2024-03-27 text/html CAIB 198910 ![CDATA[Bases que han de regir la convocatòria per a la constitució d'una borsa de treball de monitors/es de lleure, per cobrir laboralment les possibles necessitats de personal de l'Ajuntament de Sant Josep de sa Talaia]] 14232 CAIB 14224 ![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per Decret d'Alcaldia núm. 2024-1268 de data 26.03.2024, s'han aprovat les bases de la convocatòria per a la creació d'una borsa de treball de monitors/es de lleure, grup C2 CD 12, per cobrir laboral i temporalment les possibles necessitats d'aquest Ajuntament i que es transcriuen a continuació: </span></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">“BASES PROVISIÓ BORSA TREBALL MONITOR/A TEMPS LLIURE</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. </span><strong><span style="background-color:null">Objecte</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">És objecte de la present convocatòria la creació d'una borsa de treball de directors/es de temps lliure o personal equivalent, personal laboral temporal, per cobrir les possibles necessitats urgents de provisió de llocs de treball de director/a d' escoles d'estiu i altres activitats que organitza l'Ajuntament de Sant Josep de sa Talaia, mitjançant el sistema de concurs, grup classificació C2 nivell CD 14, d'acord amb l'aprovació de la fitxa descriptiva i valoració de llocs de treball temporal de «Director/a de temps lliure, Monitor/a de temps lliure i Monitor/a de temps lliure-TP», adoptada per acord plenari el 31 de març de 2022.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. </span><strong><span style="background-color:null">Requisits dels/de les aspirants</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2.1. Per prendre-hi part, les persones interessades han de complir els següents requisits:</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a. Tenir nacionalitat espanyola, sense perjudici del que disposa l'article 57 del Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'estatut bàsic de l'empleat públic.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b. Posseir la capacitat funcional per a l'acompliment de les tasques.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c. Tenir complits 16 anys i no excedir de l'edat màxima de jubilació forçosa.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d. Estar en possessió del títol oficial de graduat escolar/graduat en educació secundària obligatòria (ESO), formació professional de primer grau o equivalent.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">e. Estar en possessió de les titulacions de monitor/a de temps lliure establides (Decret 23/2018, de 6 de juliol, pel qual es desplega parcialment la Llei 10/2006, de 26 de juliol, integral de la joventut), o ser titulats d'estudis universitaris o de formació professional de grau superior relacionats amb l'educació, els esports o el lleure, o amb l'activitat específica que es dugui a terme (d'acord amb el Reglament de regulació de les activitats de lleure infantil i juvenil en l'àmbit territorial de l'illa d'Eivissa, BOIB Nº40 de 19 de març de 2011).</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el cas de titulacions obtingudes a l'estranger, s'haurà d'estar en possessió de la corresponent convalidació o de la credencial que acrediti, si és el cas, l'homologació. La titulació s'acreditarà mitjançant l'expedició dels títols corresponents per l'autoritat acadèmica competent. Aquesta mateixa autoritat podrà declarar també l'equivalència de títols.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">f. Acreditar el requisit de coneixements de llengua catalana de nivell B2, de conformitat amb el Decret 11/2017, de 24 de març, d'exigència del coneixement de la llengua catalana en els procediments selectius d'accés a la funció pública i per ocupar llocs de treball de l'Administració de la Comunitat Autònoma de les Illes Balears. </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els coneixements de llengua catalana s'han d'acreditar mitjançant l'aportació d'un certificat corresponent a un nivell igual o superior al que exigeix el Decret 11/2017, expedit o reconegut com a equivalent o que estigui homologat per la Direcció General de Política Lingüística, o bé expedit per l'Escola Balear d'Administració Pública.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">g. Haver satisfet la taxa de 15,00 €. El pagament dels drets d'examen es realitzarà exclusivament per Internet, a l'apartat pagament en línia de tributs (autoliquidacions) del web www.santjosep.org dins el termini de presentació de les sol·licituds. El pagament dels drets d'examen no suposa en cap cas el tràmit de presentació de la sol·licitud a l'Administració dins del termini establert. No correspon la devolució de l'import íntegre satisfet en concepte de taxa per drets d'examen, en els supòsits d'exclusió de les proves selectives per causes imputables als interessats. No obstant això, es procedirà a la devolució de la taxa quan, per causes no imputables al subjecte passiu, l'activitat tècnica o administrativa que constitueixen el fet imposable de la taxa no es realitzi. D'acord amb el previst a l'article 18.5 de la Llei 66/97, de 30 de desembre, de mesures tributàries i administratives, queden exemptes del pagament de la taxa de drets d'examen les persones amb discapacitat igual o superior al 33%. En aquest cas s'haurà d'acreditar la discapacitat amb el corresponent certificat. La falta de justificació del pagament íntegre dels drets d'examen, en el termini de presentació de sol·licituds, determinarà l'exclusió definitiva de l'aspirant.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">h. No haver estat separat mitjançant expedient disciplinari del servei de qualsevol de les administracions públiques o dels òrgans constitucionals o estatutaris de les comunitats autònomes, ni trobar-se en inhabilitació absoluta o especial per a ocupacions o càrrecs públics per resolució judicial, per a l'accés al cos o escala de funcionari, o per exercir funcions similars a les que es desenvolupen en el cas de personal laboral, en què hagués estat separat o inhabilitat. En el cas de ser nacional d'un altre estat, no trobar-se inhabilitat o en situació equivalent ni haver estat sotmès a sanció disciplinària o equivalent que impedeixi, en el seu estat, en els mateixos termes, l'accés a l'ocupació pública.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Amb caràcter previ a la presa de possessió, l'interessat ha de manifestar que no desenvolupa cap lloc o activitat en el sector públic dels que delimita la Llei 53/84, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques, i que no percep pensió de jubilació, retir o orfandat. Si realitza cap activitat privada, inclosa la de caràcter professional, ho haurà de declarar en el termini de deu dies naturals comptats a partir del dia de la presa de possessió, per tal que la corporació acordi la declaració de compatibilitat o incompatibilitat.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">i. Amb caràcter previ a la presa de possessió, l'</span><strong><span style="background-color:null">interessat ha d'aportar el certificat negatiu del Registre Central de Delinqüents Sexuals</span></strong><span style="background-color:null"> que acrediti que no ha estat condemnat per sentència ferma per cap delicte contra la llibertat i la indemnitat sexual, ni per tràfic d'ésser humans (article 13.5 de la LO 1/1996, de 15 de gener, modificada per la Llei 26/2015 de 28 de juliol, de modificació del sistema de protecció a la infància i l'adolescència). </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2.2. Els/les aspirants han de reunir els requisits establerts en aquestes bases a la finalització del termini de presentació de sol·licituds i mantenir-los durant tot el procés selectiu. En aquest sentit, es podran efectuar les comprovacions oportunes durant tot el procés. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2.3. De conformitat amb el que disposa l'article 22.2 del Reial decret legislatiu 1/2013, de 29 de novembre, que aprova el text refós de la Llei general de drets de les persones amb discapacitat, en l'àmbit de l'ocupació, les condicions bàsiques d'accessibilitat i no-discriminació a què es refereix el capítol V seran d'aplicació amb caràcter supletori respecte al que preveu la legislació laboral. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. </span><strong><span style="background-color:null">Presentació de sol·licituds </span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les sol·licituds per a prendre part en el procés selectiu es presentaran, dins el termini de DEU (10) DIES HÀBILS, comptadors a partir del dia següent de la publicació de la convocatòria en el BOIB. La resta dels anuncis relacionats amb la convocatòria es publicaran únicament en el tauler d'anuncis de la seu electrònica del web de l'Ajuntament.</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Amb certificat digital, a la seu electrònica: http://santjosep.sedelectronica.es / catàleg de tràmits / instancia general + pujar fitxer (escanejats).</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Sense certificat digital, a través de la resta de formes previstes a l'article 16 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Sol·licitar participar en la convocatòria de borsa de monitors/es de temps lliure 2024 i adjuntar la documentació que s'assenyala a continuació:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Model de sol·licitud firmat i datat (annex I). </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Fotocòpia del document nacional d'identitat en vigor. En cas de no posseir nacionalitat espanyola, d'acord amb l'article 57 del Reial decret legislatiu 5/2015, fotocòpia del document oficial acreditatiu de la persona.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Títols exigits a les lletres </span><em><span style="background-color:null">d)</span></em><span style="background-color:null"> i </span><em><span style="background-color:null">e)</span></em><span style="background-color:null"> de la base anterior o certificat acadèmic que acrediti que té cursats i aprovats els estudis necessaris per a l'obtenció del títol corresponent, juntament amb el document que acrediti que ha abonat els drets per a l'expedició, si és el cas.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Fotocòpia del justificant d'autoliquidació de 15,00 € per la taxa de participació.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Fotocòpia del certificat de coneixements de llengua catalana exigit a la lletra </span><em><span style="background-color:null">f)</span></em><span style="background-color:null"> de la base anterior (nivell B2). </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. Annex II (autobaremació). </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7. Fotocòpia dels documents acreditatius dels mèrits, d'acord amb el barem establert en el punt 6 i indicat a l'annex II d'autobaremació. L'òrgan de selecció no valorarà els mèrits que no s'acreditin juntament amb la instància de sol·licitud i estiguin indicats a l'annex II d'autobaremació per participar en el procés selectiu.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones aspirants han de conservar una còpia segellada i registrada de la sol·licitud, per si els fos requerida en cap moment. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La presentació de la instància implica, als efectes de la Llei orgànica 15/1999, de 13 de desembre, de protecció de dades de caràcter personal, el consentiment dels afectats perquè l'Ajuntament de Sant Josep la utilitzi per a la gestió, i és obligatòria la formalització. Es disposa, en tot cas, dels drets d'accés, rectificació, cancel·lació i oposició en els termes previstos a la legislació vigent i és responsable del fitxer l'Ajuntament de Sant Josep de sa Talaia. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Tota la documentació que es presenta en llengua estrangera ha d'anar acompanyada de la corresponent traducció jurada a la llengua catalana o a la castellana.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La participació en aquesta convocatòria comporta l'acceptació de les presents bases.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. </span><strong><span style="background-color:null">Admissió dels aspirants</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4.1. Finalitzat el període de presentació de sol·licituds, la llista provisional d'admesos i exclosos al procés selectiu es publicarà en el tauler d'anuncis de la seu electrònica del web municipal, amb expressió del document nacional d'identitat dels aspirants admesos i exclosos i, en el seu cas, de la causa de la no-admissió.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Amb la finalitat d'evitar errors i, si se'n produeixen, possibilitar-ne l'esmena dins el termini i en la forma escaient, les persones interessades han de comprovar no només que no figuren a la relació de persones excloses sinó que, a més, els números de DNI consten a la relació pertinent de persones admeses.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Als efectes de l'establert a la present base, s'entenen com a causes d'exclusió no esmenables:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La realització del pagament de la taxa fora del termini de presentació d'instàncies.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La presentació de la sol·licitud fora de termini.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La falta de compliment de qualsevol requisit de participació el darrer dia del termini de presentació d'instàncies.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Qualsevol altre que resulti de la normativa aplicable o del que prevegin les bases específiques de cada convocatòria.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La resolució indicarà també el lloc, data i hora de realització de la prova específica de català per als aspirants que no hagin acreditat documentalment la titulació requerida. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4.</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Per als aspirants que no hagin acreditat documentalment, dins el termini de presentació de sol·licituds, els coneixements corresponents de llengua catalana, es farà un prova específica que servirà per acreditar-los, el resultat de la qual serà </span><em><span style="background-color:null">apte</span></em><span style="background-color:null"> o </span><em><span style="background-color:null">no apte</span></em><span style="background-color:null">. La qualificació de no apte implicarà l'eliminació de l'aspirant.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el cas que algun dels aspirants obtingui el nivell exigit una vegada exhaurit el termini de presentació de sol·licituds, s'haurà de presentar en el lloc i en la data assenyalats per a la realització de la prova específica de català per tal d'acreditar-lo mitjançant l'aportació d'algun dels títols o certificats previstos en aquesta base. En tot cas, la comissió tècnica designada per avaluar aquesta prova decidirà sobre l'admissió dels certificats que aportin els aspirants.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4.</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Per esmenar el possible defecte, acompanyar els documents que siguin preceptius o presentar reclamacions, es disposarà d'un termini de TRES (3) DIES HÀBILS, a comptar des del dia següent de la publicació de la llista provisional d'admesos i exclosos en el procés selectiu en el tauler d'anuncis de la seu electrònica del web municipal. Aquesta esmena no és aplicable als mèrits al·legats però no aportats. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones sol·licitants que dins el termini assenyalat no esmenin els defectes justificant el dret a ser admeses seran definitivament excloses del procés selectiu.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4.</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Si es presenten reclamacions, seran estimades o desestimades mitjançant la resolució que aprovi la llista definitiva. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La resolució definitiva indicarà els membres del tribunal qualificador, el lloc, la data i l'hora d'inici del procés selectiu del concurs de mèrits. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4.</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Els errors de fet poden ser esmenats en qualsevol moment, d'ofici o a petició de la persona interessada. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. </span><strong><span style="background-color:null">Tribunal qualificador</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. L'òrgan de selecció estarà constituït per un president, dos vocals, els suplents i un secretari/ària amb veu però sense vot. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els membres han d'estar en possessió d'una titulació acadèmica de nivell igual o superior a l'exigit a les persones aspirants. La meitat de les persones, com a mínim, de les que són membres de l'òrgan de selecció, han de posseir una titulació corresponent a la mateixa àrea de coneixements que l'exigida a les persones aspirants.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.</span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. L'òrgan no pot constituir-se ni actuar sense l'assistència de més de la meitat dels membres, titulars o suplents indistintament, ni sense president/a ni secretari/ària, i les decisions s'han d'adoptar per majoria.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.3. L'òrgan de selecció quedarà facultat per interpretar aquestes bases, resoldre els dubtes i incidències que es plantegin i per prendre els acords necessaris per assegurar el correcte desenvolupament de la convocatòria aprovada en tot el que no estigui previst a les bases.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.4. L'òrgan de selecció pot disposar la incorporació a les seves tasques d'assessors o especialistes.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.5. Els membres de l'òrgan de selecció han d'abstenir-se d'intervenir, i ho notificaran a l'autoritat convocant, quan concorri alguna de les circumstàncies previstes a l'article 23 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.6. Així mateix, els aspirants podran recusar els membres de l'òrgan quan es doni alguna de les circumstàncies esmentades en el paràgraf anterior, d'acord amb el que preveu l'article 24 de la Llei 40/2015, d'1 d'octubre.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5.7. Conclosa la valoració del procés selectiu, l'òrgan de selecció ha de fer públic en el tauler d'anuncis de l'Ajuntament i en el tauler d'anuncis del web municipal una llista provisional de les puntuacions obtingudes per les persones aspirants, amb indicació del número del document nacional d'identitat. Hi figurarà la puntuació obtinguda a la fase de concurs. Aquesta s'ha de publicar per ordre de major a menor puntuació total. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7.2. Ordre de prelació. En cas d'empat, s'ha de resoldre tenint en compte, successivament, els criteris establerts a l'article 4.4 del Reglament de funcionament de borsins de personal de l'Ajuntament de Sant Josep de sa Talaia (BOIB núm. 64, de 21/06/2016).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7.3. Les persones aspirants disposen d'un termini de TRES (3) DIES HÀBILS, comptadors a partir de l'endemà de la publicació de la llista en el tauler d'anuncis municipal, en el del web i en el de la seu digital, per al·legar les rectificacions pertinents sobre la valoració provisional del procés selectiu. En cas contrari, s'entendrà elevada a definitiva. L'òrgan de selecció ha d'elevar la llista definitiva a la Presidència de la corporació per a la constitució mitjançant decret de la borsa de treball. Aquesta es publicarà en el tauler d'anuncis de la corporació, en el del web municipal i en el de la seu digital.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. </span><strong><span style="background-color:null">Forma de contractació</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8.1. La contractació de les places de la borsa de treball estarà sempre condicionada, per una banda, al nombre d'infants matriculats a l'escola d'estiu i altres activitats infantils, de forma que només es procedirà a contractar el nombre de monitors/res necessàries d'acord amb el nombre de matrícules, i sempre d'acord amb el que estableix el Decret 23/2018, de 6 de juliol, pel qual es desplega parcialment la Llei 10/2006, de 26 de juliol, integral de la joventut, en especial en allò referit a l'article 48.3 del mateix.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8.2. Per ordre de prelació, seran contractats com a MONITOR/A DE TEMPS LLIURE per a l'escola d'estiu, per un termini que normalment comprèn de l'última setmana de juny al 31 de juliol, prorrogable un mes més d'acord amb el nombre d'inscripcions. Igualment, l'ordre de prelació serà el condicionant per a la contractació per a la resta d'activitats de temps lliure dels diferents departament que hi treballin. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8.3. El tipus de contracte, que estarà condicionat a l'existència de crèdit, i serà d'àmbit laboral per obra o servei, podrà ser a temps complet o a temps parcial, depenent de la necessitat laboral. De la mateixa manera, l'ordre de la present borsa regirà el torn de trucada. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8.4.
