&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: black"&gt;1. El 3 de juliol de 2021 es va publicar la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III)&lt;strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/strong&gt;mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 202, modificada per la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d&amp;apos;agost de 2022 (BOIB núm. 103, de 6 d&amp;apos;agost de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Les persones o entitats que figuren en l&amp;apos;annex d&amp;apos;aquesta resolució varen presentar una sol·licitud de subvenció en el marc de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Els tècnics de la Direcció general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic han examinat les sol·licituds i han emès un informe desfavorable sobre les sol·licituds de subvenció descrites en l&amp;apos;annex amb la motivació que figura en aquest annex.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. L&amp;apos;11 d&amp;apos;abril de 2024 es va emetre la proposta de resolució provisional del director general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic per la qual es deneguen les subvencions en el marc de la convocatòria &lt;span style="color: black"&gt;pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) &lt;/span&gt;&amp;nbsp;(BOIB núm. 50, de 16 d&amp;apos;abril de 2024).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. El 10 de maig&amp;nbsp; de 2024, EIVISSA SL. , titular de l&amp;apos;expedient MOVESIII-4980/2021, va presentar un escrit d&amp;apos;al·legacions contra la proposta de resolució esmentada en el punt anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;En la proposta de resolució es denega la subvenció a EIVISSA SL. Pel motiu següent: «&lt;span style="color: black"&gt;Pressupost o contracte de subministrament signat amb data anterior al registre de sol·licitud, s&amp;apos;incompleix el punt 4.3.b) i el 11.3.2.h) de la convocatòria.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. En l&amp;apos;escrit d&amp;apos;al·legacions, EIVISSA SL.&amp;nbsp; indica que no incompleixen els punts&lt;em&gt; 4.3.b)&lt;/em&gt; ni &lt;em&gt;11.3.2.h)&lt;/em&gt; indicats com a motiu de denegació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;7. El 13 de maig de 2024, una vegada revisada la documentació, es va emetre un informe tècnic en que s&amp;apos;informa desfavorablement a les al·legacions presentades per EIVISSA SL. El pressupost signat pel sol·licitant en data anterior a la sol·licitud (24/10/2023) es considera l&amp;apos;acceptació del pressupost i un compromís ferm per a la realització de la instal·lació del PRVE.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: white"&gt;8. El 15 de maig de 2024 es va emetre la proposta de resolució definitiva del director general d&amp;apos;Economia Circular, Transició Energètica i Canvi Climàtic per la qual es deneguen &lt;/span&gt;les subvencions en el marc de la convocatòria &lt;span style="color: black"&gt;pública de subvencions per a actuacions de suport a la mobilitat elèctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. El Decret 75/2004, de 27 d&amp;apos;agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. L&amp;apos;Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en matèria d&amp;apos;energia (BOIB núm. 72, de 24 de maig de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;4. El Reial Decret 266/2021, de 13 d&amp;apos;abril, pel qual s&amp;apos;aprova la concessió directa d&amp;apos;ajuts a les comunitats autònomes i a les ciutats de Ceuta i Melilla per a l&amp;apos;execució de programes d&amp;apos;incentius lligats a la mobilitat elèctrica (MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu. (BOE núm. 89, de 14 d&amp;apos;abril de 2021).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021 per la qual s&amp;apos;aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (Programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència Europeu —BOIB núm. 88, de 3 de juliol de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. La Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 3 d&amp;apos;agost de 2022 per la qual es modifica i amplia el crèdit de la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 28 de juny de 2021 per la qual s&amp;apos;aprova la convocatòria pública de subvencions per a actuacions de suport a la mobilitat elèctrica (programa MOVES III) en el marc del Pla de Recuperació, Transformació i Resiliència europeu finançat per la Unió Europea – NextGenerationEU —BOIB núm. 103, de 6 d&amp;apos;agost de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Denegar la concessió d&amp;apos;una subvenció &lt;span style="color: black"&gt;per a actuacions de suport a la mobilitat elèctrica (Programa MOVES&amp;nbsp;III) &lt;/span&gt;als beneficiaris que figuren en l&amp;apos;annex, d&amp;apos;acord amb el motiu que figura en l&amp;apos;annex.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. Declarar conclòs el procediment i, per tant, arxivar els expedients indicats a l&amp;apos;annex.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. Publicar aquesta Resolució al &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&amp;apos;Empresa, Ocupació i Energia en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb els articles&amp;nbsp;123 i 124 de la Llei&amp;nbsp;39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article&amp;nbsp;57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
