&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 2&amp;nbsp;d'abril&amp;nbsp;de 2024, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;“Resolució &amp;nbsp;revocació total &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185),&amp;nbsp;en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2.Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de EXPLOTACION RURAL HORT DE SON SUAU, SC, entre d'altres,&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;que figuren en l'annex de la Resolució de concessió, RES-2 de data 10 de novembre de 2022, (BOIB núm. 157, de 3 de desembre de 2022) amb les dades i els imports corresponents&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;(amb un import concedit de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;649,50€).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova que el beneficiari no acredita la condició d'explotació prioritària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;5. A la resolució de concessió ocupa el nº111 d'ordre amb dret a ajuda. De la seva puntuació es desprèn que obté 25 punt per titular d'explotació prioritària. Essent el total de la puntuació obtinguda de 62 punts. Els beneficiaris que no varen obtenir dret a ajuda tenien una puntuació de 52 punts.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;6. El dia 10 d'octubre de 2022 es denega per part del director gerent del FOGAIBA la sol·licitud de Ratificació a l'explotació EXPLOTACION RURALHORT DE SON SUAU, SC amb CIF J07727118, expedient de RIA 2725 , del Catàleg d'Explotacions Agràries Prioritàries de les Illes Balears al no complir amb els requisits establerts a l'article 5 de la Llei 19/1995, de 4 de juliol, de modernització de les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;7. Atès el punt anterior, no manté la puntuació obtinguda a la concurrència, essent actualment de 37 punts, per la qual cosa no te dret a ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;8. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;9. El 12 de desembre de 2023 es notifica a la persona interessada, mitjançant la publicació al web de FOGAIBA la esmentada deficiència, a causa de l'incompliment total de les obligacions o els compromisos contres als quals està condicionada l'eficàcia de l'acta de concessió de la subvenció, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorreguts els 10 dies hàbils, la persona interessada no ha presentat cap al·legació.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;10. S&lt;/em&gt;&lt;/span&gt;&lt;em&gt;'ha considerat l'Informe/proposta provisional de resolució de revocació total de 7 de març de 2024 de l'ajuda concedida a EXPLOTACION RURAL&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;HORT DE SON SUAU, SC. amb CIF J07727118.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Per tot això, dict la següent&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Resolució &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;1. Revocar totalment&amp;nbsp;l'ajuda concedida al beneficiari, mitjançant la Resolució del vicepresident en matèria agrària del FOGAIBA de 10&amp;nbsp;de novembre&amp;nbsp;de 2022, per l'import i amb les dades detallades en l'&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;annex d'aquesta resolució&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, que és un total d'1 expedient i que comença i acaba amb &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;EXPLOTACION RURAL HORT DE SON SUAU&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, &amp;nbsp;i que suma un import total de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;0&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;649,20&amp;nbsp;euros, relativa a la línia d'ajuda “Inversions en les explotacions agràries”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;Finalitzar el procediment i arxivar l'expedient INEA2019_1/454.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Notif&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;icar aquesta resolució &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a la persona interessada, mitjançant la publicación en el Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
