text/html 29215 CAIB 29217 687971 ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'apartat 8.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 14 d'abril de 2023 per la qual s'aprova la convocatòria de les ajudes, per al foment de la producció integrada, per l'any 2023 especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, procediment administratiu comú de les administracions públiques.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>2.En data 18 d'abril de 2023, es va publicar el BOIB núm. 49 la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova, per l'any 2023, la convocatòria d'ajudes destinades al foment de producció integrada.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>3.En data 30 de maig de 2023, es publica en el BOIB núm. 71, la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució de la presidenta del FOGAIBA de 27 de febrer de 2023, de convocatòria, per a l'any 2023, dels ajuts corresponents a les intervencions en forma de pagaments directes que preveu el Pla estratègic de la PAC (PEPAC), així com altres resolucions de convocatòria d'ajuts que preveuen les intervencions al desenvolupament rural.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>4.De conformitat amb l'apartat sisè de l'esmenada Resolució, el termini de presentació de sol·licituds de la convocatòria va acabar dia 30 de juny de 2023. Es varen registrar un total de 300 sol·licituds.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>5.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han duit a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les bases reguladores d'aquestes ajudes, constatant que no compleixen alguns dels requisits establerts en la convocatòria.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>6.En data 20 de febrer de 2024, es publica en el BOIB núm. 25 la Resolució de denegació als beneficiaris de les ajudes, Rd1<em> </em>conjunta de la Secció II, per l'incompliment del requisit previst a l'apartat 7 del punt tercer de la convocatòria d'estar al corrent de les obligacions tributàries.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>7.En data 30 de maig de 2024, es publica en el BOIB núm. 72 les Resolucions de concessions del beneficiaris de l'ajuda de producció integrada 2023-2027.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>8.Els òrgans gestors han detectat errors en la concessió de l'ajuda i per tant escau la revisió i s'estima oportú promoure d'ofici la modificació parcial de la resolució de concessió abans esmentada, número d'edicte 5202. Concretament, el beneficiari CAN MORBE, SAT, amb expedient intern 214 . A l'annex I de la present resolució es detallen els imports concedits modificats amb els percentatges de cofinançament correctes.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:#000000"><em>9.L'article 109.2 de la Llei 39/2015, d'1 d'octubre de procediment administratiu comú de les administracions públiques, estableix que les administracions públiques, podran, així mateix, rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics o existents en els seus actes.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
