&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fets&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. En data 30 d'abril de 2024, amb registre d'entrada núm. GOIBE275371/2024, l'entitat IDCQ Hospitales y Sanidad, S.L.U., amb NIF B-87324844, va presentar al Servei de Salut de les Illes Balears, mitjançant els seus representants els senyors Víctor Ribot Murillo i Juan Luis Vidal Chalver, la sol·licitud d'habilitació i integració a la Xarxa de Centres i Serveis Sanitaris de Suport a l'Assistència Urgent i Emergent a Comunitaris i Britànics Desplaçats Temporalment a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.Una vegada revisada la documentació presentada d'acord a l'apartat 3 de l'annex I de la Resolució del director general del Servei de Salut de les Illes Balears (BOIB núm. 56, de 27 d'abril de 2024), s'ha comprovat que l'entitat sol·licitant compleix els requisits que s'exigeixen en el Decret llei 1/2024, de 22 de març, pel qual es regulen determinats aspectes de l'activitat sanitària urgent i emergent a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. L'article 43 de la Constitució espanyola reconeix el dret a la protecció a la salut, i l'article 30.48 de l'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer, confereix a la Comunitat Autònoma la competència exclusiva en matèria d'organització, funcionament i control dels centres sanitaris públics i dels serveis de salut, planificació dels recursos sanitaris, coordinació de la sanitat privada amb el sistema sanitari públic i la promoció de la salut en tots els àmbits, en el marc de les bases i la coordinadora general de la sanitat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. La Llei 14/1986, de 25 d'abril, general de sanitat, que té per objecte la regulació general de totes les accions que permetin fer efectiu el dret constitucional esmentat de protecció de la salut, estableix que són titulars d'aquest dret tots els espanyols i ciutadans estrangers que tenguin establerta la residència en el territori espanyol, així com els estrangers no residents a Espanya i els espanyols fora del territori nacional, que tenen garantit aquest dret en la forma que les lleis i els convenis internacionals estableixin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La Llei 16/2003, de 28 de maig, de cohesió i qualitat del Sistema Nacional de Salut, estableix en l'article 2.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, com a principi general, la col·laboració entre els serveis sanitaris públics i privats en la prestació dels serveis als usuaris del Sistema Nacional de Salut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;L'article 4 de la Llei 5/2003, de 4 d'abril, de salut de les Illes Balears, disposa que són titulars dels drets i deures, sens perjudici del que estableixi la llei estatal, els espanyols i estrangers residents en qualsevol municipi de les Illes Balears; els espanyols i els estrangers no residents a les Illes Balears que tinguin establerta la residència en el territori espanyol, amb l'abast que determini la legislació estatal; els nacionals dels estats membres de la Unió Europea, respecte dels drets que resultin de l'aplicació del dret comunitari europeu i dels tractats i convenis subscrits per l'Estat espanyol que els sigui aplicable, i els nacionals dels estats que no pertanyin a la Unió Europea, només respecte dels drets que els reconeguin les lleis, els tractats i els convenis subscrits per l'Estat espanyol amb els seus països d'origen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;El Decret llei 1/2024, de 22 de març, pel qual es regulen determinats aspectes de l'activitat sanitària urgent i emergent a les Illes Balears, que té per objecte establir un marc d'ordenació i regulació de l'assistència sanitària urgent i emergent no hospitalària a les Illes Balears, així com regular la relació entre els serveis de transport sanitari que prestin assistència a urgències i emergències i els centres hospitalaris de les Balears. Així mateix, regula la creació de la Xarxa de Centres i Serveis Sanitaris de Suport a l'assistència urgent i emergent a comunitaris i britànics desplaçats temporalment a les Illes Balears, i s'estableixen les formes, els requisits i el procediment d'habilitació perquè centres i serveis sanitaris de titularitat privada prestin serveis sanitaris de caràcter urgent i emergent a les Illes Balears als estrangers temporals comunitaris i britànics amb dret a rebre assistència sanitària per part del Servei de Salut de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La Resolució del director general del Servei de Salut per iniciar i aprovar el procediment relatiu a habilitar i integrar centres privats a la Xarxa de Centres i Serveis Sanitaris de Suport a l'Assistència Urgent i Emergent a Comunitaris i Britànics Desplaçats Temporalment a les Illes Balears (BOIB núm. 56, de 27/04/2024).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Proposta de resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Propòs al director general del Servei de Salut de les Illes Balears que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Habilitar i integrar a la Xarxa de Centres i Serveis Sanitaris de Suport a l'Assistència Urgent i Emergent a Comunitaris i Britànics Desplaçats Temporalment a les Illes Balears en el marc del Decret 1/2024, de 22 de març, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;a l'entitat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;IDCQ Hospitales y Sanidad, S.L.U.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Relació de centres:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Centre: Hospital Quirónsalud Son Verí &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;2.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Establir el finançament de l'assistència sanitària a pacients temporals estrangers comunitaris o britànics, conforme al que s'estableix en l'article 20 del Decret llei 1/2024, de 22 de març, pel qual es regulen determinats aspectes de l'activitat sanitària urgent i emergent a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;​​​​​​​​​​​​​​&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Notificar aquesta resolució a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Notificar aquesta resolució a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Publicar aquesta resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; i establir que tindrà efecte des de l'endemà de la publicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Per tot això dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Interposició de recursos &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució —que exhaureix la via administrativa— es pot interposar un recurs contenciós administratiu davant el jutjat contenciós administratiu en el termini de dos mesos comptadors des de l'endemà de la publicació d'aquesta resolució, d'acord amb els articles 8 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="background-color:null"&gt;No obstant això, les persones interessades poden optar per interposar contra aquesta resolució un recurs de reposició davant el mateix òrgan que la dicta en el termini d'un mes comptador des de l'endemà de la data de publicació. En aquest cas no es podrà interposar el recurs contenciós administratiu fins que no s'hagi dictat una resolució expressa o presumpta sobre el recurs de reposició, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
