font-size:12px">L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a<strong>&nbsp;</strong>les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el <em>Butlletí Oficial de les Illes Balears</em>&nbsp;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; El 3 de desembre de 2022, es publica la Notificació de la Resolució de concessió als beneficiaris de les ajudes RES2/ INEA2019_1. Entre altres beneficiàries hi ha ISABEL GELABERT GENOVARD, amb NIF ***2284** i número d'expedient INEA2019_1/217, amb un import d'inversió de 15.982,86 €, un import concessió de 7.991,43 € i un termini d'execució de 12 mesos.</em></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><em>3. En data 29 de setembre de 2023 i amb número de registre d'entrada GOIB614834/2023, José Roselló Nicolau, amb NIF ***1678**, com a representant autoritzat d'Isabel Gelabert Genovard, presenta sol·licitud de renúncia de l'ajuda concedida</em><span style="color:#000000"><em>.</em></span></span></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><em>4. L'article 94.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que «l'interessat podrà desistir de la seva sol·licitud o, quan no estigui prohibit per l'ordenament jurídic, renunciar dels seus drets». En el punt 4 del mateix article es contempla que «l'Administració acceptarà de ple el desistiment o la renúncia, i declararà conclòs el procediment tret que, havent-se personat en el procediment tercers interessats, instassin aquests la seva continuació en el termini de 10 dies des de la notificació del desistiment o de la renúncia».&nbsp;&nbsp;</em></span></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>5. L'article </em><span style="background-color:#ffffff"><span style="color:#000000"><em>21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes&nbsp;aplicables”.&nbsp;</em></span></span></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>6. L'article </em><span style="background-color:#ffffff"><span style="color:#000000"><em>43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció.
