&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En data 26 de setembre de 2023, el director general d'Atenció a la Dependència va emetre l'informe justificatiu relatiu a la necessitat de concertar el servei de promoció de l'autonomia personal i prevenció de la situació de dependència per a persones grans en situació de dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En data 27 de setembre de 2023, la consellera de Famílies i Afers Socials va ordenar l'inici del procediment per dur a terme la convocatòria d'acció concertada del servei de promoció de l'autonomia personal amb programes modulars per a persones grans en situació de dependència, amb entitats d'iniciativa privada que tenguin acreditat el servei de promoció de l'autonomia personal per a persones en situació de dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Llei 39/2006, de 14 de desembre, de promoció de l'autonomia personal i atenció a les persones en situació de dependència, i el Reial decret 1051/2013, de 27 de desembre, pel qual es regulen les prestacions del Sistema per a l'Autonomia i Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població, modificat pel Decret 54/2013 i pel Decret 31/2016.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Decret 63/2017, de 22 de desembre, de principis generals dels procediments d'accés als serveis de la Xarxa Pública d'Atenció a la Dependència per a gent gran en situació de dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Decret 32/2023, de 26 de maig pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Decret 8/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El Decret 12/2023, de 10 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 16/2023, de 20 de juliol, de la presidenta de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. L'Acord del Consell de Govern de 6 de març de 2023 pel qual s'aprova la previsió de les prestacions i els serveis que s'han de concertar durant l'any 2023 i es declaren els serveis d'interès econòmic general (BOIB núm. 29, de 7 de març), modificat per l'Acord del Consell de Govern de 24 d'abril de 2023 (BOIB núm. 52, de 25 d'abril) i per l'Acord del Consell de Govern de 13 d'octubre de 2023 (BOIB núm. 140, de 14 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Aprovar la convocatòria d'acció concertada del servei de promoció de l'autonomia personal i prevenció de la situació de dependència per a persones majors en situació de dependència, i establir el procediment de la convocatòria, d'acord amb l'annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aplicar el procediment ordinari de convocatòria d'acció concertada que preveuen la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i el Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;3. Aprovar el Plec de condicions tècniques relatiu al servei esmentat, que es pot consultar a la seu de la Direcció General d'Atenció a la Dependència i al web &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;http://serveissocialsicooperacio.caib.es&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la consellera de Famílies i Afers Socials en el termini d'un mes comptador des de l'endemà que s'hagi publicat, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà que s'hagi publicat la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objecte i àmbit d'aplicació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.1. S'estableix el procediment de convocatòria del concert social del servei de promoció de l'autonomia personal i prevenció de la situació de dependència per a persones majors en situació de dependència, a l'empara de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i el Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.2. Se subjecta a aquest procediment la concertació estimada de 349 mòduls anuals del servei de promoció de l'autonomia personal i prevenció de la situació de dependència per a persones majors en situació de dependència, que ofereixen prestacions d'estimulació cognitiva, rehabilitació funcional, habilitats socials i relacionals i formació de cuidadors, per millorar les condicions de vida tant de les persones com de les famílies.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.3. Aquest servei està recollit en el punt 6.3 de l'annex del Decret 32/2023, de 26 de maig, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2023-2027, s'estableixen principis generals per a les carteres insulars i locals i es modifiquen diverses normatives de l'àmbit social (BOIB núm. 70, de 27 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.4. D'acord amb l'article 3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;de la Llei 12/2018, també és objecte del concert assolir els objectius d'igualtat de gènere i d'innovació en la gestió de les entitats i els serveis públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Òrgan instructor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'òrgan instructor del procediment és el director general d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Lloc i termini de presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1. El termini per presentar les sol·licituds és de deu dies hàbils comptadors des de l'endemà que s'hagi publicat aquesta convocatòria en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.2. Les entitats interessades han de presentar les sol·licituds de manera electrònica mitjançant el Registre electrònic comú (REC). S'hi ha d'adjuntar la sol·licitud específica del procediment, disponible a la Seu Electrònica d'aquesta Administració, signada electrònicament. En cas que presentin la sol·licitud de manera presencial, l'Administració, d'acord amb l'article 68.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, els requerirà que la presentin electrònicament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Requisits de les entitats&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. Les entitats han de tenir acreditat per l'administració competent el servei de promoció de l'autonomia personal i prevenció de la situació de dependència, el dia que finalitzi el termini per presentar les sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. Les entitats han de tenir una experiència de, com a mínim, d'un any en la prestació del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.3. Les entitats han d'acreditar la solvència financera i tècnica d'acord amb els criteris establerts en les lletres &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;d) &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;i&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; e)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del punt 5.2 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.4. Així mateix, les entitats han de complir els requisits mínims establerts en el desplegament del títol VII de la Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears; els requisits que estableix l'article 5 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i els requisits que disposa l'article 4 del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.5. El servei de promoció de l'autonomia personal i prevenció de la situació de dependència per a persones en situació de dependència està declarat d'interès econòmic general, atès el que disposa l'annex 2 de l'Acord del Consell de Govern de 6 de març de 2023, modificat per l'Acord del Consell de Govern de 24 d'abril de 2023 (BOIB núm. 52, de 25 d'abril) i per l'Acord del Consell de Govern de 13 d'octubre de 2023 (BOIB núm. 140, de 14 d'octubre). Per tant, en aquest procediment poden subscriure acords d'acció concertada, a més de les entitats del tercer sector d'acció social que prestin el servei objecte del concert i el sol·licitin, totes les persones físiques o jurídiques de caràcter privat, amb ànim de lucre o sense, sigui quina sigui la forma jurídica que adoptin, que prestin el servei objecte del concert i el sol·licitin expressament en els terminis i amb la forma que es determinen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Documentació que s'ha de presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1. Els impresos oficials de la sol·licitud i dels documents que s'han d'emplenar i presentar són a disposició de les persones interessades en els enllaços corresponents del web de la Direcció General d'Atenció a la Dependència. Quan en la sol·licitud s'inclogui una adreça de correu electrònic, s'entendrà que s'aporta a l'efecte dels avisos que s'esmenten en l'article 41.6 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2. A la sol·licitud (imprès 1) s'hi ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Acreditació de l'experiència de, com a mínim, d'un any en la prestació del servei de promoció de l'autonomia personal adreçat a gent gran en situació de dependència. Aquesta experiència es pot acreditar mitjançant una declaració responsable signada per la persona responsable de l'entitat, acompanyada de la documentació justificativa sobre la realització d'activitats subvencionades, concertades o contractades per qualsevol administració pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Declaració responsable (imprès 2) que l'entitat no està sotmesa a les prohibicions de contractar amb l'Administració en virtut de sanció administrativa ferma, d'acord amb la Llei 38/2003, de 17 de novembre, general de subvencions, i la Llei 58/2003, de 17 de desembre, general tributària, i d'acord amb l'article 71 de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, ni a cap dels supòsits de prohibició per ser beneficiària de subvencions, establerts en els apartats 1 i 2 de l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions; així com de no incórrer en la prohibició que estableix l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, i de no haver estat sancionada per resolució ferma en els darrers quatre anys per la comissió d'infraccions greus o molt greus en matèria de relacions laborals, ocupació, empreses usuàries de treball temporal, seguretat social, emigració, moviments migratoris i treball d'estrangers, com també de complir qualsevol altra normativa que, amb caràcter general o específic, sigui aplicable, tant per la naturalesa jurídica de l'entitat com pel tipus de servei objecte de concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Acreditació de solvència financera (imprès 3), mitjançant l'aportació dels darrers comptes anuals de l'entitat presentats en el registre oficial corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Acreditació de solvència tècnica (imprès 4), mitjançant una declaració responsable dels mitjans personals i materials destinats a dur a terme el servei objecte de concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Documentació acreditativa, si escau, dels canvis d'accionariat o de titularitat per preservar la identitat institucional que justifica la concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3. El personal tècnic del Servei de Centres i Programes II de la Direcció General d'Atenció a la Dependència comprovarà d'ofici que les entitats sol·licitants tenen el servei autoritzat i acreditat, així com que estan al corrent de les obligacions tributàries i de la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4. La presentació de la sol·licitud suposa que l'entitat autoritza la Direcció General d'Atenció a la Dependència perquè pugui demanar a altres administracions qualsevol documentació, les dades i els informes que consideri necessaris per tramitar l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Tramitació dels concerts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. Els serveis tècnics de la Direcció General d'Atenció a la Dependència han d'examinar les sol·licituds i la documentació adjunta perquè l'òrgan instructor pugui determinar si compleixen els requisits que estableix la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. L'òrgan instructor, una vegada revisades les sol·licituds i la documentació adjunta exigida en el punt 5 d'aquesta convocatòria, ha de fer els requeriments necessaris a les entitats les sol·licituds de les quals no incloguin la documentació acreditativa del compliment dels requisits, perquè, en el termini de deu dies hàbils, esmenin el defecte o aportin la documentació que hi manca, amb la indicació que, si no ho fan, es considerarà que desisteixen de la seva sol·licitud, amb la resolució prèvia que s'ha de dictar en els termes que disposa l'article 21 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.3. Una vegada esmenades les sol·licituds, s'han d'aplicar els criteris de preferència assenyalats en el punt 8 d'aquesta convocatòria, a l'efecte de determinar els mòduls assignats a cada entitat sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.4. En aquest procediment, les entitats interessades han de participar en la proposta d'assignació dels mòduls d'acord amb el punt 8.2 d'aquesta convocatòria i signar l'acta d'assignació que s'aixecarà després de l'aplicació dels criteris de preferència a què fa referència el punt 8. La signatura d'aquesta acta suposa l'acceptació dels mòduls assignats a l'efecte de continuar el procediment d'acord amb el punt següent. Les entitats interessades i participants en el procediment poden manifestar i fer constar en aquesta acta les al·legacions que considerin oportunes als efectes del que disposa l'article 82 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.5. L'òrgan instructor ha d'elaborar la proposta de resolució que ha d'elevar a la consellera de Famílies i Afers Socials per a la resolució corresponent. Aquesta resolució s'ha de notificar a les persones interessades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.6. Aquest procediment de concertació s'ha de resoldre en el termini màxim de tres mesos comptadors des de l'endemà de l'entrada de la sol·licitud en el registre corresponent. Si en el termini indicat no se n'ha dictat una resolució expressa, s'entendrà que la sol·licitud ha estat desestimada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Formalització dels concerts&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.1. Els concerts que s'estableixen a l'empara d'aquesta convocatòria s'han de formalitzar mitjançant un document administratiu en el qual es facin constar els drets i les obligacions recíprocs, a més de les característiques concretes del servei i altres circumstàncies derivades de la Llei 4/2009, dels decrets de desplegament i d'aplicació d'aquesta Llei, i del Plec de condicions tècniques del concert, i, en concret, el contingut regulat en l'article 8 de la Llei 12/2018. També s'hi ha d'incloure expressament el compromís de les parts en relació amb la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia dels drets digitals, i la Llei 19/2013, de 9 de desembre, de transparència, accés a la informació pública i bon govern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2. El règim de concert s'iniciarà a partir de la seva formalització. No obstant l'anterior, per aquelles entitats que prestin el servei en virtut d'un concert previ i sempre que mantinguin el títol que les habilita per a la prestació del servei concertat, els efectes econòmics del concert s'iniciaran a partir de dia 1 de gener de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Ofertes de les entitats i criteris de preferència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.1. En primer lloc s'assignaran els mòduls d'acord amb l'arrelament de la persona en l'entorn d'atenció. L'arrelament es determinarà segons si s'ha duit a terme un mínim del 50 % dels mòduls grupals a la zona afectada en la data de la reunió a què fa referència el punt següent d'aquesta convocatòria. Respecte d'això, s'entendrà que l'entitat ha duit a terme el mòdul sempre que hagi presentat la documentació justificativa a què fa referència el punt 6.2 del Plec de condicions tècniques, i el tècnic responsable l'hagi conformada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.2. Respecte als mòduls no arrelats, i sempre amb el límit del nombre màxim de mòduls previst en la convocatòria i, si escau, el nombre màxim de mòduls/hores que consta en la resolució d'autorització o acreditació, es convocarà una reunió amb totes les entitats sol·licitants, presidida pel cap del Servei de Centres i Programes II, per distribuir els mòduls no arrelats entre les entitats sol·licitants fins a exhaurir tots els mòduls que ofereix l'Administració, d'acord amb els criteris següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;En relació amb els criteris de preferència assenyalats en l'article 6 de la Llei 12/2018, l'ordre d'elecció d'acord amb el qual es distribuiran els mòduls es determinarà segons el percentatge de mòduls efectivament prestats durant el concert anterior que hagin determinat l'arrelament d'acord amb el punt 8.1 d'aquesta convocatòria. En cas d'empat, tindrà prioritat l'entitat que hagi prestat el servei a més municipis assignats per zona. Finalment, com a criteri de desempat final, es tindrà en compte el total de persones que hagin rebut el servei durant la vigència del concert. Atès que es tracta d'un servei declarat d'interès econòmic general en el qual poden participar entitats privades amb ànim de lucre, sempre que existeixin anàlogues condicions d'eficàcia, qualitat i costs, així com d'eficiència pressupostària, per formalitzar els acords d'acció concertada tenen preferència les entitats del tercer sector d'acció social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Les entitats poden decidir en qualsevol moment deixar de participar en el procediment de distribució dels mòduls segons l'ordre de participació indicat en l'apartat &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. Aquesta renúncia a continuar participant en el procediment d'elecció afectarà únicament els futurs mòduls no distribuïts i es farà constar expressament en l'acta final que han de signar totes les parts participants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;En el cas que una de les zones quedi deserta perquè cap entitat l'hagui seleccionada, s'oferirà novament a les entitats participants d'acord amb l'ordre previst en l'apartat &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; d'aquest punt, i, en el cas que cap entitat accepti la zona afectada, els mòduls sobrants no seran distribuïts a altres zones en cap cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;Una vegada finalitzat el procés de distribució, en el marc de la reunió convocada per la Direcció General, les entitats es poden intercanviar zones per acord mutu (en cap cas fraccions de zones). Aquestes actuacions s'han de reflectir en el contingut de l'acta que han de signar totes les entitats, de conformitat amb el disposa la lletra següent. Una entitat no pot renunciar a un mòdul en favor d'una altra entitat, però sí que dues entitats es poden intercanviar les zones afectades per la distribució duita a terme d'acord amb aquest apartat 8.2, a l'efecte de millorar l'eficiència en la prestació territorial del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;De la reunió convocada per distribuir els mòduls, la Direcció General confeccionarà una acta en què es descriuran el procés de distribució, les al·legacions presentades i els acords adoptats. L'acta l'han de signar totes les entitats participants en el procés i s'elevarà a l'òrgan instructor perquè emeti la proposta de resolució corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

Comitè Tècnic d'Assessorament&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1. El Comitè Tècnic d'Assessorament estarà integrat pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. President o presidenta: el cap o la cap del Servei de Centres i Programes II.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presidenta suplent: la cap del Departament de la Direcció General d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Secretari o secretària: un dels tres tècnics o tècniques vocals de la Direcció General designat pel president o presidenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2. El Comitè Tècnic d'Assessorament té, entre altres funcions, la d'informar l'òrgan instructor en relació amb el procediment de concertació i sobre les condicions específiques que facin referència al servei objecte del concert, com també informar preceptivament sobre la modificació prevista en l'article 24 del Decret 48/2017. A més, pot fer propostes de millora relatives a les condicions d'aplicació dels criteris de preferència i a les condicions d'execució del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.3. El Comitè Tècnic d'Assessorament queda vàlidament constituït amb l'assistència, com a mínim, dels membres següents: el president o presidenta (o la presidenta suplent), el secretari o secretària i tres vocals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Programes amb mòduls i distribució territorial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La previsió del nombre màxim de mòduls per concertar es descriu en l'annex 2 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Vigència del concert&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.1 El règim de concert s'iniciarà a partir de la seva formalització. No obstant l'anterior, per aquelles entitats que prestin el servei en virtut d'un concert previ i sempre que mantinguin el títol que les habilita per a la prestació del servei concertat, els efectes econòmics del concert s'iniciaran a partir de dia 1 de gener de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.2. El concert finalitzarà en tot cas el 30 de novembre de 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Pressupost i preu màxim del servei&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.1. L'import màxim estimat per assignar és de 952.072,00 euros. En tot cas, aquest valor estimat té caràcter orientatiu i no vinculant. La despesa real quedarà limitada pels preus que ofereixin les entitats concertades i pels serveis que l'Administració requereixi efectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.2. Aquest import s'indica únicament a efectes de publicitat i no suposa cap compromís de despesa. Per això, no consta cap consignació pressupostària, que s'ha d'acreditar en el moment en què es materialitzi el servei de concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.3. El preu de referència per cada mòdul del programa és de 1.350,36 € (33,759 €/hora), amb l'IVA inclòs, durant l'any 2024, i 1.377,64 (34,441 €/hora), amb l'IVA inclòs, durant l'any 2025.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Condicions tècniques d'execució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.1. Les condicions tècniques d'execució s'han d'ajustar al Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones majors i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.2. El Plec de condicions tècniques detalla els drets i les obligacions d'ambdues parts, l'objecte, els serveis que s'han de prestar, els criteris d'intervenció amb els usuaris, els mitjans que ha d'aportar l'entitat adjudicatària i els sistemes de coordinació amb l'Administració, i, en concret, el contingut regulat en l'article 8 del Decret 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Seguiment&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El seguiment del concert és farà d'acord amb el punt 6, sobre control, seguiment i avaluació del servei, del Plec de condicions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Obligacions de les entitats concertades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.1. El concert social obliga l'entitat concertada a prestar els serveis del concert als usuaris gratuïtament i sense cap cost complementari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.2. Mitjançant el concert social, l'entitat d'iniciativa privada titular del servei s'obliga a complir el Plec de condicions tècniques; les normes establertes en el títol VII de la Llei 4/2009; la Llei 12/2018, i els decrets de desplegament i d'aplicació corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.3. L'entitat concertada s'obliga a fer tots els mòduls objecte del concert i a mantenir-ne l'autorització i l'acreditació durant el període de vigència del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.4. L'entitat concertada s'obliga a atendre els usuaris que hagin sol·licitat l'accés al servei i tenguin PIA de servei de promoció de l'autonomia personal, tenint en compte el nombre màxim de mòduls atorgats a cada zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.5. Les entitats concertades han de facilitar a la Direcció General d'Atenció a la Dependència la relació dels usuaris que hagin assistit a les sessions dels mòduls i les altes i les baixes que s'hi hagin produït, una vegada finalitzin aquests mòduls.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.6. Les entitats concertades s'han de fer càrrec exclusivament del personal laboral adscrit al servei concertat, de les seves retribucions i de les obligacions en matèria de seguretat social; aquest personal, en extingir-se el concert, no es pot consolidar, en cap cas, com a personal de l'Administració que concerta el servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.7. Les entitats concertades han d'indemnitzar els afectats pels danys i perjudicis que es causin, per aquestes mateixes o per tercers, com a conseqüència de l'execució del concert social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.8. La percepció indeguda de quantitats amb càrrec al servei per part de les entitats concertades suposa l'obligació de reintegrament d'aquestes quantitats, amb la tramitació prèvia del procediment que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.9. Les entitats concertades del servei&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;queden subjectes al control de caràcter financer i a les funcions inspectores i sancionadores de les administracions competents en la matèria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.10. Les entitats concertades han de comunicar la prestació de serveis complementaris i assumir tota la responsabilitat de l'execució d'aquests serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.11. Les entitats concertades han de comunicar qualsevol incidència que suposi una modificació o alteració respecte als plecs de condicions tècniques pactats amb l'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.12. Les entitats concertades es comprometen a fer ús de les aplicacions informàtiques i de gestió de la Direcció General d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;15.13. Les entitats concertades estan obligades a subministrar a l'Administració, amb el requeriment previ, tota la informació necessària per al compliment de les obligacions que estableix la Llei 19/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Penalitats&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;L'incompliment de les condicions previstes per prestar el servei suposa l'aplicació del punt 10, sobre incompliments i penalitats, del Plec de condicions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Criteris d'accés i llista d'espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El criteri d'accés dels usuaris i la llista d'espera del servei es regulen d'acord amb el punt 4.4, sobre criteris per a l‘acollida dels participants, del Plec de condicions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Publicitat&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Les entitats d'iniciativa privada acollides al règim de concert social, juntament amb la seva denominació, han de fer constar en la documentació, en totes les comunicacions (informes, fulls, documents, tríptics de difusió, missatges electrònics, webs, insercions en premsa, articles a diaris i a revistes especialitzades) i en la publicitat la condició d'entitat pertanyent a la Xarxa Pública d'Atenció a la Dependència, segons les indicacions del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Manual d'identitat corporativa&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que els facilitarà l'Administració, sempre amb el vistiplau de la Conselleria de Famílies i Afers Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Prerrogatives de l'Administració&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.1. L'òrgan instructor del procediment de concertació té la prerrogativa d'interpretar-lo i de resoldre'n els dubtes que sorgeixin durant el compliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;19.2. L'òrgan resolutori pot modificar el procediment per raons d'interès públic, acordar-ne la resolució i determinar-ne els efectes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Són causes d'extinció dels acords d'acció concertada les que estableix l'article 9 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Modificació del concert&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;21.1.Es podran modificar les aspectes tècnics prevists en aquests plecs així com el preu del servei d'acord amb el procediment i els límits prevists en l'article 24 del Decret 48/2017, i tot respectant el contingut de la resta de normativa que resulti d'aplicació, quant al contingut i les condicions d'aquest servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

En el cas que hi hagi llista d'espera, resultarà d'aplicació aquest concert el què disposa l'apartat tercer de l'article 23 del Decret 48/2017, pel que fa a la possibilitat d'incrementar el crèdit autoritzat mitjançant un expedient d'ajust comptable, sempre que hi hagi crèdit adequat i suficient i que l'entitat disposi de places acreditades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
