El 27 de maig de 2023, al BOIB Núm. 70 va publicar la resolució de la Presidència de l'IMAS de dia 26 de maig de 2023 d'aprovació de la convocatòria dels premis del Consell de Mallorca a la Innovació Social 2023 </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">2.A aquesta resolució de la convocatòria es va autoritzar una despesa diamant d'aquest expedient per un import total de 48.000,00 euros,<span style="color:#000000"> </span>a</span><span style="color:#000000"> </span><span style="color:#000000">càrrec</span><span style="color:#000000"> </span><span style="color:#000000">de</span><span style="color:#000000"> </span><span style="color:#000000">la</span><span style="color:#000000"> </span><span style="color:#000000">partida</span><span style="color:#000000"> </span><span style="color:#000000">pressupostària</span><span style="color:#000000"> 4</span><span style="color:#000000">0.23142.48101</span><span style="color:#000000"> </span><span style="color:#000000">del</span><span style="color:#000000"> </span><span style="color:#000000">vig</span>ent pressupost de despeses. Els reconeixements i les mencions no tenen dotació econòmica. </span></span></span></p>

Instruïdes totes les sol·licituds presentades dintre del termini que finalitzà el 16 de juny de 2023, es va constituir el 25 de setembre de 2023 el Jurat dels Premis Consell de Mallorca 2023 . Posteriorment, el 18 d'octubre de 2023 el Jurat dels Premis Consell de Mallorca de 2023 va proposar com a candidatures guanyadores per a cada categoria les següents: </span></span></span></p>

No obstant, referent a</span><span style="color:#000000; font-family:"Times New Roman",Times,serif"> la categoria de reconeixement a la trajectòria d'una entitat o persona, i si és el cas, la menció, atès que encara no s'ha constituït el Consell Assessor de Serveis Socials de l'IMAS, òrgan que segons les bases ha de proposar i valorar els reconeixements, el Jurat no ha pogut validar la proposta.</span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000009">5. Atesa la previsió continguda al punt 13 de les Bases aprovades, en data de 4 d'octubre de 2023 la Presidència de l'IMAS va dictar Resolució complementària a la Resolució de la Presidència de l'IMAS d'aprovació de la convocatòria dels Premis del Consell de Mallorca a la Innovació Social 2023, per la qual va delegar expressament en el director gerent la competència per resoldre la concessió (<em>BOIB 138, de 10 d'octubre de 2023)</em></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000009">6. Posteriorment, el 21 de novembre de 2023 al BOIB Núm 158, es va publicar la resoluci</span>ó de 9 de novembre de 2023 del president de l'IMAS per a la l'ampliació del termini per resoldre i notificar el procediment de la convocatòria dels premis del Consell de Mallorca a la <span style="color:#000000">Innovació Social 2023.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7. Així el 20 de novembre de 2023, l'òrgan instructor va emetre informe en el que proposa: </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«<strong>1.- Resoldre parcialment </strong>la convocatòria dels Premis del Consell de Mallorca a la Innovació Social 2023, atès que no es disposa en aquests moments de la proposta del Consell Assessor de Serveis Socials de l'IMAS amb relació als reconeixements a la trajectòria d'una entitat o persona, I d'acord amb això, </span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8. El Servei Juridicoadministratiu i la Intervenció Delegada de l'IMAS han emès els informes favorables a aquesta proposta.</span></span></span></p>
<p><strong><span style="color:#000000"><strong>Consideracions<strong> </strong>Jurídiques</strong></span></strong></p>
<p><strong><span style="color:#000000"><strong>1</strong>.- </span></strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">El Ple del Consell de Mallorca, per acord de dia 11 d'abril de 2019, va aprovar els Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 67 de 18 de maig de 2019). L'article 2.1 dels Estatuts disposa que l'IMAS, té per objecte fonamental l'exercici, en forma directa i descentralitzada, de les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i protecció de menors.</span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>2.-</strong> D'acord amb l'article 3 dels Estatuts de l'IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d'obrar necessària per complir els seus fins. Entre les seves facultats al punt m) d'aquest article 3 es troba la d'atorgar premis.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>3</strong>.- El <span style="color:#000000">Consell Executiu del Consell de Mallorca</span> el 2 de març de 2023<span style="color:#000000"> va aprovar el Pla estratègic de subvencions de l'Institut Mallorquí d'Afers Socials per a l'any 2023 incloent en la línia de subvencions corresponent a l'Àrea de Persones amb Discapacitat els «Premis Consell de Mallorca a la Innovació Social».</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#0000ff"><span style="color:#000000"><strong>4.- </strong></span><span style="color:#000000">La D</span><span style="color:#000000">isposició Addicional Primera de l'Ordenança general de subvencions del Consell Insular de Mallorca, regula el procediment a seguir per a convocar i concedir Premis per part dels subjectes inclosos dins l'àmbit d'aplicació d'aquesta Orde</span><span style="color:#000000"><span style="background-color:#ffffff">nança, que són tant el Consell Insular de Mallorca com els organismes autònoms que en depenen. A aquesta disposició addicional Primera s'estableix que en les convocatòries corresponents s'han d'indicar el nombre de premis convocats, els requisits dels participants, l'import i els criteris d'adjudicació, que s'han de determinar per la qualitat i per la idoneïtat, i l'adequació de l'activitat premiada a la finalitat específica pretesa. </span></span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong><span style="background-color:#ffffff">5. </span></strong><span style="background-color:#ffffff">L'òrgan competent per resoldre aquesta convocatòria és la Gerència de l'IMAS </span></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong><span style="background-color:#ffffff">6.</span></strong><span style="color:#000000"> </span><span style="background-color:#ffffff">D'acord amb el Títol I sobre Procediments de concessió i gestió de les subvencions, de la Llei 38/2003 de 17 de novembre, General de Subvencions, al seu article 26 preveu que la resolució del procediment (concessió dels Premis) es notificarà individualment als guan</span>yadors i a les entitats proponents, els quals han de complir amb les obligacions establertes a les Bases d'aquesta convocatòria. </span></span></span></span></p>

<p><strong>Cinquè. </strong><span style="color:#000000; font-family:"Times New Roman",Times,serif">PUBLICAR aquesta Resolució en els portals establerts a l'apartat 16 de les Bases.</span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Sisè. </strong>INFORMAR que una vegada es validi per el jurat la proposta del Consell Assessor de Serveis Socials de l'IMAS, es resoldran els atorgaments dels reconeixements a la trajectòria d'una entitat o persona.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Setè. </strong>Comunicar aquesta Resolució a la Direcció insular de persones amb discapacitat i Innovació Social, al Servei de Gestió Econòmica i a la Intervenció Delegada. </span></span></span></span></p>
<p><span style="background-color:#ffffff; color:#000000; font-family:"Times New Roman",Times,serif">Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la notificació de la present resolució.</span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><span style="background-color:#ffffff">Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.</span></span></span></span></span></p>
