CAIB 2023-11-24 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Antecedents</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1. El <span style="color:#000000">29 de novembre de 2022,</span> es va publicar en el <em>Butlletí</em><em> Oficial de les Illes Balears</em> l'Ordre 30/2022 del conseller de Model Econòmic, Turisme i Treball per la qual s'estableixen les bases reguladores i s'aprova la convocatòria per a la concessió d'ajuts <em>de</em> <em>minimis </em>per a la modernització i la innovació en la higiene i en la neteja dels establiments d'allotjament turístic, destinada a la compra de mecanismes d'elevació de llits, per acomplir l'article 37 bis de la Llei 8/2012, del turisme de les Illes Balears, en el marc del Pla de Recuperació, Transformació i Resiliència finançat per la Unió Europea Next Generation EU.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El 28 de febrer de 2023, es va publicar en el <em>Butlletí</em><em> Oficial de les Illes Balears </em><em>la </em>Resolució del conseller de Model Econòmic, Turisme i Treball per la qual es modifica la convocatòria esmentada en el punt anterior, en el sentit d'ampliar el termini de presentació de sol·licituds i de modificar la composició de la Comissió Avaluadora.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2. D'acord amb el que s'exposa en l'Ordre 30/2022 i en el punt 5 de la convocatòria, la convocatòria està sotmesa al règim <em>de</em> <em>minimis</em> establert en el Reglament (UE) 1407/2013 de la Comissió Europea, de 18 de desembre de 2013, relatiu a l'aplicació dels articles 107 i 108 del Tractat de funcionament de la Unió Europea en les ajudes <em>de</em> <em>minimi</em><em>s</em>. En conseqüència, les ajudes previstes són compatibles amb el mercat interior i, alhora, resten exemptes de l'obligació de notificació establerta en l'article 108, apartat 3, del Tractat de funcionament de la Unió Europea.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. El termini per presentar sol·licituds es va iniciar el 30 de novembre de 2022 i finalitzà el 28 d'abril de 2023, d'acord amb l'establert en el punt 13 de la convocatòria. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. El 27 de juny, analitzades totes les sol·licituds presentades i d'acord amb l'article 10 de l'Ordre 30/2022, es va publicar en el <em>Butlletí Oficial de les Illes Balears</em> un requeriment conjunt a fi que les persones sol·licitants esmenassin les deficiències indicades, amb l'advertència que, si no ho feien, s'entendria que desistien de la sol·licitud.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El</span><span style="color:#000000"> </span><span style="color:#000000">23 d'agost de 2023</span><span style="color:#000000">, </span><span style="color:#000000">la Comissió Avaluadora </span><span style="color:#000000">n'</span><span style="color:#000000">emeté</span><span style="color:#000000"> informe </span><span style="color:#000000">en el qual, </span><span style="color:#000000">en aplicació dels criteris per a l'adjudicació dels ajuts </span><span style="color:#000000">prevists en la convocatòria</span><span style="color:#000000">, </span><span style="color:#000000">es relacionen </span><span style="color:#000000">les </span><span style="color:#000000">persones </span><span style="color:#000000">sol·licitants que compleixen els requisits per poder ser benefici</span><span style="color:#000000">àries</span><span style="color:#000000"> </span><span style="color:#000000">de l'ajut </span><span style="color:#000000">i l</span><span style="color:#000000">a quantia individual</span><span style="color:#000000"> d'</span><span style="color:#000000">aquest</span><span style="color:#000000">, calcula</span><span style="color:#000000">t</span><span style="color:#000000"> d'acord amb </span><span style="color:#000000">els </span><span style="color:#000000">punts 10 i 11 de la convocatòria.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En concret, la </span><span style="color:#000000">C</span><span style="color:#000000">omissió </span><span style="color:#000000">A</span><span style="color:#000000">valuadora considera que n</span><span style="color:#000000">o és necessari aplicar el prorrateig </span><span style="color:#000000">establert</span><span style="color:#000000"> en el punt 10 de la convocatòria, atès que hi ha crèdit suficient per atorgar a tot</span><span style="color:#000000">es les persones</span><span style="color:#000000"> benefici</span><span style="color:#000000">à</span><span style="color:#000000">ries l'import de l'ajut, d'acord amb la intensitat prevista en el punt 11 de la convocatòria. Això és:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>a)</em><span style="color:#000000"> </span>Per als establiments de fins a 50 habitacions, se subvenciona el 50 % de la despesa elegible.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>b)</em><span style="color:#000000"> </span>Per als establiments d'entre 51 i 150 habitacions, se subvenciona el 40 % de la despesa elegible.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><em>c)</em><span style="color:#000000"> </span>Per als establiments de més de 150 habitacions, se subvenciona el 30 % de la despesa elegible.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">La despesa elegible de l'ajuda és del 100 % del preu unitari de compra del mecanisme d'elevació de llits, amb un import màxim de 380 euros.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. El 19 de setembre de 2023 es va publicar en el <em>Butlletí Oficial de les Illes Balears</em>, la primera proposta de resolució provisional amb la relació de les persones proposades com a beneficiàries amb un ajut per import igual o superior a 30.000 euros, atorgant un termini de 10 dies per a presentar al·legacions mitjançant el tràmit electrònic especificat en les bases de la convocatòria. No consta que durant aquest període d'audiència s'hagin presentat al·legacions.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">7. <span style="color:#000000">D'acord amb l'informe de la Comissió Avaluadora de 16 d'octubre de 2023, en aplicació dels criteris per a l'adjudicació dels ajuts prevists en la convocatòria i d'acord amb l'exposat en l'antecedent 5 anterior, tal com </span>preveu el primer paràgraf de l'article 13.2 de l'Ordre 30/2022 del Conseller de Model Econòmic, Turisme i Treball i atès que no s'han presentat al·legacions mitjançant el tràmit electrònic específic, el director general de Turisme va formular la primera proposta de resolució definitiva.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Aquesta proposta de resolució definitiva, d'acord amb el segon paràgraf de l'article 13.2 de l'Ordre 30/2022 s'ha notificat, mitjançant la publicació en el <em>Butlletí Oficial de les Illes Balears</em> de 24 d'octubre de 2023, a les persones interessades a les quals se'ls hi va atorgar un termini de deu dies perquè pugui renunciar a l'import de la subvenció contingut en la proposta. En aquest termini de deu dies no consta que s'hagi presentat cap renúncia, per la qual cosa, d'acord amb el paràgraf tercer de l'article 13.2 de l'Ordre 30/2022, s'entén que la persona sol·licitant l'accepta.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">8. Els expedients inclosos en la proposta de resolució definitiva han estat fiscalitzats de conformitat per la Intervenció de la CAIB dia 14 de novembre de 2023.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">9. L'annex d'aquesta resolució</span> <span style="color:#000000">conté la relació de les persones beneficiàries amb un ajut per import igual o superior a 30.000 euros.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">10. Consta en l'expedient administratiu que totes les persones beneficiàries es troben al corrent de les obligacions tributàries i amb la Seguretat Social.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">11. El Reial decret 449/2022, de 14 de juny, pel qual es regula la concessió directa de subvencions destinades al finançament de les estratègies de resiliència turística per a territoris extrapeninsulars, en el marc del Pla de Recuperació, Transformació i Resiliència, i pel qual es modifiquen diversos reials decrets en matèria turística.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">12. Autoritzar i disposar una despesa global de 480.645,28 €, a favor de les persones beneficiàries que figuren en l'annex i pels imports individuals que s'hi indiquen, amb càrrec a la partida pressupost<span style="color:#000000">ària </span><span style="color:#00000a">12201/G/751C01/77000/MR071</span> <span style="color:#000000">dels</span> pressuposts vigents de la Comunitat Autònoma de les Illes Balears.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3</span><span style="color:#000000">.</span><span style="color:#000000"> Fer constar que, d'acord amb el punt </span><span style="color:#000000">15</span><span style="color:#000000"> de la convocatòria, el període d'execució de les accions subvencionables, enteses com la compra dels mecanismes d'elevació de llits, finalitza als dos mesos d'</span><span style="color:#000000">ençà</span><span style="color:#000000"> </span><span style="color:#000000">que es publiqui </span><span style="color:#000000">aquesta</span><span style="color:#000000"> resolució de concessió </span><span style="color:#000000">en el </span><span style="color:#000000"><em>Butlletí Oficial de les Illes Balears,</em></span><span style="color:#000000"> d'acord amb el que estableix l'article 13 de l'Ordre </span><span style="color:#000000">30/2022.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4</span><span style="color:#000000">.</span><span style="color:#000000"> Fer constar que, d'acord amb el punt 1</span><span style="color:#000000">6</span><span style="color:#000000"> de la convocatòria, </span><span style="color:#000000">e</span><span style="color:#000000">l termini per a la justificació de la subvenció és d'un mes, comptador des de l'endemà de la conclusió del termini d'execució establert en </span><span style="color:#000000">el punt</span><span style="color:#000000"> anterior. </span><span style="color:#000000">El mateix </span><span style="color:#000000">punt </span><span style="color:#000000">disposa</span><span style="color:#000000"> que la justificació de l'ajuda consisteix </span><span style="color:#000000">a</span><span style="color:#000000"> presenta</span><span style="color:#000000">r</span><span style="color:#000000"> la factura i els corresponents justificants bancaris o anàlegs que acreditin el pagament de la factura proforma presentada juntament amb la sol·licitud. D</span><span style="color:#000000">'acord amb l'article 1</span><span style="color:#000000">5</span><span style="color:#000000"> de l'Ordre, </span><span style="color:#000000">la presentació de la justificació </span><span style="color:#000000">ha de </span><span style="color:#000000">fer-se</span><span style="color:#000000"> exclusivament de forma telemàtica, a través del tràmit específic «</span><span style="color:#000000">Justificació de la subvenció» </span><span style="color:#000000">que es </span><span style="color:#000000">troba</span><span style="color:#000000"> en l'</span><span style="color:#000000">apartat «Mecanismes d'elevació de llits» de la</span><span style="color:#000000"> pàgina web mrrturisme.caib.es.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les justificacions dels ajuts </span><span style="color:#000000">que s'hagin pogut </span><span style="color:#000000">presenta</span><span style="color:#000000">r </span><span style="color:#000000">en el tràmit telemàtic específic a partir del dia 19 de setembre de 2023, inclòs, seran analitzades una vegada es publiqui </span><span style="color:#000000">aquesta</span><span style="color:#000000"> resolució de concessió </span><span style="color:#000000">en el </span><span style="color:#000000"><em>Butlletí Oficial de les Illes Balears</em></span><span style="color:#000000"><em>.</em></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Fer constar que la persona beneficiària de la subvenció ha de complir el règim de publicitat establert en el punt 19 de la convocatòria. Les característiques dels cartells informatius s'especificaran en la pàgina web mrrturisme.caib.es</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. Fer constar que aquesta subvenció ha estat finançada amb fons procedents del Ministeri d'Indústria, Comerç i Turisme, en el marc del Pla de Recuperació, Transformació i Resiliència del Mecanisme de Recuperació i Resiliència.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Interposició de recursos</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Turisme, Cultura i Esports en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
