    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 9.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de data 21 de maig&amp;nbsp;de 2020, per la qual es convoquen, ajudes &lt;strong&gt;&amp;nbsp;&lt;/strong&gt;per la Cooperació entre agents per desenvolupar cadenes curtes de comercialització&amp;nbsp;mitjaçant accions de promoció, corresponents a l' any 2020, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 16&amp;nbsp;de novembre&amp;nbsp;de 2023, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;“&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓ DE REVOCACIÓ&amp;nbsp;TOTAL&lt;/strong&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;Programa de Desenvolupament Rural de les Illes Balears 2014-2020&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;Convocatòria: COCCI2020_1 &lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1 . En data 14/07/2020 va tenir entrada en el Registre del GOVERN DE LES ILLES BALEARS, número registre 17126/2020, la sol·licitud d'ajuda presentada per AGRÍCOLA AUBOCASSER, S.L amb NIF B65592347&amp;nbsp;, per a la convocatòria 2020_1 de la línia de Cooperació entre agents per desenvolupar cadenes curtes de comercialització mitjançant accions de promoció.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. En data 28/08/2021 es va publicar en el BOIB nº116 la Resolució de concessió COCCI 2020_1-R3 en data 10 d'agost de 2021, on es va concedir l'ajuda a l'interessat (expedient COCCI 2020_1/005). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. El 05/10/2022 l'interessat presenta la sol·licitud de pagament (REGAGE22e00044224990).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Analitzada la documentació presentada i la memòria fotogràfica de les actuacions, s'ha observat que&lt;/em&gt;&lt;/em&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;em&gt;totes les actuacions s'han realitzat &amp;nbsp;sense la publicitat del fons d'ajuda requerida a la convocatòria,&amp;nbsp;és a dir, sense el logotip del fons del finançament Illes Sostenible i/o sense fer referència a aquest fons a les actuacions publicitàries.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Les factures de millores web de Global Lles &amp;nbsp;(1.595€) i la factura 355/021120 de Abril publicaciones SL referent a l'edició ‘'video fiesta'' (800€) &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;no són admissibles per no acreditar realment què inclouen ni s'han publicitat amb el logotip Illes Sostenibles.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Factura 0021 amb concepte ‘'Evento 5 noviembre'' de M.Monserrat; degut a que la festa no es va poder realitzar per causa del COVID-19, no es considera admissible cap de les despeses presentades&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="color:#000000"&gt;&lt;em&gt;(1.284€).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Les tres factures referents a ‘'compras fiesta'' no són admissibles perquè el producte de promocional objecte de promoció és l'oli, i es tracta de botelles de vi (3.829,53€).&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;- Les factures de FONK «Aubocassa Groth Strategy», referents a ‘'promocion web'', no detallen quines xarxes socials ni nº posts realitzats, ni hores dedicades, ni dies i mesos imputats, ni aporta una mostra significativa de les publicacions o promoció realitzades on es puguin acreditar les actuacions i el logotip. Les factures no detallen que siguin per a la campanya ‘dando la lata', en tot cas de la documentació aportada d'aquesta campanya es demostra que no es va realitzar amb el logotip obligatori &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(8.030,00€) &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Eliminant les factures no admissibles o que no s'acredita el compliment amb la publicitat del fons d'ajuda (Import total: 15.538,53€), no arriba al 50% de la quantitat aprovada.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Atesa l'esmentada Resolució de concessió de l'ajuda, i d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, el beneficiari s'obliga, entre altres, a realitzar les actuacions auxiliades dins del termini establert i a justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en la forma i els terminis determinats en la convocatòria. L'article desè de la convocatòria a l'apartat 2 diu que s'hauran de complir les normes d'informació i publicitat. L'article onzè a l'apartat 8 estableix que ha de justificar correctament com a mínim el 50% de la quantitat aprovada. El mateix article, a l'apartat 4.a determina el següent: «Caldrà aportar una memòria fotogràfica justificativa de les actuacions, en què es vegi la publicitat realitzada del projecte amb el logotip comunitari i el fons de finançament».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6.En data 26 de octubre de 2023 se li notifica telemàticament la Proposta provisional de revocació total de l'expedient, comunicant-li que disposa de deu dies hàbils per presentar al·legacions. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. En data d'avui, l'interessat no ha presentat cap al·legació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- R&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;esolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 21 de maig de 2020, per la qual es convoquen ajudes per la Cooperació entre agents per desenvolupar cadenes curtes de comercialització mitjançant accions de promoció, per a l'any 2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- &lt;/em&gt;&lt;/span&gt;&lt;em&gt;Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Llei 39/2015, de règim jurídic de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Conclusió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement de la revocació per l'incompliment d'obligacions i la no execució correcta, per incomplir les normes de publicitat obligatòries i tenir altres irregularitats, d'almenys el 50% de la inversió concedida, d'acord amb els apartats 10&lt;/em&gt;&lt;sup&gt;&lt;em&gt;è &lt;/em&gt;&lt;/sup&gt;&lt;em&gt;i 11è de la convocatòria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;D'acord amb la Proposta de dia 25/10/2023,&amp;nbsp;dict la següent&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolució&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Procedir a la revocació total de la resolució d'ajuda concedida a l'interesat que figura a l'Annex I, que és un total d'1 expedient i que és AGRICOLA AUBOCASSER S.L&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;amb NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B65592347&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, mitjançant Resolució de concessió del vicepresident del FOGAIBA de dia 10/08/2021, la qual concedia a l'interessat una ajuda per un import de 22.813,00 &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;€&lt;/em&gt;&lt;/span&gt;&lt;em&gt;.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El motiu de la revocació és per l'incompliment dels requisits i obligacions establerts a la convocatòria &lt;/em&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;(article 10&lt;/em&gt;&lt;/span&gt;&lt;sup&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;è&lt;/em&gt;&lt;/span&gt;&lt;/sup&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;&amp;nbsp;Obligacions beneficiaris: publicitat; article 11&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;sup&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;è&lt;/em&gt;&lt;/span&gt;&lt;/sup&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;&amp;nbsp;apartat 8 : almenys 50%) &lt;/em&gt;&lt;/span&gt;&lt;em&gt;. &lt;/em&gt;&lt;span style="color:#111111"&gt;&lt;em&gt;No s'ha fet la publicitat amb el logotip del fons de finançament en cap de les actuacions. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Revocar l'ajuda concedida en la resolució del vicepresident del FOGAIBA de 10/08/2021, corresponent a l'expedient COCCI2020_1/005 per l'import indicat en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. En conseqüència, deixar sense efecte l'esmentada resolució de concessió de l'ajuda i procedir a l'arxiu de les actuacions de l'expedient &amp;nbsp;COCCI2020_1/005.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
