    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que el Ple de l'Ajuntament de Sóller, en sessió extraordinària de dia 24 de febrer de 2023, va aprovar inicialment la modificació &lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt;l Reglament&lt;/span&gt; &lt;span style="color:#000000"&gt;municipal regulador de la utilització d'armes autoritzades el dia del Firó&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Atès que en data 2 de març de 2023 es va publicar l'esmentat acord al BOIB núm. 27, per a la seva exposició pública durant trenta dies hàbils, i havent transcorregut aquest termini sense presentar-se reclamacions, la modificació es considera aprovada definitivament sense necessitat d'acord exprés del Ple, i per tant es procedeix a la publicació íntegra del seu text:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Des de la creació del primer Reglament regulador de la utilització de trabucs i escopetes el dia del Firó en la nostra localitat, festa emblemàtica i popular del nostre poble, hi ha hagut una modificació en les normes que regulen les armes i explosius que habitualment s'utilitzen en aquest dia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La voluntat de la creació d'aquell reglament era l'aplicació d'unes mesures que tenien per objecte prevenir els accidents i l'ús irracional de les armes de foc, prèviament estudiades i debatudes amb els grups afectats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquest objectiu s'ha de mantenir, actualitzar i adaptar a les normes i lleis que actualment afecten i, especialment al Reial Decret 137/1993, de 29 de gener pel qual s'aprova el Reglament d'Armes, Reial Decret 989/2015, de 30 d'octubre, pel qual s'aprova el Reglament d'articles pirotècnics i cartutxeria, Reial Decret 130/2017, de 24 de febrer, pel qual s'aprova el Reglament d'Explosius, així com tota normativa sectorial que reguli els aspectes d'aquest reglament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Capítol II: Escopeters, en l'actualitat a causa de les modificacions en el Reglament d'armes estatal que no autoritza la sortida d'aquest tipus d'armes, quedarà eliminat, no obstant amb la nova redacció quedarà oberta la possibilitat de retornar a la seva utilització en cas de modificació de la norma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per la qual cosa, previ els informes administratius favorables, l'Ajuntament de Sóller acorda aprovar amb caràcter normatiu d'obligat compliment, el present Reglament Regulador de les Armes Autoritzades el dia del Firó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTOL I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;ARMES AUTORITZADES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article primer&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Armes Autoritzades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les armes d'avantcàrrega tipus trabucs i espingardes, propietat o no de l'Ajuntament de Sóller, sempre que presentin la documentació legalment establerta, d'acord amb la normativa pertinent i que en el seu cas s'incorpori a la tramitació corresponent, podran ser utilitzades el dia del Firó. El nombre d'autoritzacions serà determinat per l'Ajuntament de Sóller o l'entitat organitzadora autoritzada per aquest Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També podran ser incorporades aquelles armes que determini l'Ajuntament de Sóller o l'entitat organitzadora autoritzada per aquest Ajuntament, previ els requisits que consideri, d'acord amb la normativa aplicable i les autoritzacions sectorials corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els porteadors, porteadors-tiradors o tiradors de les armes autoritzades hauran de ser veïns o nascuts a Sóller, Fornalutx o Deià; circumstàncies a justificar documentalment mitjançant la reglamentària certificació municipal o registral corresponent. Els veïns de Sóller, no serà necessària la certificació, es comprovarà d'ofici.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article segon&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Requisits dels porteador. Porteador-tirador. Tirador&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per l'ús de les armes autoritzades s'haurà de complir amb els requisits exigits pel Reglament d'Armes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el cas d'armes d'avantcàrrega, també s'haurà de comptar amb l'acreditació de la formació específica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article tercer&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Edat&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les persones autoritzades hauran de tenir, almenys, divuit anys el Dia del Firó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article quart&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Cens i identificació&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les armes autoritzades quedaran registrades a l'Ajuntament de Sóller a l'efecte de ser comptabilitzades i es procedirà a la tramitació a la Delegació del Govern en les Illes Balears per a la seva autorització.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La persona portadora de l'arma haurà de dur la identificació facilitada per l'Ajuntament de Sóller, per si fos requerida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTOL II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;NORMES DE COMPORTAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article cinquè.-&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els participants hauran d'assumir el compromís, per escrit, de complir les normes de comportament següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Utilitzar una càrrega de pólvora per tirada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Actuar en conjunt, no podent abandonar el grup, per cap concepte, sense autorització del cap de grup i raons motivades en cas d'armes d'avantcàrrega o les que determini l'Ajuntament de Sóller o l'entitat organitzadora autoritzada per aquest Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Emprar la pólvora o munició autoritzada, entregada o reconeguda per l'Ajuntament de Sóller o l'entitat organitzadora autoritzada per aquest Ajuntament. Per cap concepte podran fer ús d'altra munició.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Portar sempre la identificació lliurada per l'organització per a les armes autoritzades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No entrar dins domicilis particulars, bars, cafès o locals públics amb les armes carregades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vegada carregades les armes, disparar a l'aire, preveient que no hi hagi cap balcó, fanal o elements aeris als quals es puguin causar danys.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda prohibit apuntar, per cap concepte, a cap persona, encara que les armes estiguin descarregades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Complir l'horari d'utilització de les armes, petards i altres explosius autoritzats, que serà des de les 14:30 hores fins després del cant de la Balanguera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Complir les indicacions dels responsables de l'Organització, en relació amb els actes de la festa i, si s'escau, de la Policia Local, Guàrdia Civil o altres forces de seguretat autoritzades, en relació amb les seves competències.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Complir les normes de trànsit i, en general, qualsevol normativa d'obligat compliment.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Respectar sempre i mai menysprear a les autoritats, agents de l'autoritat, participants en la festa i ciutadans en general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Utilitzar solament els petards i altres explosius que els col·lectius entregaran als seus membres. En cas contrari, podran ser requisats i sancionats els qui els portin, si aquells no estan dins el marc previst per la llei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article sisè&lt;/strong&gt;.- Els participants en les modalitats de trabucaires, espingardes i altres modalitats que es puguin crear, seguiran en tot rigor les normes internes dels col·lectius que participen al Firó, d'acord amb l'organitzadora de la Festa 11 de Maig.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;CAPÍTOL IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;RÈGIM SANCIONADOR&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Article setè&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;Règim sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Preventivament, a instàncies de l'Ajuntament de Sóller i/o en exercici de les seves competències, la Policia, Guàrdia Civil i/o força de seguretat actuant, per evitar mals majors, podrà intervenir l'arma en el supòsit de gamberrisme, incompliment de les normes reguladores d'aquest Reglament, excés d'alcohol, i altres que puguin constituir una amenaça a la seguretat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Sense perjudici de la responsabilitat penal, civil o administrativa que puguin incórrer els participants per una conducta imprudent o per l'incompliment d'aquest Reglament, l'Ajuntament de Sóller podrà, prèvia tramitació d'expedient sancionador motivat, acordar la no participació en la festa d'aquells, des d'un a tres anys.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Els participants seran responsables dels seus actes, responent, segons pertoqui, penalment, civilment o administrativament de les seves accions o omissions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La utilització de les armes de foc fora de l'horari establert i la participació en la festa amb arma de foc sense la corresponent autorització l'Ajuntament de Sóller o l'entitat organitzadora autoritzada per aquest Ajuntament, es considerarà com un ús indegut d'aquelles, denunciable davant l'autoritat competent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DISPOSICIÓ DEROGATÒRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Queda derogat el Reglament Regulador de la Utilització de Trabucs i Escopetes el dia del Firó.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;DISPOSICIÓ FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La present ordenança, que consta de set articles i una Disposició derogatòria i una final, entrarà en vigor, una vegada aprovada definitivament per l'Ajuntament de Sóller i publicitat el seu text íntegre en el «BOIB».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
