    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ple de la Corporació, en sessió ordinària de dia 25 de gener de 2024, ha aprovat les bases reguladores per a la concessió de subvencions i ajudes econòmiques en règim de concurrència competitiva per impulsar el sector cultural local 2024, que s'insereixen a continuació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;BASES REGULADORES I CONVOCATÒRIA DE SUBVENCIONS I AJUDES ECONÒMIQUES EN RÈGIM DE CONCURRÈNCIA COMPETITIVA PER IMPULSAR EL SECTOR CULTURAL LOCAL 2024 DE L'AJUNTAMENT DE POLLENÇA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'Ajuntament de Pollença convoca la concessió en règim de concurrència competitiva de l'any 2024, d'acord amb les condicions següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.- OBJECTE DE LA CONVOCATÒRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'objectiu d'aquesta convocatòria és donar suport a la cultura local i contribuir el foment i desenvolupament en el sector cultural del municipi de Pollença pel que fa a les produccions artístiques i creatives. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Amb la finalitat de reforçar un pilar fonamental de la nostra identitat i un factor clau per al desenvolupament sociocultural de la ciutadania, aquestes subvencions i ajudes econòmiques pretenen, també, afavorir una acció conjunta entre el sector públic i el privat i ser d'utilitat tant pels projectes emergents com per aquells que compten amb una major trajectòria. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les activitats subvencionables s'han d'iniciar i desenvolupar dins el període comprès entre l'&lt;strong&gt;1 de gener de 2024 i el 31 d'octubre de 2024 &lt;/strong&gt;i s'han d'englobar dins una de les categories següents: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Arts Escèniques: teatre, dansa, música, òpera, teatre musical, performance, cabaret, recital, titelles, circ o comèdia.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Arts Plàstiques, audiovisuals i literàries: dibuix, pintura, gravat, còmic, escultura, ceràmica, orfebreria, art digital, fanart, fotografia, net.art, vídeoart i altres publicacions.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Jornades, seminaris, trobades, mostres i estudis i treballs d'investigació sobre temes relacionats amb el patrimoni, la història, la naturalesa, l'arquitectura i/o la llengua.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es cobreix, així, la competència que confereix l'article 30.26 de l'Estatut d'Autonomia de les Illes Balears, regulat per la Llei Orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.- NATURALESA DE LA CONVOCATÒRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es convoquen subvencions i ajudes econòmiques adreçades a l'atenció del sector de població dins de l'àmbit de la cultura. Tenen caràcter voluntari i eventual i no poden invocar-se com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les subvencions d'aquesta convocatòria són de caràcter voluntari, excepcional i anul·lables. Són revocables i reintegrables en qualsevol moment per les causes previstes a la Llei o en aquestes bases. No generen cap dret a l'obtenció d'altres subvencions i anys posteriors i no es poden al·legar com a precedent. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix, són compatibles amb altres subvencions i ajudes que puguin rebre les persones i entitats beneficiàries pel mateix concepte, sempre que el total rebut no superi el cost del concepte subvencionat. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El fet de rebre una ajuda o subvenció implica l'obligatorietat de dur a terme el concepte subvencionat. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.- DOTACIÓ PRESSUPOSTÀRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per aquesta finalitat existeix crèdit adequat al Pressupost general de l'Ajuntament de Pollença de l'&lt;strong&gt;exercici 2024, a l'aplicació pressupostària 330-48004 per un import de 40.000 euros.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.- PERSONES I ENTITATS BENEFICIÀRIES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podran sol·licitar les subvencions:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les persones físiques amb vocació o formació artística.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les associacions i fundacions culturals sense finalitat de lucre inscrites al registre d'entitats culturals de la Direcció General de Presidència, Cultura i Igualtat del Govern de les Illes Balears i donades d'alta al registre d'entitats locals de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les agrupacions de persones físiques o jurídiques privades i les comunitats de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat, que encara que no tinguin personalitat jurídica, puguin dur a terme les accions que es pretenen fomentar.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.- ACTIVITATS SUBVENCIONABLES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Qualsevol projecte cultural englobat dins l'àmbit de les arts escèniques –com per exemple les disciplines de teatre, dansa, música, òpera, teatre musical, performance, cabaret, recital, titelles, circ o comèdia–, de les arts plàstiques, visuals o literàries –com per exemple les disciplines de dibuix, pintura, còmic, gravat, escultura, ceràmica, orfebreria, art digital, fanart, fotografia, net.art, vídeoart o altres publicacions–, de les Jornades, seminaris, trobades, mostres i estudis i treballs d'investigació –com per exemple relacionats amb el patrimoni, la història, la naturalesa, l'arquitectura i/o la llengua– que potenciï i enriqueixi el teixit cultural del Municipi de Pollença i que es desenvolupi dins el mateix municipi durant l'&lt;strong&gt;1 de gener de 2024 i el 31 d'octubre de 2024&lt;/strong&gt;; període de que és objecte aquesta subvenció. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.- REQUISITS PER ACCEDIR A LES SUBVENCIONS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.1. Persones físiques: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No estar sotmesa a cap de les prohibicions per ser beneficiària que estableix l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar al corrent en les obligacions fiscals amb la Hisenda Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar al corrent en les obligacions fiscals de la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Destinar els fons aportats per l'Ajuntament de Pollença en activitats subvencionables contemplades a la clàusula.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Haver realitzat les activitats a dins el termini objecte d'aquesta subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Haver justificat i acreditat les activitats objecte de subvenció en anys anteriors, si és el cas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No haver rebut durant l'exercici de 2024 cap altra aportació en concepte de subvenció i/o ajuda econòmica de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.2. Associacions i fundacions:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar donada d'alta al registre d'entitats locals de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar inscrita al registre d'entitats culturals de la Direcció General de Presidència, Cultura i Igualtat del Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No estar sotmesa a cap de les prohibicions per ser beneficiària que estableix l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Destinar els fons aportats per l'Ajuntament de Pollença en activitats subvencionables contemplades a la clàusula.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Haver realitzat les activitats a dins el termini objecte d'aquesta subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Haver justificat i acreditat les activitats objecte de subvenció en anys anteriors, si és el cas.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No haver rebut durant l'exercici de 2024 cap altra aportació en concepte de subvenció i/o ajuda econòmica de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.- CRITERIS OBJECTIUS D'ATORGAMENT DE LA SUBVENCIÓ I QUANTIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La concessió de les subvencions d'aquesta convocatòria es regeix pels principis de publicitat, concurrència, objectivitat, igualtat i no-discriminació. Així mateix, es farà mitjançant règim de concurrència competitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La subvenció s'atorgarà en funció de la puntuació obtinguda per cada projecte presentat per les persones físics, a les associacions i a les fundacions concurrents.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per determinar el valor unitari del punt, es dividirà la quantitat destinada per la totalitat de punts obtinguts entre totes les persones físiques, les associacions i les fundacions que han sol·licitat subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Criteris de distribució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es realitzarà la repartició proporcional dels 40.000 euros a cada projecte presentat, segons la puntuació obtinguda. A partir d'aquí, s'aplicarà el següent procediment:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La subvenció s'atorgarà en funció de la puntuació obtinguda per cada persona física, associació o fundació. Per determinar el valor unitari del punt, es dividirà la quantitat destinada per la totalitat de punts obtinguts entre totes les persones físiques, associacions i fundacions que hagin sol·licitat la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'import de la subvenció serà la multiplicació del preu per punt pel total de punts obtinguts per a cada projecte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Si de l'aplicació del segon punt resulta que l'import obtingut supera el 100% de la sol·licitud presentada, aquest romanent passarà a una borsa comuna. La quantia d'aquesta borsa comuna es repartirà entre es persones físiques, associacions i fundacions que del resultat de la puntuació no puguin percebre el 100% del que han sol·licitat. El repartiment es realitzarà seguint les mateixes passes establertes des del punt primer, tot tenint en compte que en aquest cas la dotació econòmica serà la quantia de la borsa comuna de romanent. Aquesta fórmula es durà a terme fins que s'exhaureixi el pressupost de l'actual convocatòria o que tots els projectes rebin el 100% de la subvenció sol·licitada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8.- TRAMITACIÓ, PRESENTACIÓ I TERMINI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8.1. Tramitació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L' Ajuntament de Pollença facilita l'únic model de sol·licituds per aquesta convocatòria. (S'adjunta annex).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el cas d'associacions o fundacions, la presentació de les sol·licituds es farà únicament de forma telemàtica a la Seu Electrònica de l'Ajuntament de Pollença (https://ajpollenca.sedelectronica.es/info.0) i hauran d'anar adreçades a la Batlia Presidència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La presentació de la sol·licitud i de la documentació adjunta també es pot fer en les formes previstes a l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les empreses que estan obligades a relacionar-se amb les administracions públiques a través de mitjans electrònics han de presentar la sol·licitud de forma telemàtica a la seu electrònica de l'Ajuntament de Pollença (https://ajpollenca.sedelectronica.es/info.0), en la qual hi ha disponible la informació de la convocatòria i el model de sol·licitud, així com les publicacions de la resolució de les ajudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'acord amb l'article 14 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estan obligats a presentar la documentació a través de mitjans electrònics els subjectes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;10.- PROCEDIMENT DE CONCESSIÓ. INICI, INSTRUCCIÓ I RESOLUCIÓ&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.1. Inici&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les bases i l'inici del procediment de concessió de subvencions es produeix d'ofici i el Ple de l'Ajuntament serà l'òrgan encarregat de la seva aprovació. Les bases seran publicades al BOIB, a la Base de Dades Nacional de Subvencions BDNS, al tauler d'anuncis de l'Ajuntament i al web www.ajpollenca.net, per tal que es puguin presentar les sol·licituds durant el termini establert a la base vuitena.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.2. Instrucció&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'òrgan instructor del procediment de concessió correspon a la Regidoria de Cultura que ha de dur a terme les actuacions a què es refereix l'article 24 de la Llei 38/2003 General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una Comissió Avaluadora es reunirà per examinar si els beneficiaris compleixen tots els requisits necessaris per accedir a les subvencions i avaluar les sol·licituds conforme als criteris de valoració establerts en aquestes Bases. De tot l'actuat en aquesta reunió s'aixecarà acta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comissió Avaluadora estarà integrada pels següents membre:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Secretari: Personal propi de l'Ajuntament adscrit a l'àrea de cultura ó biblioteques i arxiu municipal&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vocal: Tècnica de Cultura&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comissió Tècnica Avaluadora quedarà constituïda legalment amb l'assistència de tots els membre de la Comissió o els seus substituts si n'escau.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'òrgan instructor, a la vista de l'expedient i de l'acta de la reunió de la Comissió, formularà proposta de resolució provisional, degudament motivada, que es publicarà a la web de l'Ajuntament, obrint-se un termini de 10 dies per presentar al·legacions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si no es presenten al·legacions dins del termini concedit, la proposta de resolució formulada tindrà el caràcter de definitiva. En altre cas, una vegada examinades al·legacions presentades pels interessats, l'òrgan instructor formularà proposta de resolució definitiva, que haurà d'expressar el sol·licitant o la relació de sol·licitants pels que es proposa la concessió de la subvenció, la seva quantia, especificant la seva avaluació i els criteris de valoració seguits per efectuar-la.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La proposta de resolució definitiva es publicarà a la web de l'Ajuntament atorgant als beneficiaris un termini de 10 dies perquè comuniquin la seva acceptació. S'entendrà acceptada si dins d'aquest termini no s'expressa el contrari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.3. Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La competència per resoldre el procediment i concedir la subvenció s'atribueix a la Junta de Govern Local, que dictarà aquesta resolució un cop dictada la proposta de resolució definitiva i emès informe de fiscalització per la Intervenció Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolució es notificarà a tots els sol·licitants i es publicarà a la web de l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;11.- ABONAMENT I JUSTIFICACIÓ DE DESPESES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament de les subvencions o ajudes econòmiques es farà com a norma general, prèvia la justificació per part del sol·licitant de la quantitat subvencionada segons la proposta de resolució definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les persones beneficiàries resten obligats a justificar les despeses efectuades amb càrrec a subvenció o ajuda econòmica concedida dintre l'exercici econòmic al qual s'hagi concedit i les despeses justificades han de ser de l'esmentat termini (1 de gener de 2024 i 31 d'octubre de 2024) i presentades dins el termini corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El termini per a justificar la subvenció finalitzarà dia 12 de novembre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La documentació acreditativa per justificar les despeses serà:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Imprès normalitzat facilitat per l'Ajuntament de Pollença, de certificació bancària pel cobrament de la subvenció (&lt;strong&gt;Imprès 4.&lt;/strong&gt; Certificat bancari) i segellat per l'entitat bancària&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Memòria de l'actuació justificativa del compliment de les condicions imposades en la concessió de la subvenció, amb la descripció del projecte cultural, els objectius que s'han assolit, els resultats obtinguts, la temporalització, els mitjans de difusió utilitzats, l'avaluació i qualsevol altre aspecte que es consideri adient&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Memòria econòmica justificativa del cost del projecte cultural, que contindrà (&lt;strong&gt;Imprès 7&lt;/strong&gt;. Compte justificatiu):&lt;/span&gt;&lt;/span&gt;
	&lt;ul&gt;
		&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una relació classificada de les despeses i inversions de l'activitat, amb identificació del creditor i del document, l'import, data d'emissió i, si escau, data de pagament. Si la subvenció s'atorga d'acord a un pressupost, s'indicaran les desviacions esdevingudes.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les factures o documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa incorporats en la relació referida en el paràgraf anterior i, si escau, la documentació acreditativa del pagament pel valor de la quantitat subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
		&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una relació detallada d'altres ingressos o subvencions que hagin finançat l'activitat subvencionada assenyalant-ne l'import i la procedència.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;/ul&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les despeses s'han de justificar amb factures i altres documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa, en original i còpia per compulsar. Si s'han de retornar les factures o justificants originals, a petició de l'entitat subvencionada, s'hi ha de reflectir amb un segell la data de concessió de la subvenció així com l'import del justificant que s'imputa a la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les factures originals, acreditatives de la despesa subvencionada, expedides a nom de les persones físiques o a les entitats subvencionades i amb el seu NIF, han d'expressar clarament:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Data d'emissió, que haurà de correspondre al període comprés entre 1 de gener de 2024 i 31 d'octubre de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dades fiscals (Nom, domicili, NIF, etc.) de l'entitat emissora i de l'entitat pagadora&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Número de la factura.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Concepte detallat pel qual s'expedeix, que haurà de ser suficientment clar&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Import, desglossant la part que correspon a IVA, si procedeix. Si l'operació està exempta d'IVA s'ha d'esmentar a la factura&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si l'entitat beneficiària únicament disposa de la factura o document justificatiu que acredita la despesa rebuda per correu electrònic, s'admetrà sempre que a la impressió de la factura s'adjunti un certificat signat pel representant legal de l'entitat en que manifesti la impossibilitat o dificultat greu per obtenir el document original i declari que la factura ni s'ha utilitzat ni s'utilitzarà per justificar cap altre subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No es podrà efectuar cap pagament si no s'acredita de manera fefaent, fet que es farà constar per escrit juntament amb la presentació dels justificants d'haver realitzat la totalitat de la despesa que figuri en el pressupost de despeses que acompanyi la sol·licitud de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la despesa justificada és inferior a l'import del pressupost sol·licitat i subvencionat, es procedirà a la reducció proporcional de la subvenció o ajuda econòmica concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'import de les subvencions o ajudes econòmiques concedides en cap cas podrà ésser de tal quantia que, aïlladament o en concurrència amb altres subvencions o ajudes econòmiques d'altres Administracions Públiques o d'entitats privades, superi el cost de l'activitat a desenvolupar per la persona física o entitat beneficiària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es procedirà al reintegrament de les quantitats percebudes en els següents casos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Obtenció de la subvenció falsejant les condicions requerides o ocultant aquelles circumstàncies que ho haguessin impedit&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Incompliment total o parcial de l'objectiu de l'activitat&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Incompliment de l'obligació de justificació o la justificació insuficient&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resistència, excusa, obstrucció o negativa a les actuacions de comprovació i control financer, o la concurrència de subvencions, ajudes, ingressos o recursos per a la mateixa finalitat, procedents de qualsevol administració o ens públic o privat, nacional, de la Unió Europea o de organismes internacionals&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'incompliment de les obligacions imposades per l'Administració a les entitats col·laboradores i beneficiaris, així com dels compromisos per aquests assumits, amb motiu de la concessió de la subvenció, sempre que afectin o se refereixin al mode en que s'han d'aconseguir els objectius, realitzar l'activitat, executat el projecte o adoptar el comportament que fonament la concessió de la subvenció&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;strong&gt;12.- PROCEDIMENT DE GESTIÓ PRESSUPOSTÀRIA&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'aprovació de la despesa s'haurà d'efectuar amb caràcter previ a la convocatòria de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolució de la concessió de la subvenció comportarà el compromís de despesa corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament de la subvenció es realitzarà després que el beneficiari hagi justificat les despeses subvencionades, i s'hagi certificat pels serveis tècnics de l'àrea de Cultura envers la realització de l'activitat i compliment de la finalitat que va determinar la concessió de la subvenció d'acord amb l'article 32 de la Llei 38/2003, de 17 de novembre, General de Subvencions i 88 del RD 887/2006, de 21 de juliol, pel qual s'aprova el Reglament General de Subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pagament de les subvencions o ajudes econòmiques es farà, com a norma general, després que el sol·licitant hagi justificat les despeses subvencionades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;13.- OBLIGACIONS DE LES PERSONES I ENTITATS BENEFICIÀRIES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Seran obligacions mínimes de les persones i entitats beneficiàries de les subvencions:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dur a terme i acreditar l'activitat objecte de la subvenció d'acord amb les condicions establertes&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Comunicar a l'Ajuntament de Pollença les modificacions que s'hagin produït i que siguin causa de la concessió o compliment de la subvenció&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Comunicar a l'Ajuntament de Pollença, en qualsevol moment, l'obtenció de subvencions o ajudes per a la mateixa finalitat i no consignades en el sol·licitud&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Constituir les garanties que siguin exigibles, en el seu cas&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Fer constar que el projecte cultural està subvencionat o patrocinat per l'Àrea de Cultura de l'Ajuntament de Pollença mitjançant la inclusió dels logotips inclosos a l'Annex 8&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sotmetre's a les actuacions de fiscalització i control de la Intervenció de l'Ajuntament de Pollença.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'Ajuntament de Pollença podrà, en qualsevol moment, auditar tan econòmica com tècnicament, el projecte objecte de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
