&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1.- Incoar l'expedient de declaració com Bé Catalogat del fons documental i bibliogràfic que formaven part dels fons propietat de Bernat Riera Alemany, General Riera, recollits al llistat inclòs a l'informe i detallats a les fitxes de l'annex I de l'informe tècnic de 09/11/2023, que s'adjunta i forma part integrant del present acord.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2.- Els efectes d'aquesta incoació són els que genèricament estableixen la Llei 12/98, de 21 de desembre, del Patrimoni Històric de les Illes Balears i la normativa concordant.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3.- L'acord de declaració s'haurà d'adoptar en el termini d'un any, comptador des de la data d'iniciació del procediment, el qual caducarà un cop transcorregut aquest termini. Caducat el procediment, no es podrà tornar a iniciar fins al cap d'un any, llevat que ho demani el titular del bé.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4.- Notificar aquesta resolució als interessats, a l'Ajuntament de Palma i al Govern de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5.- Publicar aquest acord en el Butlletí Oficial de les Illes Balears i en el Boletín Oficial del Estado, anotar-ho al Catàleg Insular del Patrimoni Històric de Mallorca i comunicar-ho al de la Comunitat Autònoma de les Illes Balears perquè procedeixi a anotar-lo al Catàleg General del Patrimoni Històric de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Tot això, de conformitat amb el que estableix l'article 14 i següents reguladors del procediment de declaració de béns catalogats de la Llei 12/1998, de 21 de desembre, del patrimoni històric de les Illes Balears.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El trasllat d'aquest acord es fa a reserva de l'aprovació de l'Acta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;INFORME TÈCNIC&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. MEMÒRIA DESCRIPTIVA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La sol·licitud de declaració fa referència a tota una sèrie de béns pertanyents a Bernat Riera Alemany (Andratx 1864-Palma 1926), conegut com a General Riera. A la primera sol·licitud, el primer lot incloïa llibres, manuscrits correspondència i documents, plaques estereoscòpies, reculls de premsa i un arbre genealògic de la casa Formiguera. El segon lot incloïa pintures, mobles i elements decoratius. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Bernat Riera Alemany, conegut com el General Riera, estudià medicina a Barcelona entre 1880 i 1884, desenvolupant la seva tasca professional a Andratx i al Cos de Medicina Militar, principalment a l'Hospital Militar (1897-1926), però també a Cuba (1895-1897), durant la Guerra de Cuba, i a altres hospitals de la resta de l'estat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El seu interès per la medicina científica, principalment sobre la higiene i les transmissions infeccioses, el va convertir en un actor molt actiu durant els debats i controvèrsies sorgides a la societat mallorquina entre el segle XIX i XX sobre l'enderrocament de les murades de Palma, del qual ell era un dels grans defensors. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Bernat Riera es va casar Amparo Pou Moreno, vinculada familiarment amb el comtat de Santa Maria de Formiguera. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Com s'ha dit, la propietat ha desistit de la tramitació de la declaració dels béns inclosos en el lot 2. En aquest lot s'incloïen peces de mobiliari, pintures de diferents autors i èpoques. Es tractava d'un conjunt molt heterogeni, amb obres de desigual qualitat i, per tant, sense valors susceptibles de ser considerats suficients per a la seva declaració. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El lot 1, el conformen un conjunt bibliogràfic que inclou llibres de diferent temàtica (medicina, botànica, història, etc.) i un conjunt documental, que constitueix la part amb més valors patrimonials, amb documentació manuscrita i plaques estereoscòpiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest grup documental inclou llibres de capbreus i censals des del s. XVI de la casa del compte de Santa Maria de Formiguera; correspondència privada del General Riera i d'Amparo Pou (amb l'Arxiduc, Emilio Castelar, etc,) o llibres de viatges i dietaris on s'inlouen escrits i dibuixos de Santiago Rossinyol, Costa i Llobera, Miquel des Sants Oliver, Maria Antònia Salvà, Caffaro, Joan Alcover, Miquel Ferrà, etc. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquest lot 1, presenta valors suficients per a què, una part pugui ser declarat com a Bé Catalogat. De fet, l'Arxiu del Regne de Mallorca ha mostrat interès en poder adquirir part d'aquest fons, que serà el què es recollirà com a part integrant de la declaració de Bé Catalogat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El conjunt documental i bibliogràfica que s'inclou a la declaració com a Bé catalogat queda conformat pels següents elements (el número d'inventari correspon al remés per la propietat): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;S'haurà d'estar al que assenyala la llei 12/98, del patrimoni històric de les Illes Balears, especialment en el seus articles 3 (col·laboració dels particulars), 22 (protecció general dels béns del patrimoni històric), 26 (deure de conservació), 27 (incompliment del deure de conservació), 28 (reparació de danys), 44 (Règim general dels béns mobles), 46 (col·leccions), 47 (conservació) i el que assenyala la llei 16/1985, de 25 de juny, del patrimoni històric espanyol, especialment al seu Títol VII, Cap. 1, del Patrimoni documental i bibliogràfic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. CONCLUSIÓ &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
