text/html CAIB ca 443286 ca 2024-07-12 32276 CAIB 688758 2024-07-13 32278 ![CDATA[Resolució del conseller d'Empresa, Ocupació i Energia, a proposta definitiva del director general d'Economia Circular, Transició Energètica i Canvi Climàtic, per la qual es minora la quantitat de l'ajut i es proposa el pagament en el marc de la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència europeu finançat per la Unió Europea-NextGenerationEU]] CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En data de la signatura electrònica, el director general d'Economia Circular, Transició Energètica i Canvi Climàtic ha formulat la proposta definitiva següent:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES&nbsp;III)<strong><em> </em></strong>mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021</span>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Les persones o entitats que figuren en l'annex d'aquesta proposta varen obtenir una subvenció per a actuacions de suport a la mobilitat eficient i sostenible.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Les persones o entitats que figuren en l'annex d'aquesta Proposta varen presentar la documentació justificativa de les actuacions duites a terme, en què s'acredita que l'import de l'actuació ha estat inferior al previst inicialment.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. Els tècnics de la Direcció General d'Economia Circular, Transició Energètica i Canvi Climàtic han informat favorablement sobre el pagament de les subvencions descrites en l'annex, en què s'inclou una minoració de l'import proporcional a les modificacions efectuades, les quals s'han calculat d'acord amb la Resolució de convocatòria d'aquests ajuts.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">5. En data 12 de juny de 2024 es va emetre una proposta de resolució provisional per la qual es minora la quantitat de l'ajut i es proposa el pagament del&nbsp; director general d'Economia Circular, Transició Energètica i Canvi Climàtic (BOIB núm.&nbsp; 80, de 15 de juny de 2024).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. S'ha exhaurit el termini que es concedia per presentar al·legacions sense que se'n hagin presentat.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Decret legislatiu&nbsp;2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm.&nbsp;196, de 31 de desembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decret&nbsp;75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm.&nbsp;122, de 2 de setembre de 2004).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm.&nbsp;72, de 24 de maig de 2008).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Reial Decret&nbsp;266/2021, de 13 d'abril, pel qual s'aprova la concessió directa d'ajuts a les comunitats autònomes i a les ciutats de Ceuta i Melilla per a l'execució de programes d'incentius lligats a la mobilitat elèctrica (MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu. (BOE núm.&nbsp;89, de 14 d'abril de 2021).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021 per la qual s'aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES&nbsp;III) en el marc del Pla de Recuperació, Transformació i Resiliència europeu (BOIB núm.&nbsp;88, de 3 de juliol de 2021).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Proposta de resolució definitiva</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propòs al conseller d'Empresa, Ocupació i Energia que dicti una resolució en els termes següents:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Reconèixer l'obligació i proposar el pagament d'una subvenció als beneficiaris que figuren en l'annex, d'acord amb l'import que s'hi indica.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Revocar parcialment la subvenció concedida pel motiu que s'indica en l'annex.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Autoritzar i disposar negativament la despesa a revocar parcialment dels beneficiaris i pels imports detallats a l'annex.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Establir que els beneficiaris estan obligats a complir el que disposa l'apartat catorzè de la Resolució del conseller de Transició Energètica i Sectors Productius de 28 de juny de 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Disposar que tota alteració de les condicions establertes per a la concessió de la subvenció, com també l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions públiques o ens públics, nacionals o internacionals, dona lloc a la revisió parcial o total de la subvenció i, per tant, al reintegrament de la quantitat corresponent més els interessos de demora.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Publicar aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposició de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Empresa, Ocupació i Energia en el termini d'un mes comptador des de l'endemà de la notificació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
