    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En el Boletín Oficial de las Illes Balears núm. 20, de 10 de febrero de 2024, se ha publicado la Ordenanza fiscal que regula el precio público por prestación del servicio de suministro de agua potable de la Mancomunitat Migjorn de Mallorca, donde se ha detectado un error en la publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Rectificar el error advertido en la publicación de la Ordenanza fiscal que regula el precio público por prestación del servicio de suministro de agua potable de la Mancomunitat Migjorn de Mallorca, en el sentido de&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;donde dice:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Tarifa en los establecimientos turísticos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;debe decir:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Tarifa en los establecimientos turísticos, por cada 4 plazas:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quedando redactado de la siguiente forma:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANZA FISCAL QUE REGULA EL PRECIO PÚBLICO POR PRESTACIÓN DEL SERVICIO DE SUMINISTRO DE AGUA POTABLE DE LA MANCOMUNITAT MIGJORN DE MALLORCA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 1. Naturaleza, objeto y funcionamiento.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. En uso de las facultades conferidas por el artículo 106 de la Ley 7/1985 de 2 de abril Reguladora de las Bases de Régimen Local, esta Mancomunitat, establece el precio público por prestación del servicio de suministro de agua potable a domicilio, que regula por la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Será objeto de esta exacción el suministro de agua en la modalidad de contador que la mancomunitat se compromete a prestar por gestión directa, asumiendo su propio riesgo, o por cualquier otra forma de gestión de las previstas en las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 2. Obligación de contribuir&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Hecho imponible. Está determinado por el suministro de agua efectuado y la obligación de contribuir nacerá desde que el peticionario haya suscrito la correspondiente póliza de abono y esté instalada la acometida y contador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Sujeto pasivo. Está obligado al pago el peticionario del suministro y suscriptor de la póliza de abono, sea propietario o arrendatario de la finca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 3. Tarifas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Las cuotas aplicables en base a esta ordenanza son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;TARIFA:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;a) &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Tarifa general de suministro fuera de los núcleos urbanos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 1: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo hasta 20 m3 por bimestre por vivienda: &lt;strong&gt;0,61 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 2: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 21 y 40 m3 por bimestre por vivienda:&lt;strong&gt; 1,02 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 3: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 41 y 60 m3 por bimestre por vivienda:&lt;strong&gt; 1,50 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 4: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 61 y 80 m3 por bimestre por vivienda: &lt;strong&gt;2,20 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 5: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 81 y 100 m3 por bimestre por vivienda:&lt;strong&gt; 3,50 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 6: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo superior a 100 m3 por bimestre por vivienda:&lt;strong&gt; 5,50 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;b)&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; Tarifa del suministro en los puntos generales de los núcleos urbanos de los municipios mancomunados:&lt;strong&gt; 0,65 euros/m3.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;c) &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Tarifa en los establecimientos turísticos, por cada 4 plazas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 1: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo hasta 20 m3 por bimestre por vivienda: &lt;strong&gt;0,67 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 2: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 21 y 40 m3 por bimestre por vivienda:&lt;strong&gt; 1,12 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 3: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 41 y 60 m3 por bimestre por vivienda: &lt;strong&gt;1,65 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 4: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo entre 61 y 80 m3 por bimestre por vivienda:&lt;strong&gt; 2,42 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 5:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt; consumo entre 81 y 100 m3 por bimestre por vivienda:&lt;strong&gt; 3,85 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 6: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo superior a100 m3 por bimestre por vivienda:&lt;strong&gt; 6,05 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;d) &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Tarifa a los contadores provisionales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 1: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo hasta 20 m3 por bimestre: &lt;strong&gt;0,61 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Tramo 2: &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;consumo superior a 21 m3 por bimestre:&lt;strong&gt; 5,50 euros/m3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3.2 &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Bonificaciones&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) A las viviendas donde se acredite documentalmente (certificado de convivencia o título de familia numerosa) que conviven cinco o más personas se les aplicará el precio del primer escalón, hasta un máximo de 6 m3 por persona y bimestre; si se supera ese consumo será de aplicación la tarifa progresiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) A las explotaciones agrícolas que cuenten con más de quince animales del tipo vacas, bueyes, cerdos, caballos, ovejas, cabras o similares, previa presentación del libro de registro de la explotación actualizado por la Administración Autonómica, se les aplicará el precio del primer escalón, hasta un máximo de 12 m3 por animal y bimestre; si se supera ese consumo será de aplicación la tarifa progresiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;3.3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;En cualquier caso, se establece una &lt;strong&gt;cuota de servicio&lt;/strong&gt;, por abonado y bimestre, de&lt;strong&gt; 7,50 €.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 4. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;Las cuotas exigibles para esta exacción tendrán en todo caso carácter bimensual y se recaudarán por recibo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Normas de gestión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;La exacción se considerará devengada desde que nazca la obligación de contribuir tal y como establece el artículo 2º, párrafo 1, de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 6. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;La persona interesada en que se le preste el servicio de suministro de agua en la modalidad de agrícola (fuera de los núcleos urbanos) deberá suscribir ante todo, la correspondiente póliza de abono y jutificar uno de estos tres supuestos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) que la vivienda que debe recibir el suministro de agua ha obtenido la correspondiente cédula de habitabilidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) En caso de que solicite el suministro para obras, deberá presentar la correspondiente licencia municipal de obras en vigor.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Si se solicita el suministro para una explitación agrícola, deberá presentarse el libro de registro de la explotación que cumpla los requisitos previstos en el artículo 3.2.b&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 7.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;En los supuestos en que el suministro se hubiese pactado a nombre del titular de la propiedad y éste enajenase o transmitiera sus derechos a favor de terceros, para que el suministro pueda seguir dándose en la forma contratada, será necesario que el cambio de titular sea comunicado a la mancomunitat, dentro del plazo máximo de un mes desde la fecha de la transmisión de la propiedad de la finca y que además el nuevo propietario suscriba la póliza correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;En caso contrario, la mancomunitat podrá dar por finalizado el contrato dejando de efectuar el suministro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Infracciones y sanciones tributarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Artículo 8. &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;En todo lo que hace referencia a infracciones y sanciones tributarias, sus distintas calificaciones, así como en las sanciones que a las mismas correspondan en su caso y su acción investigadora, se aplicarán las normas de Régimen Local vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Disposición adicional 1ª.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Se considerará que un abonado tiene un consumo excesivo como consecuencia de una avería cuando éste supere en un 40% el correspondiente al mismo período del año anterior siempre que persistan las mismas condiciones de utilización del edificio o del vivienda o, en su defecto, el consumo medio de los dos bimestres anteriores en el momento de la avería.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En este caso, y si éste fuera causa de una avería en la red de distribución interior del edificio, la facturación de todo el consumo se realizará de acuerdo con los siguientes apartados:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a. Al consumo equivalente al considerado como normal de acuerdo con lo establecido en el primer párrafo, se le aplicará la tarifa vigente en cada momento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b. Al consumo que resulte de restar al consumo total el resultado de aplicar el apartado anterior, se le aplicará la tarifa correspondiente al primer bloque de la tarifa vigente en cada momento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c. Para la aplicación de este sistema será necesario que la entidad suministradora certifique, previa inspección, la realidad de la avería. Una vez comprobada, el abonado deberá acreditar su reparación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;d. En el supuesto caso de averías continuadas, este sistema sólo será de aplicación para aquellas averías que se produzcan pasados doce meses después de la que dio lugar a la aplicación de lo establecido en los apartados anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e. En caso de que la avería afecte al consumo de más de un período de facturación (bimestre), sólo se aplicará la tarifa reducida, como máximo, a dos períodos de facturación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Disposición adicional 2ª&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El suministro de agua potable de esa mancomunitat está destinado exclusivamente al consumo humano y animal. No está permitido utilizarla para regar. Se considerará que una vivienda (calculada para 4 personas) tiene un consumo excesivo, cuando en un período de facturación (bimestre) el consumo de agua sea superior a 100 m3.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En las explotaciones agrícolas, en los establecimientos dedicados a agroturismo, turismo rural, viviendas vacacionales y viviendas donde estén empadronadas más de 4 personas, este consumo será proporcional al número de personas, plazas turísticas o animales que estén registradas o empadronadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En caso de que durante dos períodos de facturación consecutivos, o tres períodos no consecutivos, un abonado tenga un consumo que supere el límite antes mencionado, según sus circunstancias, se le sustituirá el contador por un contador con un caudal limitado de 12,5 m3 mensuales por persona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Asimismo a partir de la entrada en vigor de la presente ordenanza, todos los nuevos contadores que se instalen, tanto en los nuevos abonados como aquellos que se sustituyan de los ya instalados, ya incluirán este tipo de limitador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Disposición final.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De acuerdo con lo que dispone el artículo 103 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears, esta Ordenanza entrará en vigor, una vez aprobada definitivamente por la Junta de Gobierno, en partir de la fecha en que se publique su texto íntegro en el Boletín Oficial de la Comunidad Autónoma de las Illes Balears y siempre que haya transcurrido el plazo previsto en el artículo 113 de la citada ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
