CAIB text/html ![CDATA[Resolució del Conseller d’Empresa, Ocupació i Energia per la qual es corregeix l’error observat al l’annex de la Proposta de resolució provisional del director general d’Economia Circular, Transició Energètica i Canvi Climàtic de 25 d’abril de 2024 per la qual es revoquen les subvencions per a la realització d’instal·lacions d’autoconsum amb fonts d’energia renovable, amb o sense emmagatzematge, en el sector serveis i altres sectors productius de l’economia; i per a la incorporació d’emmagatzematge en instal·lacions d’autoconsum, amb fonts d’energia renovable, ja existents en el sector serveis i altres sectors productius,(Programes 1,2 i 3)]] CAIB 21902 21904 ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. <span style="color:black">L' 11 de setembre de 2021, en el BOIB núm.125, es va publicar la convocatòria pública de subvencions per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, en el sector serveis i altres sectors productius de l'economia; i per a la incorporació d'emmagatzematge en instal·lacions d'autoconsum, amb fonts d'energia renovable, ja existents en el sector serveis i altres sectors productius, en el marc del Pla de Recuperació, Transformació i Resiliència europeu mitjançant la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 6 de setembre de 2021, modificada per l</span>a Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 19 d'octubre de 2022 (BOIB núm.137, de 22 d'octubre de 2022).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 25 d'abril de 2024 es va emetre la <span style="color:black">Proposta de resoluci</span>ó provisional del director general d'Economia Circular, Transició Energètica i Canvi Climàtic per la qual es revoquen les subvencions <span style="color:black">per a la realització d'instal·lacions d'autoconsum amb fonts d'energia renovable, amb o sense emmagatzematge, en el sector serveis i altres sectors productius de l'economia; i per a la incorporació d'emmagatzematge en instal·lacions d'autoconsum, amb fonts d'energia renovable, ja existents en el sector serveis i altres sectors productius, en el marc del Pla de Recuperació, Transformació i Resiliència europeu (</span>Programes 1,2 i 3) (BOIB núm. 56 de 27 d'abril de 2024)</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Amb posterioritat, s'ha detectat un error en l'annex de la Proposta esmentada.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició. Així mateix, la rectificació d'errors ha d'especificar, si escau, els efectes jurídics que se'n deriven i s'ha de notificar o publicar preceptivament quan faci referència a actes que han estat notificats o publicats.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
