    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El Consell Executiu del Consell de Mallorca, en sessió ordinària de dia 13 de desembre de 2023, ha adoptat l'Acord següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. Aprovar el Pla de patrocini publicitari esportiu de la Direcció Insular d'Esports del Departament de Medi Ambient, Medi Rural i Esports de conformitat amb el següent text:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;“PLA DE&amp;nbsp; PATROCINI PUBLICITARI ESPORTIU DE LA DIRECCIÓ INSULAR D'ESPORTS DEL CONSELL DE MALLORCA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquest Pla determina les necessitats de la Direcció Insular d'Esports del Consell de Mallorca de formalitzar contractes de patrocini publicitari i s'ha d'entendre com una fita més en la tramitació del corresponent procediment de contractació amb què pretenem garantir la correcta execució que conclourà, si escau, amb l'adjudicació i formalització del contracte de patrocini publicitari.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;1. MARC NORMATIU&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Per la formalització de contractes de patrocini publicitari s'ha de tenir en compte:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Llei 34/1988, d'11 de novembre, general de publicitat &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Article 22.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El contracte de patrocini publicitari és aquell pel qual el patrocinat, a canvi d'una ajuda econòmica per a la realització de la seva activitat esportiva, benèfica, cultural, científica o d'una altra índole, es compromet a col·laborar en la publicitat del patrocinador.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El contracte de patrocini publicitari es regeix per les normes del contracte de difusió publicitària quan li siguin aplicables.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Llei 29/2005, del 29 de desembre, de Publicitat i Comunicació Institucional.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article 3. &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Requisits de les campanyes institucionals de publicitat i comunicació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Només es podran promoure o contractar campanyes institucionals de publicitat i de comunicació quan tinguin algun dels objectius següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Promoure la difusió i el coneixement dels valors i principis constitucionals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Informar els ciutadans dels seus drets i obligacions legals, d'aspectes rellevants del funcionament de les institucions públiques i de les condicions d'accés i ús dels espais i serveis públics.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;h) Donar suport a sectors econòmics espanyols a l'exterior, promoure la comercialització de productes espanyols i atreure inversions estrangeres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;i) Difondre les llengües i el patrimoni històric i natural d'Espanya.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;j) Comunicar programes i actuacions públiques de rellevància i interès social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Les campanyes institucionals de publicitat i de comunicació es desenvoluparan exclusivament quan concorrin raons d'interès públic i en l'exercici de competències pròpies.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Les campanyes institucionals contribuiran a fomentar la igualtat entre homes i dones i respectaran la diversitat social i cultural present a la societat.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Les campanyes institucionals s'han d'ajustar sempre a les exigències derivades dels principis d'interès general, lleialtat institucional, veracitat, transparència, eficàcia, responsabilitat, eficiència i austeritat en la despesa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article 8. &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Contractes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Els contractes vinculats a les campanyes regulades per aquesta Llei s'han d'adjudicar d'acord amb la seva normativa aplicable, respectant estrictament els principis de publicitat i concurrència, i sempre atenent criteris objectius com ara el cost econòmic i l'eficàcia prevista del pla de mitjans. Aquests mateixos criteris objectius han de ser observats pels contractistes en els supòsits de subcontractació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Llei 13/2010, 9 de desembre, de publicitat institucional de les Illes Balears. &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Estan sotmesos a la llei:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c) Els consells insulars.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Article 2&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;S'entén per publicitat institucional tota activitat de comunicació emesa, promoguda, subvencionada, patrocinada o contractada, individualment o conjuntament amb altres entitats públiques o privades, pels subjectes sotmesos a la llei, que tengui per objecte difondre un missatge comú a una pluralitat de destinataris mitjançant qualsevol format, suport o mitjà, sigui o no publicitari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Article 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Objectius de la publicitat institucional&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La publicitat institucional ha de tenir algun dels objectius següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Promoure la difusió i el coneixement dels valors i principis constitucionals i estatutaris, i fomentar actituds positives i comportaments adequats dels ciutadans envers aquests principis i valors.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Donar a conèixer polítiques, programes, serveis i actuacions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Informar del contingut de les disposicions normatives i dels actes que, per la seva rellevància, ho aconsellin.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Difondre el coneixement i la imatge de la comunitat autònoma, de les entitats que la formen i de les seves institucions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Promoure el patrimoni cultural, lingüístic i natural de les Illes Balears, així com qualssevol altres tipus de béns tangibles o intangibles rellevants de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Donar suport als sectors i a les activitats econòmiques de la comunitat autònoma i promoure els productes i serveis de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Article 6&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Contractació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;1. Els contractes relatius a la publicitat institucional es regeixen per la legislació de contractes del sector públic i la resta de disposicions que els sigui d'aplicació, tot respectant els principis d'igualtat, lliure concurrència, publicitat, objectivitat, eficàcia i eficiència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Llei 2/2023, de 7 de febrer, de l'activitat física i l'esport de les Illes Balears&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Article 5. &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Finalitats&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les administracions de les Illes Balears, en el marc de les seves competències, fomentaran l'activitat física i l'esport i en tutelaran l'exercici, amb la finalitat d'aconseguir la màxima qualitat i excel·lència, i la fidelització de les persones esportistes, practicants i usuàries, així com la iniciació en l'activitat per les persones sedentàries, mitjançant la pràctica compatible amb la salut i la seguretat, d'acord amb les finalitats següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;p) Fomentar les ajudes públiques i el patrocini en l'àmbit de l'activitat física i l'esport en els termes que es determinin legalment o reglamentàriament.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;Article 9 &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Competències dels consells insulars&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Correspon a l'administració dels consells insulars, d'acord amb l'article 70.9 de l'Estatut d'Autonomia de les Illes Balears, l'exercici de les competències que determina aquesta llei en els àmbits territorials respectius, a més de les establertes en la Llei 6/1994, de 13 de desembre, d'atribució de competències als consells insulars en matèria de patrimoni històric, de promoció sociocultural, d'animació sociocultural, de dipòsit legal de llibres i d'esports,: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;a) Planificar, en col·laboració amb la resta d'administracions públiques, fomentar i executar els programes d'esport en edat escolar i d'activitat física per a totes les persones, d'acord amb els termes expressats en aquesta llei i en els reglaments que la despleguin. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;b) Promoure l'activitat física, l'exercici físic i l'esport orientat a la salut. Treballar per crear adherència a l'activitat física i esportiva a tota la societat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;c) Planificar i executar programes d'activitat física i esportiva adaptada. També executar programes que promoguin l'activitat física i esportiva entre les persones amb qualque tipus de malaltia crònica. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;n) Organitzar, regular i patrocinar competicions i manifestacions esportives i d'activitat física en l'àmbit de les seves competències insulars. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Art. 113 &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Patrocini Públic&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Les administracions esportives de les Illes Balears podran acudir al patrocini esportiu com a instrument de comunicació, difusió i associació a la imatge institucional, en relació amb esdeveniments, persones esportistes o entitats esportives que transmetin valors de l'esforç, del treball, de la companyonia i de l'esforç personal i col·lectiu, amb ple compliment a la normativa general sobre publicitat i contractació pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Llei 9/2017, de 8 de novembre, de contractes del sector públic, pel qual es trasposen a l'ordenament jurídic espanyol les Directives del Parlament Europeu i del Consell 2014/23/UE i 2014/24/UE, de 26 de febrer de 2014.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Decret de la Presidència del Consell de Mallorca de data 28 de juliol de 2023 pel qual s'estableixen les competències dels departaments del Consell Insular de Mallorca &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Atribueix al Departament de Medi Ambient, Medi Rural i Esports el planificar, ordenar, coordinar i gestionar actuacions en matèria esportiva. Desplegar una oferta general i específica de programes, serveis i recursos orientada a cobrir les necessitats esportives, així com fomentar i promoure les activitats esportives, entre d'altres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;2. CARACTERÍSTIQUES DEL CONTRACTE DE PATROCINI&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Entenem per patrocini aquell pagament, en metàl·lic o en espècie, que una empresa o entitat fa per cobrir les despeses d'un esdeveniment, en aquest cas esportiu, a canvi de diferents contraprestacions publicitàries que li resulten interessants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El contracte de patrocini publicitari té per objecte una publicitat de caràcter indirecte, que s'ha anomenat “retorn publicitari”, i que consisteix fonamentalment en el fet que el patrocinat permet que el patrocinador faci pública la seva col·laboració econòmica en l'activitat del patrocinat i també, si així s'estipula, que el patrocinat efectuï comportaments actius amb aquesta mateixa finalitat. El patrocinador, a canvi, gaudeix de la notorietat i la ressonància de l'activitat que desenvolupa el patrocinat, amb la finalitat d'incrementar entre el públic el coneixement del seu nom o marca i d'afavorir-ne la imatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El patrocini és una de les principals fonts de finançament de projectes i organitzacions a la indústria de l'esport: esdeveniments, instal·lacions, clubs, etc. Planificar-ne l'estratègia i l'activació són dues accions clau per aprofitar-ne tots els beneficis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El punt més important d'aquesta definició és la reciprocitat de la relació. Per garantir l'efectivitat dels patrocinis és essencial que tant el patrocinador com el patrocinat aportin alguns beneficis i en rebin alguns altres a canvi. Per tant, el patrocini s'ha d'entendre com una aliança de negoci entre dues parts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Aquesta figura contractual s'ha de diferenciar d'altres figures que guarden relació, però que són&amp;nbsp; diferents. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Així, el contracte de publicitat es defineix en la LGP com aquell pel qual un anunciant encarrega a una agència de publicitat, mitjançant una contraprestació l'execució de publicitat i la creació, preparació o programació de la mateixa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Per altra banda, el contracte de difusió publicitària és aquell pel qual, canvi d'una contraprestació fixada en tarifes preestablertes, un medi s'obliga en favor d'un anunciant o agència a permetre la utilització publicitària d'unitats d'espai o temps disponibles i a desenvolupar&amp;nbsp; l'activitat tècnica necessària per aconseguir el resultat publicitari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;I finalment, el contracte de creació publicitària, definit com aquell pel qual,&amp;nbsp; canvi d'una contraprestació, una persona física o jurídica s'obliga en favor de l'entitat promotora a idear i elaborar un projecte de campanya publicitària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tant, en el contracte de patrocini el patrocinador s'obliga a pagar una quantitat econòmica determinada a favor d'una altra persona o entitat a canvi d'utilitzar la seva imatge en l'exercici de les seves activitats. Destaquen les següents característiques:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;És un contracte publicitari.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Hi ha un compromís per part del patrocinat de col·laborar en la publicitat del patrocinador.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La publicitat la realitza una persona física o jurídica que es dedica a una activitat aliena a la publicitària, no un professional de la publicitat (agència publicitària, mitjà de publicitat, creatiu).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es cerca la rellevància social de l'activitat del patrocinat.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Requereix d'obligacions certes i equivalents per ambdues parts.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;És un contracte onerós, l'import de la contraprestació que ha d'abonar el Consell de Mallorca estarà en funció del valor de retorn de les accions publicitàries.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;A més a més, i de conformitat amb l'article 26 de la Llei 9/2017, de 8 de novembre, de contractes del sector públics, (LCSP) el contracte publicitari de patrocini, encara que es subscrigui per una administració pública, té consideració de contracte privat, ja que el patrocinat no és una empresa dedicada als serveis publicitaris, fet que exclou la possibilitat de considerar-lo com a contracte administratiu de serveis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Direcció Insular d'Esports vol establir una col·laboració amb diferents Clubs Esportius de Mallorca en forma de patrocini publicitari esportiu i per diferenciar-lo de la figura de la subvenció pública, hem de partir de la finalitat que persegueixen ambdues figures jurídiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En el cas del patrocini publicitari, el patrocinador no pretén el foment d'una activitat d'interès públic, sinó obtenir del patrocinat una col·laboració publicitària a canvi d'una contraprestació econòmica, que serà en funció dels impactes mediàtics i el valor de retorn publicitari que obtingui aquesta publicitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En el cas de la subvenció, el beneficiari rep una quantia econòmica sense contraprestació, subjecta a la realització de l'activitat que es pretén fomentar. El beneficiari ha de complir amb els requisits i obligacions que s'hagin establert, entre les que es troba la publicitat del finançament de l'activitat subvencionada. Aquesta publicitat queda en un nivell secundari, no essent mai la causa principal de la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;En resum, si la prestació essencial és la publicitat, s'haurà de seguir la via del contracte de patrocini publicitari. En canvi, si l'objecte principal és el foment d'una activitat d'utilitat pública, d'interès social o de promoció d'una finalitat pública, s'ha d'acudir a la via de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3. NECESSITAT DE PATROCINI PUBLICITARI &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3.1. Els valors en la normativa que regula l'activitat física i l'esport&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La Llei 2/2023, de 7 de febrer, de l'activitat física i l'Esport de les Illes Balears (LAFEIB), reconeix la funció social de l'esport i el fonamenta en una sèrie de valors:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Dimensió educativa i formativa, que propicia el desenvolupament complet i harmònic de l'ésser humà.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Contribució a l'adquisició d'hàbits saludables en les persones i la seva importància per a la millora de la salut pública de la comunitat, i per afavorir el benestar personal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Foment d'actituds i compromisos cívics, d'estrènyer llaços socials i promoure valors com la igualtat, la solidaritat, la no-violència, la tolerància i la justícia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Rellevància com a factor que contribueix a la cohesió social en una comunitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Significació com a motor de desenvolupament econòmic i del benestar col·lectiu i generador d'ocupació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Importància com a factor de coneixement i conservació, la realització d'activitats respectuoses amb el medi natural i el territori, ajudant a la sostenibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;g) Foment de l'activitat turística sostenible en els àmbits de l'activitat física i l'esport.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La mateixa LAFEIB, destaca entre els principals objectius aconseguir el millorar l'educació i el foment dels valors en la pràctica de l'activitat física i l'esport; garantir i fomentar la igualtat efectiva entre homes i dones en la pràctica de l'esport i incrementar i adequar les mesures per a la prevenció i la lluita contra la violència, el racisme, la xenofòbia i la intolerància, el consum i la venda d'alcohol, el dopatge, l'alimentació no saludable i el sedentarisme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;També la LAFEIB quan regula els Programes d'Activitat física i esport en edat escolar disposa que es fomentarà els hàbits de vida saludables i els valors de la pràctica de l'esport i que aquests programes hauran de perseguir els objectius, entre d'altres, d'afegir valors a l'activitat física i l'esport i transmetre, a tots els agents que hi intervenen, els valors de cooperació, joc net i rebuig al dopatge, a la violència, al racisme, a la xenofòbia i a la intolerància en l'activitat física i l'esport, a més d'integrar a tots els companys sense cap discriminació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per altra part, el Decret 38/2015, de 22 de maig, pel qual es regula l'activitat esportiva en edat escolar a les Illes Balears regula com a principi rector el difondre, a través de les activitats del Pla de l'Activitat Física i Esportiva per a l'Edat Escolar de les Illes Balears, els principis de joc net, el respecte i la consideració envers tothom que hi participi i el respecte a l'entorn i al medi ambient, i vetlar perquè s'elimini de l'esport en edat escolar qualsevol classe de violència, racisme, discriminació o xenofòbia que pugui manifestar-s'hi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A l'article 6 d'aquest Decret es disposa que l'esport en edat escolar ha de tenir especialment en compte la formació en valors de les persones&lt;strong&gt; &lt;/strong&gt;que el practiquen, per la qual cosa els agents que hi participen, tant les entitats esportives, amb el seu personal directiu, coordinador, tècnic i monitor, com també les famílies, han de posar esment especial en la promoció del joc net i del respecte de les normes. Igualment, s'ha de parar esment especial en el desenvolupament dels valors relacionats amb la feina en equip, la companyonia i la consideració de les persones adversàries, el respecte i la tolerància en consonància amb la integració de tothom sense discriminació per raó de sexe, oferint les mateixes oportunitats de créixer a través de l'esport sense perdre el dret a ser diferent i a la igualtat d'oportunitats a través de la integració i del reconeixement de les identitats minoritàries, ja sigui per raó de capacitats o de procedència. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A nivell nacional, la &lt;em&gt;Ley 39/2022, de 30 de diciembre, del Deporte&lt;/em&gt; determina dintre dels seus fins principals: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les polítiques públiques que l'Administració General de l'Estat formuli, dins del seu àmbit competencial, s'han de dissenyar i desenvolupar en coordinació i col·laboració amb les comunitats autònomes i complir els fins següents, d'acord amb els objectius i les metes de desenvolupament sostenible que s'hagin establert a nivell internacional:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;h) La prevenció, control i erradicació de qualsevol classe de violència, el racisme, la xenofòbia, la intolerància a l'esport, així com la discriminació i la incitació a l'odi per raó de sexe, edat, discapacitat, salut, orientació o identitat sexual , expressió de gènere, nacionalitat, origen racial o ètnic, religió o creences, o qualsevol altra condició o circumstància personal o social, així com del dopatge i qualsevol tipus d'actuació fraudulenta que pugui produir-se en l'activitat esportiva, fomentant el joc net i la col·laboració ciutadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;n) El foment de l'educació física i l'esport en totes les etapes de la vida com a part fonamental de la millora de la qualitat de vida i l'adquisició d'hàbits saludables, tant dins com fora del sistema educatiu&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A nivell internacional, i en el marc de la Unió Europea, el 24 de setembre de 1992, es va aprovar una declaració de principis ètics amb l'objectiu de complementar la Carta Europea per a l'Esport. Aquest codi d'ètica esportiva va néixer, sense pretensió de tenir efectes jurídics de caràcter obligatori, com una declaració d'intencions a favor del “joc net” com a concepte central i com emblema de l'esportivitat. Un “joc net” que ha de ser entès no només com a respecte a les regles del joc sinó com a factor inherent a la pràctica de l'esport, és a dir com a valor intrínsec exercit en totes les etapes de la vida des de la infància fins a l'edat adulta.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;També la UNESCO reconeix de manera destacable el paper dels valors i les habilitats socials recollits a l'Objectiu de Desenvolupament Sostenible (ODS) número 4, en relació a una educació de qualitat. Així ha creat una aliança educativa que pretén incorporar els valors esportius en tots els plans d'estudi escolars, comptat amb organitzacions de rellevància com l'Agència Mundial Antidopatge, el Comitè Internacional de joc Net, el Comitè Olímpic i Paralímpic Internacional i el Consell Internacional per a la Ciència i l'Educació Física &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;3.2. Foment de valors dins l'àmbit de l'esport i l'activitat física&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Com es pot comprovar, l'esport és una eina magnífica d'integració i cohesió social. La pràctica esportiva iguala als ciutadans i fomenta principis com ara l'esforç, la disciplina, la constància, la feina en equip i respecte a l'adversari; comportaments imprescindibles per poder viure en comunitat. A través de l'esport es fomenten els valors que constitueixen una societat més lliure, sana i democràtica. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;La Direcció Insular d'Esports, en l'àmbit de les seves competències, té interès a crear campanyes&amp;nbsp; que fomentin part d'aquests valors a través de l'esport.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;L'esport de base, també conegut com a esport amateur o esport formatiu, juga un paper crucial en la formació i desenvolupament d'infants i joves. A més de promoure l'activitat física i la salut, l'esport de base també té un impacte significatiu en l'adquisició de valors i habilitats socials en els participants. La comprensió que cada jugador és essencial per al èxit de l'equip i la necessitat de recolzar-se mútuament en moments difícils inculca als infants la importància del treball en equip no només en l'esport, sinó també en altres aspectes de la vida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Respecte i Joc Net: L'esport de base emfatitza la importància del respecte cap als companys, entrenadors, àrbitres i oponents. Els joves aprenen a valorar la diversitat i la inclusió, i a entendre que tothom mereix ser tractat amb cortesia i consideració. A més, el joc net es promou activament, ensenyant els infants la importància de competir de manera justa, respectuosa i honesta, sense recórrer al frau o a la violència. Aprenen el respecte per les regles i l'acceptació de la derrota.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Disciplina i Responsabilitat: La participació en l'esport de base requereix compromís i disciplina. Els joves aprenen a ser responsables de les seves accions i a complir amb horaris, regles i entrenaments. La disciplina en l'esport es pot transferir a altres àrees de la vida, com els estudis i les responsabilitats quotidianes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Perseverança i Resiliència: L'esport de base ensenya als joves a enfrontar desafiaments i a perseverar malgrat els obstacles. Aprenen a fer front a la derrota i a aixecar-se després d'un fracàs, la qual cosa els ajuda a desenvolupar resiliència i una actitud positiva davant l'adversitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Autoconfiança i Autoestima: En experimentar l'èxit i la millora personal en l'esport de base, els joves construeixen la seva autoconfiança i autoestima. Guanyar habilitats esportives i superar reptes físics els brinda una sensació d'assoliment que pot tenir un impacte positiu en la seva autoimatge i actitud cap a ells mateixos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Companyonia i Amistat: L'esport de base proporciona una oportunitat per fer amics i establir connexions significatives amb companys d'equip i entrenadors. Aquesta xarxa de suport social és beneficiosa per al benestar emocional i social dels joves, brindant-los un sentiment d'afiliació i camaraderia. Experimenten un sentit de pertinença a un grup&amp;nbsp; i es fomenten les relacions interpersonals positives.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. Formació de caràcter: La participació en esports a través de clubs ajuda a formar el caràcter dels individus. Els valors com honestedat, integritat, respecte cap els altres, la humilitat i l'esportivitat es transmeten i fomenten en l'entorn esportiu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3.3. Prevenció de problemes per la manca de valors esportius&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La manca de valors esportius pot ser un problema en diferents àmbits, des de les competicions professionals fins a l'esport aficionat. Quan parlem de la manca de valors en el context esportiu, ens referim a situacions en què els principis ètics, morals i socials que s'espera inculcar a través de la participació en activitats esportives no es reflecteixen o es perden.&amp;nbsp; Algunes de les qüestions que poden contribuir a aquesta situació inclouen:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Comportament antiesportiu d'atletes o falta d'ètica esportiva: Això pot incloure trampes, manca de joc net, insults, violència, ús de substàncies prohibides per millora el rendiment, comportament agressiu o actituds poc ètiques tant dins com fora del camp.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Manca de fair play (joc net): La manca de respecte per les regles i la manca de consideració cap als companys, entrenadors, àrbitres o oponents poden soscavar la integritat del joc i descoratjar l'esperit esportiu. El no respecte cap a les figures d'autoritat a l'esport pot generar un ambient negatiu i descoratjar la participació en general.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Èmfasi excessiu en la victòria a qualsevol cost: En alguns casos, es prioritza la victòria sobre els valors fonamentals de l'esport, cosa que pot portar a comportaments poc ètics per guanyar costi el que costi.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Manca de responsabilitat: Implica la manca de compromís, puntualitat o consistència en l'assistència a pràctiques i jocs. La manca de responsabilitat pot perjudicar no només l'individu, sinó també l'equip en conjunt.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La manca de valors a l'àmbit esportiu pot tenir conseqüències negatives tant a nivell individual com col·lectiu. A nivell individual, els esportistes podrien perdre l'oportunitat de desenvolupar habilitats fonamentals per a la vida, com ara l'ètica de treball, el respecte pels altres i la capacitat de treball en equip. A nivell col·lectiu, la manca de valors pot minar la integritat i l'esperit esportiu, afectant l'ambient i la cultura dins les activitats esportives.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per abordar aquesta problemàtica, és essencial reforçar la importància dels valors ètics i morals dins dels contextos esportius. Això s'aconsegueix a través de l'educació, l'exemple de figures d'autoritat, la promoció d'un entorn esportiu positiu i establir normes clares de comportament ètic. Els programes de formació i conscienciació sobre l'ètica esportiva tenen un paper crucial per contrarestar la manca de valors a l'àmbit esportiu.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3.4. Educació en valors&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La detecció de problemes de valors entre els joves pot ser un tema complex i multifacètic, ja que els valors són intrínsecs a la cultura, la societat i les creences individuals. Tot i això, hi ha certs problemes comuns que s'associen amb els valors dels joves en l'actualitat:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Materialisme excessiu: L'obsessió per l'adquisició de béns materials, el consumisme i la valoració de l'èxit basada únicament en possessions materials pot conduir a una manca d'estima per altres valors fonamentals.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Manca d'empatia i respecte: En alguns casos, s'observa una disminució en l'empatia i el respecte pels altres, possiblement a causa de la influència de la cultura d'Internet, la desconnexió social o l'exposició excessiva a continguts que normalitzen la manca d'empatia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Ús problemàtic de la tecnologia: L'excés en l'ús de dispositius tecnològics pot afectar els valors dels joves i disminuir la capacitat de comunicació interpersonal, la concentració i l'habilitat per relacionar-se amb el món real.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Individualisme extrem: La cultura actual sovint emfatitza l'individualisme sobre la col·laboració i la comunitat. Això pot portar a una manca de solidaritat i responsabilitat social.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Pressió social i manca d'autoestima: Els joves es poden veure influenciats per estàndards socials poc realistes, cosa que pot afectar-ne l'autoestima, portant-los a adoptar valors que no reflecteixen les seves pròpies creences.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Pèrdua de valors ètics i morals: Alguns joves poden no tenir una base sòlida en termes de valors ètics i morals a causa de la manca d'orientació o models a seguir a les seves vides.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Violència a l'esport: Les activitats i les competicions esportives també estan afectades per les situacions i els problemes que són inherents a la societat en general, com són la violència, el racisme, la xenofòbia, la intolerància, l'alcohol, les drogues i altres actituds conflictives, per la qual cosa és important i necessari establir mecanismes de prevenció i control per erradicar o limitar aquests tipus de conductes, que poden incidir en aspectes relacionats amb la seguretat i l'ordre públic.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Per això es va crear la Comissió antiviolència de les Illes Balears, al Decret 12/2019, de 28 de febrer, pel qual es regula la Comissió contra la Violència a l'Esport de les Illes Balears, la majoria de casos que es tracten son esports col·lectius com: són el futbol, bàsquet o rugby entre d'altres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Les males conductes més comuns són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Comportament antiesportiu: Això pot incloure jugadors que mostren actituds agressives, faltes intencionades, provocacions o falta de respecte cap als àrbitres, oponents o companys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Violència física: Agressions físiques entre jugadors, entrenadors o inclús fanàtics, com baralles al camp o en les grades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Discriminació i assetjament: comentaris o accions discriminatòries, com racisme, sexisme o altres tipus d'assetjament són evidències d'una mala conducta als camps i grades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Incitació a la violència: Els comentaris o accions que inciten a la violència entre jugadors o fanàtics són inacceptables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquestes són algunes de les evidències de males conductes en els camps esportius. Per això és molt important abordar aquestes qüestions per mantenir la integritat i el fair-play en l'esport.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'educació, tant a casa com a les institucions educatives i formatives, té un paper vital a abordar aquests problemes. Fomentar valors positius, promoure l'empatia, el pensament crític i l'autenticitat pot ajudar a contrarestar aquests problemes i enfortir els valors positius a la joventut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'administració pública pot tenir un paper crucial a l'hora d'abordar i corregir els problemes de valors entre els joves a través de diverses accions i programes. Entre les estratègies que es poden implementar inclouen l'educació en valors, tractant de promoure programes educatius que ensenyin i fomentin valors com l'empatia, la responsabilitat social, l'ètica i el respecte des d'una edat primerenca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Això pot passar a les escoles, en les famílies, &amp;nbsp;però també a l'esport i mitjançant campanyes de conscienciació social.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, el Consell de Mallorca, com administració competent en l'esport en edat escolar i en ús de les facultats que li atribueix la normativa vigent, vol establir campanyes de conscienciació sobre els valors que la pràctica de l'esport comporta i donar-les a conèixer a tota la població mallorquina en general, fent especial incís en els infants i joves.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;L'Administració Insular, en col·laboració amb sistemes mediàtics, creatius i gràfics, pretén establir missatges de caràcter publicitari amb els què oferir campanyes d'interès general que fomentin actituds positives i comportament adequats en l'àmbit esportiu i fora d'ell a l'hora que es treballa en la conscienciació ciutadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es considera que la via del contracte publicitari de patrocini esportiu permet al Consell de Mallorca, a banda de procurar finançament de l'activitat esportiva molt necessària per les entitats, rentabilitzar aquesta inversió econòmica en forma de publicitat de la campanya que es vol transmetre i és la manera més idònia per transmetre aquests valors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;El projecte publicitari que el Consell de Mallorca vol patrocinar haurà de promoure la campanya “&lt;strong&gt;EsportNet” &lt;/strong&gt;i&lt;strong&gt; “Amb l'esport net guanyam sempre!”&lt;/strong&gt; de la Direcció Insular d'Esports per a la temporada 2023/2024 i següents. Aquest “paraigua” promocional i de valors esportius posarà el focus en tres eixos temàtics que són la base de tots els programes de l'àrea d'Esports del Consell de Mallorca: “Som equip”, “Som inclusió” i “Som entorn”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Mitjançant aquests eixos la DIE vol treballar diferents aspectes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Facilitar pautes per a una millora de l'ambient “esportiu” entre famílies, esportistes, àrbitres i tècnics en el moment de la pràctica esportiva. Treballar la comunicació a les grades, a pistes i camps, fent valer aspectes com el respecte, la no-violència física i verbal o la comunicació positiva cap a infants i joves. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Esport Net. &lt;em&gt;Som inclusió!&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Fomentar la igualtat d'oportunitats entre els seguidors esportius a través d'eines i missatges que reforcin l'aspecte de paritat de gènere, diversitat d'orientació sexual, i també l'àmbit de l'esport adaptat, en una aposta per la inclusió.&amp;nbsp; La igualtat com a un valor positiu, d'equilibri, que permet fer un esport més social, més obert i tolerant. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;3. EsportNet.&amp;nbsp; &lt;em&gt;Som entorn!&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Fomentar la sostenibilitat als espais esportius, donant eines i pautes per millorar determinats aspectes relacionats amb la conservació d'instal·lacions, la no generació de residus, el foment del reciclatge i l'aposta per instal·lacions més sostenibles, o la cura de l'entorn en la pràctica esportiva que es fa a l'àmbit natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Els patrocinis hauran d'usar una línia argumental que englobi algun/s d'aquests eixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. REPERCUSSIÓ MEDIÀTICA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'objectiu principal del contracte patrocini és la publicitat que puguin fer aquestes entitats esportives sobre la campanya “EsportNet” i “Amb l'esport net guanyam sempre!” de la Direcció Insular d'Esports per a la temporada 2023/2024 i següents.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Necessàriament les entitats esportives han de comptar amb repercussió mediàtica a nivell local, insular o inclús autonòmic.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Si bé poden comptar també amb repercussió mediàtica nacional o internacional, no és d'obligat compliment,&amp;nbsp; atès que el públic objectiu a qui aniran adreçades les campanyes publicitàries és fonamentalment insular.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A més, les campanyes han d'anar adreçades a tots els públics, involucrant tota la societat mallorquina, especialment en els infants i joves.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta repercussió mediàtica es pot fer en diferents plataformes físiques (a títol d'exemple):&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6.1 Clubs esportius d'esports col·lectius&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Es consideren esports col·lectius&lt;u&gt;,&lt;/u&gt; segons el Reial Decret 971/2007, de 13 de juliol,&amp;nbsp; aquells en els que grups de més de dos esportistes competeixen de forma simultània en el temps, amb alternança en la possessió o domini d'un mòbil, mitjançant accions tècnic tàctiques d'atac i defensa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El rendiment i l'èxit depenen de la col·laboració i coordinació dels esportistes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Interdependència: Els resultats no depenen únicament d'un sol individu, sinó de la contribució de tots els membres de l'equip. La sinèrgia entre els jugadors és fonamental per aconseguir objectius col·lectius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Rols específics: Cada membre de l'equip sol tenir un paper específic que contribueix al funcionament general de l'equip.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Comunicació i coordinació: La comunicació entre els esportistes i la coordinació d'estratègies son vitals per l'èxit d'esports col·lectius. L'enteniment de les tàctiques i l'adaptació durant el joc són claus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;6.2 Clubs esportius d'alt nivell&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La Llei 39/2022, de 30 de desembre, de l'Esport disposa l'article 11 que l'esport d'alt nivell es considera d'interès per l'Administració General de l'Estat en tant que constitueix activitat i factor essencial de desenvolupament esportiu, suposa un estímul pel foment de l'esport base en virtut de les exigències tècniques i científiques en la seva preparació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Continua el mateix article que a més d'aquelles competicions d'alt nivell, també seran considerades d'interès públic aquelles competicions en què es promogui l'esport inclusiu, la participació de les dones a l'esport, la formació en valors i el joc net des de l'esport base, la preservació de la natura a través de l'esport o qualsevol esdeveniment esportiu que doni resposta als valors de l'esport del segle XXI que tinguin a veure amb la igualtat, participació i millora de la condició física, psíquica o emocional.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els clubs esportius d'alt nivell o d'elit, a causa de la seva prominència en l'escenari esportiu, tenen una responsabilitat única per a transmetre i fomentar aquests valors en els seus atletes i seguidors perquè ofereixen una plataforma d'excel·lència esportiva i un ambient d'alt rendiment que va més enllà de l'ensenyament tècnic i tàctic. Aquestes entitats tenen la capacitat d'influir significativament en la formació del caràcter dels esportistes. En transmetre valors com la honestitat, la integritat i la responsabilitat, ajuden els esportistes a desenvolupar una mentalitat guanyadora i a enfrontar els reptes tant dins com fora del camp de joc. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Transmetre valors esportius de manera consistent i visible no només enforteix la imatge del club, sinó que també envia un missatge positiu a la societat, destacant la importància de comportar-se de manera ètica i respectuosa, a més d'ajudar a fomentar una cultura esportiva saludable, que promou la inclusió, la diversitat i el respecte mutu, reforçant la cohesió social.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La competitivitat és inherent a l'esport d'elit, però aquesta ha d'estar acompanyada d'un esperit de fair play. La transmissió de valors esportius ajuda a promoure la idea que guanyar és important, però fer-ho de manera justa i respectuosa és essencial. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els clubs d'elit i els seus esportistes solen ser ídols i models a seguir per a moltes persones, especialment per als joves. Aquests esportistes són admirats per les seves habilitats esportives, però també per la seva conducta dins i fora del terreny de joc. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

No només s'han d'enfocar en guanyar campionats i aconseguir èxits esportius, sinó també a contribuir positivament al desenvolupament de la comunitat i els seus membres. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;6.3 Clubs esportius d'alt nivell d'esports col·lectius com mitjà idoni per transmetre valors&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Per tot això, l'esport col·lectiu d'alt nivell o d'elit mallorquí el considerem un mitjà idoni per a la materialització d'aquest tasca &lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:107%"&gt;de patrocini publicitari esportiu&lt;span style="background-color:white"&gt;. Degut a la massa social a la que arriba i a més, a tot tipus de perfils de totes les edats i nivells socials. Això fa que &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;la campanya «EsportNet» i ”Amb l'esport net guanyam sempre!” per fomentar els valors, bones conductes i hàbits saludables que el vol transmetre la Direcció Insular d'Esports arribin fàcilment i de manera més significativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Aquestes entitats esportives ens poden facilitar elements i canals de gran projecció per poder assolir els objectius de la Direcció Insular d'Esports de fer transmetre principis i valors esportius rellevants per als ciutadans de la nostra illa.&amp;nbsp; Aquest fet esdevé una necessitat clau per la Direcció Insular d'Esports i es fonamenta en els següents avantatges:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;1. Major audiència potencial&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:107%"&gt;.&amp;nbsp; Els esports col·lectius sovint tenen una audiència més àmplia i diversa, el que pot augmentar la visibilitat del missatge que volem transmetre i per tant arribar a més persones.&amp;nbsp; Tenen un major nombre de seguidors i fans ja que creen molta més afició. A part de la competició, també creen un entorn d'espectacle que acompanya a la part esportiva&amp;nbsp; i per aquest motiu són esports d'entreteniment i temps d'oci per moltes persones. Hi ha un major nombre d'assistents com a públic als partits d'esports col·lectius.&amp;nbsp; A més a més al públic&amp;nbsp; podem veure persones de totes les edats, des d'adults fins a infants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;La repercussió mediàtica també és més elevada, ja que hi ha un major interès per conèixer els resultats dels esports col·lectius que tenen un major nombre de seguidors. Per això aquests esports surten molt més a la premsa i a les televisions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2&lt;strong&gt;. Exposició continua:&lt;/strong&gt; Els equips i esdeveniments esportius col·lectius solen tenir temporades més llargues i contínues, el què proporciona una exposició sostinguda al llarg del temps. Per tant la campanya de valors que volem transmetre podrà estar en actiu més temps durant l'any.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquests esports estan organitzats en lligues professionals i no professionals, i els equips de renom solen estar televisats per televisions públiques o per plataformes privades on retransmeten els partits de les lligues. D'aquesta manera els seus missatges i campanyes poden arribar a molta més gent, que és el que ens interessa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3. Identificació amb el esperit d'equip&lt;/strong&gt;:&amp;nbsp; Els equips d'esports col·lectius poden transmetre valors com el treball en equip i la col·laboració, accions que estan alineades amb els missatge que volem transmetre. Aquests missatges són molt més visuals i es donen molt més exemples a la pràctica d'esports col·lectius.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els esports col·lectius solen promoure valors com la cooperació, s'ha de treballar en conjunt per poder obtenir un resultat. També fomenten els valors del lideratge i el respecte.&amp;nbsp; S'han de respectar les normes, les decisions d'altres companys, del àrbitre o del entrenador. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquests valors se reforcen a través de la col·laboració entren companys, el suport mutu i la competència saludable. La disciplina i el sacrifici són valors fonamentals que s'han d'aplicar en tot moment per poder arribar a un bon resultat en comú.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per poder ser adjudicatari del contracte patrocini, la Direcció Insular d'Esports estableix els següents requisits que obligatòriament han de complir les entitats esportives:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Participar en categoria absoluta masculina o femenina&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Disputar lligues regulars (mínim 10 enfrontaments o jornades) i que impliquin enfrontaments amb equips d'altres CCAA diferents a les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Les competicions o jornades que figurin en els calendaris de competicions oficials de les federacions nacionals corresponents i que aquestes contemplin més d'una categoria nacional.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Seran competicions a les quals estiguin regulades les proves classificatòries que regulin els ascensos o descensos de categoria nacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Acreditar ser l'equip de màxima categoria de la modalitat o especialitat esportiva de Mallorca i participin en qualsevol de les competicions de categoria nacional descrites a continuació: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Per determinar fins quin import econòmic es vol comprometre el Consell de Mallorca, s'han d'analitzar els impactes que tindran les diferents campanyes publicitàries realitzades per entitats esportives sobre la campanya “EsportNet” o la campanya “Amb l'esport net guanyam sempre” i quin valor de retorn tindran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;El patrocini publicitari concedit serà un import en funció de les valoracions fetes per una empresa especialitzada a partir de les valoracions econòmiques en relació al l'impacte mediàtic de cada un dels equips i dels seves lligues nacionals i&amp;nbsp;&amp;nbsp; dels punts obtinguts d'acord amb el que estableixen aquest criteris:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:11.9pt"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;7.1 Quantitat econòmica fixa:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:11.9pt"&gt;&lt;span style="background-color:white"&gt;A partir de l'estudi per mesurar i analitzar l'impacte mediàtic de diferents equips d'elit de Mallorca per a l'any 2023 i següents, s'atorgaran les quantitats econòmiques fixes, com a màxim, que es relacionaran a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 1.500.000 a 1.999.999 € un 3 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 1.000.000 a 1.499.999 € un 5 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 999.999 a 500.000 € un 7 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 499.999 a 300.000 € un 9 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 299.999 a 200.000 € un 13 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 199.999 a 100.000 € un 15 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes entre 99.999 a 50.000 € un 17 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li value="1"&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:12.95pt"&gt;&lt;span style="background-color:white"&gt;Equips amb un valor econòmic d'impactes menor de 49.999 € un 19 % del valor econòmic resultant de la valoració dels impactes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;7.2 Quantitat econòmica variable: &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;A la quantia econòmica fixa, se li afegirà una quantia variable, que s'establirà en funció dels següents ítems: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;1. Escola d'iniciació esportiva no federada.&lt;/span&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es valoraran els nins i nines inscrits formalment pel club i que hagin participat al programa JEE de la DIE durant l'any 2023 (o exercicis posteriors). 1 punt per cada 5 nins i nines inscrits i fins a un màxim de 25 punts. &lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Aquesta relació d'esportistes s'acreditarà amb un certificat emès pel tècnic esportiu comarcal del Consell de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;2. Equips federats d'esport base. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es valoraran els equips de categories de base ( 6 als 16 anys, amb les seves nomenclatures particulars de cada federació)&amp;nbsp; inscrits formalment la temporada 2023-24 (o temporades posteriors) ,a una competició oficial relacionada amb una federació esportiva inscrita en el registre oficial d'entitats esportives de la CAIB o delegació d'una federació nacional reconeguda pel CSD. 3 punts per equip i fins a un màxim de 25 punts. &lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Aquesta relació d'equips s'acreditarà amb un certificat federatiu on constin la relació d'equips i la categoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;3. Resta d'equips federats o filials.&lt;/span&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es valoraran la resta d'equips del club inscrits formalment la temporada 2023-24 (o temporades posteriors), a una competició oficial relacionada amb una federació esportiva inscrita en el registre oficial d'entitats esportives de la CAIB o delegació d'una federació nacional reconeguda pel CSD. 2 punts per equip participant a una lliga insular, 3 punts per equip participant a una lliga autonòmica i 5 punts per equip participant a una lliga nacional&amp;nbsp; i fins a un màxim de 25 punts. Aquesta relació d'equips s'acreditarà amb un certificat federatiu on constin la relació d'equips i la categoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;4. Punts addicionals per resultats esportius.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es valorarà&amp;nbsp; amb 25 punts addicionals, si el club ha aconseguit un ascens de categoria, un títol oficial durant la temporada 2022-23 (o temporades posteriors) o bé si s'ha classificat per disputar competicions internacionals per a la temporada 2023-24 (o temporades posteriors).&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;La quantia econòmica variable total a distribuir entre les entitats esportives que es patrocinaran serà l'import establert en l'aplicació pressupostària de l'exercici corresponent, descomptat els imports totals de la quantia econòmica fixa.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Per determinar l'import de la quantia variable, la Direcció Insular d'Esports pot requerir a les entitats esportives l'aportació de&amp;nbsp; la documentació necessària per la valoració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:107%"&gt;Es limitarà l'import total del patrocini al 50 % de la liquidació final de l'exercici 2022 (o exercicis posteriors) del club aprovat per l'assemblea general ordinària durant l'any 2023 (o anys posteriors). Aquesta liquidació s'acreditarà amb una copia de l'acta de l'assemblea general ordinària o bé amb un certificat del secretari del club. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;L'import del patrocini no pot ser superior al valor de mercat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;Una vegada realitzades les campanyes de publicitat, s'haurà de presentar la memòria d'actuacions juntament amb l'informe de valoració dels drets de patrocini publicitari i del valor de retorn de les accions publicitàries. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8. PROCEDIMENT DE CONTRACTACIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per arribar a la formalització del contracte de patrocini publicitari amb la Direcció Insular d'Esports del Consell de Mallorca, es seguiran els procediments establerts a la Llei 9/2017, de 8 de novembre, de contractes del sector públic, per la qual es transposen a l'ordenament jurídic espanyol les directives del Parlament Europeu i del Consell 2014/23/UE i 2014/24/UE, de 26 de febrer de 2014&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;9. VIGÈNCIA DEL PLA DE PATROCINI&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Aquest del Pla serà vigent fins el 31 de desembre de 2027, sense perjudici de poder ser prorrogat tàcitament en finalitzar fins l'aprovació del nou Pla de patrocini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Sense perjudici de la vigència assenyalada, el Consell de Mallorca podrà revisar-lo o modificar-lo abans que n'acabi el període de vigència, si així ho considera oportú.” &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="line-height:107%"&gt;2. Publicar aquest Acord en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
