    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-top:6, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 6&amp;nbsp;de juliol&amp;nbsp;de 2017&amp;nbsp;per la qual es convoquen, subvencions per a la creació d'empreses per a activitats no agràries a les zones rurals, corresponents a&amp;nbsp;l'any 2017, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 &amp;nbsp;d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 3&amp;nbsp;de maig&amp;nbsp;de 2024, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En data de 15/07/2017 es va publicar la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de dia 6 de juliol de 2017, per la qual es convoquen, per a l'any 2017, subvencions per a la creació d'empreses per activitats no agràries a les zones rurals.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El 13 d'octubre de 2017, Mateu Monserrat Maimó amb NIF ***7361**, &amp;nbsp;registra la sol·licitud d'ajuda per a creació d'empreses per activitats no agràries a les zones rurals CENA2017_1 amb codi d'expedient CENA_2017_1/012&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Dins el termini estipulat a l'article vuit del Reglament d'execució (UE) núm 809/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control, les de desenvolupament rural i condicionalitat, es presenta la sol·licitud de subrogació de l'ajuda sol·licitada a l'expedient CENA 2017_1/012, amb RGE GOIBE481585, dia 24/07/2023; juntament amb els documents que acrediten el compliment del requeriments establerts al mateix article vuit, la nova beneficiaria és la filla del sol·licitant, per tant, compleix el requisit &amp;nbsp;1.1.a- &amp;nbsp;Ésser agricultors titulars d'una explotació agrària inscrita al Registre Interinsular Agrari (RIA) o titulars de predis forestals de més de 25 ha d'extensió, o bé persones que tinguin fins a un segon grau de parentiu amb el titular de l'explotació en la qual s'ubica l'activitat de diversificació, o bé persones jurídiques creades a l'efecte, sempre que el 60 % del seu capital correspongui als titulars de l'explotació agrària, o bé persones que tinguin fins a un segon grau de parentiu amb el titular de l'explotació en la qual s'ubica l'activitat de diversificació. En aquest expedient es tracta d'una subrogació per persona que té fins primer grau de parentiu amb el titular de la explotació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El gestor del Servei d'Ajudes al Desenvolupament Rural, d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'acord amb la normativa reguladora i la documentació aportada pel sol·licitant&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;ha comprovat que aquest compleix tots els requisits exigits a l'article vuit del Reglament d'execució (UE) núm 809/2014 de la Comissió, de 17 de juliol de 2014, &amp;nbsp;per poder realitzar el canvi de titularitat del sol·licitant de l'ajuda i que es pot acceptar la subrogació en tots els drets i obligacions. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de dia 6 de juliol de 2017, per la qual es convoquen, per a l'any 2017, subvencions per a la creació d'empreses per activitats no agràries a les zones rurals.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Llei 39/2015,&amp;nbsp;d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Proposta de resolució de modificació&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s' informa favorablement&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;del canvi de titular, i&amp;nbsp;es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Aprovar el canvi del titular de l'expedient CENA_2017_1/012&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;ajuda sol·licitada inicialment per &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Mateu Monserrat Maimó amb NIF ***7361**&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, amb els termes detallats en l'annex d'aquesta resolució, que és un total d'1 expedient, relativa a la línia d'ajuda “&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;creació d'empreses per activitats no agràries a les zones rurals CE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;NA2017_1 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;” i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;que assumeix formalment les obligacions assumides per l'anterior sol·licitant de l'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Notificar aquesta resolució mitjançant la publicació al Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; margin-left:0, 0pt; margin-right:0, 0pt; margin-top:0, 0pt"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0, 0pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
