6650 6652 ![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En data 5 de febrer de 2024, el cap del Servei de la UDIT, ITV i Registre Industrial ha formulat la proposta de resolució següent:</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Fets</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Les tarifes vigents en l'any 2023 que varen percebre els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos varen ser les aprovades mitjançant la Resolució del director general de Política Industrial publicada en el </span><em><span style="background-color:null">BOIB</span></em><span style="background-color:null"> número 62, de data 3 de maig de 2023, fascicle 132, Secció III, pàg 26247, amb correcció d'errades publicada en data 13 de juny de 2023, fascicle 125, Secció III, pàg. 34837.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. L'article 8 del Decret 86/2009, d'1 de juliol, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos, estableix que és necessari actualitzar anualment aquestes tarifes.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. L'article 40 de la Llei 12/2023, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2024, estableix que les quotes fixes de les taxes de la Comunitat Autònoma de les Illes Balears establertes per normes de rang legal s'han de mantenir en la mateixa quantia vigent per a l'any 2023. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Consideracions jurídiques</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. La Llei 17/1985, d'1 de juliol, sobre objectes fabricats amb metalls preciosos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El Reial decret 197/1988, de 22 de febrer, pel qual s'aprova el Reglament de la Llei d'objectes fabricats amb metalls preciosos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. El Decret 86/2009, de 27 de novembre, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. La Llei 12/2023, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2024.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Es proposa, per tant, no incrementar les tarifes a percebre pels laboratoris en les seves tasques d'anàlisi i contrastació en relació amb les de l'any 2023.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Proposta de Resolució</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Propòs a la directora general d'Indústria i Polígons Industrials que dicti una resolució en els termes següents:</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Aprovar les tarifes que consten en l'Annex I com a tarifes a percebre pels laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2.
