&lt;p style="text-align:left"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANTECEDENTS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.-Vista la sol·licitud de llicència urbanística presentada pel Sr. Guillem Crespí Sastre en representació de la Congregació Germanes Franciscanes Filles de la Misericòrdia 2018-E-RC-8529. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- Vist que mitjançant Decret de Batlia de data 7 de juliol de 2020, s'acordà procedir a l'Aprovació Inicial de la de conformitat als informes favorables tant de l'arquitecte municipal de data 4/06/2020, com de l'enginyer municipal de data 9/06/2020, on s'estableixen una sèrie de prescripcions a tenir en compte per a la realització de les instal·lacions de la dotació de serveis sol·licitada; així mateix també consta l'informe jurídic favorable de lletrat assessor de la Corporació de data 3/07/2020 en el qual es justifica la no aplicació al supòsit actual del Decret Llei 9/2020 de 25 de maig, de mesures urgents de protecció del territori de les Illes Balears, BOIB núm. 92 de data 25/5/2020. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- Vist que en el termini d'exposició pública s'han formulat dues al·legacions que son resoltes en els informes emesos per l'arquitecte municipal de data 14/12/2020 i en el informe de jurídic favorable de lletrat assessor de la Corporació de data 17/12/2020, en els mateixos queda palès que aquestes no afecten substancialment al contingut general del projecte. Ambdós informes son favorables a l'Aprovació Definitiva del projecte de reparcel·lació, urbanització i dotació de serveis que ens ocupa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- Vist que mitjançant Decret de Batlia de data 22/12/2020, s'acordà procedir a l'Aprovació Definitiva el projecte de reparcel·lació, urbanització i dotació de serveis dels terrenys situats entre els carrers Rei Joan Carles I, Príncep, Hort de Gaieta i Ronda Sud del municipi de sa Pobla, acord que es publicà al BOIB núm. 33 de 9 de març de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;FONAMENTS DE DRET &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- Són aplicables els articles 75.6 i 78.4 de la Llei 12/2017, de 29 de desembre, d'urbanisme de les Illes Balears. Igualment són aplicables els articles 122.3.b) i 161 del Reglament general per a Mallorca aprovat pel Ple del CIM el 29 de març de 2023 (BOIB 52 de 22 d'abril de 2024). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- La competència per a l'adopció d'aquest acord correspon a l'Alcalde d'acord amb els articles 21.1.j), 22.2 i 70 ter de la Llei 7/1985, de 2 d'abril, Reguladora de les bases de règim local de conformitat amb l'anterior,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMER.- Conforme l'establert als articles 122.3.b) del&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Reglament general per a Mallorca aprovat pel Ple del CIM el 29 de març de 2023&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;, realitzar l'exposició pública de l'escriptura de reparcel·lació voluntària durant el termini d'un mes, &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;dels terrenys situats entre els carrers Rei Joan Carles I, Príncep, Hort de Gaieta i Ronda Sud del municipi de sa Pobla atorgada davant el Notari de Pollença, el senyor Gonzalo Navarro Navarro De Palencia, en data 30/11/2023 baix el número del seu protocol 2.149, i posterior escriptura de ratificació, feta en data 20/12/2023 baix el número del seu protocol 2.367.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGON.- SOTMETRE&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; l'escriptura de reparcel·lació i ratificació a &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;informació pública durant el termini d'UN MES&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;, mitjançant anuncis que es publicaran en el BOIB i a la seu electrònica de l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCER.- PUBLICAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;aquest acord en el butlletí oficial de les Illes Balears, d'acord amb el previst a l'article 122.3.d) del Reglament general per a Mallorca aprovat pel Ple del CIM el 29 de març de 2023 (BOIB 52 de 22 d'abril de 2024) i en el punt d'accés electrònic municipal.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;QUART.- NOTIFICAR&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;la present resolució als propietaris dels terrenys de forma personal amb indicació dels recursos pertinents, perquè en el termini esmentat, puguin examinar l'expedient a la Secretaria General d'aquest Ajuntament (Àrea d'urbanisme) i formular les al·legacions i/o suggeriments que estimin oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La qual cosa es fa pública als efectes oportuns.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquest acord, que es refereix a una disposició administrativa de caràcter general, es pot interposar recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos a comptar de l'endemà de la notificació o la publicació al Butlletí Oficial de les Illes Balears, de conformitat amb el que preveuen l'article 112.3 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú i de les administracions públiques, i els articles 10, 25 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, sens perjudici que els particulars puguin interposar qualsevol altre recurs que considerin procedent, i de la possibilitat que tenen altres administracions públiques de formular el requeriment previ que preveu l'article 44 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. En el cas de formular requeriment, aquest s'entendrà rebutjat si, dins el mes següent a la recepció, no és contestat. En aquest supòsit, el termini de dos mesos per a la interposició del recurs contenciós administratiu es comptarà de l'endemà del dia en què es rebi la comunicació de l'acord exprés o del dia en què s'entengui rebutjat presumptament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
