    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 29 d'agost de 2018 per la qual es convoquen, ajudes per a donar suport a projectes pilot i al desenvolupament de nous productes, pràctiques, processos i tecnologies, corresponents a l'any 2020, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 11 de juny de 2024, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Antecedents&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. En data 21 de novembre de 2020 es va publicar, en el BOIB núm.198, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen subvencions per donar suport a projectes pilot i al desenvolupament de nous productes, pràctiques, processos i tecnologies per a l'any 2020.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. El vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor dels interessats que figuren a l'Annex I amb les dates i imports que figuren a l'esmentat Annex.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Atesa l'esmentada Resolució de concessió de l'ajuda, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins del termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la forma i els terminis determinats en la convocatòria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament final així com la documentació exigida, però, revisada aquesta, es comprova que la inversió admissible és inferior a l'aprovada i a la sol·licitada, tal i com es detalla a l'Annex I.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Els sol·licitants declaren que malgrat la diferència, s'han assolit tots els objectius previstos al projecte aprovat.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6.D'acord amb l'apartat novè de la Resolució de convocatòria dalt esmentada, en els casos en els quals es produeixin desviacions entre la inversió realitzada i l'aprovada, s'ajustarà l'ajuda total concedida a l'import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre i quan s'acostin de manera significativa al compliment total dels objectius prevists i suposin almenys un 50% d'execució de la quantitat total d'inversió aprovada a la resolució de concessió inicial. Aquest ajustament es farà aplicant el percentatge de subvenció que pertoqui a la inversió total admissible. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;14. Llei 39/2015, de 26 de novembre de règim jurídic de les administracions públiques .&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Proposta de resolució de revocació parcial&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa favorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Procedir a la revocació parcial de les resolucions d'ajuda concedides als beneficiaris pels imports i amb els terminis detallats a l' Annex I , que són un total de 1 expedient/s i que comença amb LABORATORI D'ABASTIMENT COOPERATIU SCOOP i acaba amb LABORATORI D'ABASTIMENT COOPERATIU SCOOP, que suma un import total de 12,366,36 euros, relativa a la línia d'ajuda “Projectes pilot i desenvolupament de nous productes, pràctiques, processos i tecnologies, per a l'any 2020”, ja que la justificació de la despesa ha estat inferior a l'aprovada. L'import total de l'ajuda finalment concedida haurà de ser de 94.299,64 euros.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Notificar la resolució a cada un dels beneficiaris de l'Annex I .&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
