    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Havent-se publicat al Butlletí Oficial de les Illes Balears (BOIB) núm. 66, de 18 de maig de 2024, l'Acord adoptat pel Ple de l'Ajuntament de Capdepera, en sessió ordinària de dia 13 de maig de 2024, en el qual s'aprovà inicialment l'expedient de la cessió gratuïta del bé patrimonial «gegants i caparrots» a Associació sense ànim de lucre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sotmès l'Acord al tràmit d'informació pública i no havent-se presentat al·legacions dins el termini legal establert, s'eleva automàticament a definitiu l'Acord fins aleshores provisional:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;«Antecedents de fet&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 22 de gener de 2024, l'Associació «Colla de Gegants i Caparrots de Capdepera» , va trametre mitjançant correu electrònic, la Resolució de la consellera de Presidència i Administracions Públiques relativa a la inscripció amb número 311000011746, Secció Primera, de la constitució de l'associació esmentada en el Registre d'Associacions de les Illes Balears. Juntament amb l'anterior va adjuntar l'Acta fundacional i els Estatuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les dades que figuren a la inscripció són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Denominació: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Colla de Gegants i Caparrots de Capdepera&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Fins i activitats estatutàries principals:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Tenir cura dels gegants i caparrots i altres elements festius de la colla, vetllar pel seu bon estat i manteniment, i acompanyar-los per tot arreu a les seves sortides&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Tenir cura dels instruments de la colla, vetllar pel seu bon estat i manteniment, i fer gaudir tothom amb la nostra música ja sigui amb gegants i caparrots o sense ells.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;- &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;Domicili: carrer Ciutat, núm. 19 de Capdepera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 30 de gener de 2024, la presidenta de la Colla va trametre mitjançant correu electrònic document mitjançant el qual posa de manifest les finalitats que persegueixen amb aquesta cessió i la justificació dels beneficis positius que se'n derivaran per a la ciutadania.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 12 de febrer de 2024, el tècnic de Cultura va emetre memòria justificativa sobre la situació actual dels béns mobles objecte de cessió, descripció de les repercussions socials, usos i línies de treball que se'n derivarien de la cessió dels béns. En concret, els béns patrimonial objecte de cessió són els caparrots «Roc» i «Esperança».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 12 de febrer de 2024, la TAG del Departament de Contractació, amb la nota de conformitat de la secretària de la corporació, va emetre informe jurídic sobre la legislació aplicable i el procediment a seguir per a la cessió gratuïta dels béns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5&lt;/strong&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;span style="background-color:null"&gt; El 12 de febrer de 2024, s'emet Provisió de batlia per a l'emissió del certificat de Secretaria sobre la inscripció del bé moble a l'Inventari de béns de l'Ajuntament amb la qualificació jurídica del bé patrimonial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 22 de febrer de 2024, la TAG del Departament de Contractació, amb la nota de conformitat de la secretària de la corporació, va emetre informe que consta a l'expedient en relació amb el procediment a seguir per a la usucapió extraordinària de béns mobles per a la seva posterior inscripció a l'Inventari Municipal, ja que aquests no contaven inscrits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El 26 de febrer de 2024, el tècnic de Cultura va emetre informe d'acreditació de la possessió dels béns objecte de cessió per un termini ininterromput de més de sis anys (2003-2023). A l'informe s'especifica amb detall la descripció i identificació dels béns mobles; n'indica el seu valor artístic i econòmic; la seva ubicació passada i actual, i la persona responsable de la seva custòdia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 27 de febrer de 2024, la TAG del Departament de Contractació, amb la nota de conformitat de la secretària accidental de la corporació, va emetre informe- proposta jurídic favorable en relació amb l'adquisició per part de l'Ajuntament de Capdepera dels béns mobles, els gegants «Roc» i «Esperança», per prescripció adquisitiva extraordinària o usucapió, per la possessió pública, pacífica i ininterrompuda durant més de sis anys d'aquests béns mobles, quedant, així mateix, acreditada la possessió en concepte d'amo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 28 de febrer de 2024, mitjançant Resolució de batlia es va acordar adquirir els béns mobles patrimonials «Roc» i «Esperança» per preinscripció adquisitiva i va acordar inscriure a l'Inventari de Béns Municipal l'alta d'aquests béns mobles qualificats com a patrimonials a l'epígraf tercer corresponent als «Mobles de caràcter històric, artístic o de considerable valor econòmic». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El 19 d'abril de 2024, es va incorporar a l'expedient el Certificat de l'Inventari de Béns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El 30 d'abril de 2024, s'ha incorporat a l'expedient l'informe d'Intervenció sobre l'estat del deute d'aquesta entitat en el qual s'acredita no haver-hi deute pendent de liquidació amb càrrec al pressupost municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El 30 d'abril de 2024, s'ha incorporat informe- proposta jurídic favorable a l'inici de l'expedient de cessió gratuïta dels béns mobles citats a favor de l'associació sense ànim de lucre «Colla de Gegants i Caparrots de Capdepera» amb NIF G-56479058.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Legislació aplicable.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Legislació aplicable a l'assumpte és la següent: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Els articles 109 a 112 del Reglament de Béns de les Entitats Locals aprovat per Reial decret 1372/1986, de 13 de juny.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— L'article 145 de la Llei 33/2003, de 3 de novembre, del Patrimoni de les Administracions Públiques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— L'article 47.2.ñ) de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Llei orgànica 1/2002, de 22 de març, reguladora del dret d'associació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;— Sentència del TS de 8 de juliol de 2002 (Rec. 9731/1997) la qual avala la possibilitat de cedir gratuïtament béns patrimonials a entitats no declarades d'utilitat pública sempre que es compleixin els requisits per a obtenir aquesta declaració. En concret «La expresión utilizada por la legislación local es un concepto jurídico indeterminado cuya concreción debe realizarse en el momento de la apreciación por al entidad local competente de la concurrencia de los requisitos exigidos por la Ley para la viabilidad de la cesión gratuita de sus bienes patrimoniales y no excluye que pueda entenderse comprendidas en la calificación expresada asociaciones que, sin haber obtenido la declaración de utilidad pública, se estime que por su actividad y fines realizan una labor de interés público, o bien otras instituciones privadas que, sin tener naturaleza asociativa, cumplan los requisitos de relevancia para el interés público y ausencia de ánimo de lucro».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De conformitat amb l'anterior, es considera que l'expedient ha seguit la tramitació establerta en la Legislació aplicable procedint la seva aprovació pel Ple, en virtut dels articles 110.1 del Reglament de Béns de les Entitats Locals aprovat per Reial decret 1372/1986, de 13 de juny i 47.2.ñ) de la Llei 7/1985, de 9 d'abril, Reguladora de les Bases del Règim Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tot l'anterior, s'emet la següent &lt;/span&gt;&lt;strong&gt;PROPOSTA D'ACORD&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; al Ple de l'Ajuntament de Capdepera:&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Participar a trobades geganteres arreu de l'illa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Realitzar tallers oberts per formar part de la Colla gegantera tant en dansa, música o suport&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Organitzar activitats escolars per donar a conèixer els gegants en la cultura popular&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Organitzar els tallers de conservació i manteniment dels gegants en els diversos àmbits: estructura, vestits i complements&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Programar sortides festives al llarg de l'any&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Programar la difusió dels gegants i la cultura popular, la preparació i assajos per a les actuacions de dansa i música&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Activitats de conservació i manteniment dels béns&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Sotmetre l'expedient a un període d'informació pública per &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;termini de 20 dies &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;mitjançant anunci en el Butlletí Oficial de les Illes Balears i en el tauler d'anuncis de l'Ajuntament, a fi que els interessats presentin les al·legacions que estimin pertinents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Així mateix, estarà a la disposició dels interessats a la seu electrònica d'aquest Ajuntament&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;4.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Finalitzat el període d'informació pública, i una vegada informades les al·legacions presentades pels Serveis Tècnics, es prosseguiran els tràmits preceptius i s'emetrà proposta a la Comissió Informativa i s'elevarà al Ple per a la seva aprovació definitiva.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Si el Dictamen que la Comissió elevi al Ple coincideix amb l'anterior proposta, la que subscriu informa, en compliment de l'article 54 del Text Refós de les Disposicions Legals Vigents en Matèria de Règim Local, aprovat per Reial decret Legislatiu 781/1986, de 18 d'abril, que aquest Dictamen s'adequarà a la Legislació aplicable.&lt;/span&gt;&lt;/p&gt;
