![CDATA[<p>La Llei 2/2016, de 30 de març, de l'impost sobre estades turístiques a les Illes Balears i de mesures d'impuls del turisme sostenible, determina en l'article 20.3 que la Comissió ha d'elaborar un pla anual d'impuls del turisme sostenible que fixi els objectius anuals prioritaris, amb criteris d'equilibri territorial.</p>
<p>El Decret 35/2016, de 23 de juny, pel qual es desplega la Llei de l'impost sobre estades turístiques i de mesures d'impuls del turisme sostenible determina en l'article 51.1 que, d'acord amb el que disposa l'article 20 de la Llei 2/2016, la Comissió ha d'elaborar un pla anual de l'impuls del turisme sostenible que fixi els objectius anuals prioritaris.</p>
<p>L'article 44 del Decret esmentat determina en el punt 2 les competències del Ple de la Comissió d'Impuls del Turisme Sostenible, i en concret la lletra <em>a)</em> disposa la competència d'aprovar, a proposta del Comitè Executiu, el Pla Anual d'Impuls del Turisme Sostenible.</p>
<p>D'acord amb el punt 3 de la disposició addicional cinquena de la Llei 5/2021, de 28 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2022, en la redacció atorgada per la disposició final quinzena del Decret llei 6/2022, de 13 de juny, de mesures urgents per reduir la temporalitat per a l'ocupació pública de les Illes Balears, en data 28 de juliol de 2022 el Ple de la Comissió d'Impuls del Turisme Sostenible va aprovar la proposta de Pla Anual 2023, a proposta del Comitè Executiu en la mateixa data.</p>
<p>En data 1 d'agost de 2022, el Consell de Govern —tot i no haver-hi una obligació legal de ratificació del Pla Anual— el va ratificar, atesa la necessitat de la seva intervenció en l'aprovació dels projectes que llavors siguin elevats pel conseller competent en matèria de Turisme conforme les propostes seleccionades per la Comissió.</p>
<p>Més endavant, en data 31 d'octubre de 2022, el Consell de Govern va aprovar la proposta de la Comissió relativa als projectes a finançar amb el Fons per afavorir el turisme sostenible corresponent al Pla anual de 2023.</p>
<p>De manera prèvia, en data 26 d'octubre de 2018, el Consell de Govern també havia aprovat els projectes a finançar amb el Fons per afavorir el turisme sostenible, corresponents al Pla Anual de 2018.</p>
<p>Per altra banda, en data 18 de desembre de 2023, el Ple de la Comissió d'Impuls del Turisme Sostenible, va aprovar una sèrie de modificacions i renúncies relatives a projectes aprovats dins el Pla anual 2023, així com una relativa a un projecte del Pla anual 2018, per tal de ser elevades al Consell de Govern per a la seva aprovació definitiva, en aplicació de l'article 35 lletra <em>c) </em>del Decret 35/2016, de 23 de juny, pel qual es desenvolupa la Llei de l'impost sobre estades turístiques i de mesures d'impuls del turisme sostenible, que determina entre les funcions de la Comissió les següents: efectuar el seguiment i l'avaluació de l'execució dels projectes aprovats pel Consell de Govern i proposar l'adopció de les mesures de suspensió, modificació o cancel·lació que, si escau, consideri oportunes.</p>
<p>També, en data 18 de desembre de 2023, la Comissió d'Impuls del Turisme Sostenible ha aprovat un pla anual extraordinari per al període 2023, el qual ha de ser publicat al <em>Butlletí Oficial de les Illes Balears</em> i al lloc web a què es refereix l'article 20.4 de la Llei 2/2016, de conformitat amb l'article 51.5 del Decret 35/2016.</p>
<p>Les modificacions abans esmentades són les següents:</p>
<p><strong>Expedient 2023-023: Inversions en la modernització i adaptació al canvi climàtic de les explotacions agràries</strong></p>
<p>Antecedents: per a aquest projecte ITS-2023-023 es va sol·licitar un import total de 8.600.000 euros, que permetia incrementar el crèdit i dotar diverses convocatòries de la línia d'inversions en explotacions agràries convocades a l'empara del PDR de les Illes Balears per als anys 2019, 2020 i següents, si escau, així com ja s‘explicava en la memòria del projecte. Finalment, es van concedir 6.000.000 d'euros per a tal fi a la Conselleria d'Agricultura, Pesca i Alimentació.</p>
<p>L'entitat executant serà el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA).</p>
<p>Es proposa modificar l'import total del projecte a 6.000.000 d'euros, que es distribueixen amb les finalitats i amb les anualitats següents:</p>
<p>· Resolució del president del FOGAIBA de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2020, subvencions per a inversions a les explotacions agràries (convocatòria INEA 2020), per un import de 5.360.601,60 euros; els 639.398,4 euros restants (per a l'anualitat 2024) es destinaran a la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, mitjançant el procediment anticipat de despesa, subvencions per a inversions en explotacions agràries, corresponents a l'any 2021. La distribució serà en les anualitats següents:</p>

<p><strong>Expedient 2023-044: Promoció de 53 habitatges de protecció pública</strong></p>
<p>Antecedents: Aquest projecte es va concedir a la Conselleria de Mobilitat i Habitatge. L'entitat executant serà l'Institut Balear de l'Habitatge (IBAVI). L'import total del projecte era de 19.830.054,11 euros. L'import concedit amb fons per afavorir el turisme sostenible va ser de 13.151.862 euros. Se sol·licita incrementar l'import total a 20.135.087,62 euros, dels quals la Direcció General d'Habitatge i Arquitectura (GOIB) assumirà 1.065.001,03 euros, el Ministeri de Transports, Mobilitat i Agenda Urbana, 1.256.000,00 euros, els Fons Next Generation, 2.922.192,00 euros i el Fons Europeu de Desenvolupament Regional, 1.740.042,49 euros, i arriba al total de 6.983.235,52 euros.</p>
<p>Es proposa modificar l'import total del projecte, que passa a 20.135.097,62 euros, i distribuir l'import ja concedit amb fons del turisme sostenible en les anualitats següents:</p>

<p><strong>Expedient 2023-019: Menorca aigua: modernització de la infraestructura hidràulica</strong></p>
<p>Antecedents: Aquest projecte es va concedir al Consell Insular de Menorca, per tal de dur a terme intervencions urgents en infraestructures hidràuliques de Menorca, en línia amb els objectius del Pla d'Acció Menorca Reserva de Biosfera.</p>
<p>Segons la informació subministrada per l'entitat, l'import del projecte és de 17.108.323,46 euros, i es van concedir 2.400.000 euros amb fons per afavorir el turisme sostenible. Ni el Consell de Menorca ni els ajuntaments implicats disposen del finançament suficient per a la seva execució completa.</p>
<p>Es proposa executar el projecte en dues fases:</p>
<p>Fase 1: amb un import de 10.876.096,64 euros, que inclou els 2,4 milions provinents de fons de l'impost de turisme sostenible, i la resta que es finançarà amb pressupost propi del Consell Insular de Menorca i els ajuntaments. Les actuacions previstes en aquesta primera fase són les corresponents a l'àrea d'influència directa dels municipis de Maó, es Castell, es Mercadal, es Migjorn Gran i Ciutadella.</p>
<p>Fase 2: per un import de 6.232.226,81 euros no es podrà executar fins que s'obtengui el finançament necessari.</p>
<p>L'entitat executant serà el Consell Insular de Menorca.</p>
<p><strong>Expedient 2023-046: Adquisició Castell d'Alaró</strong></p>
<p>Antecedents: aquest projecte es va concedir al Consell Insular de Mallorca, per tal de dur a terme l'adquisició de la finca anomenada Castell d'Alaró.</p>
<p>L'import total del projecte era d'1.100.600 euros, i es van concedir 1.100.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa assignar els fons a l'anualitat següent:</p>

<p><strong>Expedient 2023-092: Solarització d'espais públics amb aprofitament social de l'energia</strong></p>
<p>Antecedents: Aquest projecte es va concedir a la Conselleria de Transició Energètica, Sectors Productius i Memòria Democràtica. L'entitat executant serà l'Institut Balear de l'Energia.</p>
<p>L'import total del projecte era de 4.561.700 euros i es van concedir 1.885.000 euros a càrrec del fons per afavorir el turisme sostenible. L'import restant l'assumeix l'entitat amb fons d'insularitat segons la informació subministrada per l'entitat.</p>
<p>Es proposa distribuir l'import ja concedit amb fons del turisme sostenible en les anualitats següents:</p>

<p><strong>Expedient 2023-067: Demolició d'edificis Don Pepe per al restabliment dels valors ecològics de la zona afectada</strong></p>
<p>Antecedents: aquest projecte es va concedir a la Conselleria de Presidència, Funció Pública i Igualtat.</p>
<p>L'import total del projecte era de 2.214.838,51 euros, i l'import concedit va ser el mateix. Ara la Conselleria de Presidència i Administracions Públiques ha presentat la renúncia al projecte.</p>
<p>Es proposa acceptar la renúncia al projecte i que l'import de 2.214.838,51 euros passi al fons per afavorir el turisme sostenible del Pla Anual Extraordinari 2023.</p>
<p><strong>Expedient 2023-065: Facultat de Ciències - 1a fase</strong></p>
<p>Antecedents: aquest projecte es va concedir a la Conselleria de Fons Europeus, Universitat i Cultura.</p>
<p>L'import total del projecte era de 32.629.307,7 euros, i es van concedir 13.380.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa distribuir les anualitats corresponents al fons per afavorir el turisme sostenible de la manera següent:</p>

<p>L'import total finançat a càrrec del fons per afavorir el turisme sostenible és per dur a terme únicament la primera fase d'execució del nou edifici de la Facultat de Ciències.</p>
<p>L'entitat executant serà la Conselleria d'Educació i Universitats.</p>
<p><strong>Expedient 2023-093: Impuls a la mobilitat per a vianants i ciclistes</strong></p>
<p>Antecedents: aquest projecte es va concedir a la Conselleria de Mobilitat i Habitatge.</p>
<p>L'import total del projecte era de 10.000.000 d'euros, i es van concedir 1.500.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa modificar l'import total del projecte a 1.500.000 euros, així com distribuir les anualitats corresponents al fons per afavorir el turisme sostenible de la manera següent:</p>

Ara, la Conselleria competent ha renunciat al projecte.</p>
<p>Es proposa acceptar la renúncia al projecte i que aquest import de 2.000.000 d'euros passi al fons per afavorir el turisme sostenible del Pla Anual Extraordinari 2023.</p>
<p><strong>Expedient 2023-094: Desenvolupament d'una instal·lació agrovoltaica a Santa Eugènia</strong></p>
<p>Antecedents: Aquest projecte es va concedir a la Conselleria de Transició Energètica, Sectors Productius i Memòria Democràtica. L'entitat executant serà l'Institut Balear de l'Energia. L'import total del projecte era de 3.102.718,30 euros i es van concedir 1.461.559 euros a càrrec del fons per afavorir el turisme sostenible. L'import restant l'assumeix l'entitat amb fons d'insularitat.</p>

<p>· Línia C: Implementar mesures de flexibilització laboral en matèria de conciliació de la vida laboral, familiar i personal.</p>
<p>L'entitat executant serà la Conselleria d'Empresa, Ocupació i Energia.</p>
<p><strong>Expedient 2023-018: Manteniment del paisatge agrari</strong></p>
<p>Antecedents: aquest projecte es va concedir a la Conselleria d'Agricultura, Pesca i Alimentació, i l'entitat executant és el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA).</p>
<p>L'import total del projecte era de 6.000.000 d'euros, i es van concedir 2.500.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa modificar l'import total del projecte a 2.500.000 euros, així com distribuir les anualitats corresponents al fons per afavorir el turisme sostenible de la manera següent:</p>

<p>L'import de 2.500.000 euros és per dur a terme únicament la mesura <em>b)</em>, corresponent a la reestructuració de conreus d'arbres fruiters tradicionals de les Illes Balears, atès que el canvi climàtic, la sequera dels darrers anys i diverses plagues i malalties han afectat greument el conreu d'aquests arbres a les nostres illes. L'objectiu de les dues mesures —<em>a)</em> i <em>b)</em>— és comú: mantenir el paisatge agrari actual i ambdues actuacions consisteixen en ajudes a pagesos i titulars d'explotacions incloses en el marc normatiu europeu d'ajudes.</p>
<p><strong>Expedient 2023-082: Foment de la micromobilitat elèctrica a les Illes Balears</strong></p>
<p>Antecedents: aquest projecte es va concedir a la Conselleria de Transició Energètica, Sectors Productius i Memòria Democràtica.</p>
<p>L'import total del projecte era de 10.020.000 euros, i es van concedir 1.000.000 d'euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>La conselleria competent ha presentat una renúncia parcial al projecte per un import de 780.000 euros.</p>
<p>Es proposa acceptar la renúncia parcial del projecte i que l'import de 780.000 euros passi al fons per afavorir el turisme sostenible del Pla Anual Extraordinari 2023; modificar l'import total del projecte, que passa a ser de 220.000 euros, així com assignar el fons concedit a l'anualitat següent:</p>

<p><strong>Expedient 2023-020: Pagaments compensatoris per al suport de l'agricultura de muntanya</strong></p>
<p>Antecedents: Aquest projecte es va concedir a la Conselleria d'Agricultura, Pesca i Alimentació. L'entitat executant és el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA).</p>
<p>L'import total del projecte era de 2.600.000 euros, i es van concedir 1.300.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa modificar l'import total del projecte, que passa a 1.300.000 euros, amb una anualitat per a l'any 2024 d'1.300.000 euros.</p>
<p>Aquest import ha estat destinat completament a la convocatòria de l'anualitat 2023 (Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2023, de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears).</p>
<p><strong>Expedient 2023-050: Increment del sòl públic en espais naturals</strong></p>
<p>Antecedents: aquest projecte es va concedir a Conselleria de Medi Ambient i Territori.</p>
<p>L'import total del projecte era de 3.125.000 euros i es van concedir 3.125.000 euros a càrrec del fons per afavorir el turisme sostenible.</p>
<p>Es proposa modificar l'objecte del projecte i ampliar-lo a finques situades en espais naturals que resultin necessàries per a la conservació d'hàbitats i/o espècies, per a l'ús públic o la gestió d'aquests espais. Amb aquesta modificació s'amplia la possible adquisició de finques a indrets que presentin uns elevats valors mediambientals, tant per a la protecció d'hàbitats i espècies com per a l'ús públic. Aquests llocs hauran de complir, així mateix, els objectius del projecte. L'import per a l'anualitat del 2024 es manté en 3.125.000 €.</p>
<p><strong>Expedient 2018-004: Millora de l'accessibilitat i dels observatoris de les albuferes de les Illes Balears</strong></p>
<p>Antecedents: atès l'increment de preus en les matèries primeres, hi ha actuacions que estaven previstes al projecte inicial que no es podran dur a terme i, per això, l'entitat ha sol·licitat una modificació del projecte.</p>
<p>Es proposa modificar les actuacions inicials previstes al projecte inicial, reduint la magnitud d'algunes actuacions però executant el pressupost concedit en la seva totalitat i assolint igualment els objectius generals del projecte.</p>
<p>Les actuacions que no es duran a terme són:</p>
<ul>
<li>Lot A: A Mallorca no es duran a terme les actuacions previstes inicialment al Malecó del Canal del Sol i, en lloc de dur a terme el manteniment i correcció de 6.000 m, només es farà a 3.407,5 m.</li>
<li>Lot B: A Menorca només s'adequaran 420 m dels 1.050 m de l'Itinerari Blau, i de l'Itinerari Vermell no s'adequarà el mirador, els bancs ni el cartell ceràmic.</li>
<li>Lot C: A Formentera no es farà el panell interpretatiu del paisatge.</li>
</ul>
<p>Per tot això, el Consell de Govern, a proposta del conseller de Turisme, Cultura i Esports, en la sessió de 22 de desembre de 2023, adoptà entre d'altres l'Acord següent:</p>
<p><strong>Primer.</strong> Ratificar el Pla Anual d'Impuls del Turisme Sostenible extraordinari per a 2023, aprovat per la Comissió d'Impuls del Turisme Sostenible en data 18 de desembre de 2023, que s'annexa a aquest Acord.</p>
<p><strong>Segon.</strong> Prendre en consideració les modificacions i renúncies elevades per la Comissió d'Impuls del Turisme Sostenible, de conformitat amb l'article 20.4 de la Llei 2/2016, de 30 de març, de l'impost sobre estades turístiques a les Illes Balears i de mesures d'impuls del turisme sostenible.</p>
<p><strong>Tercer.</strong> Modificar o acceptar la renúncia dels següents projectes corresponents al Pla anual 2023 i Pla anual de 2018, que queden en els termes següents:</p>
<p><strong>Expedient 2023-023: Inversions en la modernització i adaptació al canvi climàtic de les explotacions agràries</strong></p>
<p>Modificar l'import total del projecte a 6.000.000 d'euros, que es distribueixen amb les finalitats i les anualitats següents:</p>
<p>Resolució del president del FOGAIBA de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2020, subvencions per a inversions a les explotacions agràries (convocatòria INEA 2020), per un import de 5.360.601,60 euros; els 639.398,4 euros restants (per a l'anualitat 2024) es destinaran a la Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, mitjançant el procediment anticipat de despesa, subvencions per a inversions en explotacions agràries, corresponents a l'any 2021. <p><strong>Expedient 2023-019: Menorca aigua: modernització de la infraestructura hidràulica</strong></p>
<p>Executar el projecte en dues fases:</p>
<p>Fase 1: Amb un import de 10.876.096,64 euros, que inclouen els 2,4 milions provinents de fons de l'impost de turisme sostenible, i la resta que es finançarà amb pressupost propi del Consell Insular de Menorca i els ajuntaments. Les actuacions previstes en aquesta primera fase són les corresponents a l'àrea d'influència directa dels municipis de Maó, es Castell, es Mercadal, es Migjorn Gran i Ciutadella.</p>

<p><strong>Expedient 2023-006: Ajuts dirigits a garantir la qualitat de l'ocupació</strong></p>

<p>L'import d'1.000.000 d'euros que es va aprovar és únicament per dur a terme l'execució de les 3 línies de la convocatòria de la forma següent:</p>
<ul>
<li>Línia A: substituir treballadors acollits a una excedència laboral o reducció de jornada de treball per a la cura de fills i filles menors o de familiars en situació de dependència.</li>
<li>Línia B: per fomentar la implementació voluntària de plans d'igualtat en empreses de menys de 50 treballadors.</li>
<li>Línia C: per la implementació de mesures de flexibilització laboral en matèria de conciliació de la vida laboral, familiar i personal.</li>
</ul>
<p>L'entitat executant serà la Conselleria d'Empresa, Ocupació i Energia.</p>
<p><strong>Expedient 2023-018: Manteniment del paisatge agrari</strong></p>
<p>Modificar l'import total del projecte a 2.500.000 euros, així com distribuir les anualitats corresponents al fons per afavorir el turisme sostenible de la manera següent:</p>

<p>L'import de 2.500.000 euros és per dur a terme únicament la mesura <em>b)</em>, corresponent a la reestructuració de conreus d'arbres fruiters tradicionals de les Illes Balears, atès que el canvi climàtic, la sequera dels darrers anys i diverses plagues i malalties han afectat greument el conreu d'aquests arbres a les nostres illes. L'objectiu de les dues mesures —<em>a)</em> i <em>b)</em>— és comú: mantenir el paisatge agrari actual i ambdues actuacions consisteixen en ajudes a pagesos i titulars d'explotacions incloses en el marc normatiu europeu d'ajudes.</p>
<p><strong>Expedient 2023-082: Foment de la micromobilitat elèctrica a les Illes Balears</strong></p>
<p>Acceptar la renúncia parcial del projecte i que l'import de 780.000 euros passin al Fons per afavorir el turisme sostenible del Pla anual extraordinari 2023; modificar l'import total del projecte, que passa a ser de 220.000 euros, així com assignar el fons concedit a la següent anualitat:</p>

<p>L'entitat executant serà la Conselleria d'Empresa, Ocupació i Energia.</p>
<p><strong>Expedient 2023-020: Pagaments compensatoris per al suport de l'agricultura de muntanya</strong></p>
<p>Modificar l'import total del projecte, que passa a 1.300.000 euros, amb una anualitat per a l'any 2024 d'1.300.000 euros.</p>
<p>Aquest import ha estat destinat totalment a la convocatòria de l'anualitat 2023 (Resolució de la presidenta del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria, per a l'any 2023, de les ajudes destinades al pagament compensatori per a zones de muntanya a les Illes Balears).</p>
<p><strong>Expedient 2023-050: Increment del sòl públic en espais naturals</strong></p>
<p>Modificar l'objecte del projecte i ampliar-lo a finques situades en espais naturals que resultin necessàries per a la conservació d'hàbitats i/o espècies, per a l'ús públic o la gestió d'aquests espais. Amb aquesta modificació s'amplia la possible adquisició de finques a indrets que presentin uns elevats valors mediambientals, tant per a la protecció d'hàbitats i espècies com per a l'ús públic. Aquests llocs hauran de complir, així mateix, els objectius del projecte. L'import per a l'anualitat del 2024 es manté en 3.125.000 €.</p>
<p><strong>Expedient 2018-004: Millora de l'accessibilitat i dels observatoris de les albuferes de les Illes Balears</strong></p>
<p>Modificar les actuacions inicials previstes al projecte inicial, reduint la magnitud d'algunes actuacions però executant el pressupost concedit totalment i assolint igualment els objectius generals del projecte.</p>
<p>Les actuacions que no es duran a terme són:</p>
<ul>
<li>Lot A: A Mallorca no es duran a terme les actuacions previstes inicialment al Malecó del Canal del Sol i, en lloc de dur a terme el manteniment i correcció de 6000 m, només es farà a 3.407,5 m.</li>
<li>Lot B: A Menorca només s'adequaran 420 m dels 1.050 m de l'Itinerari Blau, i de l'Itinerari Vermell no s'adequarà el mirador, els bancs ni el cartell ceràmic.</li>
<li>Lot C: A Formentera no es farà el panell interpretatiu del paisatge.</li>
</ul>
<p><strong>Quart.</strong> Considerar modificats en aquests termes els acords de Consell de Govern de data 31 d'octubre de 2022 i 26 d'octubre de 2018 relatius a l'aprovació de projectes a finançar amb el fons per afavorir el turisme sostenible.</p>
<p><strong>Cinquè.</strong> Ordenar la publicació del Pla Anual Extraordinari per a 2023 i aquest Acord, en el <em>Butlletí Oficial de les Illes Balears</em> i en el lloc web específic al qual es refereix l'article 20.4 de la Llei 2/2016.</p>
