&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;En data 21 de desembre de 2023, la Comunitat Autònoma de les Illes Balears va adquirir l&amp;apos;immoble situat al carrer Ter, 16, a Palma en el Polígon Són Fuster, propietat de l&amp;apos;entitat CaixaBank, SA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;Es tracta d&amp;apos;una edificació construïda a l&amp;apos;any 1994 formada per dues torres amb mateixes dimensions cadascuna (torre A i torre B), zona enjardinada i aparcaments al voltant, amb una superfície construïda de&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;32.401 m2 (segons cadastre) amb referència cadastral 2231401DD7823A0001IY.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;3. En el moment d&amp;apos;aquesta adquisició es troben a l&amp;apos;edifici vuit obres d&amp;apos;art, propietat de CaixaBank, SA, distribuïdes en la zona enjardinada i interior de l&amp;apos;immoble. &lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;A&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;rran de les&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; converses mantingudes amb aquesta entitat, e&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;l&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; de març de 202&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;, la directora general del Tresor, Política Financera i Patrimoni, va dictar resolució d&amp;apos;inici de l&amp;apos;expedient d&amp;apos;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;acceptació&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de cessió &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;d&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;e les &lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;vuit obres esmentades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;El 9 d&amp;apos;abril de 2024, la secretària general de la Conselleria d&amp;apos;Economia, Hisenda i Innovació va emetre un informe on manifesta que l&amp;apos;acceptació d&amp;apos;aquestes obres respon a un interès general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;7. CaixaBank, SA ha aportat certificat de taxació de les obres. La suma total de totes elles ascendeix a 84.700,00€. Està previst que es signi un contracte d&amp;apos;assegurança de l&amp;apos;immoble que cobreixi també els danys materials d&amp;apos;aquestes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;8. &lt;/span&gt;Consta l&amp;apos;informe fav&lt;span style="background-color: rgb(255, 255, 255)"&gt;orable del tècnic del Servei de Patrimoni, amb el vistiplau de la cap del Servei de Patrimoni, de 22&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt; d&amp;apos;&lt;/span&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;abril de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Propòs al conseller d&amp;apos;Economia, Hisenda i Innovació que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. Autoritzar l&amp;apos;acceptació de cessió d&amp;apos;ús gratuïta i temporal&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;de les vuit obres d&amp;apos;art esmentades en el fet tercer, propietat de CaixaBank SA, a favor de la Comunitat Autònoma de les Illes Balears, ubicades actualment a l&amp;apos;immoble del carrer Ter,16, a Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Per a instrumentalitzar aquesta acceptació, es procedirà a signar un contracte de comodat entre CaixaBank, SA i la&amp;nbsp;Comunitat Autònoma de les Illes Balears&amp;nbsp;en el qual s&amp;apos;estipularan les condicions de la cessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255); color: rgb(0, 0, 0)"&gt;3. Delegar en la directora general del Tresor, Política Financera i Patrimoni la signatura d&amp;apos;aquest contracte de comodat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;4. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;La cessió tindrà una durada inicial d&amp;apos;un any i es podrà prorrogar en cas que les parts així ho acordin expressament i per escrit. &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;Disposar que el període començarà des del moment en què es signi el contracte de comodat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;5. Notificar aquesta resolució a les part interessades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;6. Publicar la resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Anotar aquesta cessió d&amp;apos;ús gratuïta i temporal a l&amp;apos;Inventari General de Béns i Drets de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar recurs potestatiu &lt;span style="background-color: rgb(255, 255, 255)"&gt;de reposició davant el conseller d&amp;apos;Economia, Hisenda i Innovació en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació en &lt;/span&gt;&lt;em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;el Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;, d&amp;apos;acord amb l&amp;apos;article 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de le&lt;/span&gt;s administracions públiques, i l&amp;apos;article 57 de la Llei 3/2003, de 26 de març, de Règim Jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
