    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-top:6,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Convocatòria d'ajudes per al desenvolupament rural de l'illa de Mallorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Mallorca, de data 13 de novembre de 2020&amp;nbsp;especifica que la resolució es publicarà amb caràcter informatiu a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu&amp;nbsp;l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en Matèria Agrària del FOGAIBA en&amp;nbsp;data 26&amp;nbsp;d'octubre&amp;nbsp;de 2023, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-right:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data 19 de novembre de 2020 es va publicar, en el BOIB núm. 197, l'anunci de la publicació de l'Acord de la Junta Directiva de l'Associació de Mallorca Rural Grup d'Acció Local de Mallorca aprovant la Convocatòria, per a l'any 2020, d'ajudes al desenvolupament rural de l'illa de Mallorca, vinculades a projectes relacionats amb els àmbits agrari i/o ambiental i emmarcats en l'Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-right:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En data 4 d'agost de 2022 es va publicar al BOIB núm. 102 la Resolució de concessió del vicepresident en matèria agrària del FOGAIBA de dia 14 de juliol de 2022, a l'empara de la Convocatòria per a l'any 2020 abans esmentada, en la qual hi figurava una concessió a favor del beneficiari que apareix en l'annex I adjunt, que és 1, i que comença i acaba amb CONSELL REGULADOR DE LA INDICACIÓ GEOGRÀFICA PROTEGIDA AMETLLA DE MALLORCA amb NIF Q0700705G, amb núm. d'expedient EDLNP32020_1/042.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-right:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.En data 18 de gener de 2023, i amb número de registre d'entrada GOIBE54686/2023, el Sr. ANTONIO BONAFÉ RAMIS amb NIF &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;***&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7016&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;**, en nom i representació del CONSELL REGULADOR DE LA INDICACIÓ GEOGRÀFICA PROTEGIDA AMETLLA DE MALLORCA amb NIF Q0700705G, va presentar sol·licitud de renúncia de l'ajuda concedida per no disposar dels medis tècnics i econòmics necessaris per a l'execució del projecte, la qual cosa suposa dur a terme la revocació total de l'ajuda concedida. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-right:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4.L'article 21.1 &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.L'article 43 del Text refós de la Llei de subvencions, aprovat per decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. A conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:14,1500pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6.Atès tot això, es proposa fer la revocació total a causa de la renúncia de l'ajuda concedida pel beneficiari que s'indica a l'annex I d'aquesta resolució.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Acord pel qual s'aproven les Bases de la convocatòria, per a l'any 2020, d'ajudes al desenvolupament rural de l'illa de Mallorca, vinculades a projectes relacionats amb els àmbits agrari i/o ambiental i emmarcats en l'Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:5,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:5,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;p&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;rocediment &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministratiu comú de les &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministracions &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s'informa favorablement i proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Acceptar la renúncia &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de l'ajuda concedida per Resolució del vicepresident en matèria agrària del FOGAIBA de dia 14 de juliol del 2022, presentada pel beneficiari detallat en l'annex I adjunt, que són un total d'1 expedient i que comença amb CONSELL REGULADOR DE LA INDICACIÓ GEOGRÀFICA PROTEGID&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A AMETLLA DE MALLORCA i acaba amb CONSELL REGULADOR DE LA INDICACIÓ GEOGRÀFICA PROTEGIDA AMETLLA DE MALLORCA, relativa a la línia d'ajuda «Suport a la implementació a les operacions incloses els EDL No Programats MALLORCA» de la Convocatòria per a l'any 2020, d'ajudes al desenvolupament rural de l'illa de Mallorca, vinculades a projectes relacionats amb els àmbits agrari i/o ambiental i emmarcats en l'Estratègia de Desenvolupament Local Participatiu 2014-2020 de Mallorca. EDLNP32020_1.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Revocar totalment l'ajuda concedida en la Resolució del vicepresident en matèria agrària del FOGAIBA de dia 14 de juliol de 2022 abans esmentada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Declarar conclòs el procediment i arxivar l'expedient.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
