![CDATA[Resolució del conseller de Turisme, Cultura i Esports, a proposta del director general de Turisme, per la qual es revoquen parcialment les subvencions concedides en el marc de la convocatòria de minimis per a la modernització i la innovació en la higiene i en la neteja dels establiments d’allotjament turístic, destinades a la compra de mecanismes d’elevació de llits, i se’n proposa el pagament, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea Next Generation EU]] 310 ca CAIB 28207 ca 380403 CAIB CAIB 28203 687695 2024-06-13 2024-06-18 text/html 2024-06-18 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En la data de la signatura electrònica, el director general de Turisme ha formulat la proposta de resolució següent:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fets</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. En el <em>Butlletí</em><em> Oficial de les Illes Balea</em><em><span style="background-color:#ffffff">rs</span></em> <span style="background-color:#ffffff">núm. 155, de</span> <span style="color:#000000"><span style="background-color:#ffffff">29 de novembre de 2022,</span></span> <span style="background-color:#ffffff">es va publicar l'Ordre 30/2022</span> <span style="background-color:#ffffff">del conseller de Model Econòmic, Turisme i Treball per la qual s'estableixen les bases reguladores i s'aprova la convocatòria per a la concessió d'ajuts </span><em><span style="background-color:#ffffff">de</span></em> <em><span style="background-color:#ffffff">minimis </span></em><span style="background-color:#ffffff">per a la modernització i</span> <span style="background-color:#ffffff">la innovació en la higiene i en la neteja dels</span> <span style="background-color:#ffffff">establiments d'allotjament turístic, destinada a la compra de mecanismes d'elevació de llits, per acomplir</span> <span style="background-color:#ffffff">l'article 37 bis de la Llei 8/2012, del turisme de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea Next Generation EU.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="background-color:#ffffff">2. En el </span><em><span style="background-color:#ffffff">Butlletí</span></em><em><span style="background-color:#ffffff"> Oficial de les Illes Balears </span></em><span style="background-color:#ffffff">núm. 26, de 28 de febrer de 2023, es va publicar la Resolució del conseller de Model Econòmic, Turisme i Treball per la </span>qual es modifica la convocatòria esmentada en el punt anterior en el sentit d'ampliar el termini de presentació de sol·licituds i de modificar la composició de la Comissió Avaluadora.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. D'acord amb el que s'exposa en l'Ordre 30/2022 i en el punt 5 de la convocatòria, aquesta està sotmesa al règim <em>de</em> <em>minimis</em> establert en el Reglament (UE) 1407/2013 de la Comissió Europea, de 18 de desembre de 2013, relatiu a l'aplicació dels articles 107 i 108 del Tractat de f<span style="color:#000000">uncionament de la Unió Europea </span><span style="color:#000000">en</span><span style="color:#000000"> les ajudes </span><span style="color:#000000"><em>de</em></span><span style="color:#000000"> </span><span style="color:#000000"><em>minimis</em>. En conseqüència, les ajudes previstes són compatibles amb el mercat interior i, alhora, resten exemptes de l'obligació de notificació establerta en l'article 108, apartat 3, del Tractat.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. En el <em>Butlletí</em><em> Oficial de les Illes Balears</em> núm. 162, de 28 de novembre de 2023, es varen publicar les resolucions per les quals es concedeixen les subvencions en el marc de la convocatòria de subvencions esmentada. A les persones que figuren en l'annex d'aquestes resolucions se'ls va concedir una subvenció i es va autoritzar i disposar una despesa pels imports individuals que s'indicaven en les resolucion<span style="background-color:#ffffff">s, </span> <span style="background-color:#ffffff">que s'indiquen també en l'annex d'aquesta proposta de resolució, amb càrrec a la partida pressupostària </span>12201/G/751C01/77000/00 MR071 <span style="background-color:#ffffff">dels pressuposts de la Comunitat Autònoma de les Illes B</span>alears per a l'any 2023.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els expedients de concessió de subvencions en els quals es concedia una subvenció per import igual o superior a 30.000 euros varen ser fiscalitzats de conformitat per la Intervenció de la CAIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. En el <em>Butlletí</em><em> Oficial de les Illes Balears</em> núm. 172, de 21 de desembre de 2023, es varen publicar les resolucions per les quals es concedeixen subvencions en el marc de la convocatòria de subvencions esmentada. A les persones que figuren en l'annex <span style="background-color:#ffffff">d'aquesta</span> <span style="background-color:#ffffff">proposta de resolució se'ls va concedir</span> <span style="background-color:#ffffff">una subvenció i es va autoritzar i disposar una despesa pels imports individuals que s'indicaven en les esmentades resolucions, així com en l'annex d'aquesta proposta de resolució, a</span>mb càrrec a la partida pressupostària 12201/G/751C01/77000/00 MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any 2023.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els expedients de concessió de subvencions en els quals es concedia una subvenció per import igual o superior a 30.000 euros varen ser fiscalitzats de conformitat per la Intervenció de la CAIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. En el <em>Butlletí</em><em> Oficial de les Illes Balears</em> núm. 12, de 25 de gener de 2024, es varen publicar les resolucions per les quals es concedeixen subvencions en el marc de la convocatòria de subvencions esmentada. A les persones que figuren en l'annex <span style="background-color:#ffffff">d'aquesta</span> <span style="background-color:#ffffff">proposta de resolució se'ls va concedir</span> <span style="background-color:#ffffff">una subvenció i es va autoritzar i disposar una despesa pels imports individuals que s'indicaven en les esmentades resolucions, així com en l'annex d'aquesta proposta de resolució, a</span>mb càrrec a la partida pressupostària 12201/G/751C01/77000/00 MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any 2024.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Els expedients de concessió de subvencions en els quals es concedia una subvenció per import igual o superior a 30.000 euros varen ser fiscalitzats de conformitat per la Intervenció de la CAIB.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. Tal com es va fer constar en les resolucions de concessió, d'acord amb el punt 15 de la convocatòria, el període d'execució de les accions subvencionables finalitza als dos mesos des de la publicació de la resolució de concessió en el <em>Butlletí Oficial de les Illes Balears</em><span style="color:#000000">. </span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. Tal com es va fer constar en les resolucions de concessió, d'acord amb el punt 16 de la convocatòria, el termini per a la justificació de la subvenció és d'un mes comptador des de l'endemà de la conclusió del termini d'execució establert en el punt anterior. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">9. Consta en els expedients administratius corresponents </span><span style="color:#000000">que</span> les persones que figuren en l'annex d'aquesta proposta de resolució no han <span style="color:#000000">justificat completament la realització de l'actuació subvencionable per tot l'import establert en la resolució de concessió. És a dir, l'import de l'actuació subvencionable justificat ha estat inferior a l'import de l'actuació subvencionable previst en la resolució de concessió.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">10. El<span style="color:#000000"> </span>14</span><span style="color:#000000"> de </span><span style="color:#000000">maig</span><span style="color:#000000"> de 2024, </span><span style="color:#000000">el conseller de Turisme, Cultura i Esports </span><span style="color:#000000">va dictar la resolució </span><span style="color:#000000">per la qual s'inicia el procediment de revocació parcial de subvencions concedides en el marc de la convocatòria </span><span style="color:#000000">de referència</span><span style="color:#000000">, </span><span style="color:#000000">en</span><span style="color:#000000"> relació a</span><span style="color:#000000">mb</span><span style="color:#000000"> les subvencions concedides mitjançant </span><span style="color:#000000">les resolucions publicades </span><span style="color:#000000">en el </span><span style="color:#000000"><em>Butlletí</em></span><span style="color:#000000"><em> Oficial de les Illes Balears</em></span><span style="color:#000000"> </span><span style="color:#000000">núm. 162, </span><span style="color:#000000">de </span><span style="color:#000000">28 de novembre de 2023 i núm. 172, de 21 de desembre de 2023.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">11. El</span><span style="color:#000000"> 2 de maig de 2024, </span><span style="color:#000000">el conseller de Turisme, Cultura i Esports </span><span style="color:#000000">va dictar la resolució </span><span style="color:#000000">per la qual s'inicia el procediment de revocació parcial de subvencions concedides en el marc de la convocatòri</span><span style="color:#000000">a de referència</span><span style="color:#000000">, </span><span style="color:#000000">amb</span><span style="color:#000000"> relació a les subvencions concedides mitjançant </span><span style="color:#000000">les resolucions publicades </span><span style="color:#000000">en el </span><span style="color:#000000"><em>Butlletí</em></span><span style="color:#000000"><em> Oficial de les Illes Balears</em></span><span style="color:#000000"> </span><span style="color:#000000">núm. </span><span style="color:#000000">12,</span><span style="color:#000000"> </span><span style="color:#000000">de </span><span style="color:#000000">25</span><span style="color:#000000"> </span><span style="color:#000000">de gener de 2024.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">12. A totes les persones que es relacionen en l'annex d'aquesta proposta de resolució se'ls va notificar la resolució d'inici del procediment de revocació parcial, en la qual s'indicava l'import que s'havia de revocar i se'ls atorgava un termini de deu dies per presentar-hi al·legacions.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">No consta que s'hagin presentat al·legacions en el termini establert.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="background-color:#ffffff">13</span>. D'acord amb l'article 17.1 de l'Ordre 30/2022 del conseller de Model Econòmic, Turisme i Treball per la qual s'estableixen les bases reguladores d'aquesta convocatòria, correspon la revocació parcial de la subvenció si, posteriorment a la resolució de concessió de la subvenció, la persona beneficiària no justifica part del projecte.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En conseqüència, atès que, d'acord amb l'apartat 16 de la convocatòria, les persones beneficiàries que apareixen en l'annex d'aquesta proposta de resolució han justificat adequadament les&nbsp;</span></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">actuacions realitzades però per uns imports inferiors als <span style="color:#000000">establert</span><span style="color:#000000">s</span><span style="color:#000000"> en la resolució de concessió, </span><span style="color:#000000">correspon </span><span style="color:#000000">revocar</span><span style="color:#000000"> parcial</span><span style="color:#000000">ment</span><span style="color:#000000"> l</span><span style="color:#000000">es</span><span style="color:#000000"> resoluci</span><span style="color:#000000">ons</span><span style="color:#000000"> de concessió </span><span style="color:#000000">i ordenar el pagament de l'import adequadament justificat.</span> </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">Per això,</span> en l'annex s'indica:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em> L'import de l'actuació subvencionable establert en la resolució de concessió.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em> L'import de l'actuació subvencionable justificat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em> L'import de l'ajut concedit en la resolució de concessió.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>d)</em> L'import de l'ajut justificat i proposat per al pagament, el qual s'ha calculat aplicant a l'import de l'actuació subvencionable justificat el percentatge d'intensitat de l'ajut que es preveia en la resolució de concessió.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>e)</em> L'import de l'ajut que s'ha de revocar, que és la diferència entre l'import de l'ajut concedit en la resolució de concessió i l'import de l'ajut justificat i proposat per al pagament.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">14. Reconèixer l'obligació i proposar el pagament de la subvenció per un import global de <span style="background-color:#ffffff">70.103,79</span> € a favor de les persones beneficiàries que figuren en l'annex i pels imports individuals allà indicats, amb càrrec a la partida pressupostària 12201/G/751C01/77000/00 MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l'any 2024.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Aprovar la liquidació de la subvenció a les persones beneficiàries que figuren en l'annex i pels imports individuals que s'hi indiquen.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Fer constar que aquesta subvenció ha estat finançada amb fons procedents del Ministeri d'Indústria, Comerç i Turisme en el marc del Pla de Recuperació, Transformació i Resiliència del Mecanisme de Recuperació i Resiliència.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6.
