&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. El 26 de desembre de 2023, en el BOIB núm. 164, es va publicar la Resolució del conseller d&amp;apos;Empresa, Ocupació i Energia de 22 de desembre de 2023 &lt;/span&gt;per la qual s&amp;apos;aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l&amp;apos;any 2024 per al foment d&amp;apos;instal·lacions d&amp;apos;energia solar fotovoltaica i microeòlica adreçada a persones físiques dins el Programa FEDER 2021-2027.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Les persones que figuren en l&amp;apos;annex d&amp;apos;aquesta resolució varen presentar una sol·licitud de subvenció en el marc de la convocatòria de referència.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Els titulars dels expedients que apareixen en l&amp;apos;annex han presentat un escrit en el que indiquen que desisteixen de la sol·licitud de subvenció presentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El conseller d&amp;apos;Empresa, Ocupació i Energia és l&amp;apos;òrgan competent per resoldre aquest procediment atesa l&amp;apos;estructura orgànica del Govern de les Illes Balears i d&amp;apos;acord amb l&amp;apos;Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en matèria d&amp;apos;energia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. La Llei 38/2003, de 17 de novembre, General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. El Decret legislatiu&amp;nbsp;2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el Text refós de la Llei de subvencions (BOIB núm.&amp;nbsp;196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;4. L&amp;apos;article 94, de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, preveu que l&amp;apos;Administració, en el supòsit de renúncia de la persona interessada als seus drets, acceptarà la renúncia completament i resoldrà el procediment declarant aquesta circumstància, amb indicació dels fets produïts i les normes aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;5. La Resolució del conseller d&amp;apos;Empresa, Ocupació i Energia de 22 de desembre de 2023 per la qual &lt;/span&gt;per la qual s&amp;apos;aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l&amp;apos;any 2024 per al foment d&amp;apos;instal·lacions d&amp;apos;energia solar fotovoltaica i microeòlica adreçada a persones físiques dins el Programa FEDER 2021-2027 (BOIB núm. 174, de 26 de desembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. Acceptar el desistiment de les sol·licituds de subvenció presentades&lt;/span&gt; &lt;span style="color: black"&gt;pels beneficiaris dels expedients que apareixen en l&amp;apos;annex&lt;/span&gt; per al foment d&amp;apos;instal·lacions d&amp;apos;energia solar fotovoltaica i microeòlica adreçada a persones físiques dins el Programa Operatiu FEDER 2021-2027 (FOTOPAR 2024)&lt;span style="color: black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. &lt;span style="color: black"&gt;Declarar conclòs el procediment i per tant, arxivar els expedients.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;3. Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&amp;apos;Empresa, Ocupació i Energia en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb els articles&amp;nbsp;123 i 124 de la Llei&amp;nbsp;39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article&amp;nbsp;57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació de la resolució, d&amp;apos;acord amb l&amp;apos;article&amp;nbsp;46 de la Llei&amp;nbsp;29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
