<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En sessió ordinària de la Junta de Govern Local de l'Ajuntament de Sant Joan de Labritja celebrada el dia 21 de març de 2024 es va aprovar les bases reguladores que han de regir la convocatòria de Subvencions Directes i Nominatives del municipi de Sant Joan de Labritja per a l'any 2024, que es transcriuen a continuació: </span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">1. Les ajudes que es concedeixin tindran el caràcter de subvenció i es regiran per la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS- i el seu reglament de desenvolupament, bases d'execució del pressupost 2024 i document annex, les presents bases, conveni regulador en aquells casos que es consideri i l'acord especifico de concessió.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">2. Les ajudes directes que es concediran directa i nominativament, exclusivament, als beneficiaris relacionats en l'annex de les Bases del Pressupost Municipal i en la base 1 de la present convocatòria.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">3. Les ajudes rebudes són compatibles amb la percepció d'altres ajudes procedents de qualsevol altra administració o entre públic o privat, sempre que el seu import se de tal quantitat que aïlladament o en concurrència amb altres subvencions no superi el total de l'activitat subvencionada, d'acord amb el que es preveu en l'article 19.3 de la Llei 38/2003, de 17 de novembre, General de Subvencions.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 3. Crèdit pressupostari.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Les subvencions previstes en la present convocatòria estan consignades en el pressupost municipal de l'any 2024 per un import total de <strong>224.800,00 euros</strong>, amb càrrec a les aplicacions pressupostàries detallades en la Base 1 de les presents Bases.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">En qualsevol cas, la concessió de les subvencions queda condicionada a l'existència de crèdit adequat i suficient en el moment de resolució de la concessió, conforme a l'article 56.2 del Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, General de Subvencions -RLGS-.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 4. Quantia de les ajudes.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">L'ajuda econòmica ascendirà com a màxim a l'import que figura en l'annex de les Bases d'Execució del pressupost municipal de l'any 2024 i en les presents Bases.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 5.- Destinataris.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Podran sol·licitar les ajudes previstes en aquesta convocatòria les persones físiques, jurídiques, Comissions, Confraries etc. previstes en la Base 1 de la convocatòria i per a la subvenció directa i per l'import màxim que figura en aquesta base, en el termini màxim de <strong>tres mesos</strong> a comptar del de la data d'inserció de les presents Bases en el tauler d'anuncis i en la Seu electrònica de l'Ajuntament de Sant Joan de Labritja.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Les sol·licituds hauran d'anar acompanyades de tots els documents previstos en la Base 6.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Si la sol·licitud es presentés fos de termini no seran tingudes en compte en el present exercici, perdent el dret a la seva recepció.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Si a la sol·licitud li faltés algun dels documents relacionats en la Base 1 o es presentessin incomplets, seran requerits per a l'esmena dels mateixos en un termini màxim de 10 dies hàbils. En cas que no s'emplenés correctament el requeriment referit, les sol·licituds no seran tingudes en compte donant lloc a la perduda del dret a la percepció de la subvenció prevista en aquesta convocatòria per al beneficiari.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">El beneficiari no ha d'estar culpable en alguna de les prohibicions establertes en l'article 13 de la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS- </span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 6. Sol·licituds i documentació.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Els beneficiaris de subvenció prevists en la Base 1 d'aquesta convocatòria podran sol·licitar ajuda econòmica per l'import previst en aquesta, per a foment de les activitats que duguin a terme els beneficiaris dins dels fins previstos en aquestes bases i que tradicionalment es ve subvencionant en exercicis anteriors, havent de presentar necessàriament per a la seva tramitació i concessió la següent documentació:</span></span></span></span></span></p>
<ul>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Annex I</strong>. Model de sol·licitud de la subvenció. Serà emplenat i signat per l'interessat o representant legal de l'entitat o associació sol·licitant de la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Fotocòpia del DNI de l'interessat o del representant legal </strong>de l'entitat o associació sol·licitant de la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Fotocòpia del NIF de l'entitat o associació</strong> sol·licitant de la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Documentació acreditativa de la vigència del càrrec que ostenta el representant legal</strong> de l'entitat o associació sol·licitant de la subvenció o, si és el cas, acreditació de l'autorització corresponent per a realitzar la sol·licitud de subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Si el sol·licitant de la subvenció es tracta d'una entitat o associació legalment constituïda, haurà de presentar <strong>còpia dels Estatuts, així com les modificacions</strong> que s'haguessin produït.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Certificat de titularitat bancària</strong> en el qual s'acrediti el número de compte corrent on ha d'ingressar-se la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Certificat d'estar al corrent de les seves obligacions amb l'Agència Estatal d'Administració Tributària (AEAT)</strong>.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Certificat d'estar al corrent de les seves obligacions amb la Tresoreria General de la Seguretat Social</strong>. En cas que l'entitat o associació no estigui inscrita en el sistema de la Seguretat Social, haurà de presentar el certificat o informe d'inexistència d'empresari.</span></span></span></span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 8. Termini i lloc de presentació de les sol·licituds.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">1. El <strong>termini de presentació de sol·licituds serà de tres mesos</strong> a comptar de l'endemà de la publicació de les presents Bases en el Tauler d'anuncis i en la Seu electrònica de l'Ajuntament de Sant Joan de Labritja.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">2. Les sol·licituds juntament amb la restant documentació que s'indica en la base anterior, hauran de presentar-se en el Registre General de l'Ajuntament de Sant Joan de *Labritja, sense perjudici del que s'estableix en l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques -LPACAP- acompanyada de tota la documentació prevista en la Base 6.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">3. La presentació de sol·licituds a aquesta convocatòria implica l'acceptació de les seves bases.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 9. Procediment i resolució.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Tant l'article 22 de la Llei 38/2003, de 17 de novembre, General de Subvencions -LGS- com els articles 7 i 8 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de Subvencions, disposen que el procediment ordinari de concessió de subvencions es tramitarà en règim de concurrència competitiva. A l'efecte d'aquesta llei, tindrà la consideració de concurrència competitiva el procediment mitjançant el qual la concessió de les subvencions es realitza mitjançant la comparació de les sol·licituds presentades, a fi d'establir una prelació entre les mateixes d'acord amb els criteris de valoració prèviament fixats en les bases reguladores i en la convocatòria, i adjudicar, amb el límit fixat en la convocatòria dins del crèdit disponible, aquelles que hagin obtingut major valoració en aplicació dels citats criteris.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">No obstant això, podran concedir-se de manera directa les següents subvencions:</span></span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">a) Les previstes nominativament en els Pressupostos Generals de les Entitats Locals, en els termes recollits en els convenis i en la normativa reguladora d'aquestes subvencions.</span></span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">A l'efecte del que s'estableix en el paràgraf anterior, s'entén per subvenció prevista nominativament en els Pressupostos Generals de l'aquella en què almenys la seva dotació pressupostària i beneficiari apareguin determinats en els estats de despesa del Pressupost. L'objecte d'aquestes subvencions haurà de quedar determinat expressament en el corresponent conveni de col·laboració o resolució de concessió que, en tot cas, haurà de ser congruent amb la classificació funcional i econòmica del corresponent crèdit pressupostari.</span></span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">b) Aquelles l'atorgament o la quantia de la qual vingui imposat a l'Administració per una norma de rang legal, que seguiran el procediment de concessió que els resulti d'aplicació d'acord amb la seva pròpia normativa.</span></span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">c) Amb caràcter excepcional, aquelles altres subvencions en què s'acreditin raons d'interès públic, social, econòmic o humanitari, o altres degudament justificades que dificultin la seva convocatòria pública.</span></span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">El procediment per a dur a terme l'atorgament de la concessió directa de les subvencions previstes en aquestes bases és el següent:</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>A.-</strong> Una vegada que es formuli la sol·licitud s'emetrà informe d'Intervenció sobre l'existència de consignació pressupostària per a l'atorgament de la corresponent subvenció nominativa, s'emetrà informe-proposta en relació amb l'atorgament de la subvenció.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>B.-</strong> Per acord de Junta de Govern Local s'atorgarà la subvenció, de conformitat amb el que s'estableix en aquestes bases o conveni que se subscrigui si és el cas, quant a termini i forma de justificació.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>C.-</strong> Es notificarà l'acord de concessió als interessats, segons el que s'estableix en l'article 40 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Publiques, ajustant-se la pràctica d'aquesta notificació a les disposicions contingudes en l'article 41 de la precitada norma.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">1.- Les sol·licituds presentades seran resoltes per la Junta de Govern Local, així com la necessitat o no de subscriure conveni regulador individualitzat per a cadascuna d'elles.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">2.- La Secretaria i la Intervenció revisaran les sol·licituds presentades i comprovaran que reuneixen els requisits assenyalats en les bases de la convocatòria.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">3.- S'emetrà informe d'Intervenció sobre l'existència de consignació pressupostària per a l'atorgament de la corresponent subvenció nominada.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">4.- A proposta de la Regidoria de Cultura s'elaborarà llista provisional d'admesos i ajudes que se'ls assignen, així com dels exclosos i les seves causes proposant la seva aprovació a la Junta de Govern Local.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">5.- La Junta de Govern Local acordarà aprovar provisionalment la llista anterior amb especificació de la causa d'exclusió, en cas de no reunir els requisits previstos en la llei, pressupost municipal de 2023 o en aquestes Bases, que serà notificada als interessats, concedint-los un termini d'esmena de 15 dies, si escau, conforme a l'article 68 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques -LPACAP-.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">6.- Rebudes i analitzades les esmenes, s'elaborarà la llista definitiva dels beneficiaris de les ajudes i l'import de les ajudes a atorgar, així com dels exclosos que serà remesa, a proposta de la regidoria de cultura, a la Junta de Govern Local per a la seva aprovació definitiva.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">7</span></span><span style="color:#000080"><span style="color:#000000">.- El termini màxim per a notificar la resolució del procediment serà de dos mesos, comptats a partir de l'endemà de la finalització del termini de presentació de sol·licituds.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Si transcorregut aquest termini no s'hagués dictat resolució expressa, les sol·licituds presentades s'entendran desestimades.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><em><strong>CONTINGUT DELS CONVENIS:</strong></em></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">De conformitat amb l'article 65.3 del Reial decret 887/2006, de 21 de juliol, estableix que la resolució o, si és el cas, acord o conveni hauran d'incloure els següents extrems: </span></span></span></span></span></p>

<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Determinació de l'objecte de la subvenció i dels seus beneficiaris, d'acord amb l'assignació pressupostària.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Crèdit pressupostari al qual s'imputa la despesa i quantia de la subvenció, individualitzada per a cada beneficiari si fossin varis.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Compatibilitat o incompatibilitat amb altres subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, nacionals, de la Unió Europea o d'Organismes Internacionals.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Terminis i mètodes de pagament de la subvenció, possibilitat d'efectuar pagaments anticipats i abonaments en compte, així com el règim de garanties que hauran d'aportar els beneficiaris.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Termini i forma de justificació per part del beneficiari del compliment de la finalitat per a la qual es va concedir la subvenció i de l'aplicació dels fons percebuts.</span></span></span></span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 10. Obligacions dels beneficiaris.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Els beneficiaris de les ajudes concedides hauran de complir les següents obligacions:o</span></span></span></span></span></p>
<ul>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Complir l'objectiu, executar el projecte, realitzar l'activitat o adoptar el compromís i obligacions que fonamenta la concessió de la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Justificar davant l'òrgan concedent o l'Entitat col·laboradora, si és el cas, el compliment dels requisits i condicions, així com la realització de l'activitat i el compliment de la finalitat que determinin la concessió o gaudi de la subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Sotmetre's a les actuacions de comprovació, a efectuar per l'òrgan concedent o, així com qualssevol altres de comprovació i control financer que puguin realitzar els òrgans de control competents, tant nacionals com comunitaris, aportant quanta informació li sigui requerida en l'exercici de les actuacions anteriors.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Comunicar a l'òrgan concedent l'obtenció d'altres subvencions, ajudes, ingressos o recursos que financin les activitats subvencionades.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Acreditar, amb anterioritat a dictar-se la proposta de resolució, que es troba al corrent en el compliment de les seves obligacions tributàries i enfront de la Seguretat Social, en tot cas, es podrà autoritzar l'Ajuntament a obtenir aquestes dades.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">No mantenir deutes de qualsevol naturalesa amb l'Ajuntament de Sant Joan de Labritja.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Disposar dels llibres comptables, registres diligenciats i altres documents degudament auditats, en els termes exigits per la Legislació mercantil i sectorial, aplicable al beneficiari en cada cas.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Conservar els documents justificatius de l'aplicació dels fons rebuts, inclosos els documents electrònics, en tant puguin ser objecte de les actuacions de comprovació i control.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Donar l'adequada publicitat de caràcter públic del finançament de programes, activitats, inversions o actuacions de qualsevol tipus que siguin objecte de subvenció.</span></span></span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Si s'estigués en curs d'alguna de les causes de reintegrament, s'haurà de procedir al reintegrament de la quantia rebuda.</span></span></span></span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 11. Pagament de les ajudes concedides. Justificació de les ajudes.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">De conformitat amb el que es disposa en Llei 38/2003, General de Subvencions -LGS-, per a la justificació de les ajudes es requerirà una altra documentació que l'acreditativa del requisit per a obtenir la condició de beneficiari prevista en la Base 6 d'aquesta convocatòria.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><em><strong>DOCUMENTACIÓ PER A LA JUSTIFICACIÓ DE LA SUBVENCIÓ:</strong></em></span></span><span style="color:#000080"><span style="color:#000000"> </span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Tots els beneficiaris de les ajudes previstes en aquesta convocatòria hauran de presentar la documentació justificativa de la subvenció, havent de presentar els següents documents:</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>1. Annex II</strong>. Model de justificació de la subvenció. Serà emplenat i signat per l'interessat o representant legal de l'entitat o associació sol·licitant de la subvenció.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>2. Memòria justificativa</strong> de les actuacions, activitats o projectes realitzats. Haurà d'acreditar que s'ha complert la finalitat perquè es va atorgar la subvenció.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>3. Documents justificatius de la despesa realitzada</strong>. Forma d'acreditació:</span></span></span></span></span></p>

<p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>1 Nòmines pagades en efectiu</strong>. Es justificarà el pagament, presentant la nòmina signada per el/la treballador/a.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>2 Nòmines pagades per transferència bancària</strong>. Es justificarà el pagament, presentant la nòmina i el justificant bancari de la transferència a nom del/de la treballador/a, havent de figurar el mes i any a què correspongui.</span></span></span></span></span></p>
<p style="margin-left:80px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">5. Viatges: En cas de presentar-se despeses corresponents a viatges relacionats amb l'activitat subvencionada (hotels, bitllets d'avió, vaixell, restaurants…), hauran de justificar-se mitjançant factura o rebut, que a més de les dades relacionades anteriorment, hauran de contenir el nom i cognoms de les persones que realitzin l'activitat.</span></span></span></span></span></p>
<p>4.Certificat d'estar al corrent de les seves obligacions amb l'Agència Estatal d'Administració Tributària (AEAT).</p>
<p>5.Certificat d'estar al corrent de pagament amb la Tresoreria General de la Seguretat Social. En cas que l'entitat o associació no estigui inscrita en el sistema de la Seguretat Social, haurà de presentar el certificat o informe d'inexistència d'empresari.</p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><em><strong>OBSERVACIONS DELS DOCUMENTS JUSTIFICATIUS DE LA DESPESA REALITZADA:</strong></em></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">1. No s'admetran com a documents justificatius de la despesa realitzada, els següents: albarans, factures proforma, fulles de comanda, tiquets.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">2. En el cas de les nòmines, només s'imputarà l'import que reflecteixi la transferència bancàries, que serà l'import net de la nòmina (líquid a percebre per part del/de la treballador/a). Per a imputar l'import de la nòmina bruta a la subvenció, el beneficiari haurà d'aportar, a més, el justificant del pagament de les retencions d'IRPF a la AEAT al costat del model 111 del període que correspongui, i el justificant de pagament de les assegurances socials a la Seguretat Social (RLC, antic TC-1 i RNT, antic TC-2).</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">3. En el cas dels viatges, s'exceptuarà de l'obligació que es faci constar en la factura o rebut el nom i cognoms de les persones que realitzin l'activitat als sol·licitants beneficiaris l'import dels quals de la subvenció concedida no superi els 3.000,00 €. En aquest cas, es podrà substituir per un certificat on consti el nom i cognoms de les persones que realitzin l'activitat emès per l'interessat o representant legal de l'entitat o associació beneficiària de la subvenció.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><em><strong>TERMINI PER A LA PRESENTACIÓ DE LA JUSTIFICACIÓ:</strong></em></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">1. APIMAs i CEIPs: Les activitats subvencionades hauran de dur-se a terme en el curs escolar 2024-2025. El termini per a presentar la documentació justificativa finalitzarà el <strong>29 de març de 2025</strong>.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">2. Resta de beneficiaris: Les activitats subvencionades hauran de dur-se a terme l'any 2024. El termini per a presentar la documentació justificativa finalitzarà el <strong>30 de novembre de 2024</strong>.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 12. Compatibilitat de les ajudes.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Les ajudes regulades per la present convocatòria seran compatibles amb altres de la mateixa finalitat, qualsevol que sigui l'Administració o Entitat que les concedeixi.</span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000"><strong>Base 13. Control i reintegrament.</strong></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">Procedirà el reintegrament de les quantitats percebudes i l'exigència de l'interès de demora des del moment del pagament de la subvenció fins a la data en què s'acordi la procedència del reintegrament, i en la quantia fixada en l'article 38.2 de la Llei General de Subvencions, en els següents casos:</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">a) Obtenció de la subvenció falsejant les condicions requerides per a això o ocultant aquelles que ho haguessin impedit.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">b) Incompliment total o parcial de l'objectiu, de l'activitat, del projecte o la no adopció del comportament que fonamenten la concessió de la subvenció.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">c) Incompliment de l'obligació de justificació o la justificació insuficient, en els termes establerts en l'article 30 de la Llei 38/2003, i si és el cas, en les Normes reguladores de la subvenció.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">d) Incompliment de l'obligació d'adoptar les mesures de difusió contingudes en l'apartat 4 de l'article 18 de la citada Llei 38/2003.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">e) Resistència, excusa, obstrucció o negativa a les actuacions de comprovació i control financer previstes en els articles 14 i 15 de la Llei 38/2003, així com l'incompliment de les obligacions comptables, registrals o de conservació de documents quan d'això es derivi la impossibilitat de verificar l'ocupació donada als fons percebuts, el compliment de l'objectiu, la realitat i regularitat de les activitats subvencionades, o la concurrència de subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, Nacionals, de la Unió Europea o d'Organismes Internacionals.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">f) Incompliment de les obligacions imposades per l'Administració a les Entitats col·laboradores i beneficiaris, així com dels compromisos per aquests assumits, amb motiu de la concessió de la subvenció, sempre que afectin o es refereixin al mode en què s'han d'aconseguir els objectius, realitzar l'activitat, executar el projecte o adoptar el comportament que fonamenta la concessió de la subvenció.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">g) Incompliment de les obligacions imposades per l'Administració a les Entitats col·laboradores i beneficiaris, així com dels compromisos per aquests assumits, amb motiu de la concessió de la subvenció, diferents dels anteriors, quan d'això es derivi la impossibilitat de verificar l'ocupació donada als fons percebuts, el compliment de l'objectiu, la realitat i regularitat de les activitats subvencionades, o la concurrència de subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualssevol Administracions o Ens Públics o Privats, Nacionals, de la Unió Europea o d'Organismes Internacionals.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">h) L'adopció, en virtut del que s'estableix en els articles 87 a 89 del Tractat de la Unió Europea, d'una decisió de la qual es derivi una necessitat de reintegrament.</span></span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">i) En els altres supòsits previstos en la Normativa reguladora de la subvenció.</span></span></span></span></span></p>
