2024-02-22 CAIB CAIB text/html 2024-02-21 683468 ca 1030 CAIB ca 8536 2024-02-22 ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En data 11 de desembre de 2023 el Ple de l'Ajuntament de Santanyí va aprovar inicialment les modificacions al III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí, i atès que durant el tràmit d'exposició pública no s'han presentat reclamacions ni suggeriments, l'aprovació inicial de la modificació ha esdevingut a definitiva en els termes següents:</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Introducció de l'article 30 bis</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> del III Pacte sobre les condicions de treball dels empleats públics al</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> </span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif">servei de l'Ajuntament de Santanyí:</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>«REDUCCIÓ DE JORNADA PER AL PERSONAL FUNCIONARI DE CARRERA I LABORAL FIX DE MÉS DE CINQUANTA-NOU ANYS</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El personal funcionari de carrera i personal laboral fix té dret a sol·licitar una reducció de jornada de fins al 50% de la jornada laboral, amb la reducció proporcional de retribucions, a partir dels cinquanta-nou anys d'edat sense necessitat d'acreditar cap altra circumstància.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el cas del personal funcionari de carrera i personal laboral fix amb cinquanta-nou anys d'edat i més de 10 anys d'antiguitat reconeguda a l'Ajuntament de Santanyí, aquesta reducció comporta la reducció proporcional de retribucions que pertoqui, incrementada en 20 punts percentuals amb un màxim del 100% de retribucions».</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.<span style="color:#000000"> Actualització de l'article 32. RETRIBUCIONS COMPLEMENTÀRIES, apartat E) del III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí, i que queda redactat de la següent manera:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«E) GRATIFICACIONS PER SERVEIS EXTRAORDINARIS</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Respondran a serveis extraordinaris realitzats fora de la jornada normal de treball.</span> No poden ser fixes en la quantia ni periòdiques en la meritació. El preu de l'hora realitzada fora de la jornada normal de treball es calcula mitjançant la fórmula següent: total retribucions anuals dividit entre 1.647 hores anuals més el 75%.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si les hores es fan en festiu o diumenge o nocturn, s'incrementaran en un 125%, sobre el preu normal de l'hora, (75% + 50% d'hora nocturna, festiu o diumenge), considerant hores nocturnes aquelles que es facin a partir de les 22 hores fins a les 6 hores. En el cas de la Policia Local, ateses les característiques de la seva jornada de treball, no és aplicable l'increment per nocturnitat exposat en aquest paràgraf.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el cas de la Policia Local, es remuneraran, únicament amb la fórmula del 125% (sobre l'hora normal), els tres torns següents:</span></p> <ol> <li style="margin-left: 40px;"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El que comenci a les 22 h. del dia anterior al diumenge o festiu i acabi a les 6 h. del diumenge o festiu.</span></li> <li style="margin-left: 40px;"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El que comenci a les 6 h. i acabi a les 14 h. del diumenge o festiu.</span></li> <li style="margin-left: 40px;"><span style="font-family:Times New Roman,Times,serif; font-size:12px">I el que comenci a les 14 h. i acabi a les 22 h. del diumenge o festiu.</span></li> </ol> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En els serveis extraordinaris realitzats que no coincideixin amb treballs específics del lloc de treball concret, com ara trasllat de taules i cadires en revetlles o muntatge d'escenaris en festes, el preu de l'hora extraordinària queda fixat en 23,00 euros i 30,00 euros segons el paràgraf anterior. La primera hora no és fraccionable i, a partir de la segona, el preu es farà en fraccions de 30 minuts. La fixació d'aquesta quantitat unitària es fonamenta que per a la realització d'aquests treballs no es requereix una quantificació especial.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per part del Departament corresponent es donarà compte trimestralment als Delegats de Personal de la relació d'hores extraordinàries al personal que representin».</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.<span style="color:#000000"> Introducció de l'article 32 bis al capítol V del III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«<strong>Article 32 bis. Bestretes a compte</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Els empleats públics de l'Ajuntament de Santanyí tindran dret a percebre, com a bestreta, i quan ho necessiti per atendre qualsevol necessitat, l'import de fins a dues mensualitats de retribucions líquides.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquestes bestretes no meritaran gens d'interès i hauran de reintegrar-se en deu mensualitats, si es tracta d'una paga, o en dotze si es tracta de dues pagues, ja sigui en terminis mensuals, trimestrals o semestrals, a voluntat de la persona interessada.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La concessió es farà mitjançant sol·licitud prèvia de la persona interessada indicant la quantia sol·licitada i formulant el compromís de devolució amb expressió dels terminis de reintegrament. La bestreta serà abonada en el termini màxim d'un mes després de rebuda la sol·licitud.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el supòsit que, concedida la bestreta, la persona beneficiària deixàs de prestar serveis a l'Ajuntament de Santanyí o volgués sol·licitar excedència de qualsevol classe, haurà de tornar íntegrament la quantitat que resti per a l'amortització total de la bestreta, quantitat que podrà deduir-se de la liquidació corresponent.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No podrà concedir-se una altra bestreta fins que no s'hagui amortitzat íntegrament l'anterior».</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Actualització del contingut de l'Article 41. Ajudes mèdiques, sanitàries i assistencials del III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">41.3 Les quantitats de les ajudes s'incrementaran anualment segons l'IPC sempre i quan aquest sigui positiu; en cas contrari, es mantindran les quanties de l'exercici anterior.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">41.4 L'Ajuntament de Santanyí destinarà amb caràcter anual 35.500 euros (segons el Pressupost de 2023) per fer front a aquestes ajudes «segons l'IPC» i el Pressupost de la Corporació destinat a això s'incrementarà conforme el que s'incrementin les ajudes.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">41.5 Les ajudes estipulades es satisfaran sempre i quan ho sol·liciti la persona interessada, amb la presentació de la corresponent factura original en un termini màxim d'un any, a comptar des de la seva emissió</span><span style="color:#202124">.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquestes ajudes no s'abonaran en el cas de la seva cobertura per qualsevol assegurança de caràcter públic o privat que tingui concertat, en el seu cas, l'Ajuntament, a excepció d'extracció i/o radiografia.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">41.6 Per cobrar el 100% de les ajudes s'haurà d'haver treballat un any ininterrompudament en aquest Ajuntament des de la darrera contractació o nomenament. En cas contrari, es percebrà la part proporcional en funció del temps treballat i en relació amb la data de la factura.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">41.7 Aquestes ajudes només són aplicables als empleats públics d'aquest ajuntament a jornada completa, així com als seus beneficiaris, entenent-se com a tals el cònjuge o persona assimilada, fills/es o acollits/des de fet, pares/mares o germans/es sempre que en depenguin econòmicament i no estiguin emparats per un altre règim de la seguretat social. Introducció de</span><span style="color:#000000; font-family:&quot;Times New Roman&quot;,Times,serif"> l'article 45. bis del III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>«Article 45 bis</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els membres de la Junta de Personal i Comitè d'Empresa, com a representants del personal, disposaran en l'exercici de la seva funció representativa d'un crèdit horari de 176 hores en còmput anual.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'estableix la possibilitat que cada organització sindical acumuli, prèvia cessió, el crèdit horari de les persones representants del personal (membres de la Junta de Personal i Comitè d'Empresa) que a ella pertanyin. Així, cada organització sindical podrà constituir una borsa d'hores, de caràcter anual, conformada pel total dels crèdits horaris cedits i que podrà utilitzar en la forma que més convingui al compliment dels seus fins.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El gaudi del crèdit horari sindical està subjecte als següents condicionants:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Comunicació amb l'antelació suficient per garantir la correcte prestació del servei.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Màxim 3 dies consecutius.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Justificació de les labors sindicals realitzades.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les reunions convocades per l'Administració a les quals assisteixin les persones representants del personal no suposaran minoració del crèdit horari establert».</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Modificació de l'Annex IV del<span style="color:#000000"> III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí amb caràcter retroactiu a l'u de gener de dos mil vint-i-tres, i que queda redactat de la següent manera:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«<strong>COMPLEMENT D'INCAPACITAT TEMPORAL</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Durant la situació de<strong> pròrroga</strong> de sis mesos d'incapacitat temporal, regulada a l'article 128 del Reial Decret Legislatiu 1/1994, de 24 de juny, pel qual s'aprova el Text Refós de la Llei de la Seguretat Social, l'Ajuntament<strong> complementarà el subsidi d'incapacitat temporal que correspongui fins al 100% del salari de l'empleat públic</strong>.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Es garantirà el 100% de totes les prestacions recollides a la Llei General de la Seguretat Social mentre siguin empleats públics d'aquest Ajuntament».</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Introducció de l'Annex VI del<span style="color:#000000"> III Pacte sobre les condicions de treball dels empleats públics al servei de l'Ajuntament de Santanyí:</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«<strong>INDISPOSICIONS QUE NO DONIN LLOC A UNA SITUACIÓ D'INCAPACITAT TEMPORAL</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>1. OBJECTE</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquest Acord té per objecte la regulació de les situacions d'absència per una indisposició que no doni lloc a una situació d'incapacitat temporal dels empleats públics al servei de l'Ajuntament de Santanyí.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>2. CONDICIONS GENERALS</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Indisposicions sense comunicat de baixa:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Les indisposicions sense comunicat de baixa per Incapacitat Temporal, fins a 4 dies dins l'any natural dels quals 3 podran ser consecutius, no produiran cap descompte en nòmina, sempre que es justifiquin en els termes establerts a l'article 3 del present acord.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>3. TRACTAMENT DEL PERMÍS</strong></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.1. El tractament de les indisposicions establertes a l'article anterior es durà a terme de la següent manera:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Indisposicions establertes a l'article 2 (fins a 4 dies dins l'any natural dels quals 3 podran ser consecutius sense descompte en nòmina): la persona afectada haurà de sol·licitar el permís a través del programa informàtic de fitxatge, utilitzant el tipus de permís «Indisposicions sense comunicat de baixa».</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.2.
