&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1. &lt;/strong&gt;Resolució de la Presidència de l'Institut Mallorquí d'Afers Socials (d'ara endavant IMAS), de data 30 de novembre de 2022 (BOIB núm. 157, del 3 de desembre de 2022) per la qual s'aproven la convocatòria, les bases i el barem de mèrits del procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a les escales, subescales, classes i especialitats dels subgrups C1, C2 i AP de les places de l'oferta pública extraordinària per a l'any 2022.&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; E&lt;/span&gt;n sessió celebrada dia 30 d'abril de 2024, el Tribunal Qualificador, després d'haver revisat l'ordre de preferència d'elecció dels llocs oferts de les persones aspirants i atenent l'ordre de puntuació establert a la llista definitiva de baremació de mèrits, &lt;span style="color:#000000"&gt;va proposar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Aprovar la llista definitiva de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari de l'escala d'Administració especial, subescala serveis especials, classe personal d'oficis / operari-a del subgrup AP, de l'especialitat Zelador-a.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Nomenar personal funcionari de carrera de l'escala d'Administració especial, subescala serveis especials, classe persoal d'oficis / operari-a del subgrup AP, especialitat Zelador-a.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Adjudicar els llocs de treball a les persones aspirants que han superat el procés selectiu, d'acord amb l'ordre de preferència efectuat i atenent l'ordre de puntuació establert a la llista definitiva de baremació de mèrits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;I.&lt;/strong&gt; El Decret llei 6/2022, de 13 de juny, de noves mesures urgents per reduir la temporalitat en l'ocupació pública de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;II. &lt;/strong&gt;Atès l'establert a la base 9.1 de l'Annex II de la R&lt;span style="color:#000000"&gt;esolució de la Presidència &lt;/span&gt;&lt;span style="color:#000000"&gt;de l'&lt;/span&gt;&lt;span style="color:#000000"&gt;IMAS, de data &lt;/span&gt;&lt;span style="color:#000000"&gt;30&lt;/span&gt;&lt;span style="color:#000000"&gt; d&lt;/span&gt;&lt;span style="color:#000000"&gt;e novembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2022 (BOIB núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt;57&lt;/span&gt;&lt;span style="color:#000000"&gt;, de &lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; d&lt;/span&gt;&lt;span style="color:#000000"&gt;e desembre &lt;/span&gt;&lt;span style="color:#000000"&gt;de 2022), &lt;/span&gt;&lt;span style="color:#000000"&gt;per la qual e&lt;/span&gt;&lt;span style="color:#000000"&gt;s varen aprovar &lt;/span&gt;&lt;span style="color:#000000"&gt;la convocatòria, les bases i el barem de mèrits del procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a les escales, subescales, classes i especialitats dels subgrups &lt;/span&gt;&lt;span style="color:#000000"&gt;C&lt;/span&gt;&lt;span style="color:#000000"&gt;1&lt;/span&gt;&lt;span style="color:#000000"&gt;, C2&lt;/span&gt;&lt;span style="color:#000000"&gt; i A&lt;/span&gt;&lt;span style="color:#000000"&gt;P de les places de l'oferta pública extraordinària per a l'any 2022, i d'acord amb l'article 52.3 de la Llei 3/2007, en concordança amb l'article 61.8 del TREBEP, la llista de persones que han superat el procés selectiu ha de contenir, com a màxim, tantes persones aprovades com el nombre de places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;III.&lt;/strong&gt; La Presidència de l'IMAS es l'òrgan competent per resoldre els procediments de selecció i nomenar el personal funcionari de carrera, d'acord amb allò que es preveu en l'article 7.2 13) i 14) del text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials, aprovats pel Ple del Consell de Mallorca de dia 11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot això, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;* L' aspirant s'ha acollit a l'exempció del requisit d'acreditació de coneixements de llengua catalana recollit a la base 5.2 de l'Annex II de les bases específiques de la convocatòria. D'acord amb aquesta base resta obligat, en el termini de dos anys, comptadors a partir de la signatura del contracte de treball, a acreditar el nivell de coneixement de la llengua catalana exigit per a l'accés a la plaça de les categoria adscrita a l'Agrupació professional (AP).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Les persones relacionades disposaran d'un termini de tres dies hàbils des de l'endemà de la publicació pel jurament o promesa i la presa de possessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la publicació de la present Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
