    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 17&amp;nbsp;de desembre&amp;nbsp;de 2021 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponent a&amp;nbsp;l'&amp;nbsp;any 2021, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, amb&amp;nbsp;data 29&amp;nbsp;de gener&amp;nbsp;de 2024,&amp;nbsp;signa la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;1. Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de dia 26 d'octubre de 2021, per la qual es convoquen, per a l'any 2021, subvencions per a inversions a les explotacions del sector dels fruits secs, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;modificada mitjançant la resolució de 14 de desembre de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2. De conformitat amb l'apartat segon de l'esmentada modificació de Resolució, el termini de presentació de sol·licituds va acabar el dia 30/12/2021.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;3. Els òrgans gestors del Servei d'Ajudes&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;al&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, el interessat assenyalat a l'Annex adjunt no compleix amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;5. El dia 19&lt;/em&gt;&lt;em&gt;&amp;nbsp;de setembre&amp;nbsp;2023 el Servei d'Ajudes al Desenvolupament Rural ha emès el informe proposta de resolució de concessió desfavorable i proposta provisional de denegació de l'ajuda als interessats relacionats a l'annex adjunt.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;6. En data &lt;/em&gt;&lt;em&gt;19&amp;nbsp;de setembre de 2023 &amp;nbsp;es notificà, mitjançant publicació a la plana web del FOGAIBA, l'esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;7. El dia 28 de setembre de 2023, es va presentar una sol·licitud de canvi de titular i també al·legacions a la proposta de denegació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;8. Analitzades les al·legacions no es poden acceptar, ja que en el moment de la sol·licitud la persona sol·licitant havia mort, i segons el punt 3 de l'article 1732 del Codi Civil: El mandat s'acaba per mort o per concurs del mandant o del mandatari, per tant la representació no és vàlida, a més de que en el moment de la sol·licitud no estava acceptada la herència.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolució&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa desfavorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Denegar l'ajuda sol·licitada pel&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;interessat&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que figur&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nnex&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;adjunt&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ón&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;un total d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedient i que comença &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb JOSE RAMON MILLA&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, relativa a la línia d'ajudes “Inversions a les explotacions agràries”, per no complir amb algun dels requisits que s'estableixen a la convocatòria i que s'especifiquen a l'esmentat annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l 'A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;nnex adjunt.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Publicar aquesta resolució al&lt;/em&gt;&amp;nbsp;&lt;em&gt;Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l conseller d'Agricultura, Pesca i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Medi Natural&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;l' article 68.1, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
