    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Havent transcorregut el termini d'exposició al públic de l'acord d'aprovació inicial, pel Ple que es va celebrar el passat 29 de maig de 2024, de l'ordenança reguladora de la prestació patrimonial de caràcter públic no tributari per a la prestació dels serveis públics esportius a la piscina pública municipal, contra la qual no s'ha presentat cap al·legació, queda elevat a definitiu l'acord plenari inicial d'aprovació el qual texte de l'ordenança es transcriu íntegrament pel general coneixement i en compliment del disposat en l'article 70.2 de la Llei 7/1985 RBRL.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta aprovació definitiva es podrà interposar directament recurs contenciós administratiu en el termini de dos mesos a partir de l'endemà de la publicació d'aquest anunci davant el Jutjat Contenciós Administratiu de Palma de Mallorca, o qualsevol altre recurs que es consideri pertinent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ORDENANÇA REGULADORA DE LA PRESTACIÓ PATRIMONIAL DE CARÀCTER PÚBLIC NO TRIBUTARI PER A LA PRESTACIÓ DELS SERVEIS PÚBLICS ESPORTIUS A LA PISCINA PÚBLICA MUNICIPAL,&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Article 1. Fonament i naturalesa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució, i a l'empara de l'apartat 6 de l'article 20 del text refós de la Llei reguladora de les hisendes locals, (en endavant&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;TRLHL), en la redacció aprovada per la Disposició Final Dotzena de la Llei 9/2017, de 8 de novembre, de Contractes del Sector Públic (LCSP), aquest Ajuntament estableix la prestació patrimonial de caràcter públic no tributari (en endavant PPCPNT) per a la prestació dels serveis públics esportius a la piscina pública municipal, la qual es regirà per la present Ordenança Reguladora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Article 2. Pressupost de Fet de la Prestació Patrimonial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constitueix el pressupost de fet d'aquesta prestació Patrimonial:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) La prestació dels serveis públics prestats en les instal·lacions de la piscina municipal des Mercadal, que es refereixin, afectin o beneficiïn de forma particular al subjecte passiu, en els casos previstos a l'article 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Article 3. Obligats al Pagament&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Són obligats al pagament les persones físiques i jurídiques i les entitats a què es refereix l'article&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;35.4 de la Llei 58/2003, de 17 de desembre, general tributària que resultin beneficiades o&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;afectades pels serveis objecte d'aquesta ordenança per ser les persones usuàries de les&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;instal·lacions de la piscina municipal des Mercadal, en els casos previstos a l'article 6.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Article 4. Responsables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Seran responsables dels deutes tributaris, juntament amb els deutors principals, les persones o entitats a què es refereix l'article 41 de la LGT, en els supòsits i amb l'abast que allà s'assenyala.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Respondran solidàriament de les obligacions de l'obligat al pagament les persones físiques i jurídiques a què es refereixen els articles 42 de la Llei 58/2003, de 17 de desembre, general Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Seran responsables subsidiaris les persones físiques i jurídiques a què es refereix l'article 43 de la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La derivació de responsabilitat requerirà que, prèvia audiència de la persona interessada, es dicti acte administratiu, en els termes previstos a la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La responsabilitat s'exigirà en tot cas en els termes i d'acord amb el procediment previst a la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Els menors de 3 anys no pagaran entrada en les activitats lliures (1).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Als efectes d'aquesta ordenança, es consideren com a discapacitats els que determina l'article 4 del Real Decret Legislatiu 1/2013, de 29 de novembre, que aprova el text refós de la Llei general de drets de les persones amb discapacitat i de la seva inclusió social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Article 6. Bonificacions&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No existeixen bonificacions en aquesta PPCPNT.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Article 7. Periodicitat de la facturació i meritació de l'obligació de pagament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Es merita la PPCPNT i neix l'obligació de contribuir des del moment en el qual s'iniciï la prestació dels serveis subjectes a gravamen, i s'entén, a aquest efectes, que la susdita iniciació es produeix amb la sol·licitud d'aquells o a l'entrada a les instal·lacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Article 8. Declaració i Ingrés&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aquesta PPCPNT s'exigirà en règim d'autoliquidació. Les persones usuàries podran autoritzar a l'entitat gestora al cobrament de les quotes mitjançant domiciliació bancària, mitjançant un full de domiciliació bancària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El període impositiu serà l'especificat a l'article 5 per cada cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Les tarifes s'abonaran dins de la primera setmana del mes, mitjançant domiciliació bancària, llevat de les altes i les entrades puntuals que s'abonaran en metàl·lic en el moment de fer el primer ús de la instal·lació. La matrícula s'abonarà el primer mes de realitzar l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. L'import de les despeses derivades de la devolució bancària dels rebuts haurà de ser assumit pels usuaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Transcorreguts el període voluntari, s'iniciarà el període executiu per via de constrenyiment, la qual comporta l'acreditament dels recàrrecs corresponents i dels interessos de demora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Article 9. Infraccions i Sancions&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. En tot allò relatiu a la qualificació d'infraccions, així com les sancions que a les mateixes corresponguin en cada cas, s'estarà al que disposa la Llei 58/2003, de 17 de desembre, General tributària.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Per les infraccions que es produeixin en la utilització del servei la batlia o, per delegació d'aquesta, la Junta de Govern Local, podrà imposar les sancions governatives que estimi adequades, d'acord amb la legalitat vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Disposició addicional primera&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atès que el règim jurídic substantiu bàsic aplicable a la figura de les prestacions patrimonials de caràcter públic no tributari actualment establert amb caràcter general en la disposició addicional primera de la Llei 50/2003, de 17 de desembre, general tributària, i amb caràcter específic per a les entitats locals, en l'apartat 6 de l'article 20 del Text Refós de la Llei reguladora de les Hisendes Locals, no ha estat encara desenvolupat normativament pel legislador estatal, mentre no sigui dut a terme aquesta regulació normativa de desenvolupament, i en el no disposat expressament per la present Ordenança Reguladora, seran d'aplicació supletòria a la PPCPNT regulada en la mateixa, les determinacions sobre implantació, gestió, inspecció, recaptació i revisió en via administrativa establertes per a les taxes pels esmentats textos legals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Disposició Final&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La present ordenança fiscal entrarà en vigor el mateix dia de la seva publicació en el Butlletí Oficial de la Comunitat Autònoma, i s'aplicarà a partir del primer trimestral natural posterior a la seva entrada en vigor.
