![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De conformitat amb el que disposa l'aricle 45 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu comú de les administracions publiques, es publica que per decret de l'alcaldia de dia 25 d'octubre de 2023, es va aprovar la modificació i ampliació del termini de les Bases de la segona convocatòria del procés d'assignació de llicències per a l'ús privatiu de parcel·les i/o blocs amb taules de cultius de l'hort urbà de l'àrea de serveis socials de l'Ajuntament de Marratxí.</span></span></span></span></p>
<p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">BASES REGULADORES DE LA MODIFICACIÓ I AMPLIACIÓ DE LA SEGONA CONVOCATÒRIA DEL PROCÉS D'ASSIGNACIÓ DE LLICÈNCIES PER A L'ÚS PRIVATIU DE PARCEL·LES I/O BLOCS AMB TAULES DE CULTIUS DE L'HORT URBÀ DE L'ÀREA DE SERVEIS SOCIALS DE L'AJUNTAMENT DE MARRATXÍ.</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Des de l'Ajuntament de Marratxí es pretén donar una continuïtat al programa de participación ciutadana habilitat per l'Àrea de Serveis Socials de l'Ajuntament de Marratxí “Horts Urbans”.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquest programa es va posar en funcionament per primera vegada a l'any 2019. Com a conseqüència del temps transcorregut, ja ha finalitzat el primer període de llicències i, per tant, es procedeix a obrir una segona convocatòria, a més, d'establir unes noves Bases Reguladores que introdueixen els canvis que s'han considerat necessaris arran de la primera experiència viscuda.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">1. OBJECTE DE LA CONVOCATÒRIA</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'objecte d'aquestes bases és regular la cessió, mitjançant autorització temporal i després de convocatòria pública, de l'ús privatiu de béns de domini públic municipal i, en concret, de petites parcel·les de conreu i d'un espai amb taules de cultius (reservat per persones amb diversitat funcional) amb la finalitat de crear espais de participació ciutadana.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones o entitats beneficiàries hauran de desenvolupar les activitats pròpies de cultius ecològics d'un hort a la parcel·la atorgada per l'Ajuntament de Marratxí, en concret:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1) Les sembres, el manteniment, l'ordre i la neteja de la parcel·la assignada i dels espais comuns; així com del material propi i comunitari.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2) El seguiment dels principis de la agricultura ecològica i les recomanacions que pugui establir l'Àrea de Serveis Socials de l'Ajuntament de Marratxí a l'efecte.</span></span></span></span></p>
<p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A càrrec de l'Ajuntament anirà:</span></span></span></span></strong></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1) Les despeses d'aigua.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2) La supervisió per part de les persones professionals agràries.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3) El seguiment del personal tècnic de l'Àrea dels Serveis Socials.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4) Equip bàsic d'eines.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5) Abonos i compostos.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6) Manteniment de les àrees comuns i els sistema de reg.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">2. CARACTERÍSTIQUES DELS HORTS URBANS</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'hort urbà es localitza al nucli de Sa Cabana, Marratxí. Consta de 20 parcel·les (s'adjunta plànol de situació i de les parcel·les), l'adjudicació de les quals es farà en dos lots:</span></span></span></span></p>
<ul>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Lot 1: persones físiques</span></strong><span style="background-color:null">. Es destinaran a aquest lot 17 parcel·les (Annex IV).</span></span></span></span></li>
</ul>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'hort urbà disposa de 3 taules de cultiu (equivalent a una parcel.la) adaptades per aquelles persones que es desplacen amb cadira de rodes.</span></span></span></span></p>
<ul>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Lot 2: associacions o entitats sense ànim de lucre </span></strong><span style="background-color:null">Es destinaran tres (3) </span></span></span></span><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">parcel·les per l'ús d'associacions o entitats sense ànim de lucre (Annex IV).</span></span></span></span></li>
</ul>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el cas que les parcel·les d'aquest lot es quedessin sense ús (ja sigui en el moment de resoldre la convocatòria, ja sigui durant la vigència de la llicència) s'adjudicaran a qui pertoqui del Lot 1.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">3. PERSONES BENEFICIÀRIES I REQUISITS D'AQUESTS</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Pel que fa l'ús privatiu de domini públic de les parcel·les de conreu, les persones beneficiàries de l'Hort Urbà de Marratxí hauran d'acomplir, en el moment del termini de presentació de sol·licituds, els requisits següents:</span></span></span></span></p>
<p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">a) LOT 1: persones físiques</span></strong></span></span></span></p>
<ul style="margin-left:40px">
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Tenir com a mínim 18 anys complits.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estar empadronat o empadronada i residir en el municipi de Marratxí i tenir les capacitats i aptituds, tant físiques com psíquiques, que siguin necessàries per exercir les funcions atribuïdes a l'hort urbà.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No haver estat privat de l'ús privatiu per el cultiu dels horts urbans en el municipi de Marratxí o altres localitats, mitjançant un expedient amb resolució ferm.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No disposar de l'ús d'un altre hort municipal.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Formular declaració expressa, a l'escrit de formalització de la llicència, que es troba al corrent pel que fa al compliment de les obligacions tributàries.</span></span></span></span></li>
</ul>
<p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">b) Lot 2: associacions o entitats sense ànim de lucre</span></strong></span></span></span></p>
<ul style="margin-left:40px">
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'objecte social ha d'incloure activitats socials, divulgatives, formatives o de sensibilització ⮚Tenir domicili social o seu social al municipi de Marratxí.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estar registrada en el Registre Municipal d'entitats del municipi de Marratxí.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No haver estat privada de l'ús privatiu de part d'un hort urbà, del municipi o d'un altre.</span></span></span></span></li>
<li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Formular declaració expressa, a l'escrit de formalització de la llicència, que es troba al corrent pel que fa al compliment de les obligacions tributàries.</span></span></span></span></li>
</ul>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els anteriors requisits, per ambdòs lots, s'hauran de mantenir durant la vigència de la llicència. L'Ajuntament, podrà, en tot moment, realitzar controls sobre la concurrència dels dits requisits, podent procedir, si cal, a la revocació de les llicència.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">4. SOL·LICITUD, LLOC I TERMINI DE PRESENTACIÓ</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Dins del termini de 15 dies hàbils, des del dia següent a la data de publicació de les presents Bases al taulell d'edictes de la Seu Electrònica de l'Ajuntament de Marratxí, les persones interessades podran presentar una sol·licitud de llicència d'ús privatiu dels horts urbans de l'Ajuntament de Marratxí segons el model normalitzat (que s'acompanya com a Annex I per a les persones físiques, i Annex II per a les associacions o entitats sense ànim de lucre), juntament amb tota la documentació requerida segons el tipus de lot a que s'opti.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les </span><strong><span style="background-color:null">associacions o entitats sense ànim de lucre </span></strong><span style="background-color:null">estan obligades a relacionar-se a través de mitjans electrònics amb les Administracions Públiques, pel què presentaran la seva sol·licitud preferentment de manera telemàtica a la Seu Electrònica de l'Ajuntament de Marratxí (https://seuelectronica.marratxi.es), sense perjudici de fer servir qualsevol altre mitjà electrònic al seu abast.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les sol·licituds de les </span><strong><span style="background-color:null">persones físiques</span></strong><span style="background-color:null">, a més de l'anterior, poden presentar-se a qualsevol dels registres municipals següents, </span><strong><span style="background-color:null">prèvia sol·licitud de cita</span></strong><span style="background-color:null">:</span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">S'entén que la presentació d'una sol·licitud implica l'acceptació íntegra de les presents bases.</span></span></span></span></p>

Altra documentació que la persona sol·licitant consideri necessària per a l'acreditació de la seva situació socioeconòmica. Declaració de responsable.</span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Comissió Tècnica estarà integrada per la persona que ostenti la regidoria delegada dels Serveis Socials, una persona tècnica de l'Àrea, la persona que ocupi el lloc de Secretaria i un Tècnic de l'Administració General (o les persones en qui deleguin).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Comissió, estendrà una acta detallada de cada una de les intervencions que realitzi i traslladarà les actes i les propostes de resolució que resultin necessàries d'acord amb les presents bases per a dur a terme el procés d'admissió i adjudicació de les llicències. Podrà resoldre qualsevol punt o incidència que es plantegi.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les funcions d'aquesta comissió seran les següents, a proposta de l'òrgan instructor:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Admetre o excloure les sol·licituds que correspongui, en relació amb els requisits que s'enmarquenen aquestes bases.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Avaluar i baremar cada una de les sol·licituds vàlidament presentades segons els criteris de valoració.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">8. PROCEDIMENT PER A LA CONCESSIÓ DE LES LLICÈNCIES.</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Finalitzat el termini de presentació de sol·licituds, l'Àrea de Serveis Socials (òrgan instructor) comprovarà que les persones interessades compleixen els requisits, avaluarà provisionalment les sol·licituds i convocarà a la Comissió Tècnica.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Comissió Tècnica realitzarà, en funció de la puntuació obtinguda, una proposta d'adjudicació dels horts per cada un dels lots, amb la llista de persones admeses (i la seva valoració), les persones en llista d'espera i les persones excloses (indicant-hi la causa de l'exclusió).</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquesta proposta serà publicada, amb l'obertura d'un termini de cinc dies hàbils per a la presentació d'al·legacions.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Una vegada finalitzat el termini d'al·legacions, en el cas que no es presentin, la proposta serà elevada per a l‘aprovació de l'adjudicació per Decret de la regidora de Serveis Socials, per delegació del Sr. Batle, que també haurà de ser publicada. En el cas de presentación d'al·legacions, aquestes seran informades per la comissió abans de dictar la resolució esmentada.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La notificació a les persones adjudicatàries es realitzarà amb indicació del termini i el lloc en què hauran de comparèixer per formalitzar la llicència d'acord amb el document que s'adjunta com a annex, amb l'advertència que si no compareixen, l'ajuntament podrà servirse de les llistes d'espera per nomenar una nova o noves persones adjudicatàries seguint l'ordre establert a les bases, formalitzant adient llicència.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El termini màxim per resoldre el procediment serà de 3 mesos comptadors des de la finalització del termini per presentar sol·licituds.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">9. DURADA DE LES LLICÈNCIES, PREU I GARANTIA</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'adjudicació de l'ús privatiu de les parcel·les de conreu dels horts, per qualsevol dels lots, s'atorgarà per un període inicial d'un any, a comptar a partir de l'endemà de la recepció de la notificació de la llicència.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les llicències es prorrogaran d'ofici per períodes d'un any, fins arribar a un màxim total de 3 anys, tret que abans d'aquest termini tingui lloc la renúncia o la revocació de la llicència.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Aquestes pròrrogues d'ofici requeriran informe favorable de l'Àrea de Serveis Socials.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La autorització per a la utilització privativa dels horts urbans serà gratuïta, en no dur aparellada una utilitat econòmica per a la persona autoritzada. Tampoc serà necessari presentar o constituir cap garantia.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">10. PERSONES DE SUPORT</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones físiques beneficiàries de l'ús de parcel·les de conreu desenvoluparan personalment les activitats objecte de la concessió a atorgar, tot i què podran comptar amb el </span><strong><span style="background-color:null">suport d'una persona </span></strong><span style="background-color:null">qui podrà ajudar a substituir-la quan sigui necessari. La persona beneficiària respondrà íntegrament pels actes d'aquesta persona de suport, que s'hauran d'ajustar en tot moment a aquestes bases.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La </span><strong><span style="background-color:null">persona de suport </span></strong><span style="background-color:null">haurà de reunir els següents requisits des del seu inici:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Estar empadronat i residir al municipi de Marratxí.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Haurà de ser major de 18 anys.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. No haver estat privada de l'ús privatiu de part d'un hort urbà, del municipi o d'un altre.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. No disposar, en concepte de persona adjudicatari, de l'ús de cap altre hort, municipal o privat, al municipi de Marratxí.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La persona beneficiària tindrà l'obligació de comunicar a la persona tècnica de l'Àrea dels Serveis Socials, el moment en què es vulgui disposar de la persona de suport. Donant el seu nom, llinatges, DNI i domicili a efecte de notificacions. A més, haurà d'aportar una declaració jurada signada per aquella persona que compleixi els requisits esmentats anteriorment.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">L'Ajuntament podrà acordar en qualsevol moment què les persones que prestin suport cessin en les seves funcions si es comprova que no compleixen els requisits o per raons degudament justificades a l'expedient.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">11. LLISTES D'ESPERA I LA SEVA VIGÈNCIA</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones admeses que no siguin adjudicatàries de cap hort romandran en una llista de persones suplents, segons el lloc en què hagin quedat segons la puntuació obtinguda. En cas d'empat, l'ordre es determinarà segons la data de sol·licitud.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Quan hi hagi un hort vacant, s'ha d'oferir d'acord amb l'ordre estricte de prelació de la llista d'espera corresponent al tipus de persona sol·licitant. La notificació s'ha de realitzar per correu electrònic o per via telefònica.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si la persona sol·licitant a qui s'ofereix el cultiu d'un hort no manifesta en el termini de tres dies la conformitat amb la proposta, s'entén que renuncia al cultiu de l'hort urbà i se l'exclou de l'adjudicació, encara que pot continuar dins la llista d'espera.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En cas de que quedi buida alguna parcel.la quedarà obert, durant tot el període de llicència, el procediment d'adjudicació. En aquest cas, sols s'hauran de complir els requisits.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">12. PUBLICITAT DE LA CONVOCATÒRIA</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Una vegada aprovades aquestes bases per l'Àrea dels Serveis Socials, la convocatòria es publicarà al Butlletí Oficial de les Illes Balears, al taulell d'edictes de la Seu Electrònica de a la web de l'Ajuntament de Marratxí (http://www.marratxi.es), a més dels altres mitjans de difusió que consideri l'Ajuntament.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les propostes i les resolucions definitives es notificaran a les persones interessades com a mínim mitjançant anunci publicat en la pàgina web de l'Ajuntament de Marratxí. En el cas de l'adjudicació també s'ha de notificar per via telefònica i/o correu electrònic.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Els terminis de recurs contra les resolucions definitives i els actes de tràmit qualificat, que són els mateixos que els contemplats en l'apartat 15 de les presents bases, es comptaran a partir de l'endemà a aquell en què tingui lloc aquesta publicació.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">13.- LEGISLACIÓ SUPLETÒRIA I INTERPRETACIÓ DE LES BASES</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En tot allò no previst a les presents bases regirà el Reglament regulador del règim d'ús d'horts ecològics urbans del municipi de Marratxí. Igualment, li seran aplicables:</span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Per a totes aquelles qüestions no contemplades en les presents Bases, i la interpretació dels dubtes que puguin sorgir en la seva aplicació, serà competent l'òrgan amb facultats per a tramitar les mateixes, que queda autoritzat per a dictar aquells actes que siguin precisos per al seu desenvolupament.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">14.- PROTECCIÓ DE DADES</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">De conformitat amb el que es preveu en la Llei orgànica 3/2018, de 5 de desembre, de Protecció de Dades Personals i garantia dels drets digitals:</span></span></span></span></p>

No obstant això, les dades seran conservades amb finalitats d'arxiu d'interès públic o finalitats estadístiques</span></span></span></span></p>

Podrà sol·licitar la limitació del tractament de les seves dades o, en el seu cas, oposar-se al tractament d'aquests. Per a exercir els expressats drets podrà fer-ho a través dels següents mitjans:</span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La resolució per la qual s'aproven les presents bases i convocatòria posa fi a la via administrativa, podent interposar contra la mateixa, alternativament, o recurs de reposició potestatiu, en el termini d'un mes davant el mateix òrgan que va dictar l'acte, o recurs contenciós administratiu, davant els Jutjats contenciosos administratius de Palma, en el termini de dos mesos, a comptar des de l'endemà a la publicació d'aquesta resolució. Si s'optés per interposar el recurs de reposició potestatiu no podrà interposar-se recurs contenciós administratiu fins que aquell sigui resolt expressament o hagi produït desestimació per silenci.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Tot l'anterior, sense perjudici que es pugui exercitar qualsevol altre recurs que s'estimi pertinent.</span></span></span></span></p>
