&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;1. El &lt;span style="color: rgb(0, 0, 0)"&gt;29 de novembre de 2022,&lt;/span&gt; es va publicar en el &lt;em&gt;Butlletí&lt;/em&gt;&lt;em&gt; Oficial de les Illes Balears &lt;/em&gt;núm. 155&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;l&amp;apos;Ordre 30/2022 del conseller de Model Econòmic, Turisme i Treball per la qual s&amp;apos;estableixen les bases reguladores i s&amp;apos;aprova la convocatòria per a la concessió d&amp;apos;ajuts &lt;em&gt;de&lt;/em&gt; &lt;em&gt;minimis &lt;/em&gt;per a la modernització i la innovació en la higiene i en la neteja dels establiments d&amp;apos;allotjament turístic, destinada a la compra de mecanismes d&amp;apos;elevació de llits, per complir l&amp;apos;article 37 bis de la Llei 8/2012, del turisme de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea Next Generation EU.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;2. El 28 de febrer de 2023, es va publicar en el &lt;em&gt;Butlletí&lt;/em&gt;&lt;em&gt; Oficial de les Illes Balears &lt;/em&gt;nú&lt;span style="background-color: rgb(255, 255, 255)"&gt;m. 26&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;la&lt;/span&gt;&lt;em&gt; &lt;/em&gt;Resolució del conseller de Model Econòmic, Turisme i Treball per la qual es modifica la convocatòria esmentada en el punt anterior per ampliar el termini de presentació de sol·licituds i modificar la composició de la Comissió Avaluadora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;3. D&amp;apos;acord amb el que s&amp;apos;exposa en l&amp;apos;Ordre 30/2022 i en el punt 5 de la convocatòria, la convocatòria està sotmesa al règim &lt;em&gt;de&lt;/em&gt; &lt;em&gt;minimis&lt;/em&gt; establert en el Reglament (UE) 1407/2013 de la Comissió Europea, de 18 de desembre de 2013, relatiu a l&amp;apos;aplicació dels articles 107 i 108 del Tractat de funcionament de la Unió Europea en les ajudes &lt;em&gt;de&lt;/em&gt; &lt;em&gt;minimis&lt;/em&gt;. En conseqüència, les ajudes previstes són compatibles amb el mercat interior i, alhora, resten exemptes de l&amp;apos;obligació de notificació establerta en l&amp;apos;article 108, apartat 3, del Tractat de funcionament de la Unió Europea.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(206, 24, 30)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. El &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;21&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;desembre&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de 2023, &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;es va&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ren&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;publica&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;r&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; en el &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Butlletí&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt; Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;núm. &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;172&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;les &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;resoluci&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;ons&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; per les quals es &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;concedeixen les subvencions &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;en el marc de la convocatòria de subvencions esmentada.&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;A l&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;es &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;persones que figuren en l&amp;apos;annex d&amp;apos;aquest&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;es&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;una&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; subvenció i &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;es va &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;autoritza&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;r&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; i disposa&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;r&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; una despesa &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;pels imports individuals &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;que s&amp;apos;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;indi&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;caven&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Els expedients de concessió de subvencions en els quals es concedia una subvenció per import igual o superior a 30.000 € varen ser fiscalitzats de conformitat per la Intervenció de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. Tal com es va fer constar en les resolucions de concessió, d&amp;apos;acord amb el punt 15 de la convocatòria, el període d&amp;apos;execució de les accions subvencionables finalitza als dos mesos des de la publicació en el &lt;em&gt;Butlletí&lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt; Oficial de les Illes Balears &lt;/em&gt;&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;de la resolució de concessió. Atès que aquestes es varen publicar e&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;21&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;desembre&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; de 2023, el termini d&amp;apos;execució va finalitzar &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;el&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt; &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1 de febrer de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. Tal com es va fer constar en les resolucions de concessió, d&amp;apos;acord amb el punt 16 de la convocatòria, el termini per a la justificació de la subvenció és d&amp;apos;un mes, comptador des de&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;l&amp;apos;endemà de la conclusió del termini d&amp;apos;execució establert en el punt anterior. En conseqüència, el termini per a la justificació de la subvenció ha finalitzat el 21 de març de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. En els expedients administratius &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;corresponents, consta &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;que les persones que figuren en l&amp;apos;annex d&amp;apos;aquesta &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;R&lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;esolució han justificat adequadament, d&amp;apos;acord amb l&amp;apos;apartat 16 de la convocatòria, les actuacions realitzades i &lt;/span&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;pels imports que s&amp;apos;indiquen en l&amp;apos;annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. En els expedients administratius&lt;/span&gt; &lt;span style="color: rgb(0, 0, 0)"&gt;corresponents, consta que les persones beneficiàries es troben al corrent de les obligacions tributàries i amb la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;9. Hi ha crèdit adequat i suficient per imputar els pagaments dels ajuts a la partida pressupostària 12201/G/751C01/77000/MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l&amp;apos;any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions, i el Reglament d&amp;apos;aquesta, aprovat pel Reial decret 887/2006, de 21 de juliol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;2. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. La Llei 14/2014, de 29 de desembre, de finances de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. La Llei 12/2023, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l&amp;apos;any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;5. La Llei 4/2021, de 17 de desembre, de mesures extraordinàries i urgents per executar les actuacions i els projectes que s&amp;apos;han de finançar amb fons europeus en el marc del Pla de Recuperació, Transformació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;6. El Decret 75/2004, de 27 d&amp;apos;agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;7. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s&amp;apos;estableixen les competències i l&amp;apos;estructura orgànica bàsica de les conselleries de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;8. &lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;1. Autoritzar i disposar una despesa&lt;span style="background-color: rgb(255, 255, 255)"&gt; global de 70.973,06 €&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;a favor de les persones beneficiàries que figuren en l&amp;apos;annex i pels imports individuals que s&amp;apos;hi indiquen, amb &lt;/span&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;càrrec a la partida pressupostària 12201/G/751C01/77000/MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears&lt;/span&gt; &lt;span style="background-color: rgb(255, 255, 255)"&gt;per a l&amp;apos;any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;span style="background-color: rgb(255, 255, 255)"&gt;2. Reconèixer l&amp;apos;obligació i proposar el pagament de la subvenció per un import global de 70.973,06 € a favor de les persones benef&lt;/span&gt;iciàries que figuren en l&amp;apos;annex i pels imports individuals indicats, amb càrrec a la partida pressupostària 12201/G/751C01/77000/MR071 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l&amp;apos;any 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;3. Aprovar la liquidació de la subvenció a les persones beneficiàries que figuren en l&amp;apos;annex i pels imports individuals que s&amp;apos;hi indiquen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;4. Fer constar que aquesta subvenció ha estat finançada amb fons procedents del Ministeri d&amp;apos;Indústria, Comerç i Turisme en el marc del Pla de Recuperació, Transformació i Resiliència del Mecanisme de Recuperació i Resiliència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Turisme, Cultura i Esports en el termini d&amp;apos;un mes comptador des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb l&amp;apos;article 124 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques, i l&amp;apos;article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="line-height: 1"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;També es pot interposar directament un recurs contenciós administratiu davant la sala contenciosa administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l&amp;apos;endemà de la publicació, d&amp;apos;acord amb l&amp;apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
