&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En el Butlletí Oficial de les Illes Balears (BOIB) núm. 95, d'11 de juliol de 2023, es va publicar la Resolució del president de l'Institut d'Indústries Culturals de les Illes Balears de 6 de juliol de 2023 per la qual es convoquen les subvencions per donar suport a l'acceleració de les indústries culturals i creatives de les Illes Balears en el marc del Pla de Recuperació, Transformació i Resiliència&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;(finançat per la Unió Europea – Next Generation EU).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Dins el termini establert en l'apartat 7.1 de la convocatòria ―és a dir, del 13 al 30 de juliol de 2023 (ambdós inclosos)―, l'Institut d'Indústries Culturals de les Illes Balears (ICIB) va rebre un total de desset sol·licituds.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Com a conseqüència d'un problema tècnic amb el tràmit telemàtic que va tenir lloc entre les 23.09 h del 30 de juliol de 2023 i les 11.00 h del 31 de juliol de 2023, i una vegada fetes les comprovacions prèvies oportunes, l'ICIB va haver d'admetre una sol·licitud presentada el dia 31 de juliol per la impossibilitat constatada de registrar-la dins el termini previst.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. D'acord amb l'apartat 10 de la convocatòria, un cop finalitzat el termini de presentació de sol·licituds, la Comissió Avaluadora va valorar els projectes sol·licitats segons els criteris de valoració que es fixen en el punt 27 de l'annex 1&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. De conformitat amb l'apartat 13.1 de la convocatòria, la Comissió Avaluadoraes va reunir el dia 2 de novembre de 2023 per tal d'examinar les sol·licituds presentades i, posteriorment, va estendre l'acta de la sessió, a la qual s'adjuntà l'informe que va servir de base per dictar la Proposta de resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En data 23 de novembre de 2023, el president de l'ICIB va dictar la Proposta de resolució d'aquesta convocatòria d'ajuts.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El dia 24 de novembre de 2023, es va publicar la Proposta de resolució a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. D'acord amb l'apartat 14.4 i 14.5 de la convocatòria, els beneficiaris han de comunicar a l'òrgan instructor l'acceptació o la renúncia respecte de la subvenció proposada en el termini de cinc dies hàbils comptadors des de la publicació de la Proposta de resolució en la web de l'ICIB. En qualsevol cas, l'acceptació s'entén produïda automàticament si no es fa constar el contrari en el termini de deu dies hàbils comptadors des de l'endemà d'haver-se'n publicat en la pàgina web.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. D'acord amb l'apartat 14.3 de la convocatòria, una vegada publicada la Proposta de resolució, els sol·licitants disposen d'un termini de deu dies hàbils per formular-hi al·legacions. Així, dins el termini esmentat, es varen presentar les al·legacions següents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.1. L'Associació Xarxa Cinema va presentar una al·legació en relació amb l'expedient ACC 15 2023, en què sol·licita la inclusió de l'entitat com a possible beneficiària de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.2. Carmen Vidal Balanzat va presentar una al·legació en relació amb l'expedient ACC 10 2023, en què acredita el compliment dels apartats 5.3 i 5.6 de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.3. Cines Mallorquines, SL, va presentar una al·legació en relació amb l'expedient ACC 8 2023, en què argumenta el compliment dels apartats 1.3 i 2.3 de la convocatòria i sol·licita l'admissió de la sol·licitud.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.4. Iguana Teatre, SL, va presentar una al·legació en relació amb l'expedient ACC 1 i 2 2023, en què argumenta el compliment dels apartats 1.3 i 2.3 de la convocatòria i sol·licita l'admissió de la sol·licitud.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.5. Marta Jiménez Jiménez va presentar una al·legació en relació amb l'expedient ACC 11 2023, en què sol·licita la modificació de la quantitat concedida de l'ajut.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Respecte de les al·legacions formulades, es va acordar el següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.1. Al·legació sobre l'expedient ACC 15 2023: s'estima l'al·legació i s'admet la sol·licitud. La Comissió Avaluadora revisa i valora la documentació presentada d'acord amb els criteris de valoració establerts en l'apartat 27 de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.2. Al·legació sobre l'expedient ACC 10 2023: s'estima l'al·legació i s'admet la sol·licitud. La Comissió Avaluadora revisa i valora la documentació presentada d'acord amb els criteris de valoració establerts en l'apartat 27 de la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.3. Al·legació sobre l'expedient ACC 8 2023: es desestima l'al·legació.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.4. Al·legació sobre l'expedient ACC 1 i 2 2023: es desestima l'al·legació.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.5. Al·legació sobre l'expedient ACC 11 2023: s'estima l'al·legació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El personal de l'ICIB ha comprovat que les persones beneficiàries compleixen els requisits que la normativa estableix per poder rebre subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consideracions jurídiques&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18 de novembre de 2003).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. L'Ordre de la consellera d'Educació i Cultura d'1 de juliol de 2009 per la qual s'estableixen les bases reguladores de les subvencions en matèria d'educació i cultura (BOIB núm. 100, d'11 de juliol de 2009).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decret 50/2018, de 21 de desembre, pel qual s'aproven els Estatuts de l'Institut d'Indústries Culturals de les Illes Balears (BOIB núm. 160, de 22 de desembre de 2018; correcció d'errades: BOIB núm. 6, de 12 de gener de 2019).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'acord amb l'article 19.9 dels Estatuts de l'ICIB, en el cas de vacant, absència, malaltia o qualsevol altre impediment per actuar del director gerent, les seves funcions les ha d'assumir el president, sense que tengui dret a percebre cap retribució per aquest concepte. El president pot delegar les funcions del director gerent en un membre del Consell de Direcció, sense que tengui dret a percebre cap retribució per aquest concepte.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolució del president de l'Institut d'Indústries Culturals de les Illes Balears de 24 d'octubre de 2023 per la qual es deleguen les funcions de director gerent en la directora general de Cultura, com a membre del Consell de Direcció de l'ens (BOIB núm. 147, de 28 d'octubre de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La Resolució del president de l'Institut d'Indústries Culturals de les Illes Balears de 6 de juliol de 2023 per la qual es convoquen les subvencions per donar suport a l'acceleració de les indústries culturals i creatives de les Illes Balears en el marc del Pla de Recuperació, Transformació i Resiliència (finançat per la Unió Europea – Next Generation EU) (BOIB núm. 95, d'11 de juliol de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprovar i concedir subvencions per l'import total de 157.275,42 € a favor dels beneficiaris que s'inclouen en l'annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autoritzar i disposar la despesa indicada per a cadascun dels beneficiaris amb càrrec als capítols 4 i 7 del pressupost de l'ICIB, amb els imports que es detallen en l'annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Excloure de la concessió de subvencions les sol·licituds que s'indiquen en l'annex.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Informar els beneficiaris que la subvenció s'ha de justificar en els termes establerts en la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el president de l'Institut d'Indústries Culturals de les Illes Balears, en el termini d'un mes comptador a partir del'endemà d'haver-se publicat en el Butlletí Oficial de les Illes Balears, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de lajurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
