    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Ple de l'Ajuntament de Sencelles aprovà &lt;span style="color:#000000"&gt;inicialment&lt;/span&gt;, en Sessió de dia 10 de maig de 2024, l'ordenança fiscal reguladora &lt;span style="color:#000000"&gt;de la zona blava (O.R.A)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Publicada l'aprovació &lt;span style="color:#000000"&gt;inicial&lt;/span&gt; al BOIB núm. 69, de data 25 de maig de 2024, i no havent reclamacions al respecte, es publica el text íntegre de l'aprovació acordada, considerant la seva aprovació com definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;AJUNTAMENT DE SENCELLES&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;ORDENANÇA REGULADORA D'APARCAMENT (ORA)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Exposició de motius.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El tràfic és una de les matèries expressament esmentades en &lt;/span&gt;l'article&lt;span style="color:#000000"&gt; 25.2 de la Llei 7/1985 de 2 &lt;/span&gt;d'abril&lt;span style="color:#000000"&gt; reguladora de les bases de Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El legislador estatal ha procedit a concretar aquesta previsió en el Text Refós de la Llei sobre tràfic, circulació de vehicles &lt;/span&gt;de&lt;span style="color:#000000"&gt; motor i &lt;/span&gt;Seguretat viària&lt;span style="color:#000000"&gt;, aprovat pel Reial Decret Legislatiu 339/1990, de 2 de març, on &lt;/span&gt;s'atribueixen&lt;span style="color:#000000"&gt; als municipis un important elenc de competències per regular i ordenar el &lt;/span&gt;trànsit&lt;span style="color:#000000"&gt; en les vies urbanes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En concret tals competències es contemplen en &lt;/span&gt;l'article&lt;span style="color:#000000"&gt; 7 del citat Text Articulat. Aquest precepte va ser objecte &lt;/span&gt;d'una&lt;span style="color:#000000"&gt; important modificació, per part de la Llei 5/1997, de 24 de març, que el seu objectiu fonamental va ser atorgar la deguda cobertura legal a les sancions per la infracció de &lt;/span&gt;l'Ordenació&lt;span style="color:#000000"&gt; de la Regulació &lt;/span&gt;d'Aparcaments&lt;span style="color:#000000"&gt;, la denominada ORA, i a les mesures &lt;/span&gt;d'immobilització&lt;span style="color:#000000"&gt; retirada i dipòsit dels vehicles incorrectament estacionats a les zones &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; limitats; actuacions totes elles que els municipis exercien sense el degut &lt;/span&gt;suport&lt;span style="color:#000000"&gt; legal, la qual cosa havia donat lloc a una jurisprudència contradictòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La Llei 19/2001, de 19 de desembre, de reforma de la Llei sobre Tràfic, Circulació de Vehicles &lt;/span&gt;de&lt;span style="color:#000000"&gt; Motor i &lt;/span&gt;Seguretat viària&lt;span style="color:#000000"&gt;, també ha incidit en aquest tema, &lt;/span&gt;l'exemple&lt;span style="color:#000000"&gt; del qual ho trobem en els articles 71 i 72 del text legal, que al·ludeixen a les competències dels municipis. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Segons &lt;/span&gt;l'article&lt;span style="color:#000000"&gt; 7 LSV: &lt;/span&gt;s'atribueixen&lt;span style="color:#000000"&gt; als municipis, en &lt;/span&gt;l'àmbit&lt;span style="color:#000000"&gt; d´&lt;/span&gt;aquesta Llei&lt;span style="color:#000000"&gt;, les següents competències: b) la regulació mitjançant Ordenança Municipal de Circulació, dels usos de les vies urbanes, fent compatible &lt;/span&gt;l'equitativa&lt;span style="color:#000000"&gt; distribució &lt;/span&gt;dels aparcaments&lt;span style="color:#000000"&gt; entre tots els usuaris amb la necessària fluïdesa del tràfic rodat i amb &lt;/span&gt;l'ús&lt;span style="color:#000000"&gt; dels vianants dels carrers, així com &lt;/span&gt;l'establiment&lt;span style="color:#000000"&gt; de mesures &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; limitat amb la finalitat de garantir la rotació dels aparcaments, prestant especial atenció a les necessitats de les persones amb discapacitat que tenen reduïda la seva mobilitat i que utilitzen vehicles, tot i això amb la finalitat &lt;/span&gt;d'afavorir&lt;span style="color:#000000"&gt; la seva integració social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;De conformitat amb el citat precepte, els usos relacionats amb la &lt;/span&gt;circulació viària&lt;span style="color:#000000"&gt; que són susceptibles en les vies urbanes són&lt;/span&gt;: la&lt;span style="color:#000000"&gt; circulació rodada, &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; de vehicles i trànsit &lt;/span&gt;pels vianants&lt;span style="color:#000000"&gt;. La necessitat de comptabilitzar aquests usos es tradueix, precisament, en la possibilitat que els municipals adoptin una sèrie de mesures, tals com la creació &lt;/span&gt;d'àrees&lt;span style="color:#000000"&gt; &lt;/span&gt;pels&lt;span style="color:#000000"&gt; vianants, zones de tràfic limitat o àrees &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; limitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El &lt;/span&gt;Tribunal&lt;span style="color:#000000"&gt; Suprem &lt;/span&gt;ha destacat&lt;span style="color:#000000"&gt;, &lt;/span&gt;expressament&lt;span style="color:#000000"&gt;, la facultat municipal per establir limitacions &lt;/span&gt;horàries en&lt;span style="color:#000000"&gt; la durada de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; en les vies urbanes (Sentència de 29 de maig de 2000), on, després de posar de manifest els nombrosos béns, drets i interessos implicats en el &lt;/span&gt;fenomen&lt;span style="color:#000000"&gt; del &lt;/span&gt;tràfic&lt;span style="color:#000000"&gt;, assenyala: “la qualitat de la vida de la ciutat té molt a veure amb l´encertat exercici i l´adequada aplicació de quantes tècniques jurídiques estan a la &lt;/span&gt;disposició&lt;span style="color:#000000"&gt; de les Administracions Públiques competents en la matèria. La disponibilitat &lt;/span&gt;d'espais&lt;span style="color:#000000"&gt; &lt;/span&gt;físics&lt;span style="color:#000000"&gt; en les zones de domini &lt;/span&gt;públic&lt;span style="color:#000000"&gt; per &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; de vehicles, la seva ocupació temporal de manera limitada i rotatiu, de manera que sigui &lt;/span&gt;possible el&lt;span style="color:#000000"&gt; seu repartiment entre els eventuals usuaris a les diferents hores del dia, forma part &lt;/span&gt;d'aquest&lt;span style="color:#000000"&gt; conjunt de mesures que serveixen per &lt;/span&gt;pal·liar&lt;span style="color:#000000"&gt; els aspectes negatius &lt;/span&gt;d'una&lt;span style="color:#000000"&gt; realitat: la &lt;/span&gt;d'increment&lt;span style="color:#000000"&gt; &lt;/span&gt;constant&lt;span style="color:#000000"&gt; de vehicles que circulen per les ciutats, que &lt;/span&gt;afecta&lt;span style="color:#000000"&gt; interessos que, per ser de tots, adquireixen la condició de col·lectius”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El municipi de Sencelles no conta en &lt;/span&gt;l'actualitat&lt;span style="color:#000000"&gt; amb &lt;/span&gt;l'Ordenança&lt;span style="color:#000000"&gt; reguladora de l'estacionament i és necessari adequar la realitat existent amb les necessitats veïnals. Resulta &lt;/span&gt;imprescindible&lt;span style="color:#000000"&gt; un nou text normatiu que afronti la &lt;/span&gt;regulació&lt;span style="color:#000000"&gt; de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; de vehicles quant &lt;/span&gt;a l'ús&lt;span style="color:#000000"&gt; comú general del domini públic viari, i que &lt;/span&gt;introdueix&lt;span style="color:#000000"&gt; noves figures que contribueixin a donar una major satisfacció als interessos dels veïns de Sencelles. Amb aquest objectiu, &lt;/span&gt;s'ha&lt;span style="color:#000000"&gt; redactat una nova Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aquest projecte distingeix varies zones &lt;/span&gt;d'aparcament hi&lt;span style="color:#000000"&gt; introdueix un quadre &lt;/span&gt;d'excepcions&lt;span style="color:#000000"&gt;, tot això amb la intenció &lt;/span&gt;d'aconseguir&lt;span style="color:#000000"&gt; un adequat ús de les vies urbanes, en les &lt;/span&gt;quals&lt;span style="color:#000000"&gt; el domini públic, susceptible de ser utilitzat com a lloc &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt;, es caracteritza per la seva escassetat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;De conformitat amb &lt;/span&gt;l'establert&lt;span style="color:#000000"&gt; en els articles 4.b) de la Llei 7/1985, de 2 &lt;/span&gt;d'abril&lt;span style="color:#000000"&gt;, Reguladora de les bases del Règim Local, en la redacció donada per la Llei 11/1999, de 21 &lt;/span&gt;d'abril&lt;span style="color:#000000"&gt; i 7.b) de la L&lt;/span&gt;l&lt;span style="color:#000000"&gt;ei 19/2001, de 19 de desembre , de reforma del text articulat de la Llei sobre tràfic, Circulació de vehicles &lt;/span&gt;de&lt;span style="color:#000000"&gt; Motor i Seguretat Vial, aprovat per Reial Decret Legislatiu 339/1990, de 2 de març, &lt;/span&gt;L'Ajuntament&lt;span style="color:#000000"&gt; de Sencelles ESTABLEIX LA PRESENT “&lt;strong&gt;Ordenança Reguladora &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;d'aparcament&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; (ORA)”.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 1&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Objecte&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La regulació de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; en la via pública té per objecte &lt;/span&gt;l'establiment&lt;span style="color:#000000"&gt; de les mesures necessàries per garantir la rotació dels aparcaments en determinades vies públiques del municipi, mitjançant &lt;/span&gt;l'ordenació&lt;span style="color:#000000"&gt; i regulació &lt;/span&gt;d'estacionaments&lt;span style="color:#000000"&gt; per temps limitats, en els quals serà obligatori indicar &lt;/span&gt;l'inici&lt;span style="color:#000000"&gt; &lt;/span&gt;d'aquest&lt;span style="color:#000000"&gt;, amb la finalitat de fer compatible &lt;/span&gt;l'equitativa&lt;span style="color:#000000"&gt; distribució de &lt;/span&gt;l'aparcament&lt;span style="color:#000000"&gt; entre tots els usuaris i la fluïdesa del tràfic, així com el compliment de la normativa en matèria de &lt;/span&gt;seguretat viària&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Aquesta regulació és de caràcter gratuït i porta implícita la limitació del temps d'estacionament en la via pública, dins de les zones que es determinin en &lt;/span&gt;l'àmbit&lt;span style="color:#000000"&gt; territorial del municipi de Sencelles. Per això, &lt;/span&gt;s'estableixen&lt;span style="color:#000000"&gt; mesures &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; limitat en les vies públiques (funcionals, espacials, i temporals), amb la finalitat de garantir la rotació dels aparcaments , així com &lt;/span&gt;l'establiment&lt;span style="color:#000000"&gt; de mesures correctores per garantir el seu compliment&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Als efectes previstos en la present norma, els termes “aparcament” i “estacionament” seran considerats sinònims.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 2&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Determinació de les zones &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;d'estacionament&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; limitat&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Als efectes de &lt;/span&gt;l'adequada&lt;span style="color:#000000"&gt; aplicació &lt;/span&gt;d'aquesta&lt;span style="color:#000000"&gt; Ordenança, es determinarà mitjançant Decret de Batlia-Presidència les vies públiques subjectes a estacionament limitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Les zones &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; limitat podran ser objecte de modificació, tot això depenent de les condicions i evolució del tràfic i de la seva demanda. Aquestes modificacions podran dur-se a terme mitjançant Decret de Batlia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. A causa de la seva configuració, &lt;/span&gt;l'Ordenança&lt;span style="color:#000000"&gt; no estableix que les persones residents, a les zones objecte de regulació, puguin disposar &lt;/span&gt;d'una&lt;span style="color:#000000"&gt; targeta que els habiliti per estacionar els seus vehicles dins dels horaris i les zones establertes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Zones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Les zones de municipi de Sencelles que comprenen aquest servei públic es denominen zona-ORA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. S'estableix&lt;span style="color:#000000"&gt; una modalitat de zona &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; regulat i de permanència limitada, control horari (&lt;strong&gt;zona blava),&lt;/strong&gt; les vies afectades de la qual, en principi, figuren relacionades en &lt;/span&gt;l'annex&lt;span style="color:#000000"&gt; &lt;/span&gt;d'aquesta&lt;span style="color:#000000"&gt; Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Els espais en els quals &lt;/span&gt;s'implanti&lt;span style="color:#000000"&gt; el sistema d'estacionaments ORA es dividiran en fraccions urbanes denominades zones, convenientment delimitades i indicades mitjançant &lt;/span&gt;l'oportuna&lt;span style="color:#000000"&gt; senyalització vertical i horitzontal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 4&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Calendari i horari estacionament limitat.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. L'estacionament&lt;span style="color:#000000"&gt; limitat regirà durant tot &lt;/span&gt;l'any&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. L'horari&lt;span style="color:#000000"&gt; &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; de les places de rotació serà &lt;/span&gt;l'indicat&lt;span style="color:#000000"&gt; a continuació: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;*&lt;/strong&gt; diumenges i &lt;/span&gt;festius:&lt;span style="color:#000000"&gt; sense limitació horària.&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. El temps màxim &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; a la zona blava, en el període regulat, serà &lt;strong&gt;de &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;quaranta-cinc &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;minuts.&lt;/strong&gt; Transcorregut aquest període, el vehicle haurà &lt;/span&gt;d'abandonar&lt;span style="color:#000000"&gt; obligatòriament la plaça &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt;, havent de procedir a canviar el vehicle de lloc de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; a un&lt;/span&gt; altre carrer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. Per els conductors discapacitats, degudament acreditats amb la targeta atorgada conforme a les disposicions vigents, el temps màxim de permanència el període regulat en la zona blava serà de doble de &lt;/span&gt;l'establert&lt;span style="color:#000000"&gt; en el paràgraf anterior. Transcorregut &lt;/span&gt;l'esmentat&lt;span style="color:#000000"&gt; temps màxim, el vehicle també haurà &lt;/span&gt;d'abandonar&lt;span style="color:#000000"&gt; obligatòriament la plaça &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. Els horaris de regulació i limitació de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; podran ser modificats mitjançant Decret per Batlia, competent en matèria de tràfic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. Els faculta a batlia perquè, per motius &lt;/span&gt;d'interès&lt;span style="color:#000000"&gt; públic i mitjançant &lt;/span&gt;l'oportuna&lt;span style="color:#000000"&gt; resolució, pugui modificar tant els períodes com els horaris establerts, en ocasió de festejos o actes multitudinaris i pugui excloure, temporalment, determinades zones d´ORA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Títol habilitant&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Per estacionar a les zones delimitades com a places d'estacionament regulat i limitat (zona blava), &lt;/span&gt;s'haurà&lt;span style="color:#000000"&gt; de complir amb totes les normes generals que afecten &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt;, i haurà &lt;/span&gt;d'iniciar&lt;span style="color:#000000"&gt;-se &lt;/span&gt;l'inici&lt;span style="color:#000000"&gt; de &lt;/span&gt;l'estacionament&lt;span style="color:#000000"&gt; del vehicle.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. El còmput del temps &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; es podrà realitzar mitjançant un distintiu (fulla de paper) o disc de control, on el conductor indicarà &lt;/span&gt;l'hora&lt;span style="color:#000000"&gt; &lt;/span&gt;d'arribada&lt;span style="color:#000000"&gt;. Aquest distintiu de control haurà de col·locar-se en la cara interior del parabrises davanter del vehicle, de manera que sigui perfectament visible des de &lt;/span&gt;l'exterior&lt;span style="color:#000000"&gt;, a &lt;/span&gt;l'efecte&lt;span style="color:#000000"&gt; dels controls oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Quan es donin circumstàncies que així ho aconsellin, i en atenció als interessos municipals, la batlia podrà implantar altres sistemes de control &lt;/span&gt;d'horari&lt;span style="color:#000000"&gt; (per exemple, mitjançant &lt;/span&gt;l'oportú&lt;span style="color:#000000"&gt; comprovant obtingut en màquines expenedores instal·lades en la via pública, amb &lt;/span&gt;l'introducció&lt;span style="color:#000000"&gt; de monedes o targeta magnètica).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 6&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Sistema de gestió&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. El compliment del regulat en la present Ordenança, quant a la limitació &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; i, quan escaigui, a &lt;/span&gt;l'abonament&lt;span style="color:#000000"&gt; del preu públic que es determini, com a títol habilitant per l'estacionament, quedarà garantit mitjançant &lt;/span&gt;l'establiment&lt;span style="color:#000000"&gt; de la corresponent senyalització vertical i marques vials, màquines expenedores de tiquets convenientment distribuïdes dins de les zones &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; regulat i limitat, i a la implantació del servei públic de control, que es gestionarà d&lt;/span&gt;i&lt;span style="color:#000000"&gt;recte o indirectament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Qualsevol vehicle, que es trobi estacionat en una zona &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt; regulat i limitat (zona blava), i no tingui el corresponent distintiu de control horari, serà denunciat i podrà ser retirat pel servei de grua particular concertat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 7&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Vigilància i control&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La vigilància i control dins de &lt;/span&gt;l'àmbit&lt;span style="color:#000000"&gt; territorial &lt;/span&gt;d'aplicació&lt;span style="color:#000000"&gt; &lt;/span&gt;de la regulació&lt;span style="color:#000000"&gt; d'aparcaments està encomanada als agents de la policia local &lt;/span&gt;d'aquest&lt;span style="color:#000000"&gt; municipi, de conformitat amb el Text Refós de la Llei sobre Tràfic, Circulació de Vehicles a Motor i &lt;/span&gt;Seguretat viària&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Les &lt;/span&gt;denúncies&lt;span style="color:#000000"&gt; que es formulin a les zones &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt; regulat, es tramitaran per la dependència municipal encarregada dels expedients sancionadors, d´acord amb els procediments establerts, fins a la consecució del pagament de la sanció, &lt;/span&gt;sigui per via ordinària sigui&lt;span style="color:#000000"&gt; per procediment de constrenyiment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 8&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Abonaments de taxes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els titulars dels vehicles retirats de les zones &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; regulat amb limitació horària, igual que els retirats en altres vies públiques de la població, per infraccions a normes de circulació i &lt;/span&gt;seguretat viària&lt;span style="color:#000000"&gt;, hauran &lt;/span&gt;d'abonar&lt;span style="color:#000000"&gt; les taxes que regula &lt;/span&gt;l'Ordenança&lt;span style="color:#000000"&gt; Fiscal corresponent, prèviament a la recuperació &lt;/span&gt;d'aquests&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 9&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Excepcions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les prescripcions contingudes en la present Ordenança no seran &lt;/span&gt;aplicables&lt;span style="color:#000000"&gt; als següents vehicles:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Motocicletes, ciclomotors i bicicletes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Vehicles &lt;/span&gt;autotaxi&lt;span style="color:#000000"&gt; quan el conductor estigui present i realitzant un servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Vehicles destinats a &lt;/span&gt;l'assistència&lt;span style="color:#000000"&gt; sanitària, Creu Vermella o Protecció Civil, així com les ambulàncies quan es trobin en la prestació &lt;/span&gt;d'un&lt;span style="color:#000000"&gt; servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Vehicles oficials dels cossos de seguretat, exteriorment identificats, quan es trobin prestant un servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Vehicles oficials de bombers que es trobin prestant un servei i estiguin exteriorment identificats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6. Vehicles de serveis oficials, extremadament identificats, quan es trobin &lt;/span&gt;duent a terme&lt;span style="color:#000000"&gt; serveis públics de la seva competència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7. Vehicles funeraris en prestació &lt;/span&gt;d'un&lt;span style="color:#000000"&gt; servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. Vehicles que exhibeixin, de forma clara i indubtable, la possessió de la targeta de minusvàlid.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. Vehicles de les representacions diplomàtiques o consulars , acreditats a Espanya, amb placa de matrícula diplomàtica o consular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 10&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Targetes i distintius especials&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. En casos excepcionals i &lt;/span&gt;per raó de&lt;span style="color:#000000"&gt; &lt;/span&gt;l'interès&lt;span style="color:#000000"&gt; públic de &lt;/span&gt;l'activitat&lt;span style="color:#000000"&gt; que es tracti, batlia podrà atorgar targetes especials &lt;/span&gt;d'estacionament&lt;span style="color:#000000"&gt; en zona blava, per estacionar gratuïtament però respectant el límit temporal, que es tramitaran &lt;/span&gt;d'acord&lt;span style="color:#000000"&gt; amb el procediment que &lt;/span&gt;s'estableixi&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Per &lt;/span&gt;l'obtenció&lt;span style="color:#000000"&gt; de targetes especials, els interessats hauran d&lt;/span&gt;'&lt;span style="color:#000000"&gt;aportar els documents següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Fotocòpia del permís de circulació del vehicle. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Documentació acreditativa de la vinculació del vehicle a l&lt;/span&gt;'&lt;span style="color:#000000"&gt;activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) Fotocòpia del DNI o escriptura de constitució de societat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Les targetes especials es col·locaran a &lt;/span&gt;l'interior&lt;span style="color:#000000"&gt; del vehicle, al costat del parabrisa davanter, de manera que sigui permanentment visible des de l&lt;/span&gt;'&lt;span style="color:#000000"&gt;exterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 11&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Disposicions generals&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La contravenció o incompliment de qualsevol dels articles de la present Ordenança, així com de les disposicions que, en el seu desenvolupament, es dictin per la batlia, tindrà la consideració &lt;/span&gt;d'infracció&lt;span style="color:#000000"&gt; de les normes d&lt;/span&gt;'&lt;span style="color:#000000"&gt;ordenació del tràfic i circulació, en virtut del que es disposa en el Reial Decret Legislatiu 6/2015, o normativa que la substitueix, el seu Reglament de desenvolupament i altres disposicions legals concordants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Les infraccions comportaran la imposició de sancions mitjançant el procediment legal establert en el Reglament del Procediment Sancionador en matèria de Tràfic, Circulació de Vehicles &lt;/span&gt;de&lt;span style="color:#000000"&gt; Motor i &lt;/span&gt;Seguretat viària&lt;span style="color:#000000"&gt; (Reial Decret 320/1994, de 25 de febrer) o el que legal o reglamentàriament li substitueix.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. El no previst en la present Ordenança, &lt;/span&gt;s'estarà&lt;span style="color:#000000"&gt; al que disposa en el Reial decret Legislatiu 6/2015, i altra normativa, que en desenvolupament de &lt;/span&gt;l'anterior&lt;span style="color:#000000"&gt;, es dicti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 12&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Infraccions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Les infraccions a la present Ordenança es tipifiquen en Lleus i Greus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Constitueixen &lt;strong&gt;infraccions LLEUS:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) estacionar en els llocs habilitats (zona blava) sense col·locar el corresponent tiquet o distintiu de control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) no tenir visible el corresponent tiquet o distintiu de control. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c) superar el període d'estacionament establert a la zona regulada, sense arribar a excedir d'una hora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) no retirar el vehicle de la plaça &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt; una vegada excedit el temps màxim d&lt;/span&gt;'&lt;span style="color:#000000"&gt;estacionament. e) No estacionar &lt;/span&gt;a un altre carrer, quan ja s'havia estacionat amb anterioritat a la zona ORA&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Constitueixen &lt;strong&gt;infraccions GREUS:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) la utilització indeguda dels documents i targetes que acreditin les autoritzacions per l'estacionament a les zones de regulació i limitació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) &lt;/span&gt;excedir&lt;span style="color:#000000"&gt; en més d&lt;/span&gt;'&lt;span style="color:#000000"&gt;una hora del temps autoritzat per estacionar, segons &lt;/span&gt;l'hora&lt;span style="color:#000000"&gt; &lt;/span&gt;d'arribada&lt;span style="color:#000000"&gt; pel distintiu de control. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Constitueixen &lt;strong&gt;infraccions MOLT GREUS:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) No retirar els vehicles estacionar en els llocs habilitats (zona blava) sense col·locar el corresponent tiquet o distintiu de control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 13&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Les infraccions LLEUS seran sancionades amb multa de &lt;/span&gt;60 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Les infraccions GREUS seran sancionades amb multa de &lt;/span&gt;120 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. Les infraccions MOLT GREUS seran sancionades amb multa de 200 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. S'estableix&lt;span style="color:#000000"&gt; la reducció del 50% de &lt;/span&gt;l'import&lt;span style="color:#000000"&gt; de la sanció de multa si es realitza el pagament voluntari, ja sigui, ja sigui &lt;/span&gt;l'acte&lt;span style="color:#000000"&gt; de lliurament de la &lt;/span&gt;denúncia&lt;span style="color:#000000"&gt; o dins del termini de quinze dies naturals explicats des de &lt;/span&gt;l'endemà&lt;span style="color:#000000"&gt; al de la seva notificació, i es tindrà per conclòs el procediment sancionador amb les conseqüències establertes en &lt;/span&gt;l'article&lt;span style="color:#000000"&gt; 94 del Reial Decret Legislatiu 6/2015, de 30 &lt;/span&gt;d'octubre&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 14&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Immobilització i retirada del vehicle&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Es procedirà a la immobilització i retirada del vehicle de la via pública i el seu dipòsit en el lloc que designi &lt;/span&gt;l'autoritat&lt;span style="color:#000000"&gt; competent, en els casos contemplats en el Reial decret Legislatiu 6/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. La prestació del servei de retirada de vehicles de la via pública, així com la custòdia del mateix en els dipòsits municipals, reportaran les taxes establertes en &lt;/span&gt;l'Ordenança&lt;span style="color:#000000"&gt; Fiscal corresponent, que hauran de ser satisfetes abans de la devolució del vehicle, i sense perjudici de les sancions que, si escau, poguessin imposar-se.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIONS ADDICIONALS &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primera. &lt;/strong&gt;Previs els oportuns informes dels tècnics competents, la batlia podrà modificar, davant circumstàncies especials que així ho justifiquin, per a una zona concreta o per totes les zones delimitades d'aparcament ORA &lt;/span&gt;en conjunt&lt;span style="color:#000000"&gt;, &lt;/span&gt;l'horari&lt;span style="color:#000000"&gt;, la delimitació de les zones, així com les vies i les places &lt;/span&gt;d'aparcament&lt;span style="color:#000000"&gt; situades en els diferents sectors d&lt;/span&gt;'&lt;span style="color:#000000"&gt;estacionament limitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'igual&lt;span style="color:#000000"&gt; forma, a proposta motivada dels tècnic&lt;/span&gt;s&lt;span style="color:#000000"&gt; competents, la batlia podrà deixar en suspens, en la totalitat o en part del seu àmbit territorial, &lt;/span&gt;l'aplicació&lt;span style="color:#000000"&gt; de la present Ordenança durant els períodes o dies que es crea convenient, per causes relacionades amb la congestió del tràfic i els estacionaments, o altres circumstàncies &lt;/span&gt;d'interès&lt;span style="color:#000000"&gt; públic. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segona. &lt;/strong&gt;&lt;/span&gt;L'àmbit&lt;span style="color:#000000"&gt; territorial &lt;/span&gt;d'aplicació&lt;span style="color:#000000"&gt; de la present Ordenança &lt;/span&gt;s'estén&lt;span style="color:#000000"&gt; a les zones i sectors en què actualment està vigent, sense &lt;/span&gt;perjudici&lt;span style="color:#000000"&gt; &lt;/span&gt;d'ulteriors&lt;span style="color:#000000"&gt; ampliacions, reduccions o modificacions que poguessin operar-se en aquest àmbit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIONS FINALS.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primera. &lt;/strong&gt;En el no previst en la present Ordenança, i quan li sigui aplicable, regirà, amb caràcter supletori, el Reial decret Legislatiu 6/2015, de 30 d'octubre, pel qual s'aprova el Text Refós la Llei sobre Tràfic, Circulació de Vehicles a Motor i &lt;/span&gt;Seguretat viària&lt;span style="color:#000000"&gt;; el Reial Decret 1428/2003, de 21 de novembre del reglament General de Circulació i altres disposicions de desenvolupament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segona. &lt;/strong&gt;La present Ordenança, una vegada complerts els tràmits legals, &lt;/span&gt;entrarà&lt;span style="color:#000000"&gt; en vigor &lt;/span&gt;l'endemà&lt;span style="color:#000000"&gt; de la seva publicació en el BOIB. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
