    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Consell Executiu del Consell Insular de Mallorca, a la sessió ordinària de dia 13 de març de 2024,&amp;nbsp; a través del departament de Turisme, en l'exercici de les competències que té conferides i d'acord amb els objectius fixats en el Pla Estratègic de Subvencions de l'any 2024, va aprovar la convocatòria pública per dur a terme accions de foment en matèria d'informació turística 2024 d'acord amb l'Ordenança general de subvencions del Consell Insular de Mallorca publicada en el BOIB núm. 21, de 18 de febrer de 2017, modificada per l'Acord del Ple de 14 de juny de 2018 (BOIB núm.96, de 4 d'agost de&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En el pressupost de despeses del Consell de Mallorca de 2024 hi ha&amp;nbsp; crèdit adequat i suficient per fer front a la despesa derivada de la present convocatòria&amp;nbsp; per un import total de 580.000,00€ a les aplicacions pressupostàries 30.43210.76200, 30.43210.76300 i 30.43210.78900 denominada “convocatòria de subvencions per dur a terme accions de foment en matèria d'informació turística per a l'any 2024”, de finançament afectat núm. projecte 2024 2 30FIT-1 i documents comptables “A” núm. 220240012291, 220240012290 i 220240012292, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3.&amp;nbsp; El dia 21 de maig i dia 5 de juny de 2024, la Comissió avaluadora constituïda dins els actes de tràmit per vetllar pel compliment dels requisits establerts a la convocatòria va valorar els projectes presentats a les sol·licituds i a través d'aquesta valoració es proposa a la secretaria tècnica de Turisme, com a òrgan instructor de la convocatòria els beneficiaris i els imports proposats per a la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Informe favorable de compliment dels requisits de la convocatòria per a poder ser subjecte de concessió, emès per l'òrgan instructor de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Validació de la intervenció delegada de la Misericòrdia, de la redistribució de la despesa de 25 de juny de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Resolució del conseller executiu de Turisme sobre la redistribució de la despesa per a la concessió de les subvencions per dur a terme accions de foment en matèria d'informació turística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Informe jurídic favorable sobre la proposta d'aprovació de la concessió de les subvencions, emès per la TAG del servei de Governança i Sostenibilitat del Departament de Turisme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Dia 03 de juliol de 2024, la Intervenció delegada de la Misericòrdia ha fiscalitzat de conformitat la proposta de la resolució de concessió de les presents subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Consideracions jurídiques&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Decret de la Presidència del Consell Insular de Mallorca, de dia 28 de juliol de 2023 (BOIB núm. 196, de 29 de juliol de 2023; BOIB núm. 136, de 5 de octubre de 2023), estableix que el Departament de Turisme té atribuïdes les competències relatives a informació i promoció turística i suport a les oficines locals d'informació turística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Reglament orgànic del Consell de Mallorca (BOIB núm. 89, de dia 19 de juliol de 2018) a l'article 36.f)&amp;nbsp; juntament amb la base 24.5 de les Bases d'execució del pressupost de despeses vigent del Consell de Mallorca, disposen que entre les atribucions del conseller executiu estan entre d'altres resoldre les convocatòries d'ajudes i subvencions, per tant el conseller executiu, és el competent per aprovar la concessió d'aquestes subvencions i per disposar la corresponent despesa que se'n deriva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ordenança general de subvencions del Consell de Mallorca (BOIB núm. 21, de 18 de febrer de 2017) que n'estableix les bases reguladores. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. L'article 18.2.c) i d) de l'Ordenança general de subvencions del Consell Insular de Mallorca, l'òrgan instructor del procediment és la secretària tècnica del Departament de Turisme, el qual ha de dur a terme les actuacions i actes de tràmit necessaris per vetllar pel compliment del requisits de la convocatòria, i específicament, ha d'emetre un informe en què consti que, de la informació en poder seu, es desprèn que les persones beneficiaries compleixen tots els requisits necessaris per accedir-hi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La convocatòria s'adequa a les bases 34, 35 i 36 de les d'execució del pressupost de despeses del Consell de Mallorca per al 2024, relatives a la regulació de la percepció i la justificació de les subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El punt 14 de la convocatòria remet als articles 9 i 15 de l'Ordenança general de subvencions del Consell Insular de Mallorca l'obligació dels beneficiaris acreditar amb una declaració responsable, abans de dictar la proposta d'acord de concessió de la subvenció, el compliment de les obligacions tributàries amb l'Estat i amb el Consell Insular de Mallorca i els organismes autònoms que en depenen, i de les obligacions amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El punt 9 de la convocatòria, estableix que el procediment de selecció de les entitats beneficiàries es dur a terme mitjançant concurrència no competitiva, s'exceptua del requisit de fitxar un ordre de prelació en el cas de que les sol·licituds presentades reuneixin els requisits establerts i el crèdit sigui suficient, ja que el crèdit previst es dividirà entre totes les sol·licituds presentades atorgant en un primer moment el mateix import a cada sol·licitud, ja que d'acord amb l'import cert el màxim atorgable a cada subvenció és la quantia sol·licitada, el romanent que resulti es tornarà a repartir entre les sol·licituds que han demanat un import superior. sempre i quan l'expedient s'hagi complimentat correctament i acompanyat dels documents preceptius, fins exhaurir el total del crèdit pressupostari assignat a la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El punt 12.3 de la convocatòria estableix que dins els actes de tràmit, es constitueix una comissió avaluadora per vetllar pel compliment dels requisits establerts en la convocatòria. La seva valoració servirà de base a la proposta d'Acord que l'òrgan instructor presentarà, i que conté les sol·licituds admeses (detallant el pressupost sol·licitat i la subvenció concedida).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. L'expedient de despesa està sotmès al règim de fiscalització&amp;nbsp; i intervenció limitada prèvia d'acord amb l'acord de Ple del Consell de Mallorca de 12 de desembre de 2019&amp;nbsp; i els extrems que l'òrgan interventor ha de comprovar són els establerts en la fitxa 4.1.1) de l' Annex 1 d'aquest Acord.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Base 3 de la convocatòria sobre la vinculació de les aplicacions pressupostaries del projecte 2024 2 30FIT-1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El punt 12.2 de la convocatòria juntament amb l'article 18 de Ordenança general de subvencions del Consell de Mallorca (BOIB núm. 21, de 18 de febrer de 2017) es determina que s'adjuntarà un informe de l'òrgan instructor fent constar que de la informació obrant en l'expedient es desprèn que els beneficiaris compleixen tots els requisits necessaris per ser beneficiaris de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;12. La proposta d'acord de concessió de l'òrgan instructor s'ajusta el previst en el punt 12 de la convocatòria, atès que inclou les sol·licituds admeses, les reduïdes i les excloses,&amp;nbsp; amb el detall del pressupost subvencionable i la subvenció concedida als annexos I, II, III.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.CONCEDIR &lt;/strong&gt;&amp;nbsp;les subvencions econòmiques per dur a terme accions de foment en matèria d'informació turística, als beneficiaris que apareixen a l'annex I pels imports indicats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. DISPOSAR&lt;/strong&gt;&amp;nbsp; d'una despesa total de 580.000,00 € (cinc-cents vuitanta-mil) a favor dels ajuntaments, la mancomunitat i la fundació que es relacionen a l'Annex I pels imports que hi figuren, amb càrrec a les aplicacions pressupostaries: 30.43210.76200 per import de 421.252,90€, 30.43210.76300 per import de 140.000,00€, 30.43210.78900 per import de 18.747,10€ de la “convocatòria de subvencions per dur a terme accions de foment en matèria d'informació turística per a l'any 2024”, de finançament afectat núm. projecte 2024 2 30FIT-1, i&amp;nbsp; núm. de documents comptables “A” documents comptables “A” núm. 220240012291, 220240012290 i 220240012292, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. EXCLOURE&lt;/strong&gt;&amp;nbsp; la sol·licitud que figura a l'Annex II, pels motiu que s'hi detallen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.&lt;/strong&gt; &lt;strong&gt;REDUIR&lt;/strong&gt;&amp;nbsp; la sol·licitud que figura a l'Annex III, pels motiu que es detalla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. ORDENAR&lt;/strong&gt; la publicació d'aquesta resolució de concessió de les subvencions per dur a terme accions de foment en matèria d'informació turística per a l'any 2024, en el &lt;em&gt;Butlletí Oficial de les Illes Balears i &lt;/em&gt;en el web del Consell Insular de Mallorca&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6. INFORMAR, a les persones interessades del següent: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquest acte, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant aquest conseller executiu/consellera executiva o davant el Consell Executiu del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra la desestimació expressa d'aquest recurs d'alçada, hi podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir de l'endemà de rebre la notificació de la desestimació del dit recurs d'alçada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si han transcorregut tres mesos des de la interposició del recurs d'alçada i no n'heu rebut la notificació de resolució expressa, s'entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de sis mesos, comptadors a partir de l'endemà de la desestimació presumpta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstant l'anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
