16053 ![CDATA[<p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">La directora del Servei d&apos;Ocupació de les Illes Balears ha formulat la proposta de resolució següent:</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Fets</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1.&nbsp;En data 22 d&apos;agost de 2020 es va publicar al BOIB 145, la&nbsp; Resolució del conseller de&nbsp;&nbsp;&nbsp; Model Econòmic, Turisme i Treball, i President del Servei d&apos;Ocupació de les Illes Balears per la qual s&apos;aprova la convocatòria&nbsp; de subvencions amb l&apos;objecte de finançar especialitats formatives dirigides a treballadors preferentment desocupats, (SOIB Formació per desocupats), durant el període 2021-2023.</span></span><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2.&nbsp;Les empreses que consten a l&apos;Annex d&apos;aquesta Resolució han presentat una sol·licitud de subvenció i de pagament de les pràctiques, en el termini d&apos;un mes des que hagin acabat les pràctiques tots els alumnes assignats a la mateixa empresa, juntament amb la documentació&nbsp; relacionada a la convocatòria&nbsp; esmentada al punt anterior.</span></span><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">&nbsp; &nbsp;&nbsp;</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3.&nbsp;En relació amb les entitats esmentades a l&apos;Annex&nbsp; d&apos;aquesta Resolució, s&apos;ha revisat la documentació que ha d&apos;acompanyar la sol·licitud d&apos;acord amb la convocatòria.</span></span><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Així mateix, s&apos;ha comprovat que totes les empreses estan al corrent del compliment de les seves obligacions amb la Seguretat Social i de les obligacions tributàries amb l&apos;administració de l&apos;Estat i amb la hisenda de la Comunitat Autònoma de les Illes Balears.</span></span><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">També s&apos;ha dut a terme la comprovació a la base de dades del sistema d&apos;informació dels serveis públics d&apos;ocupació, de les hores de pràctiques no laborals realitzades a l&apos;empresa.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Fonaments de dret</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1.&nbsp; Pel que fa a la competència, l&apos;article 9.4.i) del Decret 22/2020, de 24 de juliol, pel qual s&apos;aprova el Text consolidat de Decret d&apos;aprovació dels Estatuts de Servei d&apos;Ocupació de les Illes Balears, preveu entre les funcions de president de Servei de Ocupació de les Illes Balears, la concessió d&apos;ajudes i subvencions.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">El Decret 12/2023, de 10 de juliol, de la&nbsp; presidenta de les Illes Balears, pel qual&nbsp; s&apos;estableixen les competències i l&apos;estructura orgànica bàsica de les conselleries de l&apos;Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 94, de 10 de juliol), modificat pel Decret 16/2023, de 20 de juliol (BOIB núm. 102, de 20 de juliol), i pel Decret 17/2023, de 23 d&apos;agost (BOIB núm. 117, de 24 d&apos;agost) estableix que les competències en matèria de treball estan atribuïdes a l&apos;actual Conselleria d&apos;Empresa, Ocupació i Energia.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Per altra banda, és aplicable la Resolució del president del Servei d&apos;Ocupació de les Illes&nbsp;&nbsp;&nbsp; Balears (SOIB) de 24 d&apos;octubre de 2023, de delegació de competències i signatura als òrgans directius del SOIB (BOIB núm. 145, de 26 de octubre).</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Resolució del conseller de Model Econòmic, Turisme i Treball i president del Servei d&apos;Ocupació de les Illes Balears per la qual s&apos;aprova la convocatòria&nbsp; de subvencions amb l&apos;objecte de finançar especialitats formatives dirigides a treballadors preferentment desocupats, (SOIB Formació per desocupats), durant el període 2021-2023.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">«25. Pràctiques professionals no laborals en empreses</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">(...)</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Abans de començar les pràctiques, l&apos;empresa on es duen a terme ha de comunicar als representants legals dels treballadors l&apos;acord de pràctiques i la relació dels alumnes que hi participen. S&apos;ha de signar un conveni entre el centre de formació i l&apos;empresa, i els alumnes en pràctiques s&apos;hi han d&apos;identificar mitjançant el document corresponent.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">(...)</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Es pot destinar a les empreses la quantitat de 3 euros per alumne i hora de pràctiques per compensar-ne l&apos;execució. Aquesta compensació s&apos;ha d&apos;atorgar en règim de concessió directa, d&apos;acord amb el Reial decret 357/2006, de 24 de març. A aquest efecte, l&apos;empresa ha de presentar una sol·licitud de subvenció i pagament de les pràctiques, segons el model normalitzat, en el termini d&apos;un mes des que hagin acabat les pràctiques tots els alumnes assignats a la mateixa empresa, juntament amb la documentació següent, d&apos;acord amb els models que es troben en el web :</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">— Declaració responsable, d&apos;acord amb els models establerts en el web del SOIB, segons si l&apos;import de l&apos;ajut sol·licitat és superior o inferior o igual a 3.000 euros.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">De conformitat amb l&apos;article 28.2 de la Llei 39/2015, d&apos;1 d&apos;octubre, i l&apos;article 61 del Reial decret 203/2021, de 30 de març, pel qual aprova el Reglament d&apos;actuació i funcionament del sector públic per mitjans electrònics, en el cas que l&apos;ajut sol·licitat superi els 3.000 euros el SOIB pot obtenir els certificats acreditatius que la persona interessada està al corrent de les obligacions amb l&apos;Agència Tributària estatal i amb la Seguretat Social, així com la verificació de les dades d&apos;identitat (DNI), excepte en el cas d&apos;oposició expressa de la persona interessada, que s&apos;ha de fer constar en el model de sol·licitud. En el cas que no s&apos;autoritzin aquestes consultes, juntament amb la sol·licitud d&apos;ajuts ha d&apos;aportar la documentació acreditativa d&apos;estar al corrent de les obligacions anteriors, així com una còpia del document d&apos;identitat, si escau.</span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">a) Còpia autèntica de la targeta d&apos;identificació fiscal de l&apos;entitat.</span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">b) Declaració responsable de veracitat de les dades bancàries.</span></span></p> <p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">c) Còpia autèntica del poder de representació de la persona que signa la sol·licitud.»</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. L&apos;article 38 del Decret 75/2004, de 27 d&apos;agost, el qual desplega la Llei de finances i de les lleis de pressuposts de la Comunitat Autònoma de les Illes Balears disposa que l&apos;Administració de la Comunitat Autònoma de les Illes Balears, prèviament a la concessió de subvencions, comprovarà d&apos;ofici que els seus beneficiaris estiguin al corrent de les obligacions amb la Hisenda de la Comunitat Autònoma. Correspon a les unitats de gestió econòmica comprovar i certificar la situació dels beneficiaris davant la Hisenda de la Comunitat Autònoma de les Illes Balears, sense perjudici que el titular de la secció pressupostària en designi d&apos;altres.</span></span></p> <p><strong><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Proposta de resolució</span></span></strong></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Propòs al conseller d&apos;Empresa, Ocupació i Energia i president del Servei d&apos;Ocupació de les Illes Balears, que dicti una resolució en els termes següents:</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">1. Aprovar la concessió d&apos;una subvenció a favor de les empreses beneficiàries que consten en l&apos;Annex d&apos;aquesta Resolució per compensar pràctiques professionals no laborals corresponents a especialitats formatives adreçades a treballadors desocupats per al període 2021-2023.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">2. Autoritzar i disposar una despesa per un import global de 9.720,00 euros a favor&nbsp; dels beneficiaris&nbsp; que consten en l&apos;Annex d&apos;aquesta Resolució, dels quals 2.760,00 euros amb càrrec a la partida pressupostària 76101 322D06 47000 00 24111 y&nbsp; 6.960,00 euros amb càrrec a la partida pressupostària 76101 322D06 48000 00 24111 dels pressuposts vigents de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">3. Reconèixer l&apos;obligació i proposar el pagament per l&apos;import global de 9.720,00 euros a favor&nbsp; dels beneficiaris&nbsp; que consten en l&apos;Annex d&apos;aquesta Resolució, dels quals 2.760,00 euros amb càrrec a la partida pressupostària 76101 322D06 47000 00 24111 y&nbsp; 6.960,00 euros amb càrrec a la partida pressupostària 76101 322D06 48000 00 24111 dels pressuposts vigents de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">4.&nbsp; Publicar aquesta Resolució al Butlletí Oficial de les Illes Balears i a la pàgina web del Servei d&apos;Ocupació de les Illes Balears.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Per tot això, dict la següent</span></span></p> <p style="text-align: center"><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Resolució</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px"><strong>Interposició de recursos</strong></span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d&apos;Empresa, Ocupació i Energia, en el termini d&apos;un mes comptador des de l&apos;endemà que s&apos;hagi publicat en el Butlletí Oficial de les Illes Balears, d&apos;acord amb el que disposa l&apos;article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l&apos;Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d&apos;abril), i l&apos;article 124 de la Llei 39/2015, d&apos;1 d&apos;octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif; font-size: 12px">També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos comptadors des de l&apos;endemà que s&apos;hagi publicat en el Butlletí Oficial de les Illes Balears, d&apos;acord amb el que estableix l&apos;article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa (BOE núm. 167, de 14 de juliol).</span></span></p> <p><span style="line-height: 1"><span style="font-family: Times New Roman, Times, serif;
