(FECOEV, SAU) per a la programació i execució de la Fira infantil Diverespai 2023/2024. Exp. 2023/00018667H</span></strong></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Havent-se presentat la següent proposta, amb la declaració prèvia d'urgència:</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">“El dia 28 de setembre de 2023, la consellera executiva del Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” va disposar la incoació de l'expedient per a la programació i execució total de la Fira Diverespai 2023/2024. </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'import a destinar a la programació i execució de la Fira Diverespai 2023/2024 ascendeix a la quantitat màxima de </span><strong><span style="background-color:null">493.894,15 € </span></strong><span style="background-color:null">(quatre-cents noranta-tres mil vuit-cents noranta-quatre euros amb quinze cèntims), amb càrrec a l'aplicació pressupostària </span><strong><span style="background-color:null">3370-2279900.</span></strong><span style="background-color:null"> L'esmentada quantitat es distribuirà entre els pressupostos de 2023 i 2024 de la següent manera:</span></span></span></span></p> <ul style="margin-left:40px"> <li><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">10.000,00 € a càrrec de la partida pressupostària 3370-2279900 del pressupost del Consell Insular d'Eivissa per l'any 2023.</span></span></span></span></li> <li><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">483.894,15 € a càrrec de la partida pressupostària 3370-2279900 del pressupost del Consell Insular d'Eivissa per l'any 2024.</span></span></span></span></li> </ul> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">El Consell Insular d'Eivissa no compta amb els mitjans propis suficients per dur a terme la programació i execució de l'esmentada fira. No obstant l'article 11.1. de la Llei 40/2015 d'1 d'octubre de règim jurídic del sector públic estableix que </span></span></span></span></p> <p style="margin-left:80px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">la realització d'activitats de caràcter material o tècnic de la competència dels òrgans administratius o de les entitats de dret públic es pot encarregar a altres òrgans o entitats de dret públic de la mateixa Administració o d'una altra, sempre que entre les seves competències estiguin aquestes activitats, per raons d'eficàcia o quan no es posseeixin els mitjans tècnics idonis per exercir-les (...). </span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Per altra banda, l'article 115.1 de de la Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88, de 7-07-2022) estableix:&nbsp; </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">1. En el marc de la legislació de règim jurídic de les administracions públiques, els consells insulars i els seus ens instrumentals poden encarregar la realització d'activitats de caràcter material o tècnic de la seva competència a altres administracions públiques. Així mateix poden acceptar els encàrrecs de gestió que els proposin altres ens públics d'acord amb els apartats següents.</span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'encàrrec ha de complir l'establert a l'Acord de fiscalització limitada prèvia per a l'adaptació dels requisits addicionals prevists a l'acord del Consell de Ministres de 30 de maig de 2008, modificat el 7 de juliol de 2011, i el 20 de juliol de 2018, respecte a l'exercici de la funció interventora en règim de requisits bàsics, adoptat pel Ple del Consell Insular d'Eivissa en sessió de data 29-11-2018, en relació als expedients d'encàrrecs de gestió.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Vist que amb data 9 d'octubre de 2023, expedient núm. 2/2023000005685, es va fer el preceptiu RC de l'exercici en curs i expedient núm. 2/2023000005686, RC a futurs de l'exercici 2024, que dota de crèdit l'encàrrec de gestió directa i eventual per dur a terme l'organització i execució de la Fira Diverespai 2023/2024, que es celebrarà en les dates determinades en la memòria tècnica, es a dir, entre els dies 26 de desembre de 2023 i 3 de gener de 2024, al Recinte Firal d'Eivissa.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En data 11 d'octubre de 2023 es va emetre memòria tècnica on es concreten tant les característiques dels treballs que s'han d'encarregar, com la justificació, els terminis, el pressupost, les formes de pagament, la possibilitat de modificacions i pròrrogues, etc. (CSV: 14614150524036363741).</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Vist l'informe tècnic favorable, de data 11 d'octubre de 2023 sobre els criteris econòmics i d'eficàcia que justifiquen que s'encarregui a Fires, Congressos i Esdeveniments d'Eivissa, SAU (FECOEV) dur a terme la prestació del servei per a la producció tècnica i execució de l'esmentada fira, que preveu la possibilitat que el mitjà propi contracti prestacions parcials amb tercers, que l'import d'aquestes prestacions no excedeix del 50% de la quantia de l'encàrrec, amb les excepcions previstes a l'article 32.7 de la Llei 9/2017 de 8 de novembre, de contractes del sector públic.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Així mateix, vist l'informe jurídic favorable, igualment, de data 11 d'octubre de 2023</span><strong><span style="background-color:null">, </span></strong><span style="background-color:null">amb el vist i plau del secretari general de la corporació, en relació a l'encàrrec de la gestió directa i eventual del Consell Insular d'Eivissa a un mitjà propi personificat, (Fires, Congressos i Esdeveniments d'Eivissa, S.A.U. (FECOEV) per dur a terme la producció tècnica i execució de la fira Diverespai 2023/2024 que es celebrarà al Recinte Firal entre els dies 26 de desembre de 2023 i 3 de gener de 2024.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Vist, que aquest encàrrec de gestió a un mitja propi personificat (Fires, Congressos i&nbsp; Esdeveniments d'Eivissa SAU, (FECOEV) per la producció tècnica i execució de la fira Diverespai 2023/2024 que es celebrarà al Recinte Firal entre els dies 26 de desembre de 2023 i 3 de gener de 2024 es realitzarà de conformitat amb la legislació vigent que hi sigui d'aplicació, i en tot cas, observant les prescripcions contingudes als articles, 11 i 86 Llei 40/2015, de 1 d'octubre, del Règim Jurídic del Sector Públic i als articles 6 i 32 de la Llei 9/2017, de 8 de novembre, de contractes del Sector Públic.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Concretament, amb relació a l'article 32.7 b) de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, i coneixent els recursos amb els que compta FECOEV i la possible necessitat de recórrer a la contractació de tercers per l'execució parcial de l'encàrrec, s'ha previst que en cas, aquests contractes no superaran en cap moment el 50% de la quantia de l'encàrrec, ja que dels 493.894,15 € que s'estima com a import total de l'encàrrec, si fos necessari&nbsp; s'arribaria a contractar amb tercers un màxim de 245.655,00 €, que suposa un 49,74% del total del pressupost.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Pel que fa a la competència per aprovar l'encàrrec de gestió a un mitjà propi personificat,&nbsp; l'article 28 de l'esmentada Llei 4/2022, disposa que</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">1. </span><strong><span style="background-color:null">Corresponen al consell executiu</span></strong><span style="background-color:null"> les atribucions següents:</span></em></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">h) Exercir les competències d'òrgan de contractació en tot tipus de contractes en els mateixos casos que la legislació de contractes del sector públic preveu per a la </span><strong><span style="background-color:null">Junta de Govern Local en els municipis de gran població</span></strong><span style="background-color:null">, sens perjudici del que pugui preveure el reglament orgànic. </span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Per la seua banda, l'apartat quart de la disposició addicional segona de la Llei 9/2017, de 8 de novembre, de contractes del Sector Públic, disposa que </span></span></span></span></p> <ol> <li><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">En els municipis de gran població a què es refereix l'article 121 de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local, </span><strong><span style="background-color:null">les competències de l'òrgan de contractació que descriuen els apartats anteriors les ha d'exercir la junta de govern local, sigui quin sigui l'import del contracte o la durada d'aquest</span></strong><span style="background-color:null">, i el Ple és competent per aprovar els plecs de clàusules administratives generals.</span></em></span></span></span></li> </ol> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">De la valoració conjunta d'ambdues preceptes entenen que correspon al Consell Executiu l'aprovació d'aquest encàrrec de gestió.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Atès l'informe proposta favorable emès pel gerent del Campament de sa Cala des Jondal en data 11 d'octubre de 2023.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En virtut de tot l'anterior i del que estableix l'article 72.d) del reglament orgànic del Consell Insular d'Eivissa (BOIB núm. 136 de 18-09-2010, correcció en BOIB núm. 148, de 14-10- 2010, modificació en BOIB núm. 48, de 16-04-2016), el conseller que subscriu, en virtut de les atribucions que tenc conferides pels Decrets de Presidència 2023000467, de data 29 de juny de 2023, d'estructura del Govern del Consell Insular d'Eivissa i creació de Departaments, núm. 2023000472, de data 28 de juny de 2023, de &nbsp;nomenament de les persones membres del Consell Executiu i de les vicepresidències del Consell Insular d'Eivissa (tots dos al BOIB núm. 88, de 29-06-2023), i amb caràcter previ a &nbsp;l'emissió del corresponent informe de fiscalització previ, preceptiu i necessari, de la Intervenció de la corporació, i per al cas que l'esmentat informe sigui favorable i de conformitat, elev al Consell Executiu del Consell Insular d'Eivissa, si ho estima adient, la següent</span></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; Portar a terme les actuacions que són objecte de l'encàrrec de gestió per a la programació i execució de la Fira Diverespai 2023/2024:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">a) Aportar personal i equips d'il·luminació, personal i equips de so, personal de càrrega i descàrrega de material, transport de personal i material, producció tècnica de les actuacions, adequar espais per tallers, aportar els requeriments tècnics pel muntatge dels inflables, les infraestructures necessàries per complir amb rigor el Pla d'autoprotecció corresponent, les infraestructures necessàries per cobrir les necessitats dels monitors i la resta de personal tècnic i, en definitiva, qualsevol equipament i/o requeriment sol·licitat per personal encarregat de desenvolupar les activitats així com les que venen definides en el pressupost.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">b)&nbsp;<span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Contractar i signar els contractes amb les empreses corresponents segons el calendari de desenvolupament de la fira.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">c)&nbsp;<span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Els pagaments a les empreses corresponents es realitzarà en els termes i terminis establerts al contracte signat entre FECOEV i les empreses en qüestió.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">d)&nbsp;<span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">La realització de tota la publicitat en premsa escrita, premsa digital, radio, impressió i distribució de tota la cartelleria i qualsevol altre material publicitari. L'escut del Consell Insular d'Eivissa haurà d'estar pressent de forma destacada en tots els suports publicitaris que s'editin per promocionar la fira.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'esmentada publicitat serà en llengua catalana. Complir l'establert a la Llei 9/2017, de 8 de novembre, de contractes del sector públic, per la qual es transposen a l'ordenament jurídic espanyol les directives del Parlament Europeu i del Consell 2014/23/UE i 2014/24/UE, de 26 de febrer de 2014. Igualment, per a la realització de la fira, estarà obligada al compliment de la Llei 7/2014, de 26 de novembre, de règim jurídic d'instal·lació, accés i exercici d'activitats de les Illes Balears.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">3. Complir el que disposa la Llei 31/1995 de 8 de novembre, de prevenció de riscos laborals, tot el seu desenvolupament normatiu i disposicions relacionades.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">4. Posar a disposició de les persones usuàries, a la recepció del recinte, fulles de reclamació i queixes.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">5. FECOEV, SAU, a l'hora de contractar personal, monitors, empreses subministradores d'inflables i altres atraccions, tallers, etc., complirà escrupolosament en les especificacions de caràcter tècnic que s'assenyalen a l'apartat 8 d'aquest document. </span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">El Consell Insular d'Eivissa es farà càrrec únicament de la venda d'entrades. El preu de les entrades ve fixat per l'ordenança reguladora del preu públic de Diverespai, publicada al BOIB núm. 184, de 8 de desembre de 2011, modificada al BOIB núm. 5, de 10 de gener de 2013.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">2. Mitjà propi destinatari de l'encàrrec</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Fires, Congressos i Esdeveniments d'Eivissa, SAU (FECOEV) és una societat mercantil de capital íntegrament públic del Consell Insular d'Eivissa (que ha subscrit el 100% de capital), creada a l'empara de l'article 103 de Reial Decret Legislatiu 781/1986, de 18 d'abril, pel qual s'aprova el text refós de les Disposicions Legals vigents en matèria de règim local i articles 89 i ss. del Reglament de Serveis de les Corporacions Locals, que adopta la forma de societat anònima (l'article 1 dels seus Estatuts vigents publicats al BOIB núm. 76, de 21-05-2015, correcció de errors en BOIB núm. 174, de 26-11-2015; modificació en BOIB núm. 30, de 08-03-2018), que té entre el seu objecte social, la realització de les activitats precises per planificar, projectar, coordinar i gestionar amb les administracions públiques les activitats inherents a un centre integrat de serveis relacionats amb la promoció econòmica, social i cultural mitjançant la gestió integral d'esdeveniments relacionats amb la promoció econòmica, turística, social, esportiva i cultural, així com a l'ús, la gestió, l'explotació i l'administració de les instal·lacions i dels béns del recinte de l'edifici anomenat Recinte Firal d'Eivissa i de l'Hipòdrom de Sant Rafel, així com d'altres que per acord del Ple del Consell Insular d'Eivissa es puguin adscriure a la societat, en alguna de les formes de gestió directa o indirecta previstes en la normativa (art. 2.2, lletres </span><em><span style="background-color:null">a</span></em><span style="background-color:null"> i </span><em><span style="background-color:null">c,</span></em><span style="background-color:null"> dels seus Estatuts).</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Altrament, l'empresa pública FECOEV a tenor de l'establert a l'apartat tercer de l'article 1 bis dels seus Estatuts, </span><strong><span style="background-color:null">tendrà la condició de mitjà propi del Consell Insular d'Eivissa </span></strong><span style="background-color:null">sempre que s'acompleixin les requisits legals per a poder ser considerada com part integrant del sector públic. Més concretament, tendrà la consideració de mitjà propi personalitzat, respecte del Consell Insular si compleix l'establert a l'article 86 de la Llei 40/2015, d'1 d'octubre, del règim jurídic del sector públic, i a l'article 32 de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, per la qual es transposen a l'ordenament jurídic espanyol les directives del Parlament Europeu i del Consell 2014/23 / UE i 2014/24 / UE, de 26 de febrer de 2014.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En el mateix sentit, de conformitat amb la instrucció de Secretaria del Consell Insular, aprovada pel Consell Executiu en data 13/05/2013, el Consell Insular pot encarregar a FECOEV directament la realització d'activitats de la seva competència per raons d'eficàcia. Així mateix, el present encàrrec compleix l'establert a l'Acord de fiscalització limitada prèvia per a l'adaptació dels requisits addicionals prevists a l'Acord del Consell de Ministres de 30 de maig de 2008, modificat el 7 de juliol de 2011, i el 20 de juliol de 2018, respecte a l'exercici de la funció interventora en règim de requisits bàsics, adoptat pel Ple del Consell Insular d'Eivissa en sessió de data 29/11/2018, en relació als expedients d'encàrrecs de gestió.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">A més, FECOEV és l'entitat que ha realitzat en altres ocasions les feines de programació i execució de la Fira Diverespai, juntament amb el Consell Insular, per la qual cosa, el seu personal és coneixedor de les accions necessàries per dur-ho a terme.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Vist que l'esmentada empresa pública disposa de mitjans per poder executar aquestes accions de programació i execució de Diverespai 2023/2024 i, tenint en compte que el Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” no compta amb els mitjans tècnics i humans idonis per portar-lo a terme, així com de l'espai per a la realització de la fira objecte de l'encàrrec, és per això que el Consell Insular d'Eivissa, mitjançant el Departament esmentat ha proposat encarregar a FECOEV la realització de les accions previstes i necessàries per a dur a terme la programació i execució de la Fira Diverespai 2023/2024.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">3. Justificació i necessitat</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">De conformitat amb l'article 70.9 i 16 de l'EAIB, el Consell Insular d'Eivissa té competències pròpies en matèria d'esport, lleure, joventut, disseny i aplicació de polítiques, plans i programes destinats a la joventut, que exerceix des que va ser transferida la competència mitjançant Llei 21/2006, de 15 de desembre, d'atribució de competències als consells de Menorca i d'Eivissa i Formentera en matèria de joventut i lleure, que estableix la transferència als consells de Menorca i d'Eivissa i Formentera de les funcions reglamentària, executiva i de gestió en matèria de joventut i lleure (BOIB núm. 184, de 23-12-2006).</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'esmentada Llei 21/2006, de 15 de desembre, d'atribució de competències als consells insulars de Menorca i d'Eivissa i Formentera en matèria de joventut i lleure, al seu article 4, estableix que el Consell Insular d'Eivissa i Formentera (des de l'any 2007, Consell Insular d'Eivissa) exercirà, dins el seu àmbit territorial i amb subjecció a l'ordenament sectorial vigent, les funcions relatives a les activitats de lleure amb infants i joves, entre les quals hi ha: </span><em><span style="background-color:null">«b) Programació i </span></em><span style="background-color:null">execució d'activitats de temps lliure infantil i juvenil». </span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'apartat tercer 7, del Decret de Presidència núm. 2023000467, Estructura del Govern del Consell Insular d'Eivissa i creació de Departaments (BOIB núm. 88, de 29-06-2023) estableix que les competències del Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” comprenen, d'entre altres:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">c) L'activitat competencial pròpia relativa a les activitats d'oci i lleure, joventut i equipaments juvenils i ordenació d'aquestes activitats.</span></em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">d) Aquest departament també gestionarà els serveis propis del seu àmbit d'actuació prestats als diferents centres propietat del Consell Insular.</span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'article 115.1 de de la Llei 4/2022, de 28 de juny, de consells insulars (BOIB núm. 88, de 7-07-2022) estableix:&nbsp; </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">1. En el marc de la legislació de règim jurídic de les administracions públiques, els consells insulars i els seus ens instrumentals poden encarregar la realització d'activitats de caràcter material o tècnic de la seva competència a altres administracions públiques. Així mateix poden acceptar els encàrrecs de gestió que els proposin altres ens públics d'acord amb els apartats següents.</span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Pel que fa a la competència per aprovar l'encàrrec de gestió a un mitjà propi personificat,&nbsp; l'article 28 de l'esmentada Llei 4/2022, disposa que</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">1. </span><strong><span style="background-color:null">Corresponen al consell executiu</span></strong><span style="background-color:null"> les atribucions següents:</span></em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">(...)</span></em></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">h) Exercir les competències d'òrgan de contractació en tot tipus de contractes en els mateixos casos que la legislació de contractes del sector públic preveu per a la </span><strong><span style="background-color:null">Junta de Govern Local en els municipis de gran població</span></strong><span style="background-color:null">, sens perjudici del que pugui preveure el reglament orgànic. </span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Per la seua banda, l'apartat quart de la disposició addicional segona de la Llei 9/2017, de 8 de novembre, de contractes del Sector Públic, disposa que </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">4. En els municipis de gran població a què es refereix l'article 121 de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local, </span><strong><span style="background-color:null">les competències de l'òrgan de contractació que descriuen els apartats anteriors les ha d'exercir la junta de govern local, sigui quin sigui l'import del contracte o la durada d'aquest</span></strong><span style="background-color:null">, i el Ple és competent per aprovar els plecs de clàusules administratives generals.</span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">De la valoració conjunta d'ambdues preceptes entenen que correspon al Consell Executiu l'aprovació d'aquest encàrrec de gestió.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">És voluntat del Consell Insular d'Eivissa, a través del Departament esmentat, fomentar totes aquelles iniciatives que a l'illa suposin una promoció d'activitats d'oci i de lleure, dirigides a infants de l'illa, i que afavoreixin la promoció de l'oci i el lleure en seus diversos àmbits.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">La Fira infantil Diverespai és un espai d'oci que es desenvolupa durant les vacances escolars de Nadal. És un lloc de socialització per als més petits, on les atraccions i activitats de temps lliure i educatives s'interrelacionen per aconseguir un procés d'educació no formal dirigit als nens i nenes d'Eivissa. S'organitza des de fa més de 20 anys, i constitueix un esdeveniment ja tradicional per els nens i nenes de l'illa durant les vacances nadalenques.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">El Consell Insular d'Eivissa, dins el marc de les seves competències i com a part de la programació de foment d'oci i lleure per a infants durant l'any 2023, te previst dur a terme la fira Diverespai 2023/2024. Aquesta es desenvoluparà entre els dies 26 de desembre de 2023 i 3 de gener de 2024.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">El Consell Insular d'Eivissa no compta amb els mitjans propis suficients per dur a terme la programació i execució de l'esmentada fira. No obstant l'article 11.1. de la Llei 40/2015 d'1 d'octubre de règim jurídic del sector públic estableix que </span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><em><span style="background-color:null">la realització d'activitats de caràcter material o tècnic de la competència dels òrgans administratius o de les entitats de dret públic es pot encarregar a altres òrgans o entitats de dret públic de la mateixa Administració o d'una altra, sempre que entre les seves competències estiguin aquestes activitats, per raons d'eficàcia o quan no es posseeixin els mitjans tècnics idonis per exercir-les (...). </span></em></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">D'altra banda, FECOEV, SAU és una societat mercantil de capital públic del Consell Insular d'Eivissa, d'acord amb l'article 1 bis dels seus Estatuts que “</span><em><span style="background-color:null">tindrà la condició de mitjà propi del Consell Insular d'Eivissa (...)</span></em><span style="background-color:null">”. Així mateix, l'apartat 2 d'aquest article estableix que “</span><em><span style="background-color:null">El Consell Insular d'Eivissa podrà encarregar a la societat l'execució de qualsevol actuació material relacionada amb l'objecte social esmentat a l'article 2 dels Estatuts sense que, d'altra banda, la societat pugui participar en cap licitació de contractació pública convocada per l'administració insular o els seus ens instrumentals. Consta al pressupost que no està previst subcontractar amb tercers més del 50% del cost total de l'encàrrec, ja que del pressupost total es destinarà a contractació externa la quantitat de 245.655,00 €, que suposa un 49,74% del total del pressupost.</span></span></span></span></p> <p><strong>6.&nbsp;Forma de pagament</strong></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">L'abonament de les quantitats relatives a les despeses objecte d'aquest encàrrec es realitzarà a mesura que es vagin presentant les corresponents factures justificatives de les despeses realitzades.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; Les actuacions han de ser variades (musicals, dansa, circ, contacontes, etc.) i dirigides a les diferents franges d'edat i, com a mínim, un 50% de les mateixes ha de ser en llengua catalana.</span></span></span></span></p> </li> </ul> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Tant en els cartells com en els díptics anunciadors de les referides actuacions ha de figurar l'escut del Consell de forma destacada i separat de la resta de patrocinadors privats, si n'hi hagés. CONTIGUTS ESPECÍFICS. ZONA B. CAN NADAL</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Can Nadal consisteix en un espai amb destacada decoració nadalenca, on s'ofereixen actuacions, comparses, jocs i activitats juvenils (scape rooms, realitat virtual, etc.), espectacles de dansa, de música, de màgia, etc., relacionats amb els personatges típics de les festes de Nadal.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Hi ha d'haver un espai amb escenari, cadires i taules per les actuacions.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En aquesta espai es desenvoluparan la major part dels concerts i espectacles.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">9. Publicitat i patrocinadors</span></strong></span></span></span></p> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">S'imprimiran la quantitat mínima de 200 cartells en color que han de ser repartits per total l'illa d'Eivissa. el motiu del cartell serà el guanyador del concurs que el Consell d'Eivissa organitzarà a aquest efecte entre tots els escolars de l'illa. Assegurances</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Com s'indica al punt 1.3. FECOEV, SAU es compromet a contractar les assegurances que corresponguin.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Entre les diferents pòlisses hi ha de haver, com a mínim, les següents:</span></span></span></span></p> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Pòlissa d'assegurances d'assistència i accidents per als participants i personal que cobreixi, com a mínim, les depeses de cures i trasllats fins a 900,00 € per víctima i un capital mínim de 3.000,00 € en cas de mort i 6.000,00 € en cas d'invalidesa.</span></span></span></span></p> </li> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Pòlissa de responsabilitat civil per afrontar els danys personals i/o materials que les activitats puguin ocasionar, amb una cobertura mínima de 150.000,00 € per víctima i 600.000,00 € per sinistre.</span></span></span></span></p> </li> </ul> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Les esmentades pòlisses han de mantenir-se en vigor durant tot el temps de durada del Diverespai.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">16. Equipament, utillatge, material fungible</span></strong></span></span></span></p> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">FECOEV, SAU aportarà la totalitat de màquines i utensilis per a la realització de les diferents activitats, espectacles, tallers, així com tots el materials i productes fungibles necessaris pel correcte desenvolupament del contracte.</span></span></span></span></p> </li> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Una relació completa d'aquest equips amb expressió de la seva potència, tensió de funcionament i demés característiques es lliurarà al representant del Consell d'Eivissa abans del començament dels treballs del servei, el qual podrà posar les objeccions que consideri oportunes en quant a la capacitat per a portar a terme el treball en qüestió. Les objeccions que es produeixin seran reparades per l'empresa adjudicatària.</span></span></span></span></p> </li> </ul> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Seran rebutjats aquells productes i materials amb data de caducitat sobrepassada o aquells per als que existeixin sospites fonamentades de toxicitat o qualsevol altre circumstància de risc potencial per a les persones, el mobiliari o els elements decoratius i/o de recobriment.</span></span></span></span></p> </li> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Els materials es guardaran al final de cada jornada en el local designat, correctament tapats i tancats de manera que s'eviti el risc de vessament o concentració d'olors.</span></span></span></span></p> </li> </ul> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">No es podran utilitzar substàncies químiques catalogades com a perilloses per les persones o el medi ambient.</span></span></span></span></p> </li> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Els materials no suposaran un risc ni per els treballadors de l'empresa adjudicatària, ni per als usuaris dels serveis, ni per les instal·lacions.</span></span></span></span></p> </li> </ul> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En cas d'anomalies a les instal·lacions degudes a la utilització o subministrament de materials o maquinària que no reuneixin les característiques anteriors, l'empresa adjudicatària estarà obligada a assumir el cost de la reparació.</span></span></span></span></p> </li> </ul> <ul> <li> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">En tot cas es garantirà el subministrament permanent de tot el material necessari.</span></span></span></span></p> </li> </ul> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">17. Guarda-roba</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">S'instal·larà una zona de guarda-roba en el lloc que es consideri més oportú, per donar servei, com a mínim, a 100 persones.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">18. Director de l'encàrrec</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Com a director de verificar l'execució de l'encàrrec es proposa el nomenament del tècnic del Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” Sr. Francesc Xavier Costa Garcia.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong><span style="background-color:null">19. Règim jurídic aplicable</span></strong></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">Aquest encàrrec de gestió a un mitja propi personificat (Fires, Congressos i Esdeveniments d'Eivissa S.A.U. (FECOEV) per dur a terme la prestació del servei de la producció i execució de la Fira Diverespai 2023/2024, que es celebrarà entre els dies 26 de desembre de 2023 i 3 de gener de 2024 al Recinte Firal d'Eivissa, es realitzarà de conformitat amb la legislació vigent que hi sigui d'aplicació, I en tot cas, observant les prescripcions contingudes als articles, 11 i 86 Llei 40/2015, de 1 d'octubre, del Règim Jurídic del Sector Públic i als articles 6 i 32 de la Llei 9/2017, de 8 de novembre, de contractes del Sector Públic.</span></span></span></span></p> <p><span style="color:null"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><span style="background-color:null">De conformitat amb l'article 11.2 de la Llei 40/2015, de 1 d'octubre, del Règim Jurídic del Sector Públic, l'òrgan encomanat té la condició d'encarregat del tractament de les dades de caràcter personal a les quals pugui tenir accés en execució de l'encàrrec de gestió, de conformitat amb l'establert a la Llei orgànica 3/2018, de 5 de desembre, de protecció de dades personals i garantia de drets digitals, al Reglament (UE) 2016/679 del Parlament i del Consell, de 27 d'abril de 2016, relatiu a la protecció de les persones físiques pel que fa al tractament de dades personals i a la lliure circulació d'aquestes dades (DOUE 4.5.2016), i a la resta de legislació vigent en matèria de protecció de dades personals, que hi sigui d'aplicació.</span></span></span></span><span style="display:none">&nbsp;</span></p> ]] ![CDATA[Acord del Consell Executiu del Consell Insular d'Eivissa, en relació amb l’encàrrec de gestió a FECOEV, SAU per a la programació i execució de la Fira infantil Diverespai 2023/2024]] CAIB 679392 620 2023-11-18 56969
