&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;En data 13 de gener de 2022, l&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; Presidència&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;Institut&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Mallorquí&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;Afers&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Socials&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(en endavant IMAS)&lt;/span&gt;&lt;span style="color:#000000"&gt; mitjançant Resolució núm. 399, &lt;/span&gt;&lt;span style="color:#000000"&gt;va&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;aprovar&lt;/span&gt;&lt;span style="color:#000000"&gt; la &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatòria pel procediment d'urgència de la concertació del &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servei d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA)&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; per l'atenció i acompanyament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; (BOIB núm. 10, de 18 de gener de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;Mitjançant Resolució de la Presidència de l'IMAS, núm. 5206 de 29 de març de 2022 (BOIB núm. 145 de 10 de novembre de 2022), es va aprovar l'adjudicació de 8 places de l'esmentat servei a l'entitat FUNDACIÓN DIAGRAMA, amb CIF núm. G73038457, per un període d'1 any, des de l'1 d'abril de 2022 fins al 31 de març de 2023 conforme als preu/plaça/dia següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«a) Cost diari per plaça ocupada: 180,02€/dia (IVA exempt). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) Cost diari per plaça no ocupada o en reserva: 164,39€/dia ( IVA exempt).&lt;/em&gt;&lt;/span&gt;&lt;em&gt;»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;El dia 31 de març de 2022, es va formalitzar la col·laboració objecte d'aquesta concertació mitjançant el corresponent Acord d'acció concertada amb l'entitat adjudicatària i a l'estipulació tercera, relativa a la vigència, es preveu la possibilitat de renovació sempre i quan l'entitat hagi obtingut l'acreditació del servei corresponent o subsisteixin les necessitats que n'hagin motivat la seva formalització, d'acord amb l'establert a la disposició final primera de la Llei 12/2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. &lt;/strong&gt;El 8 de març de 2023, prèvia tramitació de l'expedient, es va resoldre per la Presidència de l'IMAS la renovació de l'Acord d'acció concertada per una anualitat mes, que comprèn de l'1 d'abril de 2023 fins al 31 de març de 2024, amb les mateixes condicions econòmiques i tècniques (BOIB núm. 32, de 14 de març de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5&lt;/strong&gt;. L'entitat FUNDACIÓ DIAGRAMA en data de 21 d'abril de 2023 i 19 de juny de 2023, amb números de registre 62943/2023 i 71845/2023 respectivament , va presentar sol·licituds per a la revisió de les condicions econòmiques de la concertació social del servei d'&lt;span style="background-color:#ffffff"&gt;acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA)&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; per l'atenció i acompanyament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; i la concertació social del servei d'&lt;span style="background-color:#ffffff"&gt;acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA)&lt;span style="color:#000000"&gt; &lt;/span&gt;recepció i valoració diagnòstica, tenint com a referència el l Conveni Col·lectiu de Sector de Reforma Juvenil i Protecció de Menors de Balears (codi conveni: 07100585012018), aplicable als treballadors de l'entitat i l'increment general de l'Index de Preus de Consum (IPC). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;La petició relacionada amb la concertació social de tipologia recepció i valoració diagnòstica sirà objecte de resposta en el seu expedient de referència. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. &lt;/strong&gt;El cap de la Secció Econòmica, a petició de la Direcció Insular d'Infància i Família (actuament Direcció Insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència) va emetre Informe econòmic en data de 9 de maig de 2023, relatiu a la revisió del preu plaça/dia de la concertació social pel procediment d'urgència del &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servei acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA) per l'atenció i acompanyament, per el qual tenint en compte l'evolució de les despeses laborals i despeses directes de prestació del servei conforme s'indica a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;strong&gt;7. &lt;/strong&gt;Des de la Direcció Insular d'Infància i Família (actualment Direcció Insular de Centres i Programes d'Atenció Integral a la Infància i Adolescència), va emetre informe en data de 19 de maig de 2023, per el qual, proposa la revisió i actualització de les condicions econòmiques de la concertació social, pel procediment d'urgència, del &lt;/span&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:#ffffff"&gt;servei acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA) per l'atenció i acompanyament, amb efectes retroactius de data 1 d'abril de 2023 de conformitat amb la taula indicada a l'antecedent sisè.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; El 18 d'agost de 2023 la Presidència de l'IMAS va ordenar l'inici del procediment per a l'actualització i revisió de preu de la concertació pel procediment d'urgència del &lt;span style="background-color:#ffffff"&gt;servei d'acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA) per l'atenció i acompanyament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. &lt;/strong&gt;El cap de la Secció Econòmica el 2 d'octubre de 2023 va emetre informe complementari relatiu a la revisió del preu de la &lt;span style="color:#000000"&gt;concertació pel procediment d'urgència del &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servei d'acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA) per l'atenció i acompanyament, per el qual estima l'increment total màxim d'aquesta revisió de preu en 17.877,60€ (IVA exempt), i valora l'estabilitat pressupostària i la sostenibilitat financera dels pressuposts de l'IMAS, a causa d'aquesta revisió, com a favorable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. &lt;/strong&gt;El 5 d'octubre de 2023 es va reunir&lt;/span&gt; la Comissió Avaluadora prevista a la convocatòria aprovada per&lt;span style="color:#000000"&gt; l&lt;/span&gt;&lt;span style="color:#000000"&gt;a Resolució de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;13 de gener de 2022 de la&lt;/span&gt;&lt;span style="color:#000000"&gt; Presidència&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;IMAS d'aprovació&lt;/span&gt;&lt;span style="color:#000000"&gt; de la &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatòria pel procediment d'urgència de la concertació del &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servei d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA) per&amp;nbsp;l'atenció i acompanyament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; (BOIB núm. 10, de 18 de gener de 2022)&lt;/span&gt;i va aprovar l'increment del preu del concert conforme s'indica a l'antecedent sisè.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.&lt;/strong&gt; En data de 10 d'octubre de 2022 es dona tràmit d'audiència a l'entitat DIAGRAMA perquè pugui formular propostes i al·legacions abans d'acordar la revisió i la modificació de les condicions del concert, les quals ha d'acceptar expressament l'entitat concertada, sense perjudici dels recursos que aquesta pugui interposar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. &lt;/strong&gt;Atès que aquesta revisió comporta aprovació de despesa pluriennal, el Servei de Comptabilitat i Pressupost del Consell de Mallorca&lt;strong&gt; &lt;/strong&gt;ha emès informe favorable en data de 13 d'octubre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. &lt;/strong&gt;En data 25 d'octubre de 2023, l'entitat DIAGRAMA enregistra instància per la qual accepta expressament les noves condicions econòmiques proposades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; El Servei Juridicoadministatiu i la Intervenció delegada de l'IMAS han emès informe favorable a la proposta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa a la competència; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; 7.2.28&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; dels Estatuts de l'IMAS (BOIB núm. 67, de 18 de maig de 2019).&lt;span style="color:#000000"&gt; &lt;/span&gt;No obstant això, i d'acord amb l'article 8.2.1 les Vicepresidències de l'IMAS supliran a la Presidència i assumiran les seves atribucions en cas de vacant, absència, malaltia, impossibilitat física o una altre causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa al fons, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, preveu a &lt;span style="color:#000000"&gt;l''article 89 sexies la possibilitat de revisar les condicions del concert durant la seva vigència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt; Resolució de la Presidència de l'IMAS, núm. &lt;/span&gt;&lt;span style="color:#000000"&gt;399&lt;/span&gt;&lt;span style="color:#000000"&gt; de data 13&lt;/span&gt;&lt;span style="color:#000000"&gt; de gener de 2022&lt;/span&gt;&lt;span style="color:#000000"&gt;, d'aprovació de l'expedient de &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatòria&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;pel&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;procediment&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'urgència&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;la&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;concertació&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;del&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servei d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;acolliment residencial especial per a persones menors d'edat migrants no acompanyades (NNAMNA)&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; per l'atenció i acompanyament&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; (BOIB núm. 10, de 18 de gener de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; Resolució de la Presidència de l'IMAS de 8 de març de 2023 d'aprovació de la renovació de l'acord d'acció concertada del servei d'intervenció familiar en el domicili, signat amb l'entitat DIAGRAMA (BOIB núm. 32, de 14 de març de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6&lt;/strong&gt;. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears (&lt;em&gt;BOIB&lt;/em&gt; núm. 146 de 22 de novembre de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa al procediment,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;El Decret 48/2017, de 27 d'octubre, (BOIB número 132 de 28 d'octubre de 2017) pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. &lt;/strong&gt; L'article 214 del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei reguladora de les Hisendes Locals, i atès l'acord d'aprovació del règim de fiscalització i intervenció limitada prèvia de requisits bàsics i presa de raó en ingressos del Consell Insular de Mallorca i de les entitats del seu sector públic subjectes a funció interventora de data 12 de desembre de 2019, l'expedient ha de ser sotmès a la Intervenció delegada de l'IMAS per a l'emissió del preceptiu informe de fiscalització prèvia ( BOE núm. 59 de 9 de març de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Pel que fa a la despesa, hi ha crèdit suficient per afrontar aquesta despesa i s'acredita amb els documents comptables que obren a l'expedient i que s'emeten a càrrec de la partida pressupostària 20.23160.26000. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;No obstant, la despesa per a l'any 2024 queda supeditada a l'existència de crèdit pressupostari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercer. &lt;/strong&gt;NOTIFICAR aquesta resolució a l'entitat sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart&lt;/strong&gt;. INFORMAR a l'entitat interessada que, atesa la seva conformitat expressa, aquesta resolució s'inclourà com a addenda al seus acords d'acció concertada, regint-se el concert per l'Acord d'acció concertada subscrit amb l'IMAS sense perjudici de l'establiment del nou preu plaça i pressupost total del concert fitxat en aquesta resolució. No obstant, si així ho prefereixen les entitats podran instar la signatura d'una addenda específica en el termini de cinc dies des de la signatura d'aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Cinquè. &lt;/span&gt;&lt;/strong&gt;PUBLICAR aquesta Resolució en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears, &lt;/em&gt;així com al Tauler d'Anuncis de l'IMAS i a la Seu electrònica del Consell de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 (BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent.
