&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Per Resolució de la Presidència de l'Institut Mallorquí d'Afers Socials (IMAS), de data 30 de novembre de 2022 (BOIB núm. 157, de 3 de desembre de 2022), es varen aprovar la convocatòria, les bases i el barem de mèrits del procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a les escales, subescales, classes i especialitats dels subgrups C1, C2 i AP de les places de l'oferta pública extraordinària per a l'any 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En sessió celebrada dia 14 de novembre de 2023, el Tribunal Qualificador, després d'haver revisat l'ordre de preferència dels llocs oferts de les persones aspirants i atenent l'ordre de puntuació establert a la llista definitiva de baremació de mèrits, va acordar aprovar la llista definitiva de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a l'escala d'administració general, subescales, classes i especialitats del subgrup C1 de l'IMAS, corresponent a l'oferta extraordinària per a l'any 2022, i va proposar el seu nomenament com a personal funcionari de carrera de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Per Resolució de la Presidència de l'IMAS de data 24 de novembre de 2023, es va aprovar la llista definitiva de les persones aspirants que varen superar el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari de l'escala d'Administració general, subescala administrativa, classe administratiu-administrativa, subgrup C1, corresponent a l'oferta extraordinària per a l'any 2022 (Annex I de la Resolució). Així mateix, es va nomenar personal funcionari de carrera a les persones que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a l'escala d'administració general, subescales, classes i especialitats del subgrup C1 de l'IMAS (Annex II de la Resolució). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; En sessió celebrada el 19 de febrer de 2024, el Tribunal Qualificador va acordar excloure de la convocatòria a la senyora Maria Mercedes Comas Barrigon, per no complir amb el requisit establert a la base 5.1.b) i excedir de l'edat de jubilació forçosa, d'acord amb la base 6.7. A conseqüència de l'exclusió d'aquesta aspirant, va acordar modificar la llista definitiva de les persones aspirants que havien superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari de l'escala d'administració general, subescala administrativa, classe administratiu-administrativa del subgrup C1, incorporant a la següent persona aspirant segons l'odre de prelació definitiu de la convocatòria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;El Tribunal Qualificador, en sessió celebrada l'11 de març de 2024, tenint en compte els errors materials detectats a les puntuacions obtingudes a la llista definitiva de mèrits, acorda modificar aquesta llista, la qual es publica el mateix dia al tauler d'anuncis electrònic de l'IMAS, i que afecta a l'ordre de prelació de les persones aspirants i a la llista definitiva de les persones que han superat el procés selectiu d'estabilització per a l'ingrés com a personal funcionari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Atès la modificació de la llista definitiva de mèrits, en data 29 de febrer de 2024 es va donar tràmit d'audiència a les persones afectades per presentar les al·legacions que consideressin pertinents. Així doncs, efectuat el tràmit d'audiència, les persones afectades varen presentar instància en la qual manifestaven que no realitzarien al·legacions ni aportarien nous documents o justificacions i donaven per realitzat el tràmit d'audiència. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;En sessió celebrada el 14 de març de 2024, el Tribunal Qualificador acorda modificar la llista definitiva de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari de l'escala d'Administració general, subescala administrativa, classe administratiu-administrativa, subgrup C1. A més, proposa deixar sense efectes el nomenament de la senyora Maria Joaquina Martínez Castillo com a personal funcionari de carrera de l'escala d'Administració general, subescala administrativa, classe administratiu-administrativa, subgrup C1 de la Resolució de la Presidència de l'IMAS de data 24 de novembre de 2023. També proposa deixar sense efectes el nomenament de la senyora Joana Aina Serra Caimari a l'IMAS, atès que se li assigna un lloc de treball de les places ofertades pel CIM. Finalment, proposa el nomenament de personal funcionari de carrera de l'escala d'Administració general, subescala administrativa, classe administratiu-administrativa, subgrup C1 de l'IMAS, de les persones aspirants Maria José Espias Garcia i Maria Magdalena Nadal Rossello.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Per Resolució de la Presidència de l'IMAS de data 15 de març de 2024 es va modificar la Resolució de la Presidència de l'IMAS del 24 de novembre de 2023, en qual disposa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Modificar l'Annex I de la Resolució de la Presidència de l'IMAS de data 24 de novembre de 2023, per la qual s'aprova la llista definitiva de les persones aspirants que han superat el procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari de l'escala d'Administració general, subescala administrativa, classe administratiu/iva del subgrup C1, corresponent a l'oferta extraordinària per a l'any 2022. S'adjunta l'Annex I modificat a aquesta Resolució. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La Resolució de la Presidència de l'IMAS, de data 30 de novembre de 2022 (BOIB núm. 157, de 3 de desembre de 2022), per la qual es varen aprovar la convocatòria, les bases i el barem de mèrits del procés selectiu d'estabilització pel sistema de concurs excepcional per a l'ingrés com a personal funcionari a les escales, subescales, classes i especialitats dels subgrups C1, C2 i AP de les places de l'oferta pública extraordinària per a l'any 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La base 5.1 de l'Annex II de la convocatòria estableix que per tenir la condició d'aspirant i ser admeses al procès selectiu que es convoca, les persones interessades han de complir en la data d'acabament del termini de presentació de sol·licituds d'aquesta convocatòria i durant el procès selectiu els requisits establerts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La base 5.4 de l'Annex II de la convocatòria estableix que les persones aspirants han de complir els requisits exigits el dia d'acabament del termini de presentació de sol·licituds d'aquesta convocatòria, i han de mantenir-los fins al moment de la presa de possessió com a funcionari de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; La base 8.8.1 de l'Annex II de la convocatòria indica que, per garantir la cobertura real de tots els llocs oferts per l'IMAS i del Consell de Mallorca, s'oferiran els llocs vacants a la següent persona aspirant disponible en la llista definitiva de valoració de mèrits on es produeixi la vacant, segons la preferència d'elecció de llocs i l'ordre de puntuació establert a la llista definitiva de valoració de mèrits, tant si aquesta vacant es produeix per renúncia o per altres motius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; D'acord amb la base 9.1 de l'Annex II de la convocatòria i l'article 52.3 de la Llei 3/2007, de 27 de març, de la funció pública de la comunitat autònoma de les Illes Balears, en concordança amb l'article 61.8 del Reial decret legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut bàsic de l'empleat públic (TREBEP), la llista de persones que han superat el procés selectiu ha de contenir, com a màxim, tantes persones aprovades com el nombre de places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La Presidència de l'IMAS es l'òrgan competent per resoldre els procediments de selecció i nomenar el personal funcionari de carrera, d'acord amb allò que es preveu en l'article 7.2.14) del text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials, aprovats pel Ple del Consell de Mallorca de dia 11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la publicació de la present Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
