El 17 de desembre de 2022, en el BOIB núm. 164, es va publicar la Resolució del conseller de Transició Energètica, Sectors Productius i Memòria Democràtica de 12 de desembre de 2022 per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per a l'any 2023 per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a persones físiques i comunitats de propietaris dins el Programa Operatiu FEDER 2021-2027.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 8 d'agost de 2023 es va emetre <span style="color:black">la Resolució del conseller d'Empresa, Ocupació i Energia per la qual es concedeixen les subvencions per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a persones físiques i comunitats de propietaris dins el Programa Operatiu FEDER 2021-2027 (FOTOPAR 2023) (BOIB núm.115, de 19 d'agost de 2023).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Amb posterioritat, s'ha detectat un error material en l'annex de la Resolució esmentada,&nbsp; pel que es procedeix a rectificar-lo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició. Així mateix, la rectificació d'errors ha d'especificar, si escau, els efectes jurídics que se'n deriven i s'ha de notificar o publicar preceptivament quan faci referència a actes que han estat notificats o publicats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix que les administracions públiques poden rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.
