    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 12&amp;nbsp;de març&amp;nbsp;de 2024, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185),&amp;nbsp;en data 22 de juny de 2016, (BOIB núm. 81) i en data 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2.Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de BODEGAS RIBAS SAT, entre d'altres,&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;que figuren en l'annex de la Resolució de concessió, RES-&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de data &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;10&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;novembre&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 2022, (BOIB núm. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;157&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;desembre&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 2022) amb les dades i els imports corresponents&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;(amb un import concedit de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;13&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;525&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;,49€).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins el termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la manera i els terminis determinats en la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova el següent:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;a) Que el remolc adquirit marca BELLON de 3,5 TN, per un import de 7.285,00 euros (sense IVA), del proveïdor «AGRO BELLÓN, S.L. », és un model i marca diferent al remolc concedit (marca GILI de 3 TN), &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;per un import de 5.800,0&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;0&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;euros (sense IVA), del proveïdor RIBOT 24 FPM, S.L., atès aquest canvi, &amp;nbsp;es van sol·licitar 2 pressuposts alternatius en el document de notificació de deficiències ND08, publicat a la web de FOGAIBA i notificat a l'interessat via sms el dia 3 de novembre de 2023; per emetre l'Informe de moderació de costs. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;En data 7 de novembre de 2023, l'interessat va presentar per registre pressuposts de remolcs amb diferents característiques (tonatge) que el que va comprar, impossibilitant la moderació de costs. La delegació comarcal comunica al beneficiari perquè torni a esmenar i presentar els pressuposts. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;En data 16 de febrer de 2024, l'interessat presenta per registre els mateixos pressuposts de dia 7 de novembre de 2023, en els qual ha afegit la inscripció 3,5 TN al document en pdf, es comprova que els models que s'indican al pressuposts són en realitat de 3 TN i 5 TN respectivament. Per la qual cosa, es considera que no ha esmenat les deficiències.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;b) Que la factura del proveïdor TUBOSA BALEAR. S.L. nº 211639/1 no és elegible perquè no coincideix amb el concepte concedit.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;c) Que a la factura del proveïdor &amp;nbsp;TUBOSA BALEAR. S.L nº 211577/1 és elegible l'import de 8.315,01€, la resta (2.972,82€) no és elegible perquè no coincideix amb el concepte concedit.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;5. D'acord amb l'apartat novè de la Resolució de convocatòria abans esmentada, referent a subvencions per a inversions en les explotacions agrícoles en els casos en els quals es produeixin desviacions entre la inversió realitzada i l'aprovada, s'ajustarà l'ajuda total concedida a l'import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre que s'acostin de manera significativa al compliment total dels objectius prevists i suposin almenys un 50 % d'execució de la quantitat total d'inversió aprovada a la resolució de concessió inicial.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Aquest ajustament es farà aplicant el percentatge de subvenció que pertoqui a la inversió total justificada. No es reduirà l'import de la subvenció concedida sempre que la inversió executada sigui igual o superior a la màxima auxiliable. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;6. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;7. Revocar parcialment l'ajuda concedida al beneficiari, mitjançant la Resolució del vicepresident en matèria agrària del FOGAIBA de 10&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;novembre&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 2022, per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença i acaba amb&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;BODEGAS RIBAS, SAT&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;, que suma un import total de 2.703,84&amp;nbsp;euros, relativa a la línia d'ajuda “Inversions en les explotacions agràries”, ja que l'import elegible de la despesa és inferior a l'aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;2. Notificar aquesta resolució al beneficiari mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
