La política pressupostària actual està orientada pels criteris d'estabilitat i creixement econòmic pactats pels països de la Unió́ Europea, que, a més, a Espanya han trobat l'expressió́ normativa en les lleis d'estabilitat pressupostària. Aquesta orientació́ de la política pressupostària ha seguit un procés de consolidació́ dels comptes públics fins a l'eliminació́ del dèficit públic i es proposa mantenir, d'ara endavant, l'equilibri pressupostari. En la seva exposició de motius, la Llei General de Subvencions&nbsp; (38/2003, de 17 de novembre) estableix, per a les administracions publiques , la necessitat d'elaborar plans estratègics de subvencions , que relacionin els objectius i els efectes que es pretenen aconseguir, amb els costos previsibles i les seves fonts de finançament, per tal d'adequar les necessitats públiques que s'han de cobrir a través de les subvencions amb les previsions de recursos disponibles, amb caràcter previ al seu naixement i de forma plurianual.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">Des de la perspectiva administrativa, les subvencions són una tècnica de foment de determinats comportaments considerats d'interès general i fins i tot un procediment de col·laboració́ entre l'Administració́ pública i els particulars per a la gestió́ d'activitats d'interès públic.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">Hi ha una gran diversitat de subvencions de diferent naturalesa, que es concedeixen mitjançant procediments complexos i, per tant, han de ser objecte d'un seguiment i un control eficaços.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">La millora de la gestió́ i el seguiment de les subvencions, la correcció́ de les insuficiències normatives i el control de les conductes fraudulentes que es poden donar en aquest àmbit són essencials per aconseguir assignacions eficaces i eficients des d'aquesta modalitat de despesa i fer compatible la creixent importància de les polítiques de subvencions amb l'actual orientació́ de la política pressupostària.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">Al seu torn, el Tribunal de Comptes i un creixent sector de la doctrina han propugnat l'elaboració́ d'una llei general de subvencions que resolgui definitivament la situació́ d'inseguretat jurídica i les llacunes que encara subsisteixen.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">Per tant, hi ha una clara consciència de la necessitat de dotar aquest important àmbit d'activitat administrativa d'un règim jurídic propi i específic que permeti superar les insuficiències del que substitueix i prevegi instruments i procediments que assegurin una gestió́ adequada i un control eficaç̧ de les subvencions. En aquest sentit, la Llei general de subvencions s'adreça a regular amb caràcter general els elements del règim jurídic de les subvencions i conté els aspectes nuclears, generals i fonamentals d'aquest sector de l'ordenament.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#1a1a1a">En l'actualitat, aquesta matèria, el règim jurídic de la qual va ser modificat àmpliament per la Llei 31/1990, de 27 de desembre, de pressupostos generals de l'Estat per a 1991, i altres modificacions posteriors, està regulada pels articles 81 i 82 del text refós de la Llei general pressupostària, aprovat pel Reial decret legislatiu 1091/1988, de 23 de setembre. Amb aquestes modificacions es va intentar pal·liar, com a mínim en part, la dispersió́ i l'existència de llacunes en aspectes molt rellevants que tradicionalment han caracteritzat la legislació́ espanyola sobre subvencions.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Aquesta norma també estableix els principis que han de regir en la gestió de les subvencions, i que són:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Publicitat, transparència, concurrència, objectivitat, igualtat i no-discriminació.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Eficàcia en el compliment dels objectius fixats per l'Administració atorgant.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Eficiència en l'assignació i la utilització dels recursos públics.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'Ajuntament de Marratxí estableix entre d'altres les prioritats següents:</span></span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>a) Dinamització econòmica</em>: En l'actual context de crisi, hem d'estar atents a totes les oportunitats. No partirem des de zero, sinó que aprofitarem els punts forts del municipi, com ara...</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>b) Cohesió social</em>: Treballarem per una ciutat socialment equilibrada, capaç d'atendre més que mai les necessitats de les persones més vulnerables. Apostem per la redistribució dels recursos, per la convivència i per la justícia social com a valors irrenunciables.</span></span></p> <p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>c) Qualitat democràtica</em>: Fonamentarem les nostres polítiques en la transparència i el rigor, en la complicitat amb tots els ciutadans, en l'exercici honest dels valors essencials de la democràcia i en fer-los protagonistes actius dels assumptes públics.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Més enllà de l'acompliment de les obligacions normatives que té l'Ajuntament en aquesta matèria, el present pla de subvencions vol ser un instrument estratègic que estableixi les bases per a la renovació del procediment de concessió de subvencions, entre els quals destacaríem, principalment:&nbsp;</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Garantir la transparència de les actuacions i decisions de l'Ajuntament i respectar el dret de la ciutadania a una informació clara i suficient sobre tots aquells assumptes que l'afectin. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Establir criteris objectius en la concessió de subvencions i ajuts, així com el seu posterior control en l'execució, disponibilitat i justificació de les aportacions municipals.</span></span></li> </ul> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>ARTICLE 1: NATURALESA JURÍDICA I REQUISITS BÀSICS&nbsp;</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Pla Estratègic de Subvencions de l'Ajuntament de Marratxí és un instrument de planificació. El seu caràcter és programàtic, no normatiu.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'aprovació del Pla Estratègic de subvencions no suposarà generació de cap dret a favor dels potencials beneficiaris, que no podran exigir cap indemnització o compensació en el cas que el Pla no es dugui a terme en els propis termes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a l'establiment efectiu de les subvencions previstes en aquest Pla, serà requisit bàsic la inclusió de les consignacions pressupostàries corresponents en els pressuposts anuals, així com l'aprovació de les bases reguladores de la seva concessió, en el de les bases d'execució del pressupost.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>ARTICLE 2: ÀMBIT D'APLICACIÓ</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">S'entén per subvenció, als efectes d'aquest Pla, tota disposició dinerària realitzada per l'Ajuntament de Marratxí, a favor de persones públiques o privades, i que compleixin els següents requisits:</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Que el lliurament es realitzi sense contraprestació directa dels beneficiaris.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Que el lliurament estigui subjecte al compliment d'un determinat objectiu, l'execució d'un projecte, la realització d'una activitat, l'adopció d'un comportament singular, ja desenvolupats o a desenvolupar, o la concurrència d'una situació, havent de complir el beneficiari amb les obligacions materials i formals que s'hagin establert.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Que el projecte, l'acció, la conducta o la situació finançada tingui per objecte el foment d'una activitat d'utilitat pública o d'interès social o de promoció d'una finalitat pública.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>ARTICLE 3: PERÍODE DE VIGÈNCIA DEL PLA ESTRATÈGIC DE SUBVENCIONS.</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'atorgament<strong> </strong>de<strong> </strong>subvencions per part de l'Ajuntament de Marratxí durant el període 2024-2026 s'ajustarà al que s'estableix en el present Pla.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Als efectes de l'establiment de subvencions, el procediment de concessió i la seva justificació i control s'estarà a allò previst a la Llei General de subvencions i al seu Reglament, així com es preveu a l'Ordenança General de Subvencions de l'Ajuntament de Marratxí.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>ARTICLE 4: LIMITACIONS A L'ESTABLIMENT DE SUBVENCIONS</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'establiment de subvencions queda sotmès al compliment dels objectius d'estabilitat pressupostària, per tant les consignacions pressupostàries que s'aprovin i les bases reguladores de la seva concessió s'acomodaran en cada moment a aquests objectius.</span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>ARTICLE 5: PRINCIPIS ORIENTADORS</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La gestió de les subvencions es regirà pels principis de (art. 8.3 LGS):&nbsp;</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Legalitat pressupostària, existència de crèdit suficient i sotmetiment a la normativa de disposició de fons. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Sostenibilitat econòmica i financera, que la disposició comporti la quantitat necessària exclusivament. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicitat i transparència, sotmetiment de la concessió de les subvencions a l'establiment previ d'unes bases reguladores, que han de publicar-se necessàriament al BOE, DOGC o BOP.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Concurrència, objectivitat, igualtat i no discriminació, establiment dels requisits que han de complir els sol·licitants, així com els criteris objectius per a l'atorgament de la subvenció i la seva ponderació. </span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Eficàcia i eficiència, disseny adequat a les finalitats de promoció que persegueix l'Administració, així com que s'han d'assignar i utilitzar els recursos públics per a la consecució d'aquelles finalitats.</span></span></li> </ul> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">ARTICLE 6 : BENEFICIARIS</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament de Marratxí concedirà subvencions a favor de les persones o entitats privades amb la finalitat de fomentar la realització d'activitats d'utilitat pública o interès social o per promoure la consecució de fins públics atribuïts a la competència local.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les formes jurídiques admissibles per a ostentar la condició de beneficiari són les que estableix l'article 11 de la Llei General de Subvencions, i que es concretarà en les respectives bases reguladores.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>ARTICLE 7: FINALITATS I OBJECTIUS ESTRATÈGICS</strong></em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fomentar el suport a les associacions i altres entitats sense finalitat lucrativa que promoguin projectes i activitats destinats als ciutadans i ciutadanes del municipi de Marratxí.</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Promocionar en aquestes associacions i entitats la responsabilitat en allò̀ públic, fomentant la coresponsabilitat en l'organització́ d'accions i projectes conjuntament amb l'Administració́ local.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Promocionar i fomentar els valors cívics, de convivència ciutadana, de cohesió́ i de compromís en l'esdevenir del municipi de Marratxí.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Incentivar d'una manera clara els projectes i activitats innovadores que aportin un valor afegit a la comunitat o que posin en valor el nostre patrimoni local.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Afavorir aquelles activitats que promoguin i singularitzin el municipi de Marratxí en alguna manifestació́ artística.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Afavorir, fomentar i vetllar pel manteniment i la difusió de les manifestacions culturals.</span></span></p> </li> <li> <p style="margin-bottom:0px; font-size:12px"><em>ARTICLE 8: SUBVENCIONS EN RÈGIM DE CONCURRÈNCIA:</em></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La concessió de les subvencions es fa mitjançant l'aplicació dels criteris establerts a les bases reguladores i a la convocatòria. S'adjudicaran amb el límit fixat a la convocatòria dins del crèdit disponible. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Conjuntament o prèviament a la convocatòria del procés de selecció, s'hauran d'aprovar i publicar les corresponents bases específiques. L'anunci de la convocatòria detallarà els elements essencials de les bases específiques per les quals es regirà el concurs. Es crearà un òrgan col·legiat per examinar i valorar les sol·licituds, la composició del qual s'haurà de determinar en les bases específiques, i el seu president formularà la proposta de concessió. L'acord d'atorgament esmentarà, individualment, les dades de cadascun dels beneficiaris, així com l'actuació que s'ha de dur a terme, l'import del cost de l'actuació a realitzar i l'import de l'ajut atorgat. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a totes les subvencions que s'hagin de concedir pel procediment de concurrència competitiva s'hauran d'aprovar les corresponents bases específiques, que s'aprovaran conjuntament o prèviament a la convocatòria.
