    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;Es fa públic que en data de 25 de gener de 2024 s'ha dictat el Decret de Batlia núm. 2024/123 (Aprovació definitiva reparcel·lació UACLL-4) que es transcriu a continuació:&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;“DECRET DE BATLIA.- Expedient 2023/315&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;.- Vist que en data de 12 de maig de 2023 (RGE. 2023/3262) el Sr. Jaime Martínez Llabrés amb DNI 43070738-H, va presentar, en nom i representació de la JUNTA DE COMPENSACIÓN UACLL-4 (V72630510), projecte de reparcel·lació per al desenvolupament del següent àmbit: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Denominació: Unitat d'Actuació 4 &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;- Situació: Carrer es Torrent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Vist que en data de 27 de juny de 2023 es va dictar Decret de Batlia núm. 2023/795 que va resoldre aprovar inicialment el projecte de reparcel·lació i sotmetre a informació pública el projecte per un termini d'un mes; vist que no s'han realitzat al·legacions durant el període indicat i vist que la JUNTA DE COMPENSACIÓN UACLL-4 ha efectuat el pagament equivalent al 15% del sòl lucratiu lliure de càrregues d'urbanització que ascendeix a 136.033,82 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Fonaments jurídics: - &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:107%"&gt;La Legislació aplicable al sistema de reparcel·lació ve determinada per:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- Els articles 78 a 82 de la Llei 12/2017, de 29 de desembre, d'Urbanisme de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- Els articles 211 a 259 de l'Acord del Ple del Consell Insular de Mallorca d'aprovació definitiva del Reglament general de la Llei 2/2014, de 25 de març, d'Ordenació i Ús del Sòl, per a l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- Els articles 71 a 130 del Reglament de Gestió Urbanística per al desenvolupament i l'aplicació de la Llei sobre règim del sòl i ordenació urbana, aprovat pel Reial decret 3288/1978, de 25 d'agost.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- Els articles 25, 26 i 34 i següents del Text refós de la Llei de sòl i rehabilitació urbana, aprovat pel Reial decret 7/2015, de 30 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- El Reglament de Valoracions de la Llei del Sòl, aprovat pel Reial Decret 1492/2011, de 24 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- Els articles 21.1.j), 22.2 i 70 ter de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;- El Reial decret 1093/1997, de 4 de juliol, pel qual s'aproven les normes complementàries al Reglament per a l'execució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Per tot l'anteriorment exposat, d'acord amb l'article 21.1.j) de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local, &lt;/span&gt;&lt;strong&gt;RESOLC&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:#202124"&gt;PRIMER.-&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; &lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:107%"&gt;Aprovar definitivament el projecte de reparcel·lació de la &amp;nbsp;UACLL-4 de Ses Salines redactat per l'arquitecte Jaime Martínez Llabrés presentat amb Registre d'Entrada 2023/3262.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;SEGON.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt; Publicar íntegrament al Butlletí Oficial de les Illes Balears la present resolució d'aprovació definitiva, al web municipal i a&lt;span style="color:#202124"&gt; un diari de major circulació a l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;TERCER.-&lt;/span&gt;&lt;/strong&gt; &lt;span style="line-height:107%"&gt;Notificar aquesta resolució als interessats i expedir un certificat d'acord amb l'establert a la legislació hipotecària per a la inscripció del projecte al Registre de la Propietat. Al certificat a més de l'acord d'aprovació definitiva es farà constar les condicions d'eficàcia i la fermesa a la via administrativa de l'aprovació definitiva del projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;QUART.-&lt;/span&gt;&lt;/strong&gt; &lt;span style="line-height:107%"&gt;Comunicar a l'òrgan competent en matèria d'Urbanisme de la Comunitat Autònoma aquesta resolució als efectes de l'article 111.2 del Reial Decret 3288/1978, de 25 d'agost.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
