&lt;p&gt;&lt;strong&gt;«Antecedents&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1.&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En data 4 d'abril de 2023, el conseller executiu de Transició, Turisme i Esports&amp;nbsp; va aprovar la convocatòria de subvencions dirigida a les associacions de famílies d'alumnes per l'organització d'activitats físiques i/o esportives extraescolars dins el curs escolar 2022/2023. L'extracte d'aquesta convocatòria es va publicar al BOIB núm. 54, de 27 d'abril de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2. La instrucció del procediment de concessió de les subvencions s'ha realitzat per la secretaria tècnica del Departament de Medi Ambient, Medi Rural i Esports, a través de la Direcció Insular d'Esports. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Els informes individuals de l'òrgan instructor determinen que els beneficiaris compleixen tots els requisits per accedir a les subvencions i han servit de base per elaborar la proposta de resolució de concessió i reconeixement d'obligacions de subvencions, per un import total de 5.439,90 €. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3. En data 31 de maig de 2023 finalitzà el termini de presentació de sol·licituds, i &amp;nbsp;presentaren sol·licitud de subvenció juntament amb la documentació justificativa un total de 13 associacions, en relació a les despeses corresponents a les actuacions realitzades. Consta a l'expedient els informes de concessió i justificació relatiu a la documentació justificativa presentada per les associacions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. L'existència de crèdit adequat i suficient queda garantit en l'aplicació pressupostària 30.34101.48901 del pressupost 2023 del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Vist l'informe jurídic favorable a la concessió i reconeixement d'obligacions a favor de diverses entitats en el marc de la convocatòria esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Atès que es sotmet l'expedient a la fiscalització prèvia de la Intervenció Delegada de la Misericòrdia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. L'Ordenança general de subvencions del Consell de Mallorca aprovada el dia 23 de desembre de 2016 (BOIB núm. 21, de 18 de febrer de 2017) i modificada per Acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost de 2018.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Llei 38/2003, de 17 de novembre, General de subvencions i el reial Decret 887/2006, de 21 de juliol, pel qual s'aprova el reglament de la Llei General de Subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La convocatòria de subvencions dirigida a les associacions de famílies d'alumnes per l'organització d'activitats físiques i/ o esportives extraescolars dins el curs escolar 2022/2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. D'acord amb el decret de Presidència del Consell de Mallorca (BOIB núm. 106, de 29 de juliol de 2023) que estableix les competències dels departaments del Consell de Mallorca, correspon al vicepresident segon i conseller executiu del Departament de Medi Ambient, Medi Rural i Esports les competències en matèria d'esport. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. L'art. 33.2 k) de la Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88, de 7 de juliol de 2022), correspon al consellers executis com a titulars dels seus departaments les atribucions de resoldre les convocatòries d'ajudes i subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. L'art. 39.2 h) del Reglament orgànic del Consell de Mallorca (BOIB núm. 89, de 19 de juliol de 2018), correspon als consellers executius i conselleres executives reconèixer i liquidar les obligacions pròpies dels serveis del departament i sol·licitar al Departament d'Hisenda que ordeni els pagaments corresponents.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per tot l'exposat, &lt;span style="color:black"&gt;la consellera executiva de Promoció Econòmica i Desenvolupament Local, per suplència del conseller executiu de Medi Ambient, Medi Rural i Esports; d'acord amb el Decret de la Presidència del Consell Insular de Mallorca de 28 de juliol de 2023 pel qual s'estableixen les suplències dels consellers executius i conselleres executives dicta la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquest acte, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada en el termini d'un mes, comptador a partir de l'endemà de rebre aquesta notificació. El recurs es pot interposar formalment davant aquest conseller executiu/consellera executiva o davant el Consell Executiu del Consell Insular de Mallorca, que és l'òrgan competent per resoldre'l.&lt;/span&gt;&lt;/p&gt;
