&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021,modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d&amp;apos;agost de 2022 (BOIB núm. 103, de 6 d&amp;apos;agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Les persones o entitats que figuren en l&amp;apos;annex d&amp;apos;aquesta Resolució varen presentar una sol·licitud de subvenció en el marc de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Els titulars dels expedients que apareixen a l&amp;apos;annex han presentat un escrit en el que indiquen que desisteixen de la sol·licitud de subvenció esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El conseller d&amp;apos;Empresa, Ocupació i Energia és l&amp;apos;òrgan competent per a resoldre el procediment atès el Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s&amp;apos;estableixen les competències i l&amp;apos;estructura orgànica bàsica de les conselleries de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears (modificat pel Decret 16/2023, de 20 de juliol, de la presidenta de les Illes Balears), competència delegada en el director general d&amp;apos;Economia Circular, Transició energètica i Canvi Climàtic per la Resolució del conseller d&amp;apos;Empresa, Ocupació i Energia de 20 de juliol de 2023 de delegació de competències i de suplència dels òrgans directius de la Conselleria (BOIB núm. 103, de 22 de juliol de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. La Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El Decret legislatiu&amp;nbsp;2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el Text refós de la Llei de subvencions (BOIB núm.&amp;nbsp;196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. L&amp;apos;article 94, de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, preveu que l&amp;apos;Administració, en el supòsit de renúncia de la persona interessada als seus drets, acceptarà la renúncia completament i resoldrà el procediment declarant aquesta circumstància, amb indicació dels fets produïts i les normes aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021 per la qual s&amp;apos;aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu (BOIB núm. 88, de 3 de juliol de 2021), modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d&amp;apos;agost de 2022 (BOIB núm. 103, de 6 d&amp;apos;agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;Per tot això, dict la següent,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;span style="color: black"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Acceptar el desistiment de la sol·licitud de subvenció presentada pels beneficiaris dels expedients que apareixen a l&amp;apos;annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;2. Declarar conclòs el procediment i per tant, arxivar l&amp;apos;expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller &lt;span style="color: black"&gt;d&amp;apos;Empresa, Ocupació i Energia&lt;/span&gt; en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb els articles&amp;nbsp;123 i 124 de la Llei&amp;nbsp;39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article&amp;nbsp;57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació de la resolució, d&amp;apos;acord amb l&amp;apos;article&amp;nbsp;46 de la Llei&amp;nbsp;29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
