions anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Vuitè. Sol·licitud i documentació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- Les sol·licituds es formalitzaran en un únic model d'instància que figura com annex I d'aquest Programa, que es pot recollir a les dependències de la Direcció Insular de Patrimoni del Departament de Cultura i Patrimoni del Consell Insular de Mallorca (Centre Cultural la Misericòrdia, plaça de l'Hospital, 4, 07012 de Palma de Mallorca), o bé descarregar-la directament de la seu electrònica del Consell: &lt;span style="color:null"&gt;https://seu.conselldemallorca.net/&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Juntament amb la sol·licitud s'ha d'adjuntar la documentació següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1) Còpia de l'escriptura de propietat o nota simple registral, en el cas de particulars, o document acreditatiu de la titularitat, en el cas de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Si el sol·licitant és una persona jurídica, ha d'aportar còpia de l'escriptura de constitució o de modificació dels estatuts o del reglament intern de funcionament, inscrits en el registre corresponent. Si cal, de conformitat amb els seus estatuts, han d'aportar certificat de l'acord adoptat per l'òrgan de govern de l'entitat per sol·licitar l'ajuda i designar representant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2) Còpia del DNI-NIF/passaport, si es tracta d'una persona física o CIF, si es tracta d'una persona jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3) Si la sol·licitud es presenta en nom d'una altra persona, s'ha d'aportar autorització per actuar com a representant i còpia del DNI. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4) Reportatge fotogràfic de l'estat actual de l'element (interiors i exteriors, mínim 5 fotografies).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5) Còpia del plànol cadastral d'ubicació de la finca, en el qual s'ha d'assenyalar l'emplaçament del molí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6) Declaració responsable signada per la persona sol·licitant o representant legal relativa a les subvencions o ajudes obtingudes i/o sol·licitades d'altres institucions públiques o privades per a la mateixa activitat. El model s'adjunta com annex IV.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7) Declaració responsable de no trobar-se en la situació prevista a l'art. 11 de la Llei 11/2016 de 28 de juliol (annex VI).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8) Certificat expedit per la Tresoreria General de la Seguretat Social que acrediti que l'interessat està al corrent de les seves obligacions amb la Seguretat Social o l'autorització expressa per la seva sol·licitud telemàtica per part del Consell Insular de Mallorca (vegeu annex I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;9) Certificat de l'Agència Tributària (AEAT) d'estar al corrent de les obligacions tributàries, o l'autorització expressa per la seva sol·licitud telemàtica per part del Consell Insular de Mallorca (vegeu annex I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10) Certificació acreditativa d'estar al corrent de les seves obligacions tributàries amb el Consell Insular de Mallorca (vegeu annex I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;11) En el cas d'agrupacions de persones físiques, comunitats de béns o altres agrupacions econòmiques sens personalitat jurídica i sense ànim de lucre han de signar la sol·licitud totes les persones que la integren, adjuntar el document acreditatiu de la seva constitució, en el qual constin tots els membres que la conformen, i adjuntar-hi els DNI (en el cas de persones físiques). Així mateix, han de designar un únic representant o apoderat (amb poders suficients per complir les obligacions que, com a beneficiari, correspon a l'agrupació) i un únic domicili a l'efecte de notificacions. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;No es podrà dissoldre l'agrupació fins que hagi transcorregut el termini de &amp;nbsp;prescripció que preveuen els articles 35 i 65 de la Llei de 17 de novembre, &amp;nbsp;general de subvencions (OGS) i han de complir amb el contingut de l'art. 7.4 OGS: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;4.Constitueixen requisits necessaris perquè les agrupacions indicades en l'apartat &amp;nbsp;b) d'aquest article adquireixin la condició de beneficiàries que l'agrupació ni cap dels &amp;nbsp;seus membres no incorrin en cap de les prohibicions que s'estableixen en l'apartat 2 &amp;nbsp;de l'art.8.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;En aquests supòsits, s'han de fer constar expressament, tant en la sol·licitud com en la &amp;nbsp;resolució de concessió, els compromisos d'execució que assumeix cada membre de &amp;nbsp;l'agrupació, així com l'import de subvenció que ha aplicar cada un, el qual també té la &amp;nbsp;consideració de beneficiari.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;En qualsevol cas, s'ha de nomenar un representant o apoderat únic de l'agrupació, &amp;nbsp;amb poders bastants per a complir les obligacions que, com a persona beneficiària, &amp;nbsp;corresponen a l'agrupació.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;No es pot dissoldre l'agrupació fins que no ha transcorregut el termini de prescripció &amp;nbsp;que es preveu en els art. 39 i 65 de l'LGS.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;em&gt;&lt;span style="line-height:107%"&gt;Quan els membres de l'agrupació pretenen actuar mancomunadament en la &amp;nbsp;realització &amp;nbsp;del projecte o l'activitat, les condicions per a accedir a la subvenció i la &amp;nbsp;valoració es determinen amb l'acumulació de les condicions de cada un.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12) Quan es tracti de projectes de reutilització de molins per a la producció d'energia elèctrica, a més de tota la documentació anterior, s'ha de presentar el corresponent projecte tècnic signat per tècnic competent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Novè. Termini de presentació i esmena de documentació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1.- El termini, per a la presentació de les sol·licituds juntament amb la resta de documentació requerida, serà a partir del dia següent a la publicació d'aquest programa en el Butlletí Oficial de les Illes Balears fins el 15 d'octubre de 2024 a les 23h 59'.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Les instàncies s'han de presentar a través del Registre electrònic del Consell de Mallorca: https://cim.sedipualba.es/segex/tramite.aspx?idtramite=12082, o mitjançant l'establert als articles 14 i 16 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 02/10/2015).&amp;nbsp; En cas de presentació en les oficines assenyalades a l'article 16, s'ha de comunicar aquesta circumstància a la direcció insular de Patrimoni, dins el mateix dia, mitjançant el correu electrònic patrimoni@conselldemallorca.net&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Les persones o entitats interessades han d'omplir els models de sol·licitud i annexos d'aquest programa que estan disponibles a la Seu electrònica: https://seu.conselldemallorca.net/&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- Si la sol·licitud o la documentació fossin incorrectes o incompletes, el Consell Insular de Mallorca requerirà als interessats la rectificació o millora de la documentació presentada. Si en el termini de deu dies hàbils, comptats des de l'endemà a la recepció del requeriment d'esmena de la sol·licitud, la persona interessada no fa la rectificació reclamada o no presenta la documentació requerida, s'entendrà que ha desistit de la seva petició de conformitat amb l'article 68 de la Llei 39/2015, d'1 d'octubre de 2015, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Desè. Fiscalització prèvia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Aquest Programa no requereix de la fiscalització prèvia de la Intervenció General del Consell Insular de Mallorca, atès que al tractar-se d'una cooperació tècnica, ni s'ha d'aprovar despesa, ni adquirir compromís de despesa, ni fer cap despesa pròpiament dita. Durant la vigència del conveni no sorgirà cap obligació de pagament ni de reconeixement d'obligació amb contingut econòmic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Onzè.- Criteris objectius de valoració.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;1.- Les subvencions s'han de concedir aplicant el procediment de concurrència competitiva i, a fi d'establir una prelació entre les sol·licituds presentades, s'estableixen els següents criteris de valoració:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;1. Valoració històrica.&lt;/strong&gt; D'1 a 2 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;a. Elements datats amb anterioritat a 1900: 2 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;b. Valoració tècnica. &lt;/strong&gt;Es valoraran amb la puntuació més alta, el molins la maquinària dels quals responguin a tipologies ja gairebé desaparegudes. D'1 a 4 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. Molins de veles i molins de ramell amb pal guia, o sigui sense cua: 4 punts&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. Molins de ramell amb cua, molins amb roda de ramell i pales (de fusta o ferro): 3 punts&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c. Molins de ferro amb 10 antenes de fusta: 2 punts&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d. Molins de ferro amb 6 antenes: 1 punt&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;No es valoraran els molins que no presentin cap element de la maquinària a excepció feta que es puguin documentar mitjançant fotografia històrica i que, per suposat, aquesta sigui la maquinària a reconstruir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El màxim de punts que es pot obtenir amb aquest criteri és de 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;4. Valoració paisatgística.&lt;/strong&gt; Es valoraran amb la puntuació més elevada els molins que estiguin situats a l'entrada dels nuclis urbans històric del Pla de Sant Jordi. S'entén per nuclis urbans històrics els següents: Sant Jordi, sa Casa Blanca, s'Aranjassa, Es Pil·larí, Son Ferriol i es Coll d'en Rabassa. També es valoraran amb la puntuació més elevada, els molins situats a menys de 50 metres de les vies principals. D'1 a 2 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;a. A l'entrada d'un nucli urbà històric i a menys de 50 metres de les vies Ma 15, Ma 19, Ma 15D, Ma 19A, Ma 3011, Ma 3012, Ma 5012, Ma 5013, Ma 6011 i Ma 612: 2 punt&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;b. A la resta del territori no transformat que conforme el Pla de Sant Jordi: 1 punt&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;El màxim de punts que es pot obtenir amb aquest criteri és de 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;5. Valoració de l'entorn.&lt;/strong&gt; Es valoraran amb la puntuació més alta els molins situats al seu entorn original, on no s'hagin fet noves construccions que desvirtuïn l'espai més proper. D'1 a 3 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;a. Original: 3 punts &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;b. Semitransformat: s'entén per entorn semitransformat, els indrets que, tot i conservar l'espai agrícola i/o urbà original, presenten, en el seu entorn, edificacions tradicionals modificades i/o amb usos diferents per als quals foren edificades. Es valorarà amb 2 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;c. Transformat: s'entén per entorn transformat, els entorns agrícoles i/o urbans modificats o que presenten, en el seu entorn, edificacions de nova construcció i/o altres equipaments que distorsionen aquests espais. Es valorarà amb 1 punt&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;El màxim de punts que es pot obtenir amb aquest criteri és de 3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6. Valoració de l'ús.&lt;/strong&gt; Es valoraran amb 4 punt els molins que es situïn dins finques productives, per la qual cosa han d'estar inscrites en el Registre Interinsular Agrari de les Illes Balears (RIA) de la Conselleria d'Agricultura, Pesca i Medi Natural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;El màxim de punts que es pot obtenir amb aquest criteri és d'4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;7. &lt;/strong&gt;&lt;span style="color:black"&gt;&lt;strong&gt;Valoració energètica. &lt;/strong&gt;Es valoraran amb 4 punts les sol·licituds que incorporin un projecte de generació d'energia elèctrica, &lt;/span&gt;autoritzat per l'administració competent en matèria de transició energètica, sempre que aquesta generació sigui en règim d'autoconsum i/o tenguin connexió a línia elèctrica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;En la resta de casos, es valoraran amb 3 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2.- Un cop s'hagi fet la valoració de totes les sol·licituds, s'inclouran en el Programa els 12 elements que hagin obtingut una puntuació major, sempre que aquests elements superin els 8 punts. Per això, la puntuació a partir de la qual els elements s'han d'incloure en el Programa és de 9 punts. L'ordre de prelació s'establirà en funció de la puntuació obtinguda, ocupant la primera posició l'element que hagi obtingut la màxima puntuació, i així successivament. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3.- &lt;span style="color:black"&gt;En cas d'empat en la puntuació tindrà preferència aquella sol·licitud que hagi obtingut major puntuació d'acord amb el criteri 3: valoració tècnica. Si continua l'empat, es donarà preferència a la sol·licitud que hagin obtingut major puntuació de la suma dels criteris 6 i 7: valoració de l'ús i valoració energètica, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Si encara persisteix l'empat es donarà preferència a la sol·licitud que hagi entrat en el registre en primer lloc (&lt;/span&gt;dins els dies hàbils establerts d'acord amb l'article 31.2 b) de la Llei 39/2015, d'1 d'octubre) &lt;span style="color:black"&gt;i que, a més a més, hagi aportat la documentació completa. Si persisteix l'empat es prioritzarà aquella sol·licitud amb menys deficiències.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Dotzè. Comissió avaluadora &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;2.- Les visites es podran dur a terme tots els dies de l'any, excepte festius i diumenges. L'horari de les visites serà de 10h a 19h.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;3.- Les visites de grups superiors a 10 persones, si ho sol·licita la propietat, es realitzaran sota la supervisió d'una o més persones del&lt;/span&gt; Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;4.- El molí pot esser inclòs dins una ruta a nivell local i/o europeu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;5.- Quan es tracti dels molins productors d'energia elèctrica, aquestes visites restaran sotmeses a la normativa pròpia del sector elèctric.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Catorzè. Criteris de desestimació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Són motius de desestimació de les sol·licituds: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Les sol·licituds que es presentin fora del termini de presentació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Els molins el grau de deteriorament dels quals n'impossibiliti una restauració fidedigna a l'estat originari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Els molins que hagin sofert modificacions i/o intervencions no adients que siguin &lt;span style="color:black"&gt;irreparables i consegüentment hagin perdut el seu interès històric i/o tècnic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- En el cas del molins amb la seva funció original, restaran excloses les sol·licituds que únicament sol·licitin la restauració arquitectònica del molí. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Els molins edificats amb data posterior a 1960&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Quinzè. Procediment administratiu de concessió de les subvencions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;La tramitació administrativa correspon a la Direcció Insular de Patrimoni del Departament de Cultura i Patrimoni que ha de dur a terme totes les actuacions i els actes de tràmit necessaris per vetllar pel compliment dels requisits establerts al Programa i al conveni signat entre parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La Comissió Avaluadora és l'òrgan col·legiat a qui correspon examinar les sol·licituds presentades i emetre l'informe proposta que ha d'incloure el llistat d'elements objecte de restauració amb indicació del beneficiari, DNI/CIF, concepte i punts obtinguts, a més de la resta de sol·licituds desestimades o excloses. Aquest informe proposta s'eleva i serveix com a base per elaborar la resolució de la vicepresidenta primera i consellera executiva de Cultura i Patrimoni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2. El termini màxim de resolució és de sis mesos, comptadors des de la finalització del període de presentació de sol·licituds, transcorreguts els quals sense que se n'hagi dictat resolució, s'entendrà desestimada la sol·licitud, sense que això alliberi de l'obligació de l'administració de dictar resolució expressa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3. La resolució amb el llistat d'admissió i d'exclusió dels elements objecte de restauració serà notificat als interessats, i es publicarà al BOIB i es penjarà en el lloc web i en la seu electrònica del Consell de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;http://www.conselldemallorca.net/&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;https://seu.conselldemallorca.net/ca_ES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Setzè. Justificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;S'ha d'acreditar l'execució dels projectes amb els següents documents: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Per part del Consell Insular de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Memòria d'actuació justificativa d'haver complit el projecte, de les activitats que s'hi han fet i dels resultats obtinguts una vegada acabada l'actuació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Reportatge fotogràfic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Per part del titular del bé:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Detall d'altres ingressos o subvencions que han finançat l'activitat amb indicació de l'import i la seva procedència, si n'hi ha hagut. (annexa IV)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Relació de despeses que el beneficiari ha suportat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Dissetè. Obligacions dels beneficiaris&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Notificar a la Direcció Insular de Patrimoni, en un termini no superior a cinc dies hàbils comptats a partir d'haver rebut el projecte tècnic, el pressupost i l'esborrany del conveni de l'element que es vol restaurar, l'acceptació o la desestimació. En cas que no hi hagi cap resposta de la propietat durant aquest termini, s'entén que renuncia automàticament a l'ajuda esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Quan es tracti de projectes de restauració amb l'ús tradicional del molí en els quals la despesa de la propietat superi els 20.000,00 €, notificar a la Direcció Insular de Patrimoni, en un termini no superior a cinc dies hàbils comptats a partir d'haver rebut l'avantprojecte de l'element que es vol restaurar, l'acceptació o la desestimació. En cas que no hi hagi cap resposta de la propietat durant aquest termini, s'entén que renuncien automàticament a l'ajuda esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Signar el conveni amb el Consell Insular de Mallorca segons el model que s'adjunta a l'annex II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Fer-se càrrec de les despeses, de conformitat amb allò que disposa el punt segon d'aquest programa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- No fer intervencions no procedents en l'element restaurat. En el cas dels molins tradicionals, no alterar-ne el seu ús.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Permetre l'accés al personal del Consell Insular de Mallorca que ha de fer el projecte tècnic i el pressupost, facilitant-los la informació pertinent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Identificar, en el lloc de la restauració, que aquesta es fa amb la intervenció del Departament de Cultura i Patrimoni.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Permetre fer, en el lloc i en les dates que determini el Consell Insular de Mallorca, diverses rodes de premsa amb l'objectiu de presentar als mitjans de comunicació els treballs que s'hi fan o en vies d'execució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Sol·licitar a l'Ajuntament del municipi on es localitza l'element el permís d'obres que calgui. Igualment, si s'escau, l'autorització corresponent de la Comissió de Patrimoni Històric del Consell Insular de Mallorca si es tracta d'un bé d'interès cultural o d'un bé catalogat. Així mateix, sol·licitar en el cas dels molins productors d'energia elèctrica els permisos pertinents. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Permetre al personal de la Direcció Insular de Patrimoni del Consell Insular de Mallorca, una vegada restaurat l'element, sis visites anuals d'inspecció durant els deu anys següents a la restauració amb la finalitat de garantir que la propietat compleix les obligacions especificades en aquest Programa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Habilitar una franja no inferior a cinc metres, des de la via pública més adequada fins a l'element, per facilitar els treballs de restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Assumir la neteja de vegetació, de fems, de materials de construcció, de terra i altra brutor de l'interior dels immobles i d'un àrea al voltant d'aquests de quinze metres abans d'iniciar els treballs de restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Mantenir en bon estat l'element restaurat. Per això, conclosos els treballs de restauració, el Departament de Cultura i Patrimoni del Consell Insular de Mallorca, ha de lliurar a la propietat un manual de manteniment que aquesta ha de seguir. En cas que la propietat no pugui dur a terme aquest manteniment, haurà de contractar una empresa especialitzada per dur-ne a terme aquestes tasques. Pel que respecte als molins amb la seva funció original, el manual de manteniment lliurat pel Consell Insular de Mallorca, inclourà les edificacions i la maquinària; però en el cas dels molins productors d'energia elèctrica, el Consell Insular de Mallorca, únicament lliurà un manual de manteniment referit a les edificacions. Tot i així, pel que respecte a la maquinària i a la resta de components mecànics, elèctrics, electrònics, etc. necessaris per a la producció d'energia elèctrica, serà obligació de la propietat contractar-ne el manteniment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Permetre que el Consell Insular de Mallorca, una vegada conclosos els treballs de restauració de l'element, col·loqui en un lloc visible un panell informatiu, en el qual consti la següent informació: valors històrics, arquitectònics i tècnics de l'element, a més d'incloure fotografies, croquis i vídeos. També està permesa, si escau, la &lt;span style="color:black"&gt;introducció de publicitat comercial, en aquest panell informatiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Respecte dels molins generadors d'energia elèctrica, es permet la introducció de publicitat al motor o generador elèctric i a la coa del molí; però en el cas de la coa, les mides del logotip no poden superar els 60x60 cm, aquest logotip s'ha de situar al centre de la fletxa i s'ha de pintar, usant únicament un color.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Permetre al Consell Insular de Mallorca la divulgació de la informació abans esmentada al punt anterior a través dels següents mitjans: creació de codis QR, edició de productes informatius (mapa desplegable i altres), publicitat a Internet (llocs webs i xarxes socials), publicitat als mitjans de comunicació, publicació a la Memòria del MPC ; i qualsevol altra acció que el Consell Insular de Mallorca consideri oportuna, sempre i quan no vagi en detriment de la correcta preservació de l'element.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Respectar el règim de visites establert a l'apartat tretzè, durant un període de 10 anys.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Mantenir net i sense estris l'element restaurat i el recorregut establert per a les visites.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- &amp;nbsp;La propietat es compromet a donar a conèixer aquest conveni en el cas de transmissió de la propietat o institució d'un dret real de l'element mitjançant qualsevol tipus de transmissió &lt;span style="color:black"&gt;dominical&lt;/span&gt; d'aquest. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Divuitè. Revocació i reintegrament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Seran causa de revocació i/o reintegrament l'incompliment de les obligacions establertes al present Programa i al conveni signat a l'efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En el supòsit que es declari la procedència de reintegrament, es considerarà quantitat rebuda a reintegrar, l'import equivalent al cost dels treballs de l'equip tècnic i de la mà d'obra aportats pel Consell Insular de Mallorca que figuren a la memòria d'actuació justificativa del punt setzè.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Dinovè.&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; &lt;strong&gt;Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El règim d'infraccions i sancions administratives aplicables serà l'establert a la Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears i a la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Vintè. Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Contra aquest acte, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant aquest conseller executiu/consellera executiva o davant el Consell Executiu del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Contra la desestimació expressa d'aquest recurs d'alçada, hi podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació del dit recurs d'alçada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;[...] Patrimoni monumental, cultural, històric, artístic, arquitectònic, arqueològic i paisatgístic; gestió del Registre Insular de béns d'Interès cultural; gestió del catàleg Insular del Patrimoni Històric; administració i gestió d'instal·lacions de suport a les tasques de conservació, restauració, foment i investigació de béns que pertanyen al patrimoni històric de Mallorca [...]&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Per desenvolupar aquestes competències, el Departament de Cultura i Patrimoni desplega mitjans tant humans com a tècnics per acomplir l'estudi, la conservació, la restauració i la posada en valor dels elements que formen part del patrimoni arquitectònic de l'illa. En el marc d'aquestes atribucions, ha impulsat el Programa per a la restauració dels molins de vent d'extracció d'aigua del pla de sant Jordi de Palma, pluriennal 2024-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Que la Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears en el títol IX sobre mesures de foment i difusió, i més concretament a l'article 81, sobre el principi de col·laboració, diu que les administracions públiques col·laboraran amb els propietaris i titulars de drets sobre béns culturals per conservar-los, recuperar-los i difondre'ls, mitjançant la prestació de l'assessorament tècnic i jurídic necessari i, si s'escau, la concessió d'ajudes de tipus econòmic i financer. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Que l'article 22.3 de la llei esmentada estableix que els poders públics promouran, per tots els mitjans al seu abast, la conservació, la consolidació i la millora dels béns integrants del patrimoni històric de titularitat pública i privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Que es adient que les institucions públiques tinguin cura d'aquests béns patrimonials, amb la contrapartida, per part de la propietat, de permetre'n la visita pública i gratuïta, a més d'altres obligacions relacionades en aquest conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La propietat permetrà les visites públiques i gratuïtes a favor del Consell Insular de Mallorca, o organisme en el qual delegui, per un període de 10 anys, a grups no superiors a 30 persones, &lt;span style="color:black"&gt;prèvia sol·licitud via telefònica, correu electrònic, etc. Les visites de grups superiors a 10 persones, si ho sol·licita la propietat, es realitzaran sota la supervisió d'una o més persones del&lt;/span&gt; Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Les visites es podran dur a terme tots els dies de l'any, excepte festius i diumenges. L'horari de les visites serà de 10h a 19h.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El molí pot esser inclòs dins una ruta a nivell local i/o europeu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Quan es tracti dels molins productors d'energia elèctrica, aquestes visites restaran sotmeses a la normativa pròpia del sector elèctric.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;TERCERA.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; Són obligacions del beneficiari:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a) Les definides al Programa per a la restauració dels molins de vent d'extracció d'aigua del pla de sant Jordi de Palma, pluriennal 2024-2027:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Fer-se càrrec de les despeses dels materials, del transport i d'altres despeses corresponents a la restauració, d'acord amb el punt segon del Programa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El pressupost serà aproximat, ja que és impossible fer un pressupost tancat en uns treballs d'aquestes característiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Assumir el proveïment d'aigua per a l'obra, i la retirada i tractament dels residus derivats de l'execució de l'obra de restauració &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Mantenir en bon estat l'element restaurat i el seu entorn proper. Per això una vegada restaurat el Consell Insular de Mallorca, promocionarà a la propietat un manual de manteniment, en el termes especificats al punt dissetè.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- No realitzar intervencions que no pertoquin en l'element restaurat ni alterar-ne l'ús tradicional&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Permetre l'accés al personal del Consell Insular de Mallorca que ha de redactar el projecte tècnic i el pressupost, facilitant-los la informació pertinent per a la restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Donar la conformitat al projecte tècnic i al pressupost.&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Respectar el règim de visites establert al punt tretzè, durant un període de 10 anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Permetre fer, en el lloc i en les dates que determini el Consell Insular de Mallorca, diverses rodes de premsa amb l'objectiu de presentar als mitjans de comunicació els treballs realitzats o en vies d'execució&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Permetre deixar constància durant la restauració que aquesta es realitzà amb l'ajut del Departament de Cultura i Patrimoni del Consell Insular de Mallorca, també s'identificaran altres organisme que contribueixin a la restauració, si n'és el cas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Comptar amb el permís d'obres &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- &lt;/span&gt;Durant el període de la restauració, si escau, cedir l'ús d'una zona de 20 metres al voltant del molí, amb la finalitat de facilitar les tasques de restauració&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Permetre al personal del Departament de Cultura i Patrimoni, una vegada restaurat l'element, les visites d'inspecció corresponents durant els deu anys següents a la restauració amb la finalitat de garantir que la propietat compleix les obligacions especificades en aquest Programa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Permetre que el Consell Insular de Mallorca, una vegada conclosos els treballs de restauració, col·loqui en un lloc visible un faristol (1,10 m d'alçada aproximadament) amb la seva corresponent placa (0,44x0,34 m aproximadament), en la qual consti la següent informació: valors històrics, arquitectònics i tècnics del molí, a més d'incloure fotografies, plànols, croquis, QR i vídeos; i que la restauració de l'element ha estat feta pel Departament de Cultura i Patrimoni del Consell de Mallorca a l'empara del &lt;/span&gt;Programa per a la restauració dels molins de vent d'extracció d'aigua del Pla de Sant Jordi de Palma, pluriennal 2024-2027&lt;span style="color:black"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Permetre al Consell Insular de Mallorca la divulgació de la informació abans esmentada al punt anterior a través dels següents mitjans: creació de codis QR, edició de productes informatius (mapa desplegable i altres), publicitat a Internet (llocs webs i xarxes socials), publicitat als mitjans de comunicació, publicació a la Memòria del MPC ; i qualsevol altra acció que el Consell Insular de Mallorca consideri oportuna, sempre i quan no vagi en detriment de la correcta preservació del bé restaurat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;- Mantenir net i sense estris el molí i l'espai de visita.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;Les obligacions derivades de les particularitats d'aquesta restauració són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b) Donar a conèixer aquest conveni en cas de transmissió de la propietat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;QUARTA.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; Són obligacions del&lt;strong&gt; &lt;/strong&gt;Consell Insular de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a) Redactar el projecte de restauració del molí segons el punt segon del Programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b) Assumir la direcció i l'execució de l'obra, mitjançant el personal propi (tècnics i Brigada d'Obres) de la Direcció Insular de Patrimoni del Departament de Cultura i Patrimoni, d'acord amb el punt segon del Programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c) Respectar el règim de visites establert a la clàusula segona, durant un període de 10 anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;d) Gestionar i organitzar les visites públiques i gratuïtes segons la clàusula segona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;e) Fer inspeccions periòdiques per determinar el manteniment del bé.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;CINQUENA.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; El règim de visites, públiques i gratuïtes, que s'estableixin mitjançant aquest conveni serà vigent des de l'acabament dels treballs de restauració del molí una vegada emès el certificat de final d'obra. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Aquest règim es podrà revisar i modificar en qualsevol moment, de comú acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Quan es tracti dels molins productors d'energia elèctrica, aquestes visites restaran sotmeses a la normativa pròpia del sector elèctric.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;SISENA- &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;En cas de produir-se qualsevol problema en l'ús de l'espai restaurat o que afecti a la propietat que no s'hagi previst en el present conveni, es reunirà una comissió mixta formada per un representant de la Direcció Insular de Patrimoni de Consell Insular de Mallorca i el beneficiari i, en cas d'intervenció en el molí per part d'un altre organisme, un representant d'aquest, que analitzaran el problema i adoptaran les mesures oportunes per resoldre'l.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;SETENA.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; Seran causa de revocació l'incompliment de les obligacions establertes al Programa i al present conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;VUITENA.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;El període de vigència d'aquest Conveni començarà en el moment de la seva signatura i s'estendrà al llarg de quatre (4) anys, amb possibilitat de pròrroga, d'acord amb el que s'estableix a l'article 49. h) de la Llei 40/2015, &lt;/span&gt;d'1 de octubre, de Règim Jurídic del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Tot això, sense perjudici del compliment de les obligacions previstes en aquest conveni i en les bases del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;I, en prova de l'anterior, signen aquest Conveni en el lloc i la data abans esmentats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La vicepresidenta primera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
