    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El batle a data 26/03/2024, inscripció 2024-1222, ha dictat el decret que seguidament es transcriu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«DECRET DE NOMENAMENT DE MEMBRES DE LA JUNTA DE GOVERN LOCAL I DELEGACIÓ DE COMPETÈNCIES A FAVOR DE LA JUNTA DE GOVERN LOCAL&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedents &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituïda la Corporació Municipal pel període 2023-2027 en el Ple de l'Ajuntament de data 17 de juny de 2023 desprès del procés electoral de les eleccions municipals de dia 28 de maig de 2023, i elegit batle de Manacor, Miquel Oliver Gomila.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vist del Decret de Batlia 2568/2023 de 23 de juny de 2023 pel qual se procedeix a la constitució dels membres de la junta de govern Local i es detallen les delegacions que es confereixen a aquest òrgan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vist el Decret 3906/2023 de 17 d'octubre de 2023 pel qual es modifiquen les delegacions conferides a la Junta de Govern Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonament de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformitat amb l'article 20.1.b) LBRL en aquest municipi és obligatòria la constitució de la Junta de Govern Local per tenir una població de dret superior a 5.000 habitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Segons disposen els articles 23.1 de la Llei 7/1985 (LBRL), 23 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears (LMRLIB); 43 i 45 del Reglament orgànic municipal i 52.1 i 2 i 53 del RD 2568/1986, de 28 de novembre, pel que s'aprova el Reglament d'organització, funcionament i règim jurídic de les entitats locals (ROF), correspon al batle el nomenament i la separació dels membres de la Junta de Govern Local d'entre els regidors de la corporació i, en el cas de Manacor, en un nombre no superior a set.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Article 53 que estableix les atribucions que corresponen a la Junta de Govern Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En exercici de la potestat d'autoorganització que l'article 4.1.a) de la Llei 7/85, de 2 d'abril, reguladora de les bases del règim local (LBRL) reconeix a aquesta Corporació, aquesta batlia, en ús de les atribucions que em confereix la legislació esmentada,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primer.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Delegar les següents competències de la batlia, no sent susceptibles de ser delegades per la Junta de Govern Local en cap altre òrgan:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Delegar la convalidació dels expedients per omissió de fiscalització corresponents a l'ajuntament i als organismes autònoms de ell depenents en els termes establerts en el RD 424/2017, de 28 d'abril, pel que es regula el règim jurídic del control intern en les entitats del Sector Públic Local i normativa concordant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'àmbit de la delegació d'aquestes atribucions ho serà en tota la seva extensió, en concordança i inclusió de les matèries connexes previstes a la legislació estatal i autonòmica. Els acords que s'adoptin per delegació, s'entendran dictats per aquesta batlia com a titular de la competència originària, a la que s'haurà de mantenir informada en tot moment de l'exercici de la delegació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En els texts dels acords adoptats per la Junta de Govern Local, en virtut d'aquesta delegació s'haurà de constar aquesta circumstància mitjançant la inclusió, en la part expositiva, del text següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Tenint en compte que l'adopció d'aquest acord és competència d'aquesta Junta de Govern Local en virtut de les delegacions efectuades per la batlia mitjançant decret…..de data…, que fou publicat en el BOIB de…..”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Tercer&lt;/strong&gt;.- Donar compte d'aquesta resolució al Ple a la propera sessió que es convoqui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Quart&lt;/strong&gt;.- Difondre el contingut d'aquesta resolució, de conformitat amb el principi de transparència, mitjançant la seva publicació actualitzada i permanent a la seu electrònica municipal, en compliment d'allò que disposen els articles 5 i ss de la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació i bon govern, així com al Butlletí Oficial de les Illes Balears».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
