    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de setembre de 2015 per la qual es convoquen, subvencions per a la creació d'empreses de joves agricultors, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 &amp;nbsp;d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 17&amp;nbsp;de gener&amp;nbsp;de 2024, va signar la següent resolució,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. El 15 de setembre de 2015, es va publicar al Butlletí Oficial de les Illes Balears (BOIB) núm. 136 la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de &amp;nbsp;10 de setembre de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a la creació d'empreses de joves agricultors, modificada mitjançant les resolucions de data 26 d'abril de 2016 (BOIB núm. 54), en data 26 de juny de 2018 (BOIB núm. 80), en data 2 de març de 2020 (BOIB núm. 28),i en data 22 d'octubre de 2021 (BOIB núm. 146).&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. El 15 de desembre de 2020, el vicepresident en matèria agrària del FOGAIBA va dictar una Resolució de concessió d'ajudes per a creació d'empreses de joves agricultors, que es va publicar al Butlletí Oficial de les Illes Balears número 215, del 29 de desembre de 2020, en la qual hi figurava una concessió, entre d'altres, a favor de FRANCISCA MARIA LLINÁS HORRACH, amb NIF ***4370**, per un import de 50.000,00 euros, amb financiació 100% CAIB.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova el següent:&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a) L'explotació agrària de la qual és titular CRIAM SOMNIS SL de la que forma part la beneficiària, amb nº21209 ja no obté la qualificació de explotació prioritària, ja que es va denegar la seva inscripció com a tal.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b) De la seva puntuació es desprèn que obté 25 punt per titular d'explotació prioritària. &amp;nbsp;Essent el total de la puntuació obtinguda de 60 punts. Els beneficiaris que no varen obtenir dret a ajuda tenien una puntuació de 45 punts.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c) Atès el punt anterior, no manté la puntuació obtinguda a la concurrència, essent actualment de 35 punts, per la qual cosa no te dret a ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. El 2 de maig es va signar la baixa de l'explotació del Registre Insular Agrari&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. El 21 de març de 2023 es va signar la proposta provisional de revocació total sense rebre cap altre contestació fins al dia d'avui.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7. L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;8. Atès tot això, es proposa fer la revocació total a causa de l'incompliment de l'obligació de posar en marxa el pla empresarial com a màxim durant els nou mesos següents de la data de concessió de l'ajuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú&amp;nbsp;de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Proposta de resolució &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Per tot això, s'informa favorablement i propos&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Revocar l'ajuda concedida en la resolució&amp;nbsp;d&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;el vicepresident del FOGAIBA&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de dia &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;de dia 15 desembre de 2020&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;, a causa de l'incompliment total de les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;concessió de la subvenció,&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;corresponent a l'interessat assenyalat a l'annex adjunt i per l'import indicat en l'annex d'aquesta resolució.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Declarar conclòs el procediment i arxivar els expedients.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Publicar aquesta resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
